HomeMy WebLinkAbout0489 OrdinanceORDINANCE NO. 489 1 AN ORDINANCE RELATING TO THE PUBLIC HEALTH AND SANITATION; REGULATING THE 2 PARKING AND LOCATION OF AUTOMiOBILE TRAILERS AND REGULATING THE LICENSING, LOCATION, ERECTION, MAINTENANCE AND CONDUCT OF AUTOMIOBILE TRAILER CAMPS AND TOURIST C_AI!iPS AND 3 PROVIDING PENALTIES FOR THE VIOLATION THEREOF. 4 THE CITY COUNCIL OF THE CITY OF PASCO ORDAIN AS FOLLOWS: 5 SECTION ONE: Definitions 6 Whenever used in this ordinance, unless a different meaning appears from 7 the context: 8 (a) An "Automobile Trailer", "Trailer Coach", or "Trailer" means 9 any vehicle or structure so designed and constructed in such manner as will permit 10 occupancy thereof as sleeping quarters for one or more persons, or the conduct of 11 any business or profession, occupation or trade (or used as a selling or adver- 12 tising device) and so designed that it is or may be mounted on wheels and used 13 as a conveyance on highways or city streets, propelled or drawn by its own or other 14 motive power, excepting a device used exclusively upon stationary rails or tracks. 15 (b) A "Trailer Camp" means any park, trailer Park, trailer court, 16 camp, site, lot, parcel, or tract of land designed maintained or intended for the 17 purpose of supplying a location or accomodations for five or more trailer coaches 18 and upon which any trailer coach or trailer coaches are parked and shall include 19 all buildings used or intended for use as part of the equipment thereof whether 20 , a charge is made for the use of the trailer camp and its facilities or not. 21 "Trailer Camp" shall not include automobile or trailer sales lots on which unoccup- 22 ied trailers are parked for purposes of inspection and sale. 23 (c) A "Tourist Camp" means any park, tourist park, tourist court, 24 camp, court, site, lots, parcel or tract of land upon which five or more camp Page 25 cottages, or cabins, or tents are located and maintained for the accomodation of Z 26 transients by the day, week, or month, whether a charge is made or not. Opo W �i 27 (d) A "Unit" means a section of ground in a trailer camp not less U � N o_j3: 28 than twenty (20) feet wide or forty (40) feet long in an area designated as the ;0:o � Yc 29 location for only one automobile and one trailer. 0. 30 (e) A "Cabin Plot" means a section of ground not less twenty (20) 31 feet wide and forty (40) feet long, upon which only one camp cottage, cabin or tent 32 may be located. Page 1 (f)• The word "person" shall be construed to include persons, 2 partnerships, firms, companies, corporations, tenants, owners, lessees, or 3 licensees, their agents, heirs and assigns. 4 SECTION TWO: Enforcement 5 A Board of Investigators, consisting of the Health Officer, the Chief of the 6 Fire Department, the Chief of Police, the Building Inspector and the Chairman of 7 the Planning Commission is hereby created with the Chairman of the Planning Com- b mission as Chairman. The Chairman shall, with the approval of the members of said 9 Board, appoint a secretary for the Board among the present employees.of the City. 10 It is hereby made the duty of said Board to enforce all provisions of this 11 ordinance as prescribed herein or such provisions as may be hereinafter enacted, 12 and for the purpose of securing such enforcement, any of the above members of the 13 Board, or their duly authorized representatives shall have the right and are hereby 14 empowered to enter upon any premises on which any automobile trailers or camp cot - 15 tages or cabins or tents are located, or are about to be located, and inspect the Page 2 �1 16 same and all accomodations connected therewith at any reasonable time. The Board 17 is further empowered to issue orders granting, renewing, and revoking such permits_ 18 and licenses as are provided for in accordance with the provisions of this ordinance. 19 SECTION THREE: Location Outside Camps 20 (a) It shall be unlawful within the limits of the City of Pasco, 21 for any person to park any trailer on any street, alley, or highway, or other 22 public place, or any tract of land owned by any person, occupied, or unoccupied, 23 except as provided in this ordinance. 24 (b) Emergency or temporary stopping or parking is permitted on 25 any street, alley or highway for not longer than one hour subject to any other Z 26 and further prohibitions, regulations or limitations imposed by the traffic and 0 7 W �? 27 parking regulations or ordinances for that street, alley or highway. 2 m \ oJ 3 28 (c) No person shall park or occupy any trailer, camp, cottage, 3 �o YQ 29 cabin or tent for more than twenty-four (24) hours on the premises of any occupied a. 30 dwelling or on any lot which is not a part of the premises of any occupied dwelling, 31 either of which is situated outside an approved trailer camp; except the parking of 32 only one unoccupied trailer in an accessory garage building, or in a rear yard in Page 2 �1 i�\ 1 any district is permitted, providing no living quarters shall be maintained or 2 any business practiced in said trailer while such trailer is so parked or stored. 3 SECTION FOUR: License for Trailer or Tourist Camp; Application Therefor and Issuance thereof 4 (a) It shall be unlawful for any person to establish, operate or 5 maintain, or permit to be established, operated or maintained upon any property 6 owned or controlled by him, a trailer camp, a tourist camp, or combination of the 7 two within the corporate limits of the City of Pasco without having first secured 8 a license therefore and for each of them from the Board of Investigators created 9 by this ordinance, granted and existing in compliance with the terms of this or - 10 dinance. Such license shall expire one year from the date of issuance but may be 11 renewed under the provisions of this ordinance for additional periods of one year. 12 (b) The application for such license or the renewal thereof shall 13 be filed with the Chairman of the Board of Investigators and shall be accompanied 14 15 by a fee of one dollar ($1.00) for each unit and cabin plot in the existing or pro- posed camp and a license bond in the sum of five hundred dollars ($500.00) to guar - 16 antee compliance with the terms of this ordinance. The application for a license 17 or a renewal thereof shall be made on printed forms furnished by the Board of In - 18 vestigators and shall include the name and address of the owner in fee of the tract 19 (if the fee is vested in some person other than the applicant, a duly verified state - 20 meat by that person, that the applicant is authorized by him to construct or main - 21 tain the trailer or tourist camp and make the application), and such a legal des - 22 eription ol'the premises, upon which the trailer or tourist camp is or will be 23 located as will readily be identified and definitely locate the premises. The 24 application shall be accompanied by four copies of the camp plan showing the fol - 25 lowing, whether existing or as proposed: (1) The extent and area used for camp 26 purposes; (2) Roadways and driveways; (3) Location of sites or units for 27 trailer coaches or cabins; (4) Location and number of sanitary conveniences 28 including toilets, washrooms, laundries and utility rooms to be used by occupants 29 of units or cabins (in cases where cabins do not have such facilities in proper 30 conformance with city building, plumbing, and other ordinances); (5) Method and 31 32 plan of sewage disposal; (6) Method and plan of garbage disposal; (7) Plan for Page 3 1 water supply; (8) Plan for electrical lighting for units and cabins. 2 (c) Before such license may be issued the premises must be 3 inspected and approved by each of the members of the Board of investigators 4 or his duly authorized representative, as complying with all the provisions 5 of this ordinance and all other applicable ordinances of the City of Pasco. 6 (d) Licenses issued under the terms of this ordinance convey 7 no right to erect any building, to do any plumbing work or to do any'electrical 8 work. 9 SECTION FIVE: Zoning of Trailer and Tourist Camps 10 No trailer or tourist camp shall be located in residence District R1 or 11. Commercial District Cl, provided that the City Council, upon favorable recom- 12 mendation of the Board of Investigators may permit, upon the terms and conditions 13 of this ordinance the location of trailer or tourist camps in said districts. 14 SECTION SIX: Park Plan 15 (a) Every trailer or tourist camp shall be located on a well 16 drained site suitable for the purpose; shall have an entrance and exit well 17 marked and easily controlled and supervised; shall have roads not less than 12 18 feet gide, well drained and plainly marked in the daytime, adequately lighted 19 at night, and easily accessible to all trailer coaches; and walkways adequately 20 lighted. 21 (b) There shall be provided lots for each unit or cabin plot, 22 boundaries to be indicated by corner markers, and area not less than 800 square 23 feet, with a minimum width of 20 feet and a minimum depth of 40 feet. Each unit 24 or cabin plot shall be located. 25 Z 26 opo N Z 27 W a: 2 o N o J 3 28 3�0 Y a 29 a 30 31 Page 4 (1) Lit ,least ten feet from any building; and (2) at least as far from the building line as the nearest adjacent permanent building on the same lot; and (3) at least three feet from the property line. (c) Adjacent space shall be provided to afford (1) Space for clothes drying adjoining laundry facilities; 0 1 (2) Locations for burning space and 2 incineration. 3 SECTION SEVEN: Water Supply 4 A sufficient supply of pure healthful drinking water, approved by the Board 5 of Investigators not more than 200 feet from any unit or cabin plot shall be pro - 6 vided in convenient locations. No common drinking vessel shall be provided. Waste 7 from this supply shall be emptied into a drain connected to an approved disposal 8 system. An abundant supply of hot water shall be provided at all times for bathing, 9 washing and laundry facilities. There shall be no drinking water in toilet com- 10 partments. 11 if the water is from a private source, it shall be tested for sanitary quality 12 at intervals of 7 days. Tests shall be made by a laboratory approved by the Board 13 of Investigators. Tests shall be paid for by the permitee. 14 SECTION EIGHT: Toilets 15 The park shall provide flush toilets in conveniently located buildings not 16 more than 300 feet from each unit or cabin plot. The buildings shall be well 17 lighted at all times, ventilated with screen openings, and constructed of moisture - 18 proof material permitting satisfactory cleaning. The floors shall be concrete or 19 similar material, slightly pitched to a floor drain. 20 Toilets shall be enclosed in separate compartments, with fly doors, and have 21 the minimum width of two (2) feet eight (8) inches. Toilets shall be provided for 22 each'six in the rate of one toilet for every 15 females and one toilet for every 23 15 males. 24 In addition, every male toilet room shall have onepurinal for each 15 males, 25 but in no case shall any male toilet room be without one urinal. Z 26 Toilet rooms shall contain one lavatory with hot and cold running water for LL 0 m20 27 each toilet, but in every case not .less than one lavatory with hot and cold running 2 N oJ 3 28 water in every toilet room. ;Wo � YQ 29 These accomodations shall be based on the total park capacity according to a 30 the accepted plans, and shall be computed on the basis of a minimum of four (4) 31 persons to each unit or cabin plot, with the sexes being assumed in equal number. 32 SECTION NINE: Showers, Laundry and Utility Facilities Page 5 1 Separate bathing facilities for each sex shall be provided 300 feet from 2 the most remote unit or cabin plot. Each section shall contain 1 shower for each 3 5 families at least three (3) feet square. 4 Laundry facilities shall be provided in the ratio of 1 double tray for each 5 5 units or trailer plots. When ironing boards are provided, they shall be located 6 in a separate space from the laundry trays. 7 The construction of the showers, laundry and utility buildings shall be the 8 same or similar to that designated for the toilets by Section 8. 9 If no local means of collection of waste is provided, then slop sinks shall 10 be provided properly connected to the sewage system at a maximum distance of not 11 more than 300 feet from unit or cabin plot. 12 SECTION TEN: Sewage and Refuse Disposal 13 (a) Waste from showers, toilets, slop sinks and laundries 14 shall be wasted into a public sewer system in such manner 15 as approved by the Board of Investigators or into a private 16 sewer and disposal plant or septic tank system approved by 17 the same Board,. 18 (b) All kitchen sinks, wash basins,.or lavatories, bath or 19 shower tubs in any trailer coach located in any trailer 20 park shall empty into an approved receptable or disposal C. 21 system. 22 (c) Toilets and water closets not connected with an approved 23 disposal system shall not be used and it -shall be further 24 unlawful for any person to use or permit the use of such Page 6 25 fixtures. Z 26 SECTION ELEVEN: Garbage Receptacles o 20 �i 27 The park shall provide supervision and equipment sufficient to prevent W U (7 u=i oJ 3 28 littering the ground with rubbish and debris. A copy of the camp license and of this ordinance shall be posted therein and the camp register shall at all times be kept in said office. (b) It is hereby made the duty of the attendant or person in charge, together with the licensee to: (1) Keep at all times a register of all guests (which shall be open at all times to inspection by State and Federal Officers and officers of the city of Pasco) showing for all guests. a. Names and addresses. b. Dates of entrance and departure. c. License numbers of all trailers and towing or other automobiles. d. States issuing such licenses. e. Place of last location, and length of stay. (2) Maintain the camp in a clean, orderly and sanitary condition at all times. (3) See that the provisions of this ordinance are complied with and enforced and report promptly to the proper authorities any violations of this ordinance or any other violation of the law which may come to his attention. (4) Report to the Director of Health all cases of persons or animals affected or suspected of being afflicted with any communicable disease. (5) Prevent the running of loose dogs, cats, or other animals or pets. (6) Maintain in convenient places, approved by the Fire Department hand fire extinguishers in the ratio of one to each eight units or cabins. (7) Collect the service charge provided for in Section 13 of this ordinance, from the occupants of each unit in the camp and pay over the money so'collected to the Treasurer of the City of Pasco. a 1 A book shall be kept showing the names of the persons paying 2 said service charges and the amount paid. Z 0 F- N lo2 W 0 - 9 C9 to LL .Q o _3 �o U � Y a a 0 3 (8) Prohibit the lighting of open fires on the premises. 4 (9) Prohibit the use of any trailer or cabin by a greater number of 5 occupants than that which is designed to accomodate. 6 SECTION THIRTEEN: Service and Inspection Charges 7 There is hereby imposed a service and inspection charge of five (5) cents 8 per day per unit on -the occupant or occupants of each unit or trailer camps 9 licensed hereunder. The licensee of the trailer camp shall collect this service 10 charge for the City of Pasco and pay it over to the City Treasurer in accordance 11 with such reasonable regulations as the Treasurer may promulgate governing such 12 payments. 13 SECTION FOURTEEN: Applicability of Plumbing, Electrical, and Building Ordinances 14 All plumbing, electrical, building and other work on or at any camp licensed 15 under this ordinance shall be in accordance with the ordinances of the City of 16 Pasco, regulating such work unless said ordinances are specifically made inap- 17 plicable under the terms of this ordinance. 18 SECTION FIFTEEN: Revocation and Suspension 19 The Board of Investigators is hereby authorized to revoke any license issued 20 pursuant to the terms of this ordinance if after due investigation they determine 21 that the holder thereof has violated any of the provisions of this ordinance or that 22 any trailer, trailer camp, or tourist camp is being maintained in an unsanitary or 23 unsafe manner or is a nuisance. 24 SECTION SIXTEEN: Hearing or Granting, Denial, Renewal, or Revocation of License 25 Any person aggrieved by an order of the Board of Investigation granting, s 26 denying, remewing, or revoking a license for a trailer camp or tourist camp, under 27 this ordinance, may file a written request for a public hearing before the Board 28 within ten (10) days after issuance of such order. The Board shall give notice of 29 a public hearing upon the request to be held in not less than five (5) days after 30 service of the notice on the person requesting the hearing. The Board may also 31 give notice of the hearing to other persons directly interested in the order in 32 question. At such hearing, the Board shall determine whether the granting, denial, o Page 8 4 I. a 1 renewal, or revocation of the license was in accordance with the provisions 2 of this ordinance and shall issue written findings of fact, conclusions of law 3 and an order to carry out its findings and conclusions. These findings of fact, l 4 conclusions of law, and order shall be filed with the Secretary of the Board and 5 served by the Board upon all parties appearing or represented at said. hearing. 6 SECTION SEVENTEEN: Appeals 7 Any order of the Board of Investigators either granting, denying, renewing 8 or revoking any license under the provisions of this ordinance may be appealed 9 in the manner provided for in ordinance No. 435. 10 SECTION EIGHTEEN: Penalties 11 Any person found guilty of violating any provision of this ordinance shall 12 be deemed guilty of a misdemeanor and shall be fined not more than three hundred 13 dollars ($300.00) or imprisoned not more than ninety (90) days, or may be punished 14 by both such fine and imprisonment. Every day such violation exists shall consti- 15 tute a separate offense and be punished as such hereunder. 16 SECTION NINETEEN: Separability and Conflict 17 If any section, subsection, sentence, clause, phrase, or portion of this 18 19 20 21 22 23 24 25 Z 26 oho (n- i 27 W cc V N IL J 3 28 a Y a 29 IL 30 31 32 Page ordinance is for any reason held invalid or unconstitutional by any court of com- petent jurisdiction, such portion shall be deemed a separate, distinct and inde- pendent provision and such holding shall not affect the validity of the remaining portions thereof.
