SHALL HEREAFTER BE CREATED AND. PROVIDED FOR,BY.THE CITY. COUNCIL; AND PROVIDING THAT THE SAID BONDS. SN_n.ALL BE AND. RAIN A LIEN UPON THE PASCO MUNICIPAL WATER .SYSTEM UNTIL REDS ''DIED AS SHALL BE PROVIDED BY THE CITY COUNCIL SUBJECT TO A PRIOR LIEN OF $150,000 SPECDL WATER REVEfiTUE BONDS. ISSUEDUNTDER THE AUTHORITY' OF ORDINANCE NCI,„;BERS 345 AND 346 AND SUBJECT TO A PRIOR ILIEN OF $66,000 OF SPECIAL 'MATER REVENUE BONDS ISSUED BY THE CITY OF PASCO UNDER THE AUTHORITY OF ORDINANCE NU 1BERS 350 AND 351; AND PROVIDING FO'R THE SUBNIITT ING TO THE QUALIFIED ELtCTORS . OF, THE . C 1TTY OF PASCO OY THE SAID PROPOSE BOND ISSUE FOR THEIR APPROVAL. OR' REJECTION. The City Council of the City of.Pasco do ordain as follows: SECTION ONE: The Mayor and City Council of the City of Pasco will submit to the qualified voters of said City for thOir ratifi- cation or rejection the proposition ofimproving the municipal water system by adding a filtration plant thereto and making other improvements and additions to the said Pasco municipal water system and paying; for the' same by the' issuance. of public utility bonds as set out in the following sections of this ordinance, said proposition to be submitted to the qualified .electors of the said City at a special -election to be held on the. day of October, 1933, pur- suant to notice to be given as provided by law.. SECTION TWO: The said filtration plant ' and the improvements to the said municipal water system are to be in accordance with the report and recommendations of Messrs. Baar and Cunningham, consulting engineers, of Portland, Or.egon,, which said report is on- file nfile with'the City Clerk,.and the City.Council shall have authority to build a filtration plant of a capacity of four million 'gallons per day of* in the alternative a plant having a capacity of three million three hundred thousand gallons per day, together with authority to make an expenditure' out of the proceeds of said bond issue not exceeding, Eighty -;five Hundred (88500.00) Dollars for the purpose of supplying the Northern Pacific Railway Company v ith unfiltered water; provided further that the City Council may elect as between the alternative proposals contained in the said report of i.Jessrs. Baar and Cunningham. SECTION THREE: That the total estimated cost of the filtration plant and all improvements and additions to the said Pasco municipal water system under this ordinance shall not exceed One Hundred Thousand ($100,000.00) Dollars. The entire expenditure by the City, exclusive of grants in aid shall not exceed $80,000.00. SECTION FOUR: IT is the intention of the City Council of the ity of Pasco to issue and sell bonds bearing interest not to exceed qjgL percent payable semi-annually to be executed in such manner and payable at such times .and places as the C'ity Council may deter- mine to pay the cost of the said filtration plant and improvements and additions to the municipal water system but such bonds and interest thereon shall be payable only out of a special fund to be created by'ordinance of the City of Pasco and to be known as the "nasco Special Water Revenue Bond 'Fund Number Three." The bonds to be issued and sold shall not,exceed the sum of Eighty Thousand Dollars (980,000.00) and the proceeds shall be used only for pro- viding the said filtration plant and said improvements and additions. The said bonds shall mature at such times as shall be fixed by the City Council in not more than twenty-five (25) years from the date of their issue and shall be serial in form and issued in accordance with the laws of the State of vdashington. .SEn TION FIVE: Any and all bonds issued as herein provided and in accordance with the laws of the State of a`ashington, shall be a lien against the entire Pasco municipal water system, subject and junior to the lien of the first bonds against said system in the sum of ."150,000 issued for the purchase and construction of said system and under and by virtue of Ordinance Numbers 345 and 346 of said City and subject and junior'to the lien of the second bonds against said.system in the sum. of '66,000 issued for additions and improvements to the said municipal water system under Ordinances Number 35O and 351; and all such bon ds so issued shall contain an appropriate reference to the ordinance, to the law of the State of 1 water; provided further that the City Council may elect as between the alternative proposals contained in the said report of i.Jessrs. Baar and Cunningham. SECTION SIX: If the proposition herein outlined shall be approved by the qualified voters of the City of Pasco, then, in that event,.the City Council shall forthwith proceed to cause the necessary p-eliminary steps to be taken for the building of said filtration plant and the making of said improvements and additions to the said municipal grater system and may expend therefor from the oo general fund of the City of Pasco 'a sum not to exceed which amount is deemed necessary for such preliminary work and which amount shall be returned to the general fund of the City from the monies derived from.the sale of bonds herein provided. SECTION SEVEN: If the propositions herein outlined shall be adopted by the voters of the City of Pasco in the said election, the City Council shall employ an engineer who shall prepare full detailed plans and specifications covering the said filtration plant and im- provements and additions to the'said mater system, and file the said plan and specifications in the office of the Clerk and shall include with the said plans and specifications a detailed estim to of the probable cost of said filtration plant and improvements and additions and.thereupon the said City Council shall negotiate with th`e Director of Public 7orks of the Government.of .the United States for grant in.aid under the National Industrial Recovery Act and for the sale of the said bonds, and .shall negotiate with the State o,f Washington through its authorized agents for a grant in aid of the said project and shall offer the said bonds for sale in the manner provided by law and Make any and all contracts necessary and proper to be made for the construction of said filtration plant and the, said improvements and additions to the said municipal water system and make all necessary and proper arrangements under the said National. Industrial Recovery Act and with the proper officers and.agents of the, State of Washington for the construction of the said filtra- tion plant and the said imp-ovements and additions -to the said municipal grater. system. SECTION EIGHT: The proposition to be submitted to the qualified voters of the lity of Pasco as herein provided shall be voted upon in the following manner: Every qualified elector desiring to vote in favor of the pro.position her.in out'_ined, to-tivit, that the Jity of Pasco build and install a filtration plant and make other im-Drovements to the municipal grater system as p_°ovided in this ordinance shall do so by riar��in a cross opposite the fig st proposition, to -:-:it: For the building and installing of a filtration plant and the �,.a�,ino; of other improvements and additions to the water system, and the issuance of utility bonds -therefor in an amount not to exceed Eighty Thousand ($80,000) Dollars as provided in ordinance number. And every qualified elector desiring to vote against said proposition shall iaake a cross opposite the second proposition, to -wit: Against the proposal to build and install a filtration plant and make other improvements to the city water system and against the issuance of bonds for the payment therefor, as provided in ordinance number I SECTION NINE: This ordinance shall take effect five (5) days after its passage and publication.
