HomeMy WebLinkAbout0551 OrdinanceORDINANCE NO 551 a AN ORDINANCE REGULATING THE SALE OF REAL PROPERTY AND THE METHOD BY AND UNDER WHICH THE CITY PROPERTY SHALL BE PUT UP FOR SALE. The t ' ityl,gounc i l of the City of Pasco do ordain as follows: Section 1, Any person desiring to purchase any real property belong- ing to the City shall make application in writing to the City Clun- cil to have the said property put up for sale,which application sh- all be filed with the City Clerk. At the next regular meeting of the City Council after such application has been filed the Council shall determine whether or not the City desires to sell such property and if it is determined by the Council that such property is for sale the Council shall fix a minimum price and terms at which said pro- perty will be sold. Upon the fixing of the minimum price by the Cou- ncil the City Clerk shall notify the party or parties making the ap- plication that the Council has fixed a minimum price,stating the minimum price and terms for such property and that upon the filing of a petition to have the property sold and the posting with the City Clerk of the sum of %5.00 as a guaranteee that the applicant will bid at least the minimum price fixed for the said property at. the time of the sale the City Clerk shall advertise the said property for sale, such advertisement to published in a newspaper published in the City of Pasco,for at least two consecutive issues and shall give the minimum price and terms for which said property will be sold,together with a legal description of the property and the time and place of sale and that the sale will be at public auction to the highest bidder. Section 2, All sales shall be conducted by the City Clerk and shall be held at the Council chambers in the City Hall at the time set forth in the notice of sale. No sale shall be made unless at least r - w 'P~ �7 1 the minimum price fixed by the Council and upon the terms fixed shall be bid. If a bid equal to or higher than the minimum price fixed by the Council shall be made the property shall be sold to the highest bidder. The party making the application for sale shall have the right to make the first bid.of the minimum price for said property but unless said bid is made immediately after the opening of the sale any other person may make a bid of the minimum price. . . Section 3, Should the party making the application for sale of the property fail to appear and bid at least the minimum price for said property as fixed by the Council and no other bid or bids of the minimum price or better be received and by reason thereof the pro- perty is not sold the $5.00 posted with the application shall be forfeited to the City to cover the cost of advertising. Should the property be sold the application fee shall be returned to the appl- icant. Section 4, Upon the sale of any property as provided for in this ordinance the City Clerk shall have the necessary contract or deed issued and executed as required by law. Section 5, This ordinance shall take effect and be in force five days after it's passage and publication.
