HomeMy WebLinkAbout0369 Ordinance0 ORDINANCE NO. 369 AN ORDINANCE RE"'3rDLATING THE USE OF THE PUBLIC STREETS AND HIGHWAYS IN THE CITY OF PS, -SCO, CREATING CERTAIN ARTERIAL STREETS, PROVIDING FOR TRAFFIC STOP SIGNS AT CERTAIN STREET INTERSECTIONS, PROVIDING PENALTIES FOR THE VIOLATION THERE- OF AND 1REPEALIN1.) CERTAIN ORDINANCES AND PARTS OF ORDINANCES. THE CITY COUNCIL Or THE CITY OF PASCO DO ORDAIN AS FOLLOWS: SECTION 1. This Ordinance shall constitute and be the Traffic Ordinance of the City of Pasco, Washington, and may be cited as such. It presumptively comprises all general regulations relative to travel, traffic, standing and parking upon the public highways of said City open to the public for use of vehicles and prescribes the rights, duties and re- straints of andupon all persons as the same pertain thereto. SECTION 2. This Ordinance is hereby declared to be an exercise of the police power of the City of Pasco and State of Washington, for the public safety, and its provisions shall be liberally construed for the accomplishment of that purpose. SECTION 3. Nothing in this Ordinance shall be construed to curtail or abridge the rights , of any Person to prosecute a civil action for damages by reason of in4'ury to person or pro- perty resulting from the negligent use of the streets by the driver or operator or owner of any vehicle. SECTION 4. The words and phrases herein used shall for the purpose of this act have the meanings respectively as- cribed to them in this section except in those instances where the context clearly indicates a different meaning. (a) "Vehicle" Every device in, upon or oy which 'any person or property is or may be transported or drawn upon a public highway or street excepting devices moved by human power or used exclusively up on stationary rails or tracks. (b) "Motor vehicle." Every device, as herein de- fined, which is self-propelled. (b) "Street" The term street shall apply to that part of a public highway intended for vehicles. (d) "Curb" The term curb shall apply to the boun- aries of a street. (e) "Intersection." The area embraced within the prolongation of the lateral curb lines or, if none, then the lateral boundary lines of two or more highways or streets which join one another at an angle, whether or not such street/ or highway crosses the other. (f) "Emergency Vehicles." The phrase emergency ve- hicles shall inculde police, fire department, U. S. Mail and ambulance vehicles. (g) "Horse" The word horse. shall include all do- mestic animals used for transportation. i (h) "Driver." The word driver shall include the rider or driver of a horse, the rider of wheels and the op- ertttor of a motor vehicle. (i) "Congested district." The term congested dis- trict shall include the entire width of the following streets of the City of Pasco, to -wit: Fourth Avenue from the north side of Clark street to the south side of Columbia street; Lewis street from the west side of Fifth street to the east side of Tacoma. Avenue. (j) `*Parking Area." The term parking area shall include that part of any street along the curb line thereof designated by this ordinance as a place for the standing of vehicles. SECTION 5. Pedestrians shall have the right of way to cross streets in safety upon the crossings at street inter- sections , and all drivers of vehicles shall use due and pro- per care not to injure pedestrians. Provided, that pedes- trians when crossing a street, shall not carelessly or malic- iously inerefere with the passage of vehicles. Vehicles shall have the right of way between street intersection: and cross- ings. Pedestrians crossing streets at corner shall pass over such portion of the street as are included with the lines of a sidewalk pro f ec ted in a s trt ight ine and not diagonally. SECTION 6. (a) The following named streets shall be and are he -3by made and established Arterial Highways, to -wit: Lewis Street from the city limits on the east to the rent side of Tenth Avenve Tenth :avenue from the north .side of Lewis street to the Benton -Franklin County bridge. Fourth Avenue from the city limite on the north to the south side of C Street excepting that portion of Fourth Avenue which is in- cluded in the intersection of Lewis street. (b) The City of Pasco shall place Traffic Stop signs at the property line in the center of each street at its intersection with Lewis Street between Dedar Avenue on the east and Tenth Avenue on the west, and at the property line in the center of each street intersecting Fourth Avenue between Mar- garet Street on the north and C.street on the south excepting the Lewis Street intersection with said fourth Avenue. (c) The operator of any motor vehicle entering up- on an arterial highway, from a public or private highway, road, street, way or driveway, shall yield the right of way to vehic- les on such arterial highway and shall come to a full stop thereat when and where signs, post or other markers so direct or indicate. (d) Drivers, when approaching street intersections, . shall look out for and give right of way to vehicles on their right, simultaneously approaching a given point within the in- tersection, and whether such vehicles first enter and reach the intersection or not: Provided, This Section shall not Apply to drivers nn arterial highways. (e) No driver or operator of any vehicle shall make a U turn or a turn greater than a U turn at the intersection of Fourth Avenue with Lewis stre6t. SECTION 7. (a) Every person operating or driving a ve- hicle of any character upon the streets of the City of Pasco shall drive the same in a careful and prudent manner and at a rate of speed no g�t�erthan theipointreasonable operation,proper ta$ingunder into the conditions existing a account the amount and character of the traffic, condition of brakes, weight of vehicle, grade and width of street, condi- tion of surface and freedom of obstruction to view ahead, and so as not to undulj or unreasonable endanger life, limb, pro- perty or other rights of any person entitled to the use of the street or highway and in no event at a speed greater than twen- ty-five miles an hour* (b) Subject to the provisions of subdivision (a) of this section and except in those instances where a lower speed is specified in this Ordinance, it shall be lawful for the driver of a vehicle to drive the same at a epped not exceed- ing the following: 1. Fifteen miles an hour in traversing a grade crossing of any steam, electric or street railway when the dri- ' verve view is obstructed. A driverts view shall be deemed to be obstructed when at any time during the last one hundred feet of the approach to such crossing he does not have a clear and uninterrupted view of such railway crossing and of any traffic on such railway for a distance of four hundred feet in both directions from such crossing: Provided, that all vehicles transporting passengers for hire or transporting school child- ren over the public highway whall stop before traversing such grade crossing. When ever any person driving a vehicle approaches an interurban or steam railway grade crossing and a clearly ti .1ai- ble and positive signal gives warning of the immediate approach of a railway train or car, it shall be unlawful for the driver of the vehicle to fail to bring the vehicle to a complete stop before traversing such gra�:e crossing. 2. Fifteen milee an hour in traversing an inter- section of highways or streets when the etriver's view is ob- structed. A driver's view shall be deemed to be obstructed when at any time daring the last one hundred feet of hie approach to such intersection he does not have a clear and unirterrupted view of such intersection and the traffic upon all of the high- ways, or stye is enterla3 such intersection for a distance of three hundred feet from such intersection: 3. Fifteen miles an hour in traversing or going around curves or corners of a highway or street when the drivers view is obstructed within a distance of two hundred feet along such highway or street in the direction in which he is proceedi rg. 4. Fifteen :files an hour when passing a school house, on school days between 8 a. m. and 5 p. m. It shall be the duty of every person operating or driving any motor vehicle upon the streets of the City of Pasco to come to a full stop before passing any bus or stage loading or discharging school children. 5. Nothing herein contained shall be construed to prohibit the officers, men, apparatus and vehicles of the police and fire department of the City of Paco from proceeding at such rate of speed as may be neer-scary in the proper discharge is of their respective duties. SECTION 8. It shall be the duty of every person using the streets of the City of Pasco, to observe the "rules of the road" as hereinafter prescribed. (a) Vehicles, and persons driving or riding any ani- mals, proceeding in opposite directions shall pass to the right giving one-half of the road t;o each. (b) Vehicles proceeding in the same direction on over- taking any person riding or driving any animal shall pass to the left: relating tootheeleft ofraavehiclece in good whenfaith overtakingthe ano hers herein relating d vehicle, or any person riding or driving an animal, going in the I ame direction where the exigencies of the situation permit, shall not- sub-j-ect the .offender to arra-st under the criminal provisions of this act: but it shall be unlawful for any per- son to pass any moving vehicle or anLaial overtaken unless he has a clear view ahead of'not less than 200 yards. (c) The overtaking vehicle shall maintain its speed until clear of the vehicle or animal overtaken and the vehicle or animal being overt>ken shall turn to the right and give one -.half of the resod, and shall not increase its speed while being passed. (d) The signal of an intention to pass shall be given by one blast or stroke of the horn or other signaling device. (e)Should the overtaken vehicle not give way, three such blasts 'or signals shall be given, and Capon the failure to comply therewith, the overtaking vehicle may Cat the next suitable place safe for both vehicles go by without fur- ther signal. (f) It shall be the duty of every pereon operating or driving any motor or other vehicle, or riding or driving an* animal along or over any public highway or street when approaching any curve of such highway or street where for any reason a clear view for a distance of three hundred feet can- not be had, to hold such vehicle under control and to give signals with frequent blasts or strokes of ahorn or other sig- naling device, and to keep to the extreme inside of all curves to the right and to the extreme outside of all curves to the left. (g) It shall be unlawful to operate or drive any vehicle or combination of vehicles over or along any pavement of gravel or curshed DDek surface on a public highwayor street with one wheel or all of the wheels off the pavement or gravel or crushed rock surface except for the purpose of stop- ping off the pavement or gravel or crushed rock survace (h) Rhenever any person -driving any vehicle shall meet on any street in the City of Pasco, the persons so meet- ing shall seasonable turn their vehicles to the right of the center of the road, to permit each vehicle to pass without interfering with or interrupting the other. (i) It shall be the duty of every person operating or driving any motor or other vehicle or riding or driving any animal along or over any stre t and approaching 6ny in- tersection of a street, road or highway, with the intention of turning thereat to the right, to keep to the extreme right, and with the intention of turning to the left to proceed to any point beyond the center of the intersectio� before turning. And it shall be the duty of every such person about to turn from a standstill or while in motion to give a timely signal . from the left side of such motor vehicle, indicating the di- rection in which he intends to turn as follows: If he intends to turn to the left he shall extend his arm in a horizontal position from the left side of such motor vehicle for a reason- able length of time; if he intends to turn to the right he shall extend his arm with the forearm raised at right from the left side of such motor vehicle for a reasonable length of time and every such signal shall commence at a point riot less than fifty feet before the turn is made. And it shall be the duty of every person operating or driving any vehicle along or over any public highway and intending to stop, to extend his arm from the left side of the motor vehicle or other vehicle or animal and extend downward for a reasonable length of time before stopping. (j) Before backing, ample warning shall be given and dile backing unceasing vigilance :must be ex- ercised not to injure -:hose behind. (K) A vehicle shall before -turning to go in the opposite direction be required to go to the first inter- section of the next street and turn completely to the right of the center thereof. (1) It shall be unlawful for any motor vehicle to pass, or attempt to pass, any vehicle wivhin any street intersection in the City of Pasco. B CTION 9. (a) Every driver must drive or operate the vehicle of which he is in charge so -as to Keep a safe distance between the front end of his vehicle and the rear of the vehicle immediately preceding him. (b) Every driver on the approach of apparatus of the fire department shall immediately proceed to the right hand curb and come to a full stop standing parallel thereto. (c) Vehicles shall not approach or park nearer than twor�hundred fifty feet to any fire, and shall not be driven over fire hose belonging to the fire department of the City of Pasco. SECTION 10. It shall be unlawful for any person to neglect or refuse to :rove any vehicle drawn by horses or other animals or any automobile or other motor vehicle when standing in the streets of the City of Pa --co, when requested to move such vehicle or automobile by any offi- cer or any employee of the street department in the ex- ercise of their dut%es. SECTIO' 11. -l+henever the construction or condition of any section of a street i, such that the operation thereon of a vehicle would have a tendency to permanently injure or destroy the surface of such street, or would be dangerous to life or puoperty, , or would interfere with the work being done upon said street, the superintendent of streets may temporarily close such section. �CIUN 12. (a) It shall be unlawful for any per- son to 6rive a motor vehicle in a reckless -lanner o:rer and along the streets of the City of Pasco. For the purpose of this section, to drive in a reckless manner :hall be construed to mean the operation of a motor vehicle upon the streots in such manner as to endanger or inconven- ience unnecessarily other users of such streets. (b) It shLll be unlawful for any person to oper�.te a, motor vehicle upon the streets of the City of Pasco when such person kv s in his or her embrace another person which prevents the free and unhampered operation of the car. Any person violating the provisions of this section shall be deemed 3,uilty of reckless driving. (c) It shall be unlawful for any erson to operate a motor vehicle u -non the streets of the City of Pasco while under the influence of intoxicating liquor or of any narcotic drug. Under the influence of intoxicating liquor as used herein shall mean and cov - re not only all the well mown and easily recognized conditions and degrees of intoxicatinn, but also any abnormal, mer. -tat or physical condition which is the result of indulging in any degree in intoxicating liquor and which tends to deprive him of that clearness of intellect and control of himself which �.ie :could otherwise possess. SECTION 13. (a) Every vehicle drawn or propelled by horses, .mules or other animal .�-ovs°er shall, when driven on any street within the Citj of Pasco, during the hours of darjne:-- have filed or carried thereon in some conspicuous plat A� At least one light so fixed or carried that the light therefrom may be seen both from the front and rear of said vehicle. (b) Every vehicle or t2ailer carrying a load which projects over the rear end t�°�o feet or :Wore shall display a red flag by day and a red lantern by night on the extreme end of such projecting load. (c) Ever m -.-tor vehicle operated or driven on the streets, alleys or highways of the City of Pasco, shall, dur- ing the period from one-half hour after sunrise display one red light on the rear thereof and txo white tights on the fronts the light of which front lights shall be visible at least two hundred feet in the direction in which said vehicle is proceeding or hevil.ed. Provided that motor cycles shall be required to display one white 11ght visible at least two hun- dred feet in the direction in which said motor cycle is head- ed during the period hereinbefore, specified. (d) Bleyoles, shall be equipped with a light visible under normal atmospheric conditions at least three hundred feet in the direction toward which such bicycle is facing, and shall also carry at the rear of such bicycle a reflex mirror or a lamp exhibiting a red light plainly visible under normal atmos- pheric conditions of at least t«,°o hundred feet toward the rear. Bicycles must not tr--vel on the sidewalks of the City of Pasco at any time or place so as to interfere with pedestrians using such sidewalks; Provided, however it shall be unlawful to trav- el upon the sidewalks on a bicycle with -in the paved area of the City of Pasco. LECTION 14. When in the performance of duty the following vehicles shall have the right of way in the order n amed in the use of all streets viz; 1. Apparatus of the fire departments 2. Vehicles of the police department ; 3. Vehicles carrying United States mail; 4. Ambulances. SECTION 15. PARKIN" (a) No vehicle shall be parked for a period longer than twelve hours on any paved street of the City of Pasco. (b) No vehicle shall be topped with the left side thereof to the curb. (c) No vehicle shall be stopped or left standing • within twenty feet of any fire hydrant, unless such vehicle is in charge of some person capable of or actuf ily engaged in driving the same. (d) No vehicle shall be parked on the west side of Fourth Avenue within forty feet of the intersection with Lewis Street. (e) No vehicle shall be parked in front of the Liberty Theater within l+ewistwenty Streeteel andfrom Clark Streets curb line of the alley between (f) No vehicle, exoapt- licensed taxi vehicles, shall be marked on the west tm theei°tersection with Lewisurth Avenue beginning and at a point forty feet extending north ten feet. (g) No vehicle shall be parked or left st"din¢ on the west -dide_ of Fourth Avenue in front of Hotel Pa,-cobe- ginning at a point fifty feet from the intersecti �n of Lewis street and extending north ten feet unless such vehicle is in ohar•;e of some per,, -on capable of or ctua.11y engaged in driv- ing the same. (h) No vehicle shall be parked or left standing in front of Hotel 2ence k•eginning at a point twenty feet from the south curb line of the alley between Lewis Street and Fourlkh Avenue and extending south ten feat unlees such vehicle is in char a of some person capable of or actually engaged in driv- ing the ea.mo . (m) A vehicle shall not cross a sidewt;.lk to or rom an alley, lot or building except very slowly and with great caution. (n) No vehicle shall be g.r1=ed in front of any place of businee s in such manner, or for such length of time as to interfere with such business. (o) It shall be unlawful for any per: on, firm or cor- poration to display a "Bio Parking" siy;n u ,.)on the streets of the City of Pa: co except as hevein provi:?dd. (p) No vehicle shall restrain backed to the curb except it be actually loading or unloading, and in such case no longer tht,n the actual lo -a - ding or unloading is required. If the vehicle be drawn by horses they shall be turned at right angles to the vehicle and in the direction in which the traffic on the street is moving. (q) No vehicle shall be parked or left standing in front of any driveway leading to or frm any garage or service station in such manner that any p -rt of such vehicle shall ob- 40 struct or interfere with any such driveway. All driveways shall be lettered and marked off by the City of Pasco as herein provided. SECTIU 16. It shall be unlawful for any person under fifteen ye�.rs of age to operate or drive a :motor vehicleupon the streets of Pakoo unless such person is accompanied by his. or her parent or guardian. SECTTDN 17. Every vehicle using an internal combustion engine as a motive Dower : ,al! close the muffler, so called, and the same shall not ba cut out or disco.mected within the limits of the city. No eu.."a vehicle shall be allowed to stand idle with motor running m any street longer than three minutes unless such vehicle is in char -:e of a competent driver. SECTION 18. (a) No person shall drop or permit to be dropped from any vehicle or the machinery thereof, any oil, Brea, a or similar substance. (b) No :p,;r cn owning or in control of any live stock shall voluntarily or negligently permit any such live stock to stray upon or remain unaccompanied by a person in charge or control thereof upon the streets of the City of Pasco. (c) No re rson shall while hauli -;g , permit the vehicle at which htj is in charge to spill , drop, or lose any part of its load - (d) oad- (d) No pere n shall drive or operate a motor vehicle upon any street unless the license issued by the Secretarj of State for such vehicle is carried thereon k,,nd the person in permit an ix.Spgotion. of such license charge of such vehicle shall upon the demand of any peace officer. SECTIO,T 19. Any person who shall violate or fail to com- ply with any of the provisions of this Ordinance or who ehall counsel, asu.ist, aid, or abet any such violation or failure to comply, whall be deemed guilty of a-:aisdemeanor and shall upon conviction, be punished by a fine not exceadinglonotndrda& fifty dollars, or by imprisonment in the city jai exceed- ing ninety days, or by both such fine and imprisonment. ECTION 20. If any section or provision or part thereof of this Ordinance shall be adjudged to be invalid or i.r.nonsti- tutional , such adjudication shall not effect the e aloripartf the Ordinance ae a whole or any section, p thereof not adjudged inlaid oz• unconstitutional.
