BE CREATED AND ESTABLISHED BY THE CITY COUNCIL, SAID FUND TO BE
KNOWN AS "PASCO SPECIAL WATER REVENUE BOND FUND N0. 3', OR AT1Y
ADDITIONS TO SAID FUND WHICH SHALL HEREAFTER BE CREATED AND PROVIDED
BY THE CITY COUNCIL; AND PROVIDING TriAT SAID BONDS SHALL BE AMD
REL1AiN A LIEN UPON THE :IUNICIPAL WATER SYSTEI:i UNTIL REDEE_: FD, AS
SHALL BE PROVIDED BY THE CITY COUNCIL, SUBJECT TO THE PRIOR LIEN
OF 4150,000 SPECIAL WATER REVENUE BONDS ISSUED UNDER THE AUTHORITY
OF ORDINANCES NO. 345 AND NO. 346, AND SUBJECT TO THE PRIOR LIEN
OF .$66,000 SPECIAL WATER REVENUE BONDS ISSUED BY THE CITY OF PASCO
UNDER THE AUTHORITY OF ORDINAICES'NO. 350 AND NO. 351; SAiD BONDS
TO BE ISSUED IN THE A11OUNT OF 867, 3'75; AMID PROVIDING FOR THE SUB-
r:IITTING TO THE QUALIFIED ELECTORS OF THE CITY OF PASCO OF THE SAID
PROPOSED BOND ISSUE FOR THEIR APPROVAL OR REJECTION; THE SAID II.I-
PROVEi;iENTS TO THE SAID I: UNICIPAL WATER SYSTEI1 TO BE FINANCED IN
PART BY A GRANT FRO!,'i THE FEDERAL ADMINISTRATION OF PUBLIC WORKS."
The City Council Of The City Of Pasco Do Ordain As Follows:
Section 1.
The lv'layor and City Council of the Citir of Pasco will submit
to the qualified voters of the City of Pasco for their ratification
or rejection the proposition of improving the municipal water system
by adding a filtration plant thereto and making other improvements
and additions to the said Pasco municipal neater system, including
pumps and a supply line, and paying for the same by the issuance
of water utility bonds as set out in the follon.,ing sections of this
ordinance, said proposition to be submitted to the qualif iedlectors

of the said city at a special election to be held on the day of
September, 1938, pursuant to notice to be given as provided by law.
Section 2.
The said filtration ?dant and improvements to the said municipal
water system are to be in accordance with the report and recommenda-
tions of I:"essrs. Baar and Cunningham, Consulting Engineers, of Port-
land, Oregon, which said report is on file -siith the City Clerk, and
the City Council shall have authority to build a filtration plant
of a capacity of four million gallons per day and to make the said
other improvements to the said municipal water s;;rstem, together with
authority to expend the proceeds of said bond issue for the purposes
aforesaid.
Section 3.
The total estimated cost of the filtration plant and all im-
provements and additions to the said Pasco municipal water system
under this ordinance shall not exceed $122,500.00. The entire ex-
penditure of the City, exclusive of grants, shall not exceed the
sum of $67,375.00.
Section 4.
It is the intention of the City Council of the City of Pasco
to issue and sell bonds bearing interest at a rate not to exceed
5 per cent, payable semi-annually, to be executed in such manner
and payable at such times and places as the City Council may deter-
mine, to pay the cost of said filtration plant and improvements
and additions to the said municipal water system, but such bonds
and interest thereon shall be payable only out of a special fund
created by ordinance of.the_City Council of the City of Pasco and
to be kno-vtrn as the "Pasco Special Water Revenue Bond Fund No. 3.11
The City mill obligate itself, by ordinance, to pay into such fund,
"Pasco Special Water Revenue Bond Fund No. 311, each year out of
the revenues derived from the said municipal crater system, an amount
sufficient to pay the principal and interest on any and all of the
said water utility bonds maturing in such year, and to continue to
do so until all of the said bonds have been paid. The ponds to be
issued and sold shall not exceed the sum of �02'67,375.00, and the pro-
ceeds shall be used only for the providing of the said filtration
plant and. the --said improvements and additions. Said bonds shall
mature at such times as shall be fixed by the City Council in not
more than twenty (20) years from the date of their issue and shall
be serial in form and issued in accordance with the laws of the State
of Washington. Said City shall retain the option to pay all or any
part of said bonds in the order of their maturity on any interest -
paying date five (5) years after the date of their issue.
Section 5.
Any and all bonds issued as herein provided, and in accordance
with the laws of the State of Washington, shall be a, lien against the
entire Pasco municipal'water system, subject and junior to the lien of
the first bonds against said system in the sum of 150,000 issued for
the purchase and construction of said system and under and by virtue
of Ordinances Nos. 345 and 346 of said City, and subject and junior
to the lien of the second bonds against said system in the sum of
66,000 issued for additions and improvements to the said municipal
water system under Ordinances Nos. 350 and 351; and all
such bonds so issued shall contain an appropriate reference to

the ordinance, to the law of the State of Washington and to the
rights of the bondholders and shall define the obligation therein
created.
Section 6.
If the proposition herein outlined shall be approved by the
qualified voters of the City of Pasco, then, in that event, the
City Council shall forthwith proceed to cause the necessary -prelimi-
nary steps to be taken for the building of said filtration plant and
the raking of said improvements and additiofts to the sand municipal
water system and may expend therefor from the general fund of the
City of Pasco a sum not to exceed 8 1500.00, which mount is deemed
necessary for such preliminary work and iwhich amount shall be returned
to the general fund of the City from the monies derived from the
sale of bonds herein provided.
Section 7.
If the propositions herein outlined shall be adopted by the
voters of the City of Pasco in the said election, the City Council
shall employ an engineer who shall prepare full detailed plans and
specifications covering the said filtration plant and improvements
and additions to the said later system, and file the said plan and
specifications in the office of the Clerk and shall include with the
said plans and specifications a detailed estimate of the probable
cost of said filtration plant and improvements and additions, and
thereupon, the said City Council shall negotiate with the Director
of Public Works of the Government of the United States for a grant
in aid under the lav of the United States and the Federal Emergency
Administration of Public Works, and shall offer for sale and sell
the said bonds in manner provided by law and make any and all contracts
necessary and proper to be made for the sale of said bonds, and the
securing of said grant in aid and the construction of said filtra-
tion plant and the said other improvements and additions to the said
municipal water system, and make all necessary and proper arrange-
ments with the officers and agents of the Government of the United
States, and with others, for the construction of said filtration

plant and the said improvements and additions to the said municipal
grater system.
Section 8.
The Droposition to be submitted to the qualified voters of
the City of Pasco, as herein provided., shall be voted upon in the
following manner: Every qualified elector desiring to vote in
favor of the proposition herein outlined, to -wait That the City of
Pasco build and install a filtration plant and make other improve-
ments to the municipal water system as provided in this ordinance,
shall do so by marking a cross opposite the first proposition, to -wit;
"For the building and installing of a filtration plant
and the making of other improvements and additions to
the water system, and the issuance of Nater utility
bonds therefor in an (.mount n exceed 86'7, 3'75.00,
as provided in Ordinance No. 4.46
and every qualified elector desiring to vote against said proposi-
tion shall make a cross op-oosite the second proposition, to -gait:
"Against the proposal to build and install a filtration
plant and make other improvements to the city water sys-
tem and against the issuance "of bonds for t' e payment
therefor, as provided in Ordinance No.'n
Section 9.
This ordinance shall tape effect five (5) days after its
passage and publication.
