AN ORDINANCE RELATING TO THE USE OF ME PUBLIC HIGHWAYS OF THE CIT' Or PASCO OPEN TO THE- PUBLIC FCE ME USE C2, VEHICLES PROVIDING PENALTIES FOR THE VIOLATION THEREOF, and repealing certain ordinances AND PARTS OF ORDINANCES THE-OITY CDUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLLO''S: 'Section -l. This ordinance shall constitute the Traffic Ordinance of the City of Pasco, and may be' cited as such. It presumptively comprises all general regulations relating to travel and traffic and parking and standing upon the public highways ,and all other places of said city open to the public for the uses of vehicles, and the .rights , duties and restrains of persons as the• acme pertain thereto. Section 2. This ordinance is hereby declared to be an exercise of the police power of the State of Washington and of the Cir of Pasco, for the public safety, and its provisions shall be liberally construed. for the adcomplishment of that purpose. Section 3. Nothing in this ordinance shall be construed to curtail or abridge the rights of any pereon to prosecute a civil action for damages by reason of injury to persons or property resulting from the negligent use of the streets by the driver or operator of any vehicle or its owner or his employee or agent. Section.4. If: any portion of this ordinance should be de- clared: invalid it shall not thereby affect the validity of the re- maining portions. Section. 5. The words and phrases herein used, -u:nle ss the same -shall be clearly contrary to, or inconsistent with, the context of,the ordinance or of the .zection in which used, shall be construed as follows: DEFINITIONS: The word "vehicle" includes equestrienp.��- lead horses, and, everything on wheels or runners, except szb� c rs and. baby carriages; the word "emergency vehicles" shall include police, fire department, U. S. snail vehicle, and ambulance . The Fiord "horses` includes all domestic animals; the word "Driven' includes tha' rider or driver of a horse , the rider of vrs eels and the operator of amotor vehicle. The term"co#gested district" as used in. this ordinance shall include both sides of the following streets of the City of Pasco: Fourth Avenue, between Clark and Columbia Streets; Leeds Street between Fifth and Tacoma Avenues.The term "parking area" as used in this ordinance shall include that part of any street along -the curb line thereof designated -by td ordinance as a place f or the standing of vehicles. Section 6. PMuSTRIANS: Pedestrians have the right-of-way to{oross streets in safety and all drivers of vehicles shall exercise ali.pnoper care not to injure pedestrians. Pedestrians when crossing a street shall not carelessly or maliciously interfere with this pas- sage of vehicles. Pddestrians shall' have the right-of-way at street intersections and crossings; vshicles shall have the right-of-way between intersectiohs and crossings. Pedestrians crossing streets at -,corners shall pass over such portion o -f the streed as is included within the lines of the side walk projected in straight line, and not diagonally. . Section 7. DRIVER SIGNALS: Before slowing or stopping the driver shall signal to those behind by extending the arm diagonally douanward. In turning while in kotion, or in starting to turn from a standstill a sisal shall be given by indicating vd- th the hand the direction in which the turn is to be made. Turning to the right the left arm shall be extended diagonally upward. Turning; to the left the left arm shall be extended horizon- tally. orizon-tally. Before backing, ample warning shall be given, and while backing, unceasing vigilance must be exercised not to injure those behind Section 8. (a) RIGHT=OF-WAY: Police, Fire Department, U. S. Mail Vehicle, and ambulance shall have the right-of-way in any street and through any procession. (b) APBROACHING INTERSECTION: Vehicles shall be under such control as to permit the vehicle on the right of the vehicle approaching to first cross the intersecting street, excepting emergency vehicles. (c) At allintersections, the vehicle entering the inter- section from the right of another vehicle entering said intersection, shall have the right-of-way, except over an emergency vehicle. (d) The driver of a vehicle on the approach of any fire apparatus shall immediately drag up said ;vehicle as near as practicable to the right hand curb and bring it to a standstill. SECTION '9. TIIUTING.. (a) A vehicle turning into another street to the right shall turn the corner as near the right hand curb as practicable. (b) A vehicle turning Tinto mother _street to the left shall circle around the center of the street instesection. (c) A vehicle to cross from one side of the street to the other, to enter a place of business, alley or other private vAeOpublia property shall in doing so proceed to intersection in making turn. Section3o. SPEED LIMIT. (a) No vehicle shall travel at a.speed faster than twenty miles per hour within the City Limits be- $meen intersection of streets, and not faster than twelve miles per hour at intersection. (b) Nothing herein contained shall be construed to pro- hibit the officer, men, apLmxatus and vehicle oE' the police and fire department of the City from proceeding at such rate of speed as may be necessary in the proper discharge of their respective duties. (c) No vehicle shall be operated or moved at a sp eecl greater, than is reasonable and proper, having regard for the traffic and the use of the way by others, so as to endanger the life or limb of any person. Section 11. PARKING: (a) No vehicle shall stop with left side to the curb. (b) No vehicle shall be stopped or left standing within 20 feet of any fire hydrant, unless such vehicle is in charge of some person capable of or actually engaged in driving the same. shall 7� (c) Motor and other. vehicles not parksd with�,thirty feet of any street intersection, same to be designated by a white line painted on the curb. Vehicles in parking shall approach the right hand curb at an angle of forty-five degrees and the nearest front wheel not to exceed one foot from the curb. This subdivision of thia Sec. shall'only apply to the congested district as hereinbefore designated. Section 12. PASSING. Vehicles going in opposite direction shall pass to the right. Vehicles overtaking a vehicle shall pass to the left of said vehicle. PASSING AT INTERSECTION: No vehicle shall overtake and pass or run abreast with another vehicle travelling in the same direction at a street intersection. A motor vehicle overtaking any other vehicle, before passing, shall give a signal by one blast from horn , or bell. Section 13. Driving over fire hose is prohibited. Section la. No person shall drive any sheep, swine, or cattle or other animals in droves upon any street so as to interfere with traffic thereon. Section 15. No person shall drop or permit to be dropped from any vehicle or the machinery thereof any oil, grease or similar suketanee. Section 16. No person while hauling shall permit the vehicle of which he is in charge to spill, or drop or lose any portion of its load. Section 17. All persons and vehicles shall 7.eep off of streets temporarily closed for parades except those participating therein'. Section 18. No- person - shall ".unl,oad..a.`veht:cle in such a manner as to produce injury to the street. Section 19. Vehicles shall keep to the right of the center of the street. Section 20. On a street divided longitudinally by a parkway, viaduct, or walk, vehicle 13hall keep to the right, of such division. Section 21. Every vehicle shell pull to the right side of the street or road when Signalled from a vehicle behihd with desire to pass. Section 22. No vehicle shall remain backed up to the curb except it be actually loading or u#loading, and in such case no 'longer than the actual loading or unloading requits. The horse or horses shall be turned at the right angles to the vehicle and in the direction in which the traffic upon the street is moving. Section 23. No vehicle shall be allowed to remain upon or be driven through any street of the city of Pasco, so as to wully blocade or obstruct the said stree-., and no vehicle shall be so overloaded that the horse or horses or motive poorer, shall be unable to move it. Section 24. HORSES. Unlawful to leave any horse unbridled ibr;unattended in any street or unenclosed space without being Lecu rely fastened, unless harnessed to a vehicle with wheels to secured as to prevent movement faster than a walk. f Section engine as.a motive same shall not be city. 25. No vehicle shall be parked for a period longer than twenty-four hours upon the paved streets of the City of Pasco. Section 27. Every horse dran vehicle shall have fixed or carried thereon in some conspicuous place on the left side of such vehicle during the hours of darkness, at least one lighted lamp so fixed or carried that the light therefrom may be seen ia�lbh from both the front and rear of such vehicle. Section 28. Every vehicle or trailer earning a loaf which projects over the rear end three feet or more shall display a red flag by day and a red light by 'Aight on the extreme end of such projecting load. Section 29. No person shall operate or drive any motor vehicle on ap�.yy street, avenue or public place within the City of Pasco, witY:1he license number assigned to it by the State of Washing- ton conspicuously displayed in the front and rear of.such vehicle, sane to be kept free from grease , dust or other blurring rm. terials so as to be plainly visible at all times. Every motor vehicle operat- ed or driven on any street, avenue or public place shall be provided with adequate brakes and with a suitable bell or horn. Every bicycle and tricycle must have at least one light -*- of sufficient power to be cldarly visible at least one hundred ancl fifty feet in the direction in which said bicycle or tricycle is proeeeding or heading while on the public streets, avenges or high- aay4uring the period hereinafter provided. Every motor vehicle operated, driven on the public streets, avenues alleys or highways of the city of Pasco shall display during the period from one hour after sunset to one hour before sunrise, one red light on the rear thereof and tsvo rrhite lights on the front, the light of which front lamp to be visible at least 150 feet in the diree;'_4_ tion in which said motor vehicle is proceeding or headed. Provided, that motor cycles shall be equired to display one lamp showing a white light visible at leas150 ft. in the direction in which said motor_ vehicle is proceeding or heading during the period hereinbefore provided.. Section 30. Any person violating any section of this ordinance or any part thereof, shall be deemed guilty of a misdemeanor and shall, upon conviction, be punished by a fine not exceeding *2 -ft or by imprisonment in the �y flail not exceeding 90 days or by both such fine and imprso ent. Section 31. All ordinances gn8 parts of ordinances and especially Ordinance 111o. 240, in conflict herewith, be and the ,same are hereby repealed. Section 32. This ordinance shall take effect five days from and after its passage and publication. Passed and approved this 17th day of October,f`i922. V.
