AN ORDINANCE MATING TO THE OPERATING OF ' MOTOR VEHICLES 1`ITHIN TEE CITY OF PASCO, PROVIDING PENALTIES BEFETO, AND REPEALING OTHER ORDINANCES' THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS: SECTION ONE: In order to make the ordinances of the city of Pasco uniform with the laws of the. State of Washington, all of the provisions of the Washington Motor Vehicle Act (being Chapter 189 of the Laws of Washington for the year .1937( as amended or As they hereafter may be amended; all of the pro- visions of the Washington Highway License Act (being Chapter 188 of the Laws of Washington for the year 1937 ) as amended or as.they may hereafter be amended; and all the provisions of the ffashington State Highway.Act (being Chapter 53 of the Laws of Washington for the year 1937) as amended or as they may hereafter be amended; are -hereby adopted by the City of Pasco and by reference made a part of this ordinance. SECTION TTr`+TO: Any person violating any of the terms of the laws referred to in Section One of this ordinance within the limits of the City of Pasco shall be guilty of violation of this ordinance. SECTION THREE: Whenever a vehicle is lawfully parked or stopped in accordance with the ordinances o,f the City of Pasco upon a public street or alley within the limits of said city during the hours of darkness when there is sufficient light to reveal any person or object within a distance of 500 feet upon such street or alley, no lights need be displayed upon such parked or stopped vehicle. SECTION FOUR: On days of celebration, holidays and special occasions which tend to increase traffic, the Chief of Police shall have power and authority to establish by appropriate signs and enclosures, districts wherein no parking ofany vehicle shall be allowed. On streets where building operations are, being carried on; and for the public safety when traffic is congested the Chief of Police temporarily may close any street or portion of a street to all vehicle traffic. SECTIORT FIVE: The Police Committee of the City Council of the City of Pasco shall have full power'and authority to designate portions of any street .with the ,City of Pasco that shall not be used for parking purposes,,and it shall cause to be painted yellow the curbing of that portion of that street where parking is prohibited between the hours of 8:'00 A. M.; and 6:00 P. M. on each day except Sunday and holidays and it shall be unlawful for any person to park or leave a motor. vehicle along that portion of the street so marked yellow, but such space may be used for the loading and unloading of pass- engers or personal property, and provided further that it shall be unlawful to park any vehicle in front of any theater in the City of Pasco at any time when it is open to the public. SECTION SIX: It shall be unlawful for any person to park -any motor vehicle on.any street within the limits of the City of Pasco when standard signs have been or hereafter may. be erected and maintained prohibiting parking. SECTION SEVEN: Motor vehicles on all streets in the City of Pasco shall be parked parallel to and :within 12 inches of the right hand curb, SECTION EIGHT: The Police Committee of the City Council shall have full power and authority to designate the location of any traffic signs or standards within the limits of the City of Pasco, It shall be unlawful.for any person other than the said committee or its duly authorized agent to erect, place or exhibit any traffic signs or standards upon any street of the City of Pasco or to attempt by signs or written or printed instructions or inhibitions to regulate traffic or,the pa rj�- ing of.vehieles. SECTIONNINE: It shall be unlawful to park.any vehicle in any alley except for -loading and unloading purposes.. SECTION TEN: It shall be unlawful for any persons, firm or corporation to park or allow any vehicle to remain standing for a period longer than two hours.continuously between the hours of 8:00 A* M. and 6:00 P. M on any of the following described streets. 1. On Lewis Street between First Street and Fifth Street. 2. On Fourth Street between Columbia Street and Clark Street. 3. On Third Street Between Columbia Street and Clark Street. SECTION ELEVEN: Whan a vehicle is moved out of one park- ing space in a restricted parking zone into another parking space in a restricted zone, in the same block, the two or more continuous parkings in the same block shall be considered as one continuous parking. SECTION TWELVE: When any vehicle has been parked on any public highway of the City of Pasco for a longer time than allowed.by this ordinance the police of said city may take said vehicle to a public garage or a private garage or order the same to taken and the owner of said vehicle shall pair the towing and storage bill against said vehicle before receiving it. SECTION THIRTEEN: The. Chief of Police with the approval of the Police Committee of the City , Council of the City of Pasco shall have full power and authority to designate any street in the City of Pasco as ,en arterial street and shall, have full power and authority to erect signs so designating them and to require all persons operating motor vehicles: to stop before entering said streets. SECTION° FOURTEEN: No person shall be one of a crowd congregated in any street within the limits of the City of Pasco in such a manner as to obstruct traffic, or refuse to disburse when so congregated upon being requested so to do by any police officer. SECTION FIFTEEN: It shall be unlawful for any -pedestrian -to cross any streets within ,the limits of the city of Pasco at any place except at street intersections or any pedestrian safety lane which hereafter may be designated by the police committee of the City Council. It shall be unlawful for any pedestrian to cross any street intersection diagonally. SECTION SIXTEEN: No vehicle shall overtake or pass or attempt to pass another vehicle going in the same direction at ,.a highiray intersection except ,by direction of a traffic officer or an automatic signal device. SECTION SEVENTEEN: No vehicle that is so closed in, constructed or loaded so as to prevent .the driver from having a clear and unobstructed view of traffic at the sides or in front of the vehicle, shall be driven upon the public highway of the City of Pasco. SECTION EIGBTEEN: Any person who shall violate or fail to comply with any of the provisions of this ordinance or who shall co cancel, aid, or abet any such violation or -failure to f comply shall be deemed guilty of a m.isdemeaner. and shall be, punished by a fine of not exceeding $300.00 or -by imprisonment not to exceed ninety days or by both such fine and imprison- ment. In addition to the above penalties the P61tbe Judge of the City of Pasco shall have full -'power and authority, in ordinance tol suspend, revoke, and cancel the motor vehicle operator's license of any person convicted in any police court of negligent driving, reckless driving or driving or operating a.motor vehicle while under the influence of intoxicating liquor or of any narcotic drugs. SECTION NINETEEN: If any of . the provisions of this ordinance. are held invalid or unconstitutional the remainder of the ordinance shall not be affected. SECTION TWENTY:. Ordinances No. 369,'390, 392, .412 and all' other ordinances in conflict herewith are hereby repealed. Passed.,and approved this /97 day of , 1941. . a r A MM-Mnm .
