AN ORDINANCE RELATING TO "INTOXICATING L IQUORS, PROVOD ING FOR THE- C
CONTROL AND REGULATION THEREOF, DEFINING CRIMES AND PROVIDING PEN-
ALTIES THEREFOR,AND REPEALING ORDINANCE NUMBER 445.
The City Council of the City of Pasco do ordain as follows:
Section 1.
This ordinance shall be deemed an exercise of the police
power of the City of Pasco to aid in the neforcement of the Wash-
ington State Liquor Act for the protection of the welfare,health,
peace morale and safety of the people of the City of Pasco,and all
of its provisions shall be liberally construed for the accomplishment
of that purpose.
Section 2.
Definitions contained in Section 3 of the Washington State
Liquor Act shall be applicable to this ordinance.
Section 3.
It shall be unlawful for any person to manufacture or
sell liquor without having first obtained a license as provided
Section 23 of the Washington State Liquor Act,and. any person doing
any act required to be licensed under said Washington State Liquor
Act without having in force a license issued to him under the pro-
visions of said Act,shall be guilty of a violation of this ordinance.
Section 4.
(1) No liquor shall be kept or had by any person within the
limits of the City of Pasco unless the package in which the liquor
was contained had while containing that liquor been sealed with the
official seal prescribed under the Washington State Liquor Act,ex-
cept in the case of: (a) Liquor imported by the State Liquor Control
Board, or (b) liquor manufactured in the State for sale to the Liq-
uor Control Board,or for export, or (c) beer purchased in accordance
with the provisions of the Washington State Liquor Act, or (d) wine,
beer or liquor exempted in Section 32 of the Washington State Liquor
Act.
Section 5.
Except as permitted by the Washington State Liquor Act,
no person shall open a package containing liquor or consume liquor
in a pulic place. Every person who violates any provision of this
Section shall be guilty of a misdemeanor and on convictionthereof
shall be fined in any su:n not to exceed Twenty-five Dollars.
Section 6.
No person who is intoxicated shall be or remain in a pub -
lic place,and every person who violates any provision of this sec-
tion shall be liable,on the first conviction to a penalty of not to
exceed Ten Dollars or five days in the City jail; For a second off-,
ense to a penalty of not more than Twenty-five Dollars or fifteen
days in the City Jail; and for a third offense not more than One
Hundred Dollars or thirty days in the City Jail.
Section 7.
No person shall sell or give any liquor to any person
apparently under the influence of liquor. Any person who violates
any of the provisions of this section shall be liable on conviction
to a fine of not more than Fifty Dollars or twenty days in the City
jail.

Section 8.
Except in the case of liquor given or permitted to be'
given to a person under the age of twenty-one years by his parent
or guardian for beverage or medicinal purposes,or administered to
him or her by his or her phusician or dentist for medicinal purposes,
no person shall give,or otherwise supply liquor to any person under
the age of twenty-one years,or permit any person under that age to
consume liquor on his or her premises or on any premises under his
or her control. Any person violating the provisions of this section
shall be liable upon conviction thereof to a fine of not to exceed
One Hundred Dollars or imprisonment in the City jail for a term of
not more than thirty days.
Section 9.
It shall be -unlawful for any person under the age of twe-
nty-one years to make application for a permit to buy liquor.
Section 10..
Any violation of the 7 ashington State Liquor Act within
the limits of the City of Pasco shall be a violation of this ordin-
nance and any person violating any of the provisions of the State
Liquor Act as in'this ordinance refered to or set &ut and for and
for which no penalty has hereinbefore been speciffically provided,
shall upon conviction thereof be fined not more than Three Hundred
Dollars ori_ confined in the City jail for a term of not more than.
Ninety days, or both such fine and imprisonment.
Section 11.
Ordinance number 445, being and ordinance relating to
intoxicating liquors,providing for the control and legulation
thereof,def inging crimes and providing penalties therefor and
declaring an emergency, is hereby repealed.
Section 12.
This ordinance to be in full force and effebt five days
after its passage and publication .
