HomeMy WebLinkAbout0340 OrdinanceORD INAN OE NO., AN ORDINANCE REGULATING AND LICENSING HOTELS, ROOMING HOUSES AND LODGING HOUSES 'KITHIN THE CITY OF PASCO AND. PROVIDING PENALTIES FOR VIOLATION OF SAID ORDINANCE. THE CITY COUNCIL OF THE CITY OF PA.SCO DO ORDAIN AS FOLLOWS: Section 1. That no person.shall conduct, keep, manage, operate or cause to be conducted, kept, managed or operated :either as owners, lass -or, lessee, agent , or attorney, any hotel, rooming .house, or lodging house or other place where lodgings are furnished within the corporate li�nits' of the ::City' of Pasco, without first having obtained a license- :from the city of Vasco to so do. All said. licenses shall be issued annually and shall expire June 30tjt of each year. The fee for.each license shall be five dollars and no license shall be issued for a less amount and no such license shall be transferable. Section 2: .tor the purposes of this ordinance the word "person" shall mean and include natural persons, co- partnerships corporations and associations,and shall in - elude persons of both sexes..shall mean and include hotels , roominghouses, lodging houses and all other where lodgings are furnished.to transient customers, as distinguished from apartment or boarding houses with regular weekly or mon-ay charge reserved. Section 3. Every application for license under this ordinance shall be in writing, signed by the appli- cant and filed in the office of the City Clerk. Such application 'shall state the place where .the business is to be conducted, and shall be written upon a form fur- nished by the city. Section 4.;:The 'Chief of Police shall.examine into and investigate the character of every applicant.for license hereunder. and shall submit a recommendation to the City 0ouncil as to. whether or.not such license shall.issue and no license shall_ issue to any'person of questionable character, and when.an application for licence ks made for or. on, behalf of •a partnership., corporation or association, such application shalldesignate who shall be and shall be made by the .person tgho. shall` be'the manager or other per- son who will have charge and management of such hotel, rooming -house, or lodging house , or other place where beds or lodging are to be furnished to guests or lodgers. Section 5. No person to whom a license shall be issued under this ordinance shall suffer or permit said hotel rooming-house,1od in ouse or other lodging place to be used for any r unlawful purpose and shall at all times keep a standard hotel register in Aiich sLiall be inscribed -the. names of all guests or persons renting, using or occupying rooms or quarterstherein which register - shall. be signed by the person using.a room, rooms, space or -quarters or by someone on his behalf and under his direction. Such registration must be made and after the name or names so inscribed or :registe.red tae ratinager. of the place his agent or servant shall write the number of the. room or rooms which.such guest or person is to oc cupy , . together with . the time when such .room is rent. ed . All of which shall be done before such person is permitted to occupy or use such room or rooms. Such register at all :times shall be open to insppction by anygVest-of the house wherein such register is kept and to any executive , or• peace officer of' the City of Pasco , or of the State of Wash- ington; and such register shall be preserved for a period of one year from the date of any such registration, during which -time such inspection must be allowed, Section 6. It shall be un] wful for any person to write or cause to be written in any hotel register required. to be kept by this ordinance any other or different name than the true name of the guest or person, or the name -by which such person is generally and the true num- ber of each room to be used or occupied by such west `.at the time of such registration shall be written after,. such name or names. Section 7. :any person to whom a license shall have been issued under this ordinance shall cause each guest . froom and each apartment in such house to which the license relates to be numbered in plain and conspicuous manner, the number to be placed on the outside of the door of each room, and no two doors shall bear the safe number. Section 8. Where a license shall have been issued to any co -partnership, corporation or association to con- duct a hotel, rooming house, lodging hour- e, or place for lodgings, any person having charge, management or control thereof shall be liable to prosecution for any violation of this ordinance; and the licences and the parson in charge each MAY be charged and prosecuted for such violation and con- viction of one shall not abate any prosecution against the other for the s ame offense. Fpr the purpose of determining the. liability of any person or persons to prosecution for violation of any pro-- visions of this w dinance , it shall be sufficient to shove that such person was at the time of the act or viola - ton complained of, the person in actual charge, manage- meet or control of a house or place in which such act is alleged to have been committed, and for every violation of this ordinance the licensee himself shall be liable to prosecution also. Section 9. The City Council of the City of Fasoo may refuse to issue license, revoke any license for any cause which to them may appear sufficient or oancel such license providing that the licensee shall have fiot less tht three days notice pt the intention of said city council to cancel said license and the said licensee may be heard at said meeting at which said matter of oancel-- link license shall be taken up by the said City Council. Said licensee shall demand such hearing in writing at lealOt one day before such meeting. Section 10. It shall be unlawful for the licensee or any person in charge of any hotel, rooming house, lodging house or place covered by such license, knowingly to receive or retain as a roomer, visitor, lodger, or guest thereat any =pimp, prostitute, boot-legger, jointist, gambler, or dtienrderly person or to harbor any such or to allow any such person to be or rein upon the premises as guest, visitor, lodger, employee, or any one in any other capacity who practices or takes part in any act of prostitution, or wto, engages in or is present at any game of chance or who practiees or engages in any immoral act or any disorder- ly or unlawful conduct, or who unlawfully carries upon his person or with him or has in his room, baggage or possess- ion any intoxicating liquor, Section 11. The intention and purpose of this or- dinanoe is to assist the police department in apprehending violators of the la we and ordinances, to rid said city, if A sp possible, of pimpa ,vagrants , gamblers, prostitutes, boot- leggers, and the criminal and undesirable class, and to discourage and pilialize acts and practices which foster and encourage bad morals, and in furtherance of such purposes -this ordinance and its several provisions 'shall be given that liberal construction which Will effectuate such phrposes. Section 12. .Any person violating any provision of this ordinance shall upon conviction be punished by a fine of not more than `.Lwo Hundred Fifty Dollars ($250) or im- prisonment in the,yity Jail .for not more than ninety (90) days, or by both such fine and imprisonment. Section 13. If upon the sworn complaint of any person it shall be made to appear to the Police Judge of the City of Pasco, that there is probable cause to beliefe that any section of this ordinance or any provision hereof'is being violated, the n the Police Judge :shall forthwith issue a warrant, directed to any police officer of the City of Pasco, commanding him to search the premises designated in said warrant, and described in said complaint, to seize any intoxicating liquor, implements, furniture or fixtur es used or kept in connection with any violation of this ordinance, and to safely keep the same, and to make return of said warrant within three days, showing his acts and doings thereunder, and specifying the articles seized, and the naive of the- person or persons in whose possession, or upon whose premises the same were sound; Provided further, that a copy of said warrant shall be served upon the person or persons found in possession of said liquor or property, or in pos- sepsion of the premises, so searched, and. if no person, or, persons ase found aB aforesaid, then a copy of said warrant shia11 be poskad in a conspicious place upon the premises. Section 14. All ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 15. This ordinance shall take effect five days (5) from and atter its passage and publication.
