RAW AN ORDINANCE RELATING TO THE,"CONVENANCE OF PASSENGERS AND BAGGAGE FOR HIRE, PROVIDING FOR TAXICAB OPERATORS LICENSES AND REGULATING THE OWNERSHIP 'OF TAXICABS AND TAXICAB COMPANY'S IN THE CITY OF •PASCO. SECTION. 1: No.'automobile `or motor vehicle shall be .us,ed in the City of Pasco as a taxicab in.carrying passengers for hire or offered there- in to the public for hire in. the -'carrying of passengers except upon payment of a .license fee at the rate of $15.00per year fcr`' each such,.vehcle and the granting, by the City -.-Council of the City of Pasco of a license therefor as herein provided. SECTION 2: Each license secured a.s herein provided shall be granted upon the express condition that the person, firm, or corporation' securing the license shall provide service to the public on a`24 hour basis, and a telephone .shall be procured "a nd used, so that the public: may be :able to call for such service a t any time*. . Failure to maintain such service shall be. cause for the `revocation of. the: license. SECTION 3: The City Clerk, upon granting of a license by -the City Council and upon presentation Of, the City Treasurer's receipt show ing payment of the license fee prescribed shall issue to the appli- cant a license for.such automobile or motor vehicle, which said license shall bear a -serial number', shall set forth a brief description of *the .vehicle licensed, the name and address of the owner, and the., State License or Certificate number thereof. Such license shall.expire` onthe '31st day of December of the year in which '3t is issued and no fractional license shall be.granted and no license shall be trans- ferred from: on person .to another person, but may be transferred from ,onevehicle to .another vehicle upon application: being made therefor. Every application for such transfer shall be accompanied by a receipt from the City Treasurer showing payment of the sum of Two Dollars ($2.00), which sum is hereby determined to be the fee for the making -of such 'transfer. < _ Ordinance No:� � Page (2) SECTION 4 1aeh'vehicle.operatedas a taxicab within the City of Pasco shall have a.regular place or stand from which to operate and where - such stand or,place is on a city street a -permit shall first be ob- tained therefore and a fee of .$75.00 -per year paid. Upon the issuing of said permit the city shall cause a space of not -less than twenty feet in length on the. curb at the place designated in such permit, to be properly painted -and proper signs erected designating such space as reserved for taxicabs use only, and it shall be unlawful for any vehicle,- other ,than the vehicle for which ,the spaee is designated, to use,such space for parking purposes and any person so using such space shall be liable for a fine for improper parking. No,space shall be designated as such taxi stand. or place within one block from the corner'of 4th and Lewis streets in any direction. SECTION 5:-. The city council in.the granting of any license provided for in this ordinance to a vehicle for hire for transporting persons for compensation shall require the owner or operator thereof to pro- cure liability and property damage insurance covering passengers as :well as other persons, from a company licensed to write bodily injury, liability and property damage liability insurance in the State of Washington, on each motor propelled vehicle used or to be used in transporting persons for compensation in an amount not less than One', Thousand 41,000.00 dollars for damage to property of any person other than the assured and $5,000.00 bodily injury for each person carried and maintain,.such liability and property damage insurance in force on each motor propelled vehicle while so used under such license. Each policy for liability or property damage insurance required herein, shall be filed with the city clerk, and kept in full force and effect, and failure' so to do shall be cause for the revocation of.the license. SECTION 6: Before anyone shall operate a t axicab in t he City of Pasco, he shall first obtain from said city a taxicab operator's license hereafter referred to as.a city operator's license, said application Ordinance No.s� Page (3) shall be approved by the,Chief of Police of the City of Pasco and a fee of $2.50, shall be paid when application is made. Said license when granted.shall expire at. -the end of 'the calendar year in which they` same is grantedd may be renewed on approval --b7 the Chief of Police. Before the original city operator's license shall be`issued, the app- licant shall in addition to paying said fee, submit to being finger- printed, photographed and interviewed under the direction of the Chief of Police. In addition thereto, the Chief of Police may require the applicant to submit to a°test as-to.the applicant's ability as a driverp Chief of.Police may'suspend.,or revoke such license and.refuse to approve it -for renewal at the annual.expiration period. The City Council, if it should see fit, may refiew all such decisions of the Chief of Police. And countermand orders of the Chief of Police in refusing, suspending or revoking said city operatorts.license . It shall be unlawful as d a violation of this act.to-operate or attempt to pperate any taxicab in the City of Pasco without the operator first providing himself with a City Operator's°License then in good standing. SECTION 7: .It shall be a violation of this act if anyone shall own or acquire any interest -or eontrol'or ownership in whole or in part in any taxicab or.taxicabs operating in the -City of Pasco without dis- closing said interest to the Chief of Police of the City of Pasco, and said person shall then be fingerprinted, photographed and interviewed by or under the direction of the said Chief of Police. No fee shall be required from said person but said person shall disclose said interest and the extent thereof in a letter addressed to the Chief of Police, and shall appear personally before the said Chief of,Poliee to answer such further. ==inquiries, as the Chief of Police may desire to make. SECTION 8: The term "person" wherever used inthi.s ordinance shall be held and construed to mean and include natural persons of either sec,. firms, co -partnerships, associations,'and corporations, whether acting by themselves, by servant, agent or employee. 'It shall -be unlawful for any person to engage in the business ofR operating af.taxicab 'or taxicabs without first securing a permit so to : iio in compliance with this ordinance. W permit shall be, issued', .author izi interchange of Taxicab, or Taxicabs, but replacements.may' be ;g~Arld whe're.evidence is produced to the°satisfact-ion of the Chief of Police :that such vehicles are actually- obsolete, unsafe, or unfit for further use,, { 11 permits, shall expire on December 31st of the year in which issued.) _ SECTI6N:10: Every person owning or engaged in t he business of- operating any.taxieabs or for -hire. cars shall keep -a record of.all trips made., together with the information required upon the passenge"rts,receipt provided.for.'Iin this ordinance, which record shall be open for in spection'at all reasonable times`, by the Chief of Police or City Attorney 'and shall also cause to be constaitly carried in such, vehicles the permits issued'by the Department of Licenses of the State of, Washington .°-showing such vehicles to be properly bonded for the pro- tection of'the public, and also the'licenses-sad permits issued pur- suant to city ordinances. SECTION 11:` All vehicles operating -under authority of. t.4,8 Ordinance..',, shall b e inspected from time to time by the Chief of Police f or 't he . purpose of determining whether the same are clean, properly equipped, of good appearance, and in a safe condition for the�transportat on of passengers; and said -Chief 'shall. -at the time of such inspection., determine for the guidance of the public the capacity of •the.vehicle inspected; and it shall be unlawful for any person to drive or- operate.. ?• Ordinance No. Page (5) or., engage n,the.bus.iness of.operating, any taxicab unless and until the same has been,Y.inspected and approved by the Chief of Police, and a certificate�signed_.by'the Chief of Police showing the maximum number-!' of passengers to be carried at any one time shall be at all times prominately displayed within such vehicle. SECTION 12;' f It shall b e unlawful for any person owning, controlling or engaged in the business of operating taxicabs to employ as a driver of any such vehicle, or permit any such vehicle to be driven by a driver who does-not possess a valid and subsisting City Driver's License in accordance with°t his ordinance. SECTION 13: 'it shall b e unlawful f or any person engaged in the business of operating a taxicab to knowlingly permit any person to drive the same who has been convicted of 'driving while intoxicated within one year prior thereto. SECTION 14,11- If 4,:If any driver of a taxicab shall be convicted of driving such vehicle while drunk or under the influence of narcotics, the City Driver's License of such -driver shall be revoked, and he shall not be granted a City Driverts License'for a period of at least•one year from the.date.of such conviction. SECTION 15:<. It shall be unlawful for any person to refuse to pay the regular fare ,for a taxicab after having: hired the same. SEPTION 16 It shall b'e unlawful for apy person to cruise, drive, . or operate a taxicab repeatedly.or persistently to and fro, upon any public street* SECTION' 17: Any person violating or failing to comply with any of.the ,provisions of this ordinance shall be deemed guilty of a misdemeanor and upon coriiction thereof shall be.punished by a fine in any sum. not.exdeeding one hundred dollars, ($100,00) or by imprisonment in the
