HomeMy WebLinkAbout0440 OrdinanceORDINANCE NO. �' & All ORDINANCE REGULATING THE OPERATION, 1_701,=ENT AND PARKING OF BICYCLES ON THE STREETS, ALLEYS AND PUBLIC PLACES OF THE CITY OF PASCO, PROVIDING REQUIRE141ENTS AS TO LIGHTING EQUIPIiENT; REGULATING THE OPERATORS AND RIDERS ON BICYCLES; PROVIDING FOR THE REGISTRA- TION OF BICYCLES IN THE CITY OF P ASCO, EXA:2NATION OF THE OWNER; PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE, INCLUDING THE I1,TOUNDING OF BICYCLES, AND DECLARING AN M ERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PASCO: SECTION ONE: No person shall ride or operate any bicycle upon any street, alley or public place within the corporate limits of the City of Pasco during the period from a half hour after sunset to a half hour before sunrise, or when a fog or other atmospheric conditions render the operation of said bicycle dangerous to traffic or to the use of the street, or at any other time when there is not sufficient light to render a, person clearly discernible from a distance of two hundred feet, without having a lighted lamp affixed on the front of said bicycle, visible under normal atmos-oheric conditions from a distance of at least�00 feet in front of said bicycle and also a reflex mirror,enot less than three inches in diameter on the front of said bicycle exhibiting an amber light visible under like conditions from a distance of at least 300 feet from the front of such vehicle, and a reflex mirror, alsoGu&41o. not less than three inches in diameter, on the rear of said bicycle exhibiting a red light visible under like conditions from a, distance of at least 500 feet from the 1 of such vehicle; said reflex mirrors shall have no bars or other obstructions across their face, sh411 be water -proof and cUst-proof, and shall be kept in s,00d condition, without cracks, at all times. SECTION TWO: Each bicycle shall be equipped with a stand that will hold the same on its wheels, and whenever a bicycle is parked in a street, alley, or public place, it shall not be left lying on its side, but shall only be left standing on such stand. SECTION THREE: No person shall operate or ride on any bicycle upon any street, alley, or public place in the City of Pasco v7ith e two or more persons upon the same bicycle; provided, however, that this restriction shall not apply to tandem bicycles or other bicycles originally designed for two or More riders. SECTION FOUR: Every person riding or operating a bicycle on any street,alley, or public place shall hold the handlebar with at least one hand and shall not hold on to any other vehicle. SECTION FIVE: No person shall ride or operate any bicycle on any sidewalk in the City of Pasco. No bicycle shall be parked. on any public street or sidewalk in the business district, except parallel with the curb and in no event shall any bicycle be parked more than two feet from the curb. SECTION SIX: Every person riding or operating; a bicycle on any street, alley or public place in the City of Pasco shall keep said bicycle on the extreme right of the traffic lane, and shall not travel abreast another person riding or operating a bicycle except when passing. SECTION SEVEN: It shall be unlawful for any person or persons to run or engage or cause to be run or to be engaged in any bicycle race on any street, alley or public place within the corporate limits of the City of Pasco, except under permit from and under the supervision of the Chief of Police of said City. SECTION EIGHT: Every person riding or operating a bicycle on any street, alley or public place in the City of Pasco shall be subject to all provisions of the laws of the State of Washington, and the ordinancesof the City of Pasco, applicable to the drivers of vehicles, except the provisions thereof that by their nature can have no application. SECTION NINE: It shall hereafter be unlawful to ride or operate a bicycle within the City of Pasco unless there is at all times affixed to said bicycle, in the manner hereinafter provided, the registration number designated therefor by the Chief of Police. Such registration number shall be issued only to owners who have passed an examination covering the traffic regulations and the operation of a. bicycle to the satisfaction of the Chief of Police, said examinations to be given by the Chief of Police or assistants designated by him. SECTION TEN: The City of Pasco shall provide metallic license plates and seals, together with registration cards, said registra- tion cards and metallic license. plates having numbers stamped thereon in numerical order, beginning with number 1, and "Pasco" stamped thereon; such metallic license plates shall be suitable for attach- ment upon the frames of bicycles, and it shall be the duty of the Police Department to attach one such metallic license plate to the frame of each bicycle and to issue a corresponding registration card to the licensee upon the payment of the license fee hereinafter provided for. Such metallic license plate shall remain attached during the existence of such license. The Police Department shall also keep a record of the date of issue of each license, to whom issued, and the number thereof. It shall also be the duty of the Police Department to stamp into -the metal of the sprocket and the front of the frame of each bicycle the word, "Pasco", and the registrationwthereof. SECTION ELEVEN: It shall be the duty of every person who sells or transfers ownership of any bicycle, to report such sale or transfer by returning to the Police Department the registration card issued to such person as licensee thereof, together with the name and address of each person to whom said bicycle was sold or transferred, and such report shall be made ~Bauhin five days of the date of said sale or transfer. It shall be the duty of the purchaser or trans- feree of such bicycle to apply for a transfer of registration thereof, within five days of said sale or transfer. The provisions of this section, so far as applicable, shall apply to all persons engaged in the business of buying or selling new or second-hand bicycles, and the purchasers thereof. SECTION TWELVE: It shall be unlawful for any person to wilfully or maliciously remove, destroy, mutilate, or alter the number of any bicycle frame, license plate, seal, or registration card, of any bicycle licensed pursuant to this ordinance during the time in which such license plate, seal, or registration card is operative. SECTION THIRTEEN: The registration fee to be paid for each bicycle shall be fifty cents (50�) and shall be paid in advance; such license may be transferred 1rhen the ownership of said bicycle is transferred, and a fee of twenty --five cents (25,/,) shall be raid for the registration of such transfer. All license fees collected under this ordinance shall be paid into the General Fund of the City of Pasco. SECTION FOURTEEN: Any person who shall violate any of the in provisions of this ordinance shall upon conviction thereoflthe Police Court of the City of Pasco be punished by a fine of not more than $100.00. In addition to such penalty, the Police Judge may, either in lieu of or in addition to such fine, prohibit the opera— tion of such bicycle upon the streets, alleys and public places of the City of Pasco for a period not to exceed six months, in which event the bicycle so used in such violation shall be impounded by the Chief of Police and retained by him for the period that the operation thereof is prohibited, or if the conviction is for the operation of an unlicensed bicycle, for such time as said bicycle remains unlicensed. SECTION FIFTEEN: Parents and guardians of minors convicted of a violation of this ordinance shall be as responsible for such violation as the minor convicted thereof. SECTION SIXTEEN: All ordinances -or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION SEVENTEEN: If any clause, part or section of this act shall be adjudged invalid, such judgment shall not affect nor invalidate the remainder of this ordinance, but shall be confined in its operation to the clause, part or section directly involved in the controversy in which such judgment was rendered. SECTION EIGHTEEN: This ordinance shall take effect and be in force five (5) days from and after its passage and publication. Passed and approved this Al day of 1939.
