2 AN ORDINANCE RELATING TO THE PUBLIC HEALTH AND SANITATION,
THE COLLECTION, RMTOVAL AND DISPOSAL, OF GARBAGE; PROVIDING FOR
3 A LICENSE FOR CONJIME-RCIAL HAULING THEREOF; DEFINING OFFENSES AND
PROVIDING PENALTIES FOR THE VIOLATION THEREOF

5 THE CITY COUNCIL OF TFX CITY OF PASO ORDAIN AS FOLLOIS:
6 SECTION OP':a : Garbage shall be defined and is hereby defined
7 as follows:
8 All accumulations of household waste matter which
has been discarded as of no further value to the owner
9 thereof, including ashes, cinders, trade waste, lawn
cuttings, grass, rags, bottles, papers, broken household
10 furniture, small dead animals, boxes, barrels, shrubs,
small tree.5;: small limbs of trees, scraps of boards or
11 lumber, hollow material or ware, rubbish in general, and
any accumulation of animal, fruit or vegetable matter that
12 attends the preparation, use, cooking, storage, or handling
of meat, fish, fowl, fruits or vegetables; but shall not
13 include earth, sand, gravel, building materials, trade
waste occasioned by goods condemned in case lots or
14 greater quantities, manure, night soil, sewage, large
dead animals, automobile bodies, large treet, cleanings
15 from public or private catch basins, fire refuse, and
extraordinary waste not resulting from natural waste or
16 ordinary daily living.
17 SECTION TWO: It shall be unlawful for any person, firm or
31 that ashes may be neatly piled upon the ground near said receptacles,
32 but in no event shall ashes be piled in any lane, alley, street or

corporation to deposit, throw, place or burn any garbage in any
19
lane, alley, street or other public place within the City of
20
Pasco, or to deposit, throw or place any garbage upon any private
21
property, regardless of ownership, unless said garbage shall be
22
placed in metallic water tight cans, not exceeding thirty gallons
23
in capacity, fitted with tight covers which shall not be removed
24
except when necessary for the depositing or removal of garbage;
25
Provided, however, that boxes, barrels, shrubs, sinall trees, small's
26
limbs of trees, scraps or boards or lumber, all hollow material or

ware, and rubbish in general and broken household furniture may be

broken, cud up and placed in bundles securely tied; or in boxes,

barrels or other receptacles reasonably easy to be handled and

loaded onto a collection vehicle, and Provided further, however,
31 that ashes may be neatly piled upon the ground near said receptacles,
32 but in no event shall ashes be piled in any lane, alley, street or

1 public place. All cans, bundles or other garbage receptacles,
2 as above specified, shall be placed in convenient, accessible
3 locations on the ground or ground floor and so far as practic-
4 able at the approximate rear building line, provided that,
5 where collection may be conveniently made, such cans and other
6 receptacles may be placed on porches or steps, in open sheds or
7 barns, always on the ground floor, but in no event shall they
8 be placed in any lane, alley, street, or public place, 'here -
9 ever placed, said receptacles shall be placed in such a manner
10 as to prevent said receptacles from being upset or spilled by
11 dogs or any source whatsoever. If necessary such cans shall
12 be so secured as to render the same inaeessible to marauding
13 animals.
14 SECTION THREE: All domestic garbage before deposit in
15 the can as hereinbefore provided shall be drained and wrapped
16 in paper or otherrmaterial in such manner as to prevent as
17 nearly as possible moisture from such garbage from coming in
18 contact with the sides or bottom of the metal container.
19 SECTION FOUR: It shall be unlawful for any person,
Q0 firm or corporation to haul or cause to be hauled any garbage

through the streets or alleys of the City
of Pasco unless said

garbage shall be placed in metallic water
tight cans and unless
23
•the same shall be dumped at the City dump
according to the
24
regulations for the use thereof.
SECTION FM : From and after the
effective date of this
25
ordinance any person, firm, or corporation engaged in hauling

of garbage for profit shall pay a license
fee of $75.00.per year

the year 1942 shall be

SECTION SIX: All holders of licenses
under Section Five

of this ordinance shall provide vehicles
with tight, leak proof

metal bodies which shall at all times be
provided with a suitable

1 canvas or other type covering having eyelets provided so.that
2 it may be securely fastened over the load, and such cover shall
3 be fastened whenever required to exclude dust and prevent the
4 scattering of refuse, or when necessary to prevent the exposing
5 of unsightly refuse after the loading of the vehicle is completed
6 and is enroute t o the city dump. Said vehicle must not at any
7 time be dirven over the streets and alleys of the City of Pasco
8 in an overloaded or crowded condition, Each licensee hereunder
9 shall leave the premises served in a clean and sanitary condition
10 and shall not permit garbage to be scattered upon any od the
11 streets and alleys of the city..
12 SECTION SEVEN: All licensees hereunder shall collect
13 and haul.from all residential premises served by them at least
14 once each week all garbage as defined in this ordinance and from
15 commercial premises at least twice a week, Provided, however,
16 that any licensee hereunder shall not be required so to do in

the event the party served shall be delinquent in the payment
18
of charges made by the licensee.
'SECTION EIGBT: If any section, subsection, sub -division,
19
sentence, clause or phrase of this ordinance shall be held to be
20
unconstitutional or void such decision shall not affect the
21
validity of the remaining portions thereof*
22
SECTION NINE:.Any person, firm or corporation violating
23
any of the provisions of this ordinance shall be punished by a
24
fine of not more than $100.00 or by an imprisonment in the City.
25
Jail of not exceeding thirty days or by both such fine and impris-
