HomeMy WebLinkAbout0497 OrdinanceORDINANCE NO. 497 1 AN ORDINANCE defining "milk"; certain "milk products"; "milk 2 producer"; "pasteurization"; prohibiting the sale of adulterated and misbranded milk and milk products; requiring permits and licenses for 3 sale of milk and milk products; regulating the inspection of'dairy farms and milk plants, the testing, grading, labeling,-placarding, pasteuri- 4 zation, regrading, distribution, sale and denaturing of milk and milk products; providing for the publishing of milk grades; regulating the 5 construction of future dairies and milk plants and providing a penalty for violation hereof and repealing all ordinances in conflict herewith. 6 7 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PASCO: 8 Section 1: ENFORCEM0T INTERPRETATION: 9 This ordinance shall be interpreted according to the Model Milk 10 ordinance and Code now recommended by the United States Public Health 11 Service as now constituted or as hereafter amended. Two copies thereof 12 shall be kept on file for public inspection in the office of the City 13 Clerk and one copy in the office of the City Health Officer. 14 Section 2: DEFINITIONS: 15 The following definitions shall apply in the interpretation and the 16 enforcement of this ordinance. , 17 MILK CODE: This ordinance may be referred to as the Milk Code 18 of the City of Pasco, Washington. 19 (A) MILK: Milk is hereby defined to be the lacteral secretion 20 obtained by the complete milking of one or more healthy cows properly 21 fed and kept, excluding that obtained within fifteen days before and 22 five days after calving, or such longer period as may be necessary to 43 render the milk practically colostrum free; which contains not less than eight and one-half per cent (81) of solids not fat, and not less than 44 three and one half per cent (32, f ) of milk fat. 25 46 (B) MILK OR BUTTER FAT: Milk fat or butter fat is the fat of milk. Z 0 (C) CREAM: Cream is a portion of milk, contains not less than N - z 27 LL ? a eighteen per cent (18% �) of milk fat, and the acidity of which is not LL j3: 28 <a0 more than 0.20%, expressed as lactic acid. Y "a 29 30 (D) SKIMMED MILK: Skimmed milk is milk from which substantially all the milk fat has been removed. 31 34 (E), CHOCOLATE MILK: Chocolate milk is grade A milk to which has been added in a sanitary manner a chocolate syrup, composed of wholesome Page 1 1 ingredients. 2 (F) BUTTEUULK: Butter milk is the product which remains when 3 fat is removed from milk or cream in the process of churning. It contains 4 not less than eight and five -tenths per cent (8.5%) of milk solids, not 5 fat. 6 (G) CULTURED BUTTERIalILK: Cultured buttermilk is the product re - 7 sulting from the souring or treatment by a lactic acid culture of milk 8 or milk products. It contains not less than 8.5% of milk solids not 9 fat, and may contain not over 0.25% edible gelatin. 10 (H) MILK PRODUCTS: Milk products shall be taken to mean and in - 11 clude cream, skimmed milk, chocolate milk, buttermilk, and cultured 12 buttermilk. 13 (I) PASTEURIZATION: The term "pasteurization", and "pasteurized" 14 and similar terms shall be taken to refer to the process of heating 15 every particle of milk or milk products to a temperature of not less 16 than 142 degrees F., and holding such temperature for not less than 30 17 minutes in pasteurization apparatus approved by the health officer, pro - 18 vided that approval shall be limited to such apparatus which requires a 19 combined holder and indicating thermometer temperature tolerance of not 20 more than 12 degrees F., as shown by official tests with suitable testing 21 equipment, and provided that such apparatus shall be operated as directed 22 by the health officer and so that the indicating thermometers and the Page 2 1 23 recording thermometer charts both indicate a temperature of not less than 24 1432 degrees F., continuously throughout the holding period, provided 25 that nothing contained in this definition shall be construed as disbarring 26 any other process which has been demonstrated as of at least equal effi- Z N2z ciency and is approved by the state health authority. o_ 27 U LL�< (J) ADULTERATED MILK AND MILK PRODUCTS: .Any substance claiming 0 3 28 aYN to be in any milk or milk products defined in this ordinance but not a 29 a. conforming with the definition as given in this ordinance shall be deemed 30 adulterated and misbranded. 31 (K) MILK PRODUCER: A milk producer is any person who owns or 32 Page 2 1 1 controls one.or more cows, a part or all of the milk or milk products 2 from which is sold and delivered to another person. 3 (L) MILK DISTRIBUTOR: A milia distributor is any person who has 4 in possession, offers for sale, sells or delivers to another any milk 5 or milk products for consumption or\manufacturing purposes. 6 (M) DAIRY OR DAIRY FARM: A dairy or dairy farm is any place or 7 premises where one or more cows are kept, a part of all of the milk or 8 milk products from which is sold or delivered to any person. 9 (N) MILK PLANT: A milk plant is any place, or premises, or estab- 10 lishment where milk or milk products are collected, handled, processed, 11 stored, bottled, pasteurized, or prepared for distribution. 12 ( 0 ) HEALTH OFFICER: The term "Health officer" shall mean the health 13 officer of the City of Pa4co or his authorized representative. 14 (P) AVERAGE BACTERIAL COUNT: Average bacterial count shall be A 15 taken to mean the logarithmic average of the bacterial counts of all samples 16 taken during the grading period, including at least four samples taken 17 upon separate days. 18 (Q) GRADING PERIOD: The grading period shall be such period of 19 time as the health officer may designate, within which grades shall be 20 determined for all milk and cream supplies, provided that the grading 21 period in no case shall exceed six (6) months. 22 (R) DISINFECTANT: A disinfectant shall be taken to mean any ger- 23 micidal substance approved by the health officer. 24 (S) PERSON: The word "person" as used in this ordinance shall 25 mean "person, firm, corporation or association". Section 3: THE SALE OF ADULTERATED OR MIISBRANDED MILK OR MILK IL 0 26 PRODUCTS PROHIBITED. .W'Q 27 No person shall within the City of Pasco or its police jurisdiction, IL LL 3_J3: 28 produce, sell, offer, or expose for sale, or have in possession with SYN 29 intent to sell a y an milk or milk product which is adulterated or ungraded. 30 It shall be unlawful for any person, elsewhere than in a private home, to 31 have in possession any adulterated, misbranded or ungraded milk. 32 SECTION 4:. PERYiIT--LICENSE--APPLICATION FOR LICENSE: Page 3 J 1 No person shall engage in business as a milk producer in the City 2 of Pasco without first securing a license therefor, and no person shall 3 sell, dispose of or offer, or keep for sale as human food any milk or 4 milk products within the City of Pasco without first having obtained 5 a permit therefor from the health officer. The requirement for permits 6 applies to stores, fountains, restaurants and hotels. A license shall 7 be deemed a permit for producers and distributors. 8 It shall be unlawful for any person to bring into or receive into 9 the City of Pasco, or its police jurisdiction, for sale, or to sell, or 10 offer for sale therein, or to have in storage where milk is sold or served, 11 any milk or milk product defined in this ordinance, who does not possess 12 a permit from the health officer of the City of Pasco, andon whose vehicle 13 there does not appear in a conspicuous place the permit number in figures 14 at least three inches high and one and one-half inches wide. 15 Such a permit may be revoked by the health officer upon violation 16 by the holder of any of the terms of this ordinance, or in any emergency 17 when in the judgment of the health officer the milk supply in question 18 has become a public menace, provided that the holder of said permit shall, 19 after complying with such revocation, have the right to appeal to the 20 City Council of the City of Pasco. Each Pasteurizing operator must have 21 a permit from the City Health department of this city before he may operat( 22 a pasteurizing plant. 23 Subdivision 1: Permits shall be issued without charge and shall 24 be revocable by the health officer upon the violation, by the holder of 25 such permit, of any of the terms of this ordinance, or any reasonable Z 26 sanitary regulations imposed by the health officer. Provided that the 070 27 holder of any permit after complying with such terms of the ordinance W 0:;: Iin 28 or sanitary regulations may appeal to the City Council, who may, at its J <aU option, reinstate such person, or require the issuance of a new pdrmit. Y a 29 IL Subdivision 2: APPLICATION FOR LICENSE: Any person requiring 30 31 a milk license shall make application therefor to the health officer stating the following facts: 32 Page 4 1 (1) The name and place of residence of the applicant ..,,4 (2) Whether applicant is a producer of milk. 2 (3) The location of dairy and -herd producing milk. (4) The number of cows in each dairy herd and such other 3 information as the health officer may require; provided that the City Council shall not authorize the issuance 4 of any milk or milk vehicle license unless there by_ filed with the City Clerk a copy of the health officer's permit. 5 Upon the issuance of a license the licensee shall be given a numbered tag, which must be attached to the vehicle, in 6 plain view, and to remaio dur.ng the year for which i ssued. 7 Subdivision 3:. t`.EVOCABIE: Licenses issued under this ordinance 8 may be revoked by the City Council for any failure or refusal of the 9 licensee or person from whom he obtains milk, to comply with this or - 10 dinance or the laws of the United States or the State of Washington, 11 or the State wherein the milk is produced. Subdivision 4: FEES: The license fee for the sale or disposal 12 13 of milk or cream in the City of Pasco shall be as follows: For selling 14 or delivering milk or cream from one cow only ��2.50 per year; For sell - 15 ing or delive i milk or cream from more than one cow, $10.00 per year; 16 17 Subdivision 5: EXPIRATION OF LICENSE: All such licenses shall 18 expire on the 31st day of December next ensuing the issuance thereof 19 and no license shall be issued for less than the full annual rate. 20 Section 5: TABELING ATID PIACARDING: 21 All bottles, cans, packages, and other containers enclosing milk 22 or milk products, defined in this ordinance, shall be plainly labeled 23 or marked with (1) the name of the contents as liven in the definitions 24 in this ordinance; (2) the grade of the contents if said contents are 25 graded under the provisions of this ordinance; (3) the word "pasteurized" Z 26 o ° if the contents are to be -or have been pasteurized; (4) the word "raw" U Z 27 LL,a if the contents are raw; (5) the name of the producer of distributor; 44* 0 J. 28 OV ;�0 The label or mark shall be in letters of a size <<u 29 a and kind approved by the health officer and shall contain no marks or 30 words not approved by the health officer. The first five items in section 31 4 above shall appear on all delivery vehicles as well as the permit number 32 in a conspicuous place in figures at least three inches high and one and Page 5 1 one-half inches wide. 2 Every restaurant, cafe, soda fountain or other establishment serving 3 milk shall display at all times, in a place designated by the health 4 officer, a card furnished by the health officer stating the grade of the 5 milk at the time when delivered and whether same is raw or pasteurized. 6 Section 6: INSPECTION OF DAIRY FARMS AND MILK PLANTS FOR ThT, PURPOS] OF GRADING OR REGRADING: 7 At least once during each grading period the health officer shall 8 inspect every dairy farm producing milk or cream for consumption within 9 the city of Pasco, and all milk plants whose milk or cream is intended 10 for consumption within.the city of Paseo. In case the health officer 11 discovers the violation of any item of sanitation, he shall make a second 12 inspection after a lapse of time such as he deems necessary for the defect 13 to be remedied but not before the lapse of three days, and the second 14 inspection shall be used in determining the grade of milk or cream. 15 Two violations of this Ordinance on separate inspections within any one 16 grading period shall call for immediate degrading. 17 One copy of the inspection report shall be po=sted by the health 18 officer in a conspicuous place upon an inside wall of one of the dairy 19 farm or milk plant buildings, and said inspection report shall not be 20 removed by any person except the health officer. Another copy of the 21 inspection report shall be filed within the records of the health depart - 22 ment . Page 6 23 Section 7: TESTING OF LILK ARM IJILK PRODUCTS: 24 During each grading period at least four samples of milk or cream 25 from each dairy farm and each milk plant shall be taken on separate days z 26 and tested by the health officer. Samples of milk and cream from stores, 0 WMZ 27 cafes, soda fountains, restaurants, and other places where milk products 2 N 0J 3 28 are sold shall be tested as often as the health officer may require. �Ya 29 Bacterial counts shall,be made in conformity with the standard methods a 30 recommended by the American Public Health Association, and which are 31 hereby adopted. Tests may include such other chemical and physical 32 determinations as the health officer may deem necessary for the detection Page 6 1 of adulteration, these tests to be made in accordance with the lastest 2 standard methods of the American Public Health Association and the Asso- 3 ciation of Official Agricultural Chemists, adopted hereby, and which are 4 made a part of .this ordinance. Notices of bacterial count shall be given 5 to the producer or distributor concerned as soon. as made. Samples may 6 be taken by the health officer at any time prior to t he final delivery 7 of the milk or milk products. All stores, cafes, restaurants, soda foun- 8 tains, and other similar places shall (1) furnish the health.officer Page 7 9 upon his request, with the name of the milk plant or dairy from which 10 their milk is obtained; (2) maintain separate storage for milk and milk 11 products at a temperature not to exceed 50 degrees F., and (3) wash 12 all bottles and cans before returning to the milk plant. 13 Section S: TTS GRAD�:NG OF MIS AND CRE,4M: 14 At least once every six (6) months the health officer shall announce 15 the grade of all cream and milk supplies delivered by all producers or 16 distributors and ultimately consumed within the City of Pasco. Said grade: 17 shall be based upon the following standards, the grading of cream being 18 identical with the grading of milk_, except that the bacterial standard 19 shall be doubled. 20 CERTIFIED MILK: 21 Certified milk is milk which conforms with the current requirements 22 of the American Association of hIedical Milk Commission which aforesaid 23 requirements are adopted and made a part of this ordinance. 24 RAvv T:-sILK: 25 Grade "A" raw milk is milk the average bacterial count of which 26 as determined under Section. 6 of this ordinance does not exceed 25,000 z 0 N2 z 27 per cubic centimeter, and which. is produced upon dairy farms conforming W M ; o28c3 with all of the following items of sanitation: J Y N 29 Item 1: C0v'JS--TUBERCULOSIS--COLUAGIOUS ABORTION AND OTHER DISEASES: a 0 30 (a) A physical examination and tuberculin test of all cows shall 31 be made before any milk therefrom is sold and as often thereafter as is 32 consistent with the current requirements approved by the United States Page 7 1 Bureau of .Animal Industry and the Washington State Department. of AgriculturE 2 A certificate signed by the veterinarian and filed with the health officer 3 shall.be the only VALID evidence of the above test. Every diseased animal 4 shall be removed from the herd at once and no milk from diseased cows 5 shall be offered for sale. All reacting animals shall be isolated at 6 once and immediately excluded from the premises. All animals rail ng 7 to pass the T.B. test shall be branded with the letters t1T" or "B" on 8 the shoulder, hip or jaw and removed at once and slaughtered under the 9 direction of the health officer.. Each letter in the brand shall be not 10 less than two inches high and one and one-half inches wide. 11 ( b ) CON-TAGIOUS ABORTION: An agglutination test of all cows shall 12 be made by a laboratory approved by the state livestock sanitary authority 13 before any milk therefrom is*sold, and at least once every twelve months 14 thereafter, by a licensed veterinarian approved by the state livestock 15 sanitary authority. Said tests shall be made and cows identified by a 16 metal ear -tag or tatoo mark. All reactors shall be branded .frith the 17 letter "All on the right jaw and no milk from said reactors shall be offeree 18 for sale; provided, however, that when reactors are found retest shall 19 be made as often as the health officer may require. 20 A certificate signed by the veterinarian, filed with the health 21 officer shall be the only valid evidence of the above test, said certi- 22 ficate to bear the identification number of each animal. 23 Provided, however, that the markings on the grade sheet shall be 24 suspended for a period of 3 years except as hereinafter provided. That all raw milk dairies shall as soon as reasonably possible proceed 25 with this test so that by October 1, 1.943 at least 50 per cent of the Z 26 0 _ reactors to the abortion test shall have been removed from any herd N z 27 W U:_ lou) as certified by the 71ashington State Livestock Sanitary Board and by LL LL 28 3:x January 1, 1944, all reactors and suspects shall have been eliminated Y a 29 from the herd. 30 Nothing in this proviso shall prevent marking on the grade sheet, 31 however, where a producer or distributor refuses to make a start in this 32 work within 6 months from the date of the adoption of this ordinance. Page 8 1 Item 2: DAIRY BARN --LIGHTING: Such sections of all dairy barns 2 where. cows are kept or milked shall have at least three square feet of 3 window area for each stanchion, or shall be provided with adequate. supple - 4 mentary artificial lighting. All milking shall be done inside dairy barns, 5 Item 3: DAIRY BARNS --AIR SPACE AND VMITILATION: Such sections 6 of all dairy barns where cows are kept or milked shall have at least 7 four hundred (400) cubic feet of air space Der stanchion, and shall.be 8 well ventilated. 9 Item 4: DAIRY BARN FLOORS: The floors and gutters of such parts 10 of all dairy barns in which cows are milked shall be constructed of 11 concrete, tongue and grooved wood floor not less than two (2) inches 12 thick, or other equally impervious and easily cleaned material approved 13 by the health officer and shall be graded to drain properly and shall 14 be kept clean and in good repair. No horses, pigs, fowls, calves, etc., 15 shall be permitted in parts of the barn used for dairy purposes. 16 Item 5: DAIRY BA2N--V!ALLS AND CEILINGS: The walls and ceilings 17 of all dairy barns shall be white -washed at least once each year or paint - 18 ed at least once every two years, or finished in a manner approved by 19 the health officer and shall be kept clean and in good repair. In case 20 there is a second story above that part of the barn in which cows are 21 milked, the ceiling shall be tight. 22 Item 6': DAIRY BARN--COWYARD: All covet yards shall be graded and 23 drained as weal as practicable and kept reasonably clean. Item 7: MANURE DISPOSAL: All manure shall be removed and stored 24 25 or disposed of in such manner as best to prevent the breeding of flies therein. z 26 o ° Item 8: 14ILK HOUSE OR ROOM --COYSTRUCTION: There shall be pro- w, _ z 27 W M _ 2oa vided a separate milk house or milk room for the handling and storage IL 28 J <au of milk and the washing and disinfecting of milk apparatus and utensils, 1 Y a 29 n. provided with a tight floor constructed of concrete or other impervious 30. material and graded to provide proper drainage. The walls and ceilings 31 of the milli house or room shall be celled and of such construction as 32 to permit easy cleaning, and shall be painted at least once each year or Page 9 1 finished in a manner approved by the health officer. The milk house 2 or room shall be well lighted and ventilated and all openings effectively 3 screened to prevent the entrance of flies, and shall be used for no 4 other purpose than the handling and storage of milk and milk products, 5 and other operations.incident thereto. The clearing and other operations 6 shall be so located and conducted as to prevent any contamination to 7 the milk or to disinfected equipment. The milk room shall not open 8 directly into a stable or into any room used for domestic or other pur- 9 poses. 10 Item 9: MILK HOUSE OR ROOK --CLEANLINESS ATD FLIES: The floors, 11 ceilings and equipment of the milk house or room shall be kept clean at 12 all times. All means necessary for the elimination of flies shall be 13 used. 14 Item 10: TOILET: Every dairy farm shall be provided with a sani- 15 tary toilet. 16 Item 11: `MATER SUPPLY: The water supply shall be easily accessible, 17 adequate, and of a safe, sanitary quality. 18 Item 12: UTENSILS --CONSTRUCTION: All containers or utensils used 19 in the handling or storage of milk or milk products must be made of 20 non-absorbent material and of such construction as to be easily cleaned 21 and must be kept in good repair. Joints and seams shall be soldered 22 flush. All milk pails shall be of narrow -mouth design approved by the health officer. 23 Item 13: UTENSILS --CLEANING: All containers and other utensils 24 used in the.handling, storage, or transportation of milk and milk pro - 25 ducts must be thoroughly cleaned after each usage and no person shall z 26 U.0 offer or accept a milk bottle which has not been thoroughly cleaned. z 27 LL0a Item 14: UTEYSZLS--DISINFECTION: All containers and other utensils LL28 awo used in the handling, storage, or transportation of milk and milk products Y a 29 CL shall between each usage be disinfected with steam, hot water, or chlorine 30 or in a manner approved by the state health authority. 31 Item 15: UTENSILS --STORAGE: All containers and other utensils 32 used in the handling, storage, or transportation of milk or milk products Page 10 1 shall be stored in the milk room, so as not to become contaminated before 2 again being used. 3 Item 16: UTENSILS --HANDLING: After disinfection no container or 4 other milk or milk products utensil shall be handled in such manner as 5 to permit any part of the person or clothing to come in contact with 6 the surface with which milk or milk products come in contact. 7 Item 17: MILKING --UDDERS AND TEATS: The udders and teats of all 8 milking cows shall be clean at the time of milking. 9 Item 18: MILKING--FLAIgKS: The flanks, bellies and tails of all 10 milking cows shall be free from all visible dirt at the time of milking. 11 Item 19: MILKERS' HANDS: Milkers' hands shall be clean, rinsed 12 with disinfectant, and dried with a clean towel immediately before milking, 13 Should the milking operation be interrupted, the milkers' hands must be 14 redisinfected. Met hand milking is prohibited. Convenient facilities 15 shall be provided for the washing of milkers' hands. 16 Item 20: CLEAN CLOTHING: Milkers and milk handlers shall wear 17 clean outer clothing while working. 18 Item 21: MILK STOOLS: Milk stools shall be kept clean. 19 Item 22: REMOVAL OF MILD: Each pail of milk shall be removed 20 immediately to the milk house or straining room. No milk shall be strain - 21 ed or poured in the dairy barn. 22 Item 23: COOLING MILK: Milk must be cooled immediately after 23 milking to 50 degrees F., or less, and maintained at or below that tem - 24 perature until delivery, unless it is delivered to a milk plant for 25 pasteurization or separation, in which case it must be cooled or pasteuri- z 26 zed within two hours of the time of production. 02z 27 Item 24: BOTTLING OR CAPPIKG: Bottling and capping shall be done W Ws rlow 0'3 28 by.machine. Caps shall be purchased in sanitary tubes and kept therein J aa� in a clean place until used. Y a 29 30 Item 25: PERSONNEL --HEALTH CERTIFICATES: Every person connected 31 with a dairy or milk plant, whose work brings him or her in contact with 32 the production, handling, storage or transportation of milk or milk products, shall have, within twelve months, passed'a medical examination Page 11 1 made by the health officer or by a licensed physician approved by the 2 health officer, and shall submit such specimens of bodily discharge as 3 the health officer shall require. 4 Item 26:' NOTIFICA.TION OF DISEASE: Notice shall be sent to the 5 health officer immediately by any milk producer or distributor upon whose 6 dairy farm, or in whose milk plant any case of sickness or any infectious, 7 contagious or communicable disease occurs. 8 GRADE "B" RAj J,,�ILK: Grade "B" raw milk is milk the average bacteria] q count of which at no time prior to delivery exceeds 75,000 per cubic 10 centimeter and which is produced upon dairy farms conforming with all the 11 items of sanitation required for grade "A" raw milk except (1B),(4) or 12 (6) provided that cleanliness of the barn and cow yard shall in no case 13 be omitted. Item (23) shall apply except that the cooling temperature 14 shall be changed to seventy (70) degrees "Jahrenheit. 15 GRADE "C" RAV7 MILK: Grade "C" Raw Milk is milk the average bacteria: 16 count of which at no time prior to delivery exceeds 100,000 per cubic 17 centimeter and which is produced or, dairy farms conforming with all the 18 items of sanitation required for Grade "B" Raw Milk, except (12), (23), 19 (24), or (25), provided that cleanliness shall be in no case omitted. GRADE "D" RAMI MlILK: Grade "D" Raw -66ilk is raw milk which does not 20 21 meet the requirements of Grade "C" Raw Milk. The standard methods of milk analysis of the American Public Health 22 Association are hereby adopted and made a part of this ordinance. 23 PASTEURIZED MTI%K: 24 GRADE "A" PASTEURIZED itiilLK: Grade "A." pasteurized milk is Grade 25 "A" or Grade "B" Raw Milk which has been pasteurized, cooled, and bottled 26 o ° in a milk plant conforming with all of the follo��fing items of sanitation U) - z 27 4o< and the average bacterial count of which at no time after pasteurization o- 3 28 Sao and until delivery exceeds 25,000 per cubic centimeter. `YQ 29 �- Item 1: FLOORS: The floors of all rooms in which milk is handled 30 shall 4onstructed of concrete or other equally impervious and easily 31 cleaned material and shall be smooth, properly drained and provided with 32 trapped drains, and kept clean. Page 12 1 Item 2: WALLS AS7r CEILI1"C-9: Walls and ceilings of rooms in which 2 milk is handled or stored shall have a washable, light colored surface 3 and be kept clean. 4 Item 3: DOORS AND WINDOWS: All openings into the outer air shall S be effectively screened to prevent the access of flies. Doors shall be 6 self-closing. 7 Item 4: LIGHTING AND VEI\72ILATION: All rooms shall be well lighted 8 and ventilated. 9 Item 5: PROTECTION FROM C01TAMINATION AND FLIES: The various 10 milk -plant operations shall be so located and conducted as to prevent any 11 contamination to the milk or to the disinfected equipment. All means 12 necessary for the elimination of flies shall be used. This requirement 13 shall be interpreted to include separate rooms for (a) the pasteurizing, 14 cooling and bottling operations; (b) the container -washing and disinfect - 15 ing operation. Cans of raw milk shall not be unloaded directly into 16 the pasteurizing room. Pasteurized milk shall not be permitted to come 17 in contact with equipment with which unpasteurized milk has been in con - 18 tact subsequent to disinfection. Rooms in which milk or cream or dis- 19 infected utensils or containers are stored or handled shall not open 20 directly into any stable or living quarters. 21 Item 6: TOILET FACILITIES: Every milk plant shall be provided 22 with toilet facilities. There shall be at least one room or vestibule 23 not used for milk purposes between the toilet room and any room in which 44 milk or milk products are handled or stored. The doors of all toilet 25 rooms shall be self-closing. Toilet rooms shall be kept in a clean con- z 26 dition, in good repair, and well ventilated. In case privies or earth 0 W10 27 closets are permitted and used, they shall be separate from the building W 0 - LL LL �3 28 and shall be of a sanitary type. J a Y a 29 Item 7: WATER SUPPLY: The Treater supply shall be easily accessible, a n. 30 and of a safe sanitary quality. 31 Item 8: WASHING FACILITIES: Washing facilities shall be provided, 32 including hot running water, soap and sanitary towels of a type approved by the health officer. The use of a common towel is prohibited. Page 13 1 Item 9: MILK PIPING: Only "sanitary milk piping" of a type which 2 can be easily cleaned with a brush shall be used. ' 3 Item 10: CONSTRUCTION OF EQUIPPI1ENT: All equipment with -which 4 milk comes in contact sha 11 be constructed in such a manner as to be 5 easily cleaned. 6 Item 11: DISPOSAL. OF WASTES: All wastes shall be disposed of in 7 conformity with the requirements of the health officer. 8 Item 12: CLEANING AND DISINITFECTION OF CONTAINERS AND APPARATUS: 9 All milk containers and milk apparatus shall be thoroughly cleaned after 10 each usage. No person shall offer or accept a milk bottle or container 11 which has not been washed. 12 Item 13: STORAGE OF CONTAINER: After disinfection, all bottles, 13 cans, and other containers shall be.stored in such manner as to be 14 protected from contamination. 15 Item 14: HANDLING OF CONTAINERS AND APPARATUS: Between disinfectiol 16 and usage all containers and apparatus shall be handled in such manner 17 as to prevent any part of the person or clothing from coming in contact 18 with any surface with which milk or milk products come in contact. Item 15: STORAGE OF CAPS: Milk bottle caps shall be purchased 19 and stored only in sanitary tubes and shall be kept therein until used. 20 Item 16: PASTEURIZATION: Pasteurization shall be performed as 21 described -in the definition section of this ordinance. The time and 22 temperature record charts shall be dated and preserved for a period of 23 one year for the information of the health officer. 24 Item 17: All milk not pasteurized within two hours after it is 25 received at the plant shall then be immediately cooled to a temperature Z 26 N70 of 50 degrees Fahrenheit or less and maintained thereat until pasteurized; az W m _ LLa 27 and all pasteurized'milk shall be immediately cooled to a temperature of o 3 28 , a:M 50 degrees Fahrenheit or less and maintained thereat until delivery. j Y a 29 a Item 18: BOTTLING: Bottling shall be done at the place of pasteuri 30 nation in automatic machinery approved by the health officer in'such 31 manner as to prevent any part of the person or clothing from coming in 32 contact with any surface with wlsich milk or milk products come in contact. Page 14 Page 15 1 Item 20: CAPPING: Capping of raw milk shall be done by machinery 2 approved by the health officer. Hand capping is prohibited. Pasteurized .3 milk and cream shall be.capped by a hooded capper with skirted caps ex - 4 tending below the pouring lip of the bottle. 5 Item 21: TIME OF DELIVERY: Milk to be consumed in the form of 6 whole milk shall be delivered to the final consumer within 36 hours of 7 the time of pasteurization. 8 Item 22: HEALTH CERTIFICATES: Every person connected with a milk 9 plant whose work brings him or her in contact with the handling, storage 10 or transportation of milk or milk products shall have within twelve 11 months passed a medical examination made by the health officer or by a 12 licensed physician approved by the health officer, and shall submit such 13 specimens of bodily discharges as the health officer may require. 14 Item 23: NOTIFICATION OF DISEASE: Notice shall be sent to the 15 health officer immediately by any milk producer'or distributor upon whose 16 dairy farms or in whose milk plant any case of sickness or any infectious, 17 contagious, or communicable disease occurs. Item 24: PERSONNEL --CLEANLINESS: All persons coming in contact 181 with milk or milk products, containers or equipment shall wear clean outer 19 garments and shall keep their hands clean at all times awhile thus engaged. 20 GRADE "B" PASTEURIZED TvIILK: Grade "B" Pasteurized Milk is Grade 21 "C" Raw Milk which has been pasteurized, cooled, and bottled in a milk 22 plant conforming with all the requirements for Grade "A" Pasteurized Milk. 23 GRADE "C" PASTEURIZED MILK: Grade "C" Pasteurized 1.7ilk is pasteuri- 24 zed milk which does not meet the requirements of Grade "B" Pasteurized Milk 25 Section 9: STANDARDS AND SPECIFICATIONS KEPT ON FILES IN HEALTH Z 26 OFFICE: 0 -Z 27 The Health officer shall keep on file in his office for public W N ULL 0-j3 28 inspection printed copies and all amendments thereto of the standard ;0:o Q Q U �Ya 29 methods of ?Milk Analysis of the American Public Health Association, and CL 30 the printed provisions of the Association of Official Agricultural Chemists 31 Section 10: SUPPLEMENTARY REGRADING: 32 At any time between regular announcements of milk grades any producer Page 15 o 1 or distributor may make application for regrading his product. 2 In case the applicant's existing low grade is due to failure to 3 meet the bacteriological or temperature requirements, said application 4 must be supported by at least two examinations made subsequent to the 5 end of the previous grading period and indicating that the quality of the 6 applicant's output has improved since the last grading announcement and 7 conforms with the requirements of a higher grade. The samples upon which 8 the said two analysis are made may be brought to the health department 9 laboratory by the applicant. 10 Upon the receipt of a satisfactory application the health officer 11 shall make at least four examinations upon samples collected by the health 12 officer of the applicant's output within a period of not less than two 13 weeks and not more than three weeks of the date of the application. 14 The health officer shall award a higher grade immediately in case the 15 said four analysis indicate the.necessary quality. 16 In case the applicant's exist' -ng low grade is due to the violation 17 of an item of sanitation other than bacterial count, said application 18 must be accompanied by a statement to the effect that the violated item. 19 of sanitation has been conformed with. Within two weeks_of the receipt 20 of such an application the health officer shall make a reinspection 21 of the applicant's establishment and, in case the findings justify, shall 22 award a regrade. 23 At any time between regular announcements of milk grades the health 24 officer shall lower the grade of any milk producer of distributor if, as 25 a result of the inspection or milk analysis, a lower grade shall be z 26 justified in accordance with the terms of this ordinance. 0 N f z 27 Section 11: TRANSFERRING OR DIPPING 1JIIY: Uox IL �3 28 No milk producer of distributor shall transfer milk, or milk pro - J `<U 29 ducts or milk bottle caps, from one conta'ner to another upon the street a (L 30 or in any vehicle or store, or in any place except a bottling, or milk room especially used for that purpose, except as may be specially per - 31 32 witted by the health officer in the case of milk being delivered in bulk. The sale of dip, pump, or faucet milk is hereby expressly prohibited Page 16 Z 0 m�z W a _ U U' N LL o J3 3Ir0 j Y N a a J f 1 It shall be unlawful for hotels, soda fountains, restaurants and similar 2 establishments to sell or serve any milk except in the original container 3 in which it was received from the producer or distributor. .All mixed 4 milk drinks shall be made from milk which is stored in the original con- s tainer, and it shall be unlawful for dip, pump or faucet milk to be used 6 in the preparation of such mixed milk drinks. 7 All bottled pasteurized milk shall be bottled in the plant in which 8 it is pasteurized. The delivery of milk to and the collection of milk 9 containers from quarantined residences shall be subject to special re - 10 e -10 quirements of the health officer. 11 Section 12: IIILK AND CREAM FROL11 POI1."TS BEYOND THE Lrt,ITS OF INSPEC TION OF TBS CITY OF PASCO: 12 Milk and cream from points beyond the limits of inspection of the 13 City of Pasco may not be solJ in the City of Pasco unless produced or 14 pasteurized under grading provisions identical with those of this ordin- 15 ance, except as may be authorized by the Health Officer. 16 Section 13: SPITTING AND SI'IOXING: 17 No person shall spit or smoke in any part of any room, vehicle, 18 or other place used for the -sale, storage, handling, or transportation 19 of milk. 20 Section 14: VEHICLES: All vehicles used for delivery of milk 21 to or in the Cit of Pasco shall be so - constructed as to Y protect the milk 22 from the sun, and from contamination. Such vehicles shall be kept clean 23 while used in transporting milk or milk products. No substance capable of 24 contaminating milk or milk products shall be transported with milk or 25 milk products in such manner as to permit contamin--tion. 26 Section 15: DENATURING MISBRANDED PRODUCTS: 27 The health officer may denature with rennet or some harmless color - 28 ing matter any milk or milk products found misbranded with respect to 29 grading or sold without a permit, provided that if the conditions warrant 30 the milk or milk products may be destroyed. 31 Section 16: REPASTEURIZATION PROHIBITED: 32 No milk or milk products shall be pasteurized more than once, except Page 17 1 as may be specially permitted by the health officer. 2 Snntinn 17: FUTURE DAIRIES AND MILK PLANTS: 3 All dairies and milk plants from which milk is supplied to the 4 City of Pasco, which are hereafter constructed shall conform in their 5 construction to the requirements of the health officer, which shall not 6 be less than the Grade "A" requirements of this ordinance. 7 Section 18: REPEALING CERTAIN ORDINANCES: 8 Ordinance No. 306 and all ordinances or parts of ordinances in 9 conflict herewith are hereby repealed. 10 From and after the date on which this ordinance takes effect no 311 11 milk or milk products shall be sold to the final consumer, or to restau- 12 rants, soda fountains, grocery stores, or similar establishments, except 13 Grade A Pasteurized, Certified and Raw.
