AN ORDINANCE RELATING TO REGULATINu , SUPE NISING AND LICENSING POOL AND BILLIARD HALLS AND SOFT DRING PAR:= LORS OR PLACES, PROHIBITING PUNCH BOARDS, AND REPEAL-ING ORDINANCE NUIVI-BER 310 EIITITLED, "AN ORDINANCE RE- LATING TO LICESEL AND REGU.IATINu POOL A.ND BILLIARD HALLS AND SOFT D:h IlyX PA.,LORS OR PLACES AND PROHI- BITING PU.NDH BOARDS" , AND REPEALING ORDINANCE NUM- BER 3 26 , BEING Z ORDINANCE AMENDING ORDINANCE NUMBER 310. THE CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLOWS: Section 1. Hereafter it shall be unla,ltrful for any person, firm, or corporation to open up, engage in, or carry on any pool hall, billiard room, or soft drink par- lor or place contrary to the provisions herein, and with- out first obtaining a license therefor and paying such fee as hereinafter -orovided. Section 2. A "pool hall" as hereinafter used shall mean any place operated for gain where one or more pool, billiard, or card tables are kept or maintained.. A "soft drink parlor" shall mean any place opened up and conducted for gain, where soft drinks or re- freshments are served as distinguished from restaurants or eating houses. "Punch boards" s hall mean any wooden board, paper, card, sheet or other lottery device whereby a ticket, nt-junber, share or chance may be secured for a considera- tion, representing :Honey or other thin; of v�ilue the se- curing of which is in any degree dependant upon chance or luck. Section 3. Any person, firm or corporation desiring to obtain a license to open or conduct a billiard hall or pool hall shall make application.therefor to the city clerk of the City of Pasco, which application shall describe the premises wherein same is to be conducted, and city clerk shall issue such license upon approval of the city council, said license shall be for the period of one year unless sooner revoked by the city council, beginning July first of the year it is issued and terminating the 30th day of June following. The minimum license fee shell be five dol- lars 05.00) for each pool hall containing one pool table or billiard table , and two dollars ($2.00), for each ad- ditional pool table or billiard table. Section 4. Any person desiring to obtain a license to open or conduct a soft drin4parlor or place shall make application therefor to the city clerk of the City of Pasco, which application shall describe the premises wherein same is to be conducted and the city clerk Ladd issue s:,ch license upon the approval of the city council upon payment of a fee of five dollars 05.00) per annum. Section 5. Bo license granted to any person under the provisions of this ordinance shall be assignable and any license so granted may be revoked by the city coun- cil when in their opinion public interests will be best subserved. 0 -2- 0 2- Section 6. It shall be unlawful for any blinds, screens or other obstruction to be placed or used in any rooms where suci. billiard tables or pool t1ables shall be kept or operated, to prevent a full view of said room from the street on which said room shall front, or from the main portion of the said room so occupied , that is no curtains, boxes, or partitions or any other obstruc- tions shall inclose any room in. the interior of such pool hall used either for the purpose of cor;ducting a pool , billiard or card game. Provided further, -that it shall be unlawful for any proprietor, agent or employee of any pool hall or billiard hall to allow any person under the. age of 21 years to remain therein, either as a loiterer, spectator, or player, and it shall be :no defense to proprietor, agent or employee of said. pool or billiard hall, believe that the said minor was of age or that the said minor misre- presented his age. It is further provided that any person between the ages of 18 and 21 years of age who shall misrepresent his age and thereby be allowed to remain in said pool or z billiard hall, shall be deemed. guia %; of violat ing this section and be punished as provided in Section lVof said ordinance. Section 7. No pool room shall be allowed to remain open between the hours of 12:00 o'clock, midnight and 6:00 o' clock a.m. ti o gambling shall be permitted in said pool room, or soft drink parlor. Section 8. No pool hall or soft drink parlor 's.hal1 have therein any liquor of any kind containing a greater amount of alcohol than 1/2 of 1%. Section 9. No person intoxicated or in any degree under the influence of liquor, or in any manner disorderly shall be allowed to remain in such pool .hall or soft drink parlor. Section 10. Any proprietor, agent or employee. of such pool hall or soft drink parlor shall be liable and may be prosecuted for the violation of any, part of this ordinance and the possesslor of any liquor of a greater alcoholic content than 1/2 of 1% in an,, pool hall or soft drink parlor shall be prima facie evidence against the pro- priet-or, a3ant or euployee of such place that he has violated this ordinance. Section 11. It shall be unlawful for any pool hall, soft drink parlor or any other place to keep or display any punci1 board. Section 12. Any person who shall violate any of the provisions of this ordinance shall be deemed gthil ty of a misdemeanor and, upon conviction thereof, shall be fined in any sum not to exceed $100.00 or be imprisoned for a period not to exceed thirty days, or by both such fine and imprisonment. Section 13. Ordinance nii-nber 310 entitled "An ordinance relating to licenses and regulating pool and billiard halls and soft drink parlors or places, and prohibiting punch boards", passed by th ai ty council March 8 1921,nd or- dinance number 326 amending section S oL ordinanc5 �1 0 0 -3- number 310, passed by the city council May 16, 1922, and all other ordinances and parts of ordinances in con- flict herewith, be, and the same are , here-repeeled .
