HomeMy WebLinkAbout0484 OrdinanceORDINANCE NO.�Z 1 AN ORDINANCE CREATING A MUNICIPAL DEFENSE COMMISSION FOR THE CITY OF PASCO AND PRESCRIBING ITS POIItIERS AMD DUTIES . 2 3 WHEREAS a State of War exists between the United States 4 and those foreign powers commonly known as the "Axis Powers' 5 and the safety of our way of life is endangered, and 6 4VHEREAS the President of the United States, by Executive 7 Order signed on May 209 1941, created the Office of Civilian 8 Defense, and 9 WHEREAS the office of Civilian Defense ha.s requested the 10 cooperation and assistance of all municipalities in carrying out 11 the Civilian Defense program, and 12 11JHEREA.S it is desireable to coordinate all municipal defense 13 activity in one municipal agency, now therefore, 14 THE CITY COUNCIL OF THEE CITY OF PASCO DO ORDAIN AS FOLLOWS: 15 SECTION 1. There is hereby created the Municipal Defense 16 Commission of the City of Pasco to be composed of the Mayor as 32 cooperating in the defense program; Page 1. 17 chairman and such other persons, not exceeding eleven in number, 18 as the 11ayor may appoint from time to time. The Mayor shall 19 designate one of the members so appointed as Vice Chairman, who 20 shall be the Coordinator for the City of Pasco. Each member of 21 the Commission, including the Coordinator, shall serve at the 22 pleasure of the Mayor or until repeal of this ordinance. 23 SECTION 2. The 1t?umicipal Defense Commission is hereby author- 44 ized to expend whatever funds are appropriated to carry out the 25 functions of the Defense Commission subject, however, to all regul- z 26 ations now provided by law governing this city,: 70 0 - z 27 SECTION 3. The Numicipal Defense Commission shall be charged W w - U 0 m o-i< J 28 with the duty of and shall have power to coordinate all defense aYQ 29 activities of this city, and more particularly, shall have the a 30 following powers and duties: 31 (1) Coordinate the activities of municipal and private agencies 32 cooperating in the defense program; Page 1. r 1 (2) Keep in contact with the Office of Civilian Defense 2 to the end that all requests and suggestions from that office 3 shall receive prompt and efficient response; 4 (3) Conduct studies regarding defense problems of the 5 City of Pasco to the end that the municipal government of the 6 City of Pasco will be at all times abreast of the problems of 7 defense, and information desired.by federal, state and county 8 agencies will be readily available; 9 (4) Cooperate with the State Council of Defense; 10 (5) Survey existing facilities., proffers of facilities, 11 services and ideas originating within the city and make approp- 12 riate disposition of them; 13 (6) Act as a clearinghouse on municipal defense information 14 for all governmental and private agencies cooperating in the 15 defense program" 16 (7) Direct information regarding the defense program to all 17 municipal departments and agencies which are or may be affected 18 thereby; 19 (8) Make recommendations, from time to tame,.for improve - 20 ments in the handling of defense problems affecting the City of 21 Pasco ; 22 (9) Perform such other advisory functions as may be requested 23 by agencies or departments of the Federal, State, County or City 24 governments in connection with the National Defense program; 25 (10) Do whatever is necessary and proper, subject to the Z 26 provisions of Section 2, to carry out the intent and purpose of W1z 27 this ordinance in assisting proper local authorities in the Wa_ U ex 28 protection of life and y. The Municipal Defense Commission may expedite a a. 30 prodedure by organizing itself into subcommittees and may sub - 31 divide its work and prescribe such rules and regulations as are 32 not in conflict with the provisions of this ordinance. It may Page 2. 1 recommend, for adoption by the City Council, training regulations. 2 It may delegate the authority of preliminary hearings for dismissal 3 of voluntary workers to the heads of departments. 4 The Piunie,ipal Defense Commission may appoint additional 5 commaittees to meet any emergency that may arise but shall report 6 the same promptly to the Council of the City of Pasco, which shall 7 have the authority, at its discretion, to order the discontinuance 8 of such committee. Any person appointed to any position created 9 under this ordinance may be removed by the appointing authority 10 for any reason deemed by it to be sufficient. 11 SECTION 5. ADVISORY BULLETIN N0; 3 To: ALL AGENCIES OF THE WASHINGTON STATE ELERGENCY COMMISSION FOR NATIONAL DEFENSE. The accompanying chart which amplifies and completes the State Chart orig- inally furnished, contains a graphic presentment of the total picture of National Civilian Defense as approved by the President; outlined by the U. Si Office of Civilian Defense, and adopted by the several States including our own. This Chart has been prepared for a dual purpose: First: To define clearly the functional activities of two closely allied bodies, i.e., the "State Defense Council" and the"Emergency Commission for Nation- al Defense." A glance at the Chart will show the functions of the "Council" to be con- cerned with matters pertaining to industry and labor, agriculture, manufacturing, general public welfare, etc., insofar as they pertain to or effect production for National Defense, while the "Commission" organizes, trains and operates the Civil- ian agencies which will be called upon to assist and augment the existing forces of civil government in their several communities in the actual event of war and invasion, fire, flood, or other disaster beyond the power of the constituted forces of civil government to cope with. It will also be noted that several changes and additions have been made in the grouping of activities under certain units. These, however, do not change the character of the activities, but serve to clarify the functions of each unit and bring the program of all States into harmony with the National Plan. Second: To emphasize the leading part that Government plays in the Civil- ian effort. The President thru the U. S. Office of Civilian Defense; the Governor thru the State Emergency Commission, and the Mayor (or corresponding local author- ity) thru the Local Commissioner, who organizes the working units of the program. The heavy black line on the Chart follows this channel of control from the President on down to the local unit and its sub -sections. . It will be observed that our State Plan and program as already outlined and organized conforms to the National Plan in all essential details but one. That one exception being the official tie-in with the Mayor or local governing body in each locality. While this office has stressed and directed that all Local Com- missioners must contact and work in harmony with their Mayors, and while all have reported that the utmost cooperation and harmony exists, that is not enough. In order that the requirements of Federal authorities may be met, it is necessary that the Local Commissioner and his auxiliary units be accorded a legal status, by ord- inance or by duly adopted resolution, accepting them as a recognized adjunct to the municipal body. Thus, The Auxiliary Police Unit, for example, would have the powers and the protection of special Police or deputies when called upon in an emergency. There is attached w "Model" ordinance or Resolution drawn up and approved by the "Association of Washington Cities," a copy of which will be sent to the Mayor of your City by that body, and which you are urged to bring to the -attention of your local governing body and to use all proper efforts to have enacted, in order to af- ford your organization that legal status and protection to which its efforts in be- half of the community welfare entitles it, WALTER J.
