ORDINANCE NO. 466
AN ORDINANCE GRANTING PERMISSION TO THE PORT OF PASCO,
A MUNICIPAL CORPORATION, TO CONSTRUCT, OPERATE AND MAINTAIN
,SPUR RAILROAD TRACKS AND OTHER STRUCTURES.
THE CITY COUNCIL OF TIDE CITY OF PASCO DO ORDAIN AS FOLLOWS:
SECTION ONE: Permission is hereby granted to the Port
of Pasco, a municipal corporation, to construct, lay down,
maintain and operate spur tracks upon, over and along the
entire length of River Avenue in Riverside Addition to Pasco.
SECTION TWO: Said spur tracks shall be constructed and
maintained on a level with'the street grade of said street as
now established or as the said grade may hereafter be changed.
.The said Port shall be liable for all damages, if any, caused
by the construction or operation of said railroad tracks.
This grant is also subject to the right of the said city to
cause any lawful improvement in or upon said street and in
case said street be paved; graded or regraded the said Port
shall cause those portions of the street ovoupied by its
tracks or road beds to be likewise improved without cost to
said city. This grant is further subject to the rights of
said city.to make any reasonable or lawful rule or regulation -
as to the proper use of the said street as a public highway
and no structure shall materially effect the use of said street
as a public street.
SECTION TBREE: The permit hereby granted shall be in force
and effectfor a period of fifty years from and after the
effective date of this ordinance provided the said Port makes
acceptance. hereof in writing within thirty days after said
effective date.
SECTION FOUR: No assignment of this grant shall be
valid without the written consent of the city-.couucil'and the
failure of the grantee herein to make use of said spur track
at any time for continuous period of one year shall operate

as a forfeiture of this grant at the option' of the city
'council and no notice thereof need.be given.
SECTION FIVE: This grant shall be further conditioned
upon the construction by the, grantee of a pedestrian under-
crossing providing access to Kiwanis Beach and the planking
of any tracks located in the vicinity of Kiwanis Beach from
Vine Street West._along city property.,
SECTION SIX: This permit shall be revocable at any time
it shall reasonably. appear to the City Council that the State
Highway Department would divert state highway No. 410 because
of the use of said track.
