ORDIIANCE N0. 309 ORDINANCE RELITING TO INTOXICATING LIQUORS, PROHIBITING THE MANUFACTURE, POSSESSION, E OR DISPOSITION THEREOF, AND PROVIDING FOR SEARCH AND SEIZURE AidD DESTRUCTION, AND FORTIS OF PROCEDURE AND RULES OF EVIDENCE, AND FIXING PENALTIES FOR VIOLATION HEREOF. CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLL07,7S: Section 1. The phrase"intoxicating liquor" whenever used in this ordinance shall be held and construed to include ang spirituos, vinous, fermented or malt liquor, and every other liquor or liquid containing intoxicating properties, capable of being used as a beverage, whether medicated or not, and whether proprietary, patented or not, which contain alcohol, which are capable of being used as a beverage. Section 2. The word "persons" whenever used in this Ordinance, shall be held and construed to mean natural persons, firms, co -partnerships or corporations, or any other associations of ersons, whither sting by themselves as servants, agents or employees. Section. 3. It shall be unlawful for any person to manufacture, sell, barter, rrexchange, :l Five away or otherwise dispose of any intoxicating liquor, or to have, possess, or keep any,, i.ltoxicating liquor, excepting only a regularly ordained clergyman, Priest or Rabbi-., actually engaged in ministering to a re'tigious congregation, and persons having acquired d the same in a lawful manner prior to June 6, 1917, so long as said liquor is kept at the private dwelling of such person, while occupied by him as such, and kept solely for his own use, and that of his family; and excepting druggists, physicians and surgeons, license,, by ;he State of Washington, as such, and when aegriring and using the same in accordance with i the laws of the United States andthe State of Washington. Section 4. If upon the sworn complaint of any person it shall be made to appear to the Police Judge of the City of Pasco that 'dere is proballe cause to believe that any section of this ordinance, or any provision hereof is being violated, then the Police Judge shall forthwith issue a w.arraitt, directed to any pol ce officier of The City of Pasco, cc manding hi -n to search the premises designated in said warrant, and described ni said complaint, to seize any intoxicating liquor, implements, ftrniture or fixtures used or kept, or capable -f bding used or kept in connection with any violation of this ordinance, and to safely keep) t'h_e same, and to make return of said warraht within three dayd, showing his acts and doings j hereunder, and specifying the article seized, and the name of the person or persons in whose possession, or upon whose premises the same were found; Provid®d, further, that a copy of said warrant shall be served upon the person or persond found in possession of said liquor or property, or in possession of thepremises so searched, and if no person or persons!! are found as aforesaid, then a copy of said wa--rant shall be posted in a. conspicuous place upon thepremises. Section 5. Possession of intoxicating liquor as herein defined, of implements or equip- mldnt being used, or to be used for the purpose of manufacturin intoxic in emises so used, shall. be p i liquor, or o£ p !.rima facie evidence of violation o� this or�dir_a�ce. Section 6. Any person violating any provision of this Ordina ce shall upon conviction b' punished by a fine of not more than Two Hundred Fifty (250.00) Dollars, or imprisonment i the City Jail for not nore than ninety (90) days, or by both such fine and imprisonment. Section 7. All ordinances and parts of .ordinances in conflict herewith are hereby repealed. Section 8. This Ordinance shall take effect five (5) days from and after its passage and publication.
