ENTITLED "AN ORDINAITCE TO REGULATE AND RESTRICT THE LOCATIOW ATTD USE OF BUILDINGS AND TIE USE OF LAIND '1.'ITHIN `T'A'E CITY OF PASCO, o'.ASHINGTON; to LIMIT THE HEIGHT OF BUILDINGS; TO PRESCRIB' BUILDING LINES, AND THE SIZE OF YARDS AND OTBER OPEN SPAC1S AND FOR THESE PURPOSES TO DIVIDE THE CITY INTO DI�?'RICTS" BY PROVIDING UIMER CERTAIN RULES AA?D RESMRIC�_ TIONS FOR Ta"E ERECTION OF .APARTI IT HOUSES AND I;ULTIPLE DWELLINGS IN THE CITY AND REPEALING ALL ORDINAXCLS AND PARTS OF ORDMA CES Ir; CONFLICT ThERKTTH. Be it ordained by the City Council of the City of Pasco as follows: SECTION ONE: "There the words "apartment house or multiple dwellings" appear in this ordinance the same shall mean any building, or portion there- of, which is designed, built, rented, leased, let or hired out to be occupied, which is occupied as the home or residence of four or more families living independently of each other and doing their own cook- ing in the said building, including flats and apartments and excluding what are commonly known as tourist cabins. and,tourist homes. SECTIONT TWO: That after the effective date of this ordinance it shall be law-ful to erect, alter or remodel buildings in the City of Pasco for apartment houses and multiple dwellings upon the terms and conditions hereinafter set forth. It shall be lawful to utilize any such building so erected or structurally altered for said pur- pose for residential purposes. SECTION THREE: Any person desiring to erect or structurally alter any building in such territory for the purposes aforesaid shall make application to the building inspector for a permit to so do, which application must be in writing and upon such form as the building inspector may provide therefor; such application shall be accompanied by complete plans and specifications showing in detail v.hat it is proposed to erect under the teras of such perrit, if issued, and what alterations are proposed to be made Under the terms thereof; such plans and specifications shall be prepared in triplicate and one copy thereof shall be filed with the chairman of the commission, one copy shall be filed Trith the application with the building inspector and the remaining copy may be retained by the applicant. Upon the receipt 1Sage 2 of such application together with such plans and specifications, it shall be the duty of the building inspector to study the same, and if he finds from such study that the said proposed improvements are in conformity with the provisions of this ordinance and with. other ordinances and regulations pretaining to the erection of buildiogs within the City of Pasco, he shall, upon the pay,2cnt of the lawful fee therefor, issue such permit. SECTION FOUR: No such permit shall be issued on such application, however, unless it sufficiently appears from said application, plans and specifications that such building, when erected or structurally altered, will be prov- ided with the same depth of front, rear and side yards height limit and lot area as is required in said Ordinance No. 435 as amended for buildings erected in the particular location, provided that where it is desired to erect an apartment house or multiple dwelling upon either side of Third and Fourth Avenues between Shoshone street and the city limits the height limitation may be waived by the commission upon proper application, sub- ject . to review by the city council; provided, further, however, that one or two story apartment buildings shall be not more than fifty (50) feet in width and seventy-five (75) feet in length in residence district R-1 and that the erection of court apartments in said district shall be prohibited; provided further, however that where it is proposed to alter or remodel or repair a buildin.g.already in existence, the permit therefor may be issued with the consent of the commission, notwithstanding the fact that the front, side and rear yards, and lot area so provided shall be less in depth and. such building shall be greater in height than those provided for in such district. SECTION FIVE: This ordinance shall be regarded as supplementary and amendatory .only to ordinance No. 435 and said ordinance shall be and: remain in effect except only as the same may be in conflict with the provisions hereof; in the event of any conflict of said ordinances and the pro- visions hereof, the provisions of this ordinance shall prevail.
