HomeMy WebLinkAbout0539 OrdinanceORDINANCE NO.� AN ORDINANCE REGUTATING PAWNBROKERS AND SECOND-HAND DEALERS, PRO- VIDING FOR THE KEEPING OF RECORDS AND THE RAKING OF REPORTS AND PRO- VIDING PENALTIES. SECTION ONE: Definitions: For .the purposes of this Ordinance, the following definitions shall apply: (a) "Pawnbroker" shall mean every person engaged, in whole or in part, in the business of loaning money on' the security of pledges, deposits, or conditional sales of personal property. (b) "Second-hand dealer" shall mean every person engaged .in whole or in part in the business of buying or selling second- hand personal property, metal junk or melted metals. SECTION TWO: Duty to record transactions: It shall be the duty of every pawnbroker and second-hand dealer doing business in the City of Pasco to maintain in his place of business a book or other perman- ent record in which shall be legibly written in the English language, at the time of each loan, purchase or sale, a record thereof contain- ing: (1) The date of the transaction; (2) The name of the person or Employee conducting the same; (3) The name, a.ge, street and house number, and a general de- scription of the dress, complexion, color of hair, and facial apearance of the person with whom the transaction is had; (43 The name and street and house number of the owner of the roperty bought or received in pledge; 5) The street and house number of the pledge from which the Mperty bought or received in pledge was last removed; A description of the property bought or received in pledge, which in the case of watch shall contain the name of the maker and the number of both the works and the case, and in the case of jewelry shall contain a description of all letters and marks inscribed thereon: Provided, that .when the article bought or received is furniture, or the contents of any house or room actually inspected on the premises, a general record of the transaction shall be sufficient; (7) The price paid or the amount loaned; (8) -The naives and street and house numbers of all persons wit- nessing the transaction; and (9) The number of any pawn ticket issued therefor. Such record and all goods received shall at all times be open to the inspection of the law-enforcement officers of the City of Pasco and Franklin County. SECTION TBREE: Report to the Chief of Police: Every pawnbroker and second-hand dealer doing business in the City of Pasco shall, be- fore noon of each day, furnish to the Chief of Police of such city, on such forms as such Chief of Police may provide therefor, a full, true and correct transcript of the record of all transactions had on the preceding day, and paving good cause to believe that any property in his possession has been previously lost or stolen, he shall forth- with report such fact to the Chief of Police, together with the name of the owner, if known, and the date when, and the name of the person from whom the same was received by him. SECTION FOUR: Retention of property: No property bought or re- ceived in pledge by any pawnbroker or second-hand dealer shall be re- moved from his place of business, except when redeemed by the owner thereof, within four days after the receipt thereof shall have been reported to the Chief of Police as herein provided. SECTION FIVE: Every pawnbroker or second-hand dealer, and every. clerk, agent or employee of such pawnbroker or second-hand dealer, who sha 11 - (1) Fail to make an entry of any material matter in his book or record kept as provided for in Section Three; or (2) Make any false entry therein; or, (3) Falsify, obliterate, destroy or remove from his place of business such book or record; or, (4) Refuse to allow any law-enforcement officer of the City and County to inspect the same, or any pods in his possession, dur- in the ordinary hours of business; or, (5T Report any material matter falsely to the Chief of Police; or (6) having forms provided therefor, shall fail before noon of each day to furnish the Chief of Police with a full, true and correct transcript of the record of all transactions had on the previous day, it being the intent of this section that Satur- da 's business may be reported on Monday; or, Fail to report forthwith to the Chief of Police the posses- sion of any property which he may have good cause to believe has been lost or stolen, together with the name of the owner, if known, and the date when, and the name of the person from whom the same was received by him; or, (8) Remove, or allow to be removed from his place of business except upon redemption by the owner thereof, any property re- ceived, within four days after the receipt thereof shall have been reported to the Chief of Police; or (9) Receive any property from any person under the age of twenty-one years, any common drunkard, any habitual user of nar- cotic drugs, any habitual criminal, any person in an intoxicated condition, any known thief or receiver of stolen goods, or' any known associate of such thief or receiver of stolen property, whether such person be acting in his own behalf or as the agent of another; Shall be guilty of a misdemeanor, and may be punished upon con- viction thereof by a fine of not to exceed $300.00 or imprisonment in the city jail not to exceed ninety days, or by both such fine and imprisonment.
