HomeMy WebLinkAbout0485 OrdinancePage 1. 1 AN ORDINANCE RELATING TO THE NATIONAL DEFENSE, PRESCRIBING RULES OF CONDUCT DURING fJIR RAID IVARNINGS.AND BLACKOUTS, DEFINING 2 OFFENSES AND PRESCRIBING PENALTIES. 3 THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN: 4 SECTION 1. In construing the provisions of this ordinance, 5 save when otherwise plainly declared or clearly apparent from the 6 contents, the following definitions shall be applied. 7 The term. Fair raid and blackout warning" shall mean a blast 8 of whistles and sirens for a continuous period of three minutes, or 9 such other signal as may subsequently be designated by Federal 10 authority. 11 The term "all clear signal" shall mean a series of three 12 blasts of whistles and sirens for a continuous period of one minute 13 each, or such other signal as may subsequently be designated by 14 federal authority. 15 SECTION 2. It shall be the duty of every person who is in 16 charge of a motor vehicle when the air raid and blackout signal is 17 given to immediately pull over to the curb or roadside, and stop 18 said vehicle and turn off all lights upon said vehicle, and also to 19 shut off the motor, leaving the key in said vehicle, and go to a 20 place of safety. In cotaplying with the above provisions, it shall be 21 the duty of such person not to park the vehicle in front of a fire 22 exit, fire plug, fire station, hospital entrance, theatre entrance, 23 or at a street intersection, or to attempt to drive said vehicle 24 while laid lights are out. All of the above regulations must be 25 complied with until the all clear signal is given, provided, how- 26 ever, that the provisions of this section shall not apply to emer- Z 0 - �z 27 geney vehicles which have been designated as such by a governmental W -0N o J 3 28 authority. _jy 29 RK SECTION 3. It shall be the duty of every person in a a 30 dwelling of any kind, whether it be a home, apartment, or hotel room, 31 when said air raid and blackout signal is given to immediately turn 32 out all external lights used in connection therewith, to obscure all Page 1. z 0 NZ W it _ U Ci N LL Q O J3 Iro j Q N Y Q 0. 1 windows in the same with dark material of some kind or other 2 substance, so that no light from said.building will be visible from 3 the outside, and if this cannot be done, then it shall be the duty 4 of every such person to turn off all lights, but not to use the. 5 main switch for such purpose. The managements of hotels and apart - 6 went houses shall be held responsible for full compliance with this 7 section with reference to exterior lighting. All regulations of this 8 section shall be complied with until the all clear signal is given, 9 SECTION 4, It shall be the duty of every person in charge of 10 a store, manufacturing, industttal plant, or advertising display, 11 when said air raid and blackout warning is given, to have some one 12 on duty during said blackout and to extinguish all external lights 13 including signs of all kinds and to prevent all internal lights 14 from being visible from the outside or to extinguish the same. All 15 of the above regulations must be complied with until the all clear 16 signal is given. 17 SECTION 5. It shall be unlawful during the period of any 18 air raid or blackout period to congregate in groups of five (5) 19 or more persons on any public sidewalk, street, alley or outdoor 20 place: provided, however, that the pr&visions of this section shall 21 not apply to any persons who have been assigned duties by any 22 governmental authority: 23 SECTION 6, It shall be unlawful for any person, including 24 employees of the Washington State Liquor Control Board, to sell 25 intoxicating liquor during -the period of any air raid or blackout 26 period, 27 SECTION 7. Killen deemed necessary for the protection of public 28 peace, heilth and safety, the Chief of Police, shall make rules and 29 regulations concerning the matters covered by this ordinance, in 30 addition to those prescribed herein, which shall have the force and 31 effect of law until repealed by the City Council; 32 SECTION 84 It shall be unlawful during said warning period Page 2, 1 to wilfully refuse or neglect to comply with any of the provisions 2 of this ordinance, and the violation of or failure to comply with 3 any of the provisions of this ordinance or of the rules and, regul- 4 ations proclaimed by the Chief of Police in connection therewith 5 shall be punishable by a fine not exceeding three hundred dollars 6 ($300.00) or by imprisonment in the city jail not exceeding ninety 7 (90) days, o'r by both such fine and imprisonment. 8 SECTION 9: This ordinance shall constitute an exercise by 9 the city of its governmental functions for the protection of the 10 public peace, health and safety, and neither the city nor any 11 .individual responding to the regulations lawfully proclaimed 12 hereunder,. or called upon to assist in enforcing the same, shall 13 be liable in a suit for damages in connection �� therewith. 14 PASSED AID APPROVED THIS L DAY OF 15 16 ATTE$T : Zz Mayor j f 17 18 City Clerk 19 APPROVED AS TO FORM: 20 � ' 21 y trney 22 23 24 25 Z 26 0 �� z. 27 W — U ue N IL a O J3 28 X 0 Y a 29 a 30 31 32 Page
