WHEREAS, : the ' City of Pascoe, a city of the third chase ,
is now supplied with domestic water and fire prot4otion by a cQrp.ora
tion known as the .Pacific Power & Light CoMpany, through a source
of .supply in an open intake from the Columbia River and
WHEREAS, the said source of supply is not entirely
free from contamination, and
WHEREAS, the distribution system of said. company is
inadequate and insufficient to supply said. city's present need for
domestic, irrigation. and fire pnf'pces; and the rates charged .there-
for are excessive to..the extent that it, is prohibitive to use said
water for anything but. raere domestic .purposes, and
WHEREAS there are created. and. --existing within the
City of Pasco three .lo;cai improvement districts, being Now. 25 43 and
44'9 with a distribution. syste?1, ' imdependent of the Pacific Power &
`bight Company,T. s system and r elying f or their s carce of water:; supply
upon the Franklin ,County Irrigation District No;, I, under and by
virtue of a contract heretofore existing wi th what was known as the
Pasco Reclama tioil Cojxpany , now defunct, and the said irrigation
district.is objecting to.a compliance with. aid contract and
is failing to furnish` sufficient water. for irrigation purposes
within. the said districts within the city of Pasco and, further,
it appears that the distribution system within said improvements-.
districts is,by means of wood stave pipe, wb-ich are rapidly de-
teriating wi- and will become worthless within a short period of,
time, and -
KHEREAS the he, l't.h°,. happiness and economic welfare
of the inhabitants of the City of Pasco s.nd the continued growth
and demands of the Cityt. 'of Pasco reou.ire the acquisition, i-a=
orovement and extension of a water system, and al, ample supply of
pure wholesome waster for all purposes, and
VMTREAS ,, the law provides that the City Council
shall provide for the foregoing. by ordinance, shall specify and
adopt the system or plan proposed , .and declare the estimate-cost
thereof as/near as may be and submit the same to the qualified
votersof said city f"or their ratification.
NOW . THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO
DO QRDAIN AS FOLLO'�S' . .
Section -1. The Mayor and City Council of the City of
Pasco will submit to the qualified voters of said city for their
ratification or rejection by a majority ofth.e voters voting upon
the question the proposition. as to whether or not the City of
Pasco shell acquire by purchase or condemnation and purchase the
plant and water system of the Pacific Power & Light Company , . make
additions and improvements thereto and pay for t he same, by the
issuance of Public Utilty.Bonds as set forth in detail in the.
following sections, said proposition to be stbmitted to the
qualified voters of said city in at a special election to be held

for tha t purpose on' the9 day o ' 1922-3, pursuant to notice
to be given as provided by lair.
Section 2. The system or 'p 1 ayr.,.p r o p, w e d and the esti!mted
cost thereof as. near as may be: • i s as -follows:
(a) It is propos.e4 to pure.hase ae if a satisfactory
price can be obtained and if not to condemn and purchase the
present water system of the e?acific Pamer & Light .ompa.ny located
within the City of Pasco, including the intake, pumping plant,
maing , distributing, system, , service pipes, ::eters, and all other
property and ec ripment used in connection with said water system
theestimated cost thereof being not more than '60 ,000 , including
expense of acouisition and condemnation if necessary. ^or reference
to esti,i ted cost and expenses as aforesaid, reference is -wade to
Sawyer Brothers' report on Pasco -;later Supply System, dated :'august,
15, 1917, or, file in the office of the ,ity ole rk, concluding on page
25.
(b) A new two -unit pupping station at.an estimated cost
of "710,000, detailed specifications for Which are found in the
Report of Savyer Brothers on the Pasco 74ater Supply System, dated
Augret 15, 1917, on file in the office of the Citj Clerk, beim the
first subdivision on page 39 thereof.
(c) A tank and tower or t anks and towers complete in
place, `320,000. Reference to cost thereof being m de to Sw.�iyer
�?rothers' ,report on ?asco tater Fup_oly S*yste i, dated 4,xgust, 15,
1917, on file in the office of the "ity Clerk, at page 39 thereof,
and special tank and toTaer diagrams thereto attached, not limiting
the Aty, however, to one tank unle ss thee ame .gay be deemed ad-
visal61e .
(d) The source of .Suter supply shall be from wells,
the location of such wells whether near the :;olumbia or inland
to be determined by competent engineers if this proposition be
adopted. Reference to inland wells being found in uaiiiyer Brothers'
Report on Paseo ater Supply System dated ugv st 15, 1917, on file
in the office of the City Clerk, at page 3 and the advantages there-
in enu-:aerated ,and it will therefore be necessary to provide weans
and connections with such wells to the present s -stems , both of the
Pacific ?o - er & Light Company �rhen a c. aired , and the local i.-xprove-
ment districts systems and to nuke i=T di ate betterments and ex-

tension to the systems of distribution; that the esti fated

(e) Engineerin or cortin encies "15,000.
Section 3. Thi -.t the total estimate-` cost of the

,modified as may be deeied advisable by the City 1nineer to be
eployed for that nurnose or by the City vouncil of the vitt'
of Pasco in so far as the total cost shall not be exceeded.
Section 4. It is the intention of the ')ity Council to
create a special fund for the urrpose of defrayinc; the Lost and
a-intenance of said nvblic utility as hereinbefore described, and
to ob? °.gate �ax_d bind trie city of `'asco to set aside the 17ross
revenues of such public utility io-r :uch purpose and further, to
issue and sell bonds bearing interest not exceeding 6;'D per annu-a,
pUyab;e se-ii-arnuallu to be executed in such ~i€mner and payable
at such ti. -_yes and places as the amity council hell deter -Ane to pay
the cost of said systei, but such bonds and interest thereon shall
be payable only out of such special fund, and the bonds to be is-
sued and sold shall not exceed the total estiriiated cost of said system,
to -wit: :150,000; said bonds to aa.ture serially and not later than 20
years froa date of issuance.
Section 5. Any bonds issued as hereinbefore provided and in
accordance with Saws of the State of 'lashington, shall be a first and
prior lien against the entire systea as hereinbefore provided for, and
said botids shall contain appropriate reference to this ordinance, to
the Laws of the State of as hington , and to the ri hts of said bondhold-
ers defining the obligation therein created.
Section 6. If the proposition herein outlined shall be adopt-
ed by the qualified voters of the City of Pasco, then and in that event,
the "*ity ;;

ments and 'locate. the well or wells, froi-a fro:which the . s ounce of supply
of said !eater .shall be obtained and for. suchpreli:uinary work, it
is the intention of the City I-Winicil to elpend a. sunt not exceeding

and i,rbich aaount ~hall be returned to the general .fund of the city
of Pasco out of the monies derived frog the sale 'of bonds herein-
before referred to.
Section 7. That i:c the pzoposition herein outline+7. be
adopted by the Qualified voters of the. City *of Pasco, the. City
At,torh6y of - said city shall. i srsediately commence and proeecute the
necessary proceedings in the name of ane City of Pasco in•the
proper court to condemn and acovire the 'necessary lands ✓rights:

satisfactory price can/be obtained at once , from the owners of the
system herein referred -to, to -grit: The Pacific Power & Tight campany,
then and in that event, to proceed forthwith to condemn said system
and th-e I judgment or judg-nents in such proceedings with the costs
thereof , shall be .paid out of coneys derived.,from the sale of
bonds hereinbefore referred to. -
Section $. If.the proposition herein outlined be adopted
by the qualified voters of the city o Pasco at' said election the
:City Council shall eimploy an engineer w.4o shall cause to be prepared,
full detailed plans and specifications covering the
ea.t}ei:e plan herein proposed and filen said plans and specifications
in the office of. the City Clerk and shall include with said plans
detailed estimate of the probable cost of said , system . complete,,
and thereupon the City Council of the Citi' of Pasco shall proceed
to advertise :for bic;s for all work embodied in and necessary to.
carry out the said plan and to corAplete*t e said system and such
contract may be .one or several covering the work and --iaterial nec-
essary and Hwy be paid for either in cash, if the bonds have been .
sold, and issued, or in bonds issued .as' hereinbefore provided.
Section 9 That there shall, as soon as, convenient
and necessary tbe created' and . established in the Treasury of the City
of Pasco s fund. to be° noti�rn and desi natecl as the, City of` Pasco $pecial
Municipal Water Fund ,. into which fund, shall be ,paid .611 monies derived

for the sole purpose 'Of' d.'efrayin.&.thE- .cost and exp6nses of said water
system, and the -maintenance of the' 'sante during the operation, of the
said systork by the said -City `of 'Pasco.
Section 10. 'khe.. contemplated and 'esti anted "charges to be
wade. by the City ,of Pasco for service . to be rendered and the revenues
to be derived .from .the '.operation and maintenance of ' said grater system
are' as follows
'(a) The City of Pa'soocia.11''pay into said fund a hydrant

(b)' Prom th.e sale of water to local improvement districts

price, for such 'service with the-old Pasco Reclamation company, succeeded
by Franklin: County Irrigation 1�istr ct #1; a total of X3300:00.
6)' For. service 'to the public the Tollowing its an, estimate
of charges for water for domestic or irrigation purposes, to-wit; First
300 . gallons 01..50; next 2000 gallons , 50�-; all :in excess of. 5000 gallons,
8( per 'thousand -gallons , minimum charges` in all-cases, of §1.5.0.
The foregoing esti-mates may .be revised., modified, or chan,aed
fro i time to time ..to Meet th..e..exis:ting conditions and the "lity tUouncil
shall further provide- such', rules and, regulations for service as

Section 110 The proposition- to. be submitted to the
cual-itied voter`s of the City of Pasco as herein outlined shall
