AN ORDINANCE IN RELATION /TO NATER AIiD THE USE TIrEREOF IN LOCAL ILIPROVETIIENT
DISTRICTS NOS, 43 AND 44, 25AND OTIIE2 LOCAL IMPROVEI:DNT DISTRICTS HEREAFEER
PORLiED, AND PRESCRIBING THE 1,1ETHOD BY WHICH AND THE LIAIIITER IN 17HICIi LATERAL
AIM OTHER PIPE CONNECTIONS MY BE ITADE AID TIE MAIN PIPE LINE, AIM LATERALS
OPENED AND PENETRATED, AND
PROVIDING FOR THE LICENSING OF PERSONS TO MAKI COINECTIONS AND OPENINGS
IN SUCH MAIN PIPE AND LATERAL LINES, AIM THE OBTAINING OF A PERI,1IT THEREFOR,
AND PROVIDING FOR PENALTIES FOR THE VIOLATION THEREOF.
THE, CITY COUNCIL OF THE CITY OF PASCO DO ORDAIN AS FOLL MS:
SECTION 1. It shall be unlawfull for any person, firm of corporation
to mahe any opening in any water main or lateral in Local Improvement Districts
Nos. 43, 44, 25 and other Local Improvement Districts hereafter formed of the
City of Pasco, or to connect any private water pipe therewith without having
first taken out and procured a license so to do in the manner hereinafter
provided, to be known as an "Irrigation Nater Connector's License". The fee
for such license shall be the stun of Ten Dollars per antun, and no license
shall be issued for a period of less than one year, and shall be nontransferable
and no license shall be issued in the name of more than one person, or to any
olher than a natural person.
SECTION 2. Any person desiring an "Irrigation ,later Connector's License"
shall make application therefor. in writing to the City Council upon a blank
form to be furnished for that purpose by the City Clerk, which application
shall contain a certificate signed by at least two responsible masons, plumbers,
or builders or one of each, to the effect that the applicant is known to them
to be a reliable person, skilled in the business of laying and connecting pipe,
and is a bonifide resident of the City of Pasco. The applicant for such license
shall pay a fee provided for in this Ordinance to the City Treasurer and take
his receipt therefor and shall file with the City Clerk a bond in the sum of
One Thousand Dollars (01000.00) to be given by an approved surety company to
be approved as otherbonds to the City are approved, conditioned that the applicant
Will indemnify and save harmless the City of Pasco from all claims, actions,
or damages of evey kind and discription which may acerne to or be suffered by
any person b;r reason of any opening in any street or alley, or avenue, or other
public place made by him, or those in his employ in makin£; any connection with
water main or lateral, of for .ny other purpose or objest whatever, and that
he will also replace and restore such street, alley, avenue or other bublic
Adace to as good a state and condition as at the time of the commencement of
Said work, and maintain the same in good order to the satisfaction of the City
Of Pasco, its officers and a;ents while doing said work, and that he will comply
With all t':e provisions of tips Ordinance.
SECTION 3. The City Clerk, u.onthe presentation to him of t�_e receipt

SECTION 4. It shall "be unlawful for any person having an "Irrigation
'.'later Connector's license" as provided for in this Ordinance to make any open

SECTIOIT 5. In order to obtain the permit ptovided for in Section 4 hereof
the "Licensed Connector# emplo;yecl to mah-e connections and o-_;enings in the mains
and laterals shall first file an application in duplicate therefor, with the
City Cie -_-l> together with_ the Cit Cler'_ s receipt for Fifty Cents, stating therei-
the na-:he of the owner of the premises to be connected, ate occupant thereof, the
munber of the building thereon, if any, the legal discription of the premises, 'and
the opint where the connection is to be made, together with a plan and specification
showing the course of the -pipe from the water main or lateral to the property lin_,
showing the dimensions of the pipe and connections therewith and the fixtures,
which shall then be exarhined by the City 0le-rk or other officer, and such change;,
and modifications made as he may deem necissary, and his approval endorsed thereon
over his signatLLre, and the orig•i2ial as originally filed and prepared or as moaifie,'
and changed, filed_ in his office and shown on a map showing all connections, and
s, the duplicates as approved shall be attached to the -permit, which shall be issued

then. All permits shall ue numbered in numerical order. It shall be unlawful for
any person tin extend an„r private connection beyond the limits of the property for
which the permit was given.
Section 6. All connectiohs with mains or laterals of local Improvement

icts Nos. 43, 44, and 25 and other local Improvement Districts hereafter for -k
e City of Pasco, shall be made in a good and worman like manner, tap shall

SECTION 7. When Clarth must be piled -up and when the street or other public
place must be opened and the paving, or planking, or sidewalking disturbed, it mast
be clone in sLLch a manner as wi�I occassion the least inconvenience to the PiLblic,
and so as to permit free passage or travel along the street, and bridgeways must
be provided on sidewalks for foot passengers . In refilling the trenches the earth
must be aerosited in layers of not more than six inches iri depth and be „ell tampe'
to prevent after settlement. As soon as such connection is completed, the paving,
planking, sidewall--ing, street and earth must be restored to as good an condition as
previous to the excavation and all rubbish and surplas material, if any removed
imidiately.
RECTION 8. All connections wits, and any openings made in any main or lateral
of said Local Im-arovement Districts Nos. 43, 44, 25 and other Local Improvement
f Districts hereafter formed by the City of Pasco, in any public street, alley, avenue,
or other public _place, shall be built of such size and of such material o,nd on
such directions, and with such grades and in such manner and at such point as the —
city clerk shall direct.
S10tION 9. All. wort: clone in pursuance of any permit granted as heretofore
perscribed shall be siLbject to the intpection pf the City Clerk or other officer
of tho City of Pasco, and if unsatisfactory to the City of Pasco, the City Clerk
or other officer, upon notice of same being unsatisfactory. Said "Licensed Irrigation
later Connector" shall at once remidy said connection and satisfactmrily remove,
replase or complete said connection, and any portion or all of said work, when sin
instructed to do by the City Clerk of the Coty of Pasco, or in lose of his refusal
so to do, he shall forfeit his license for opening or making connections thereto,
and said water may be turned off.
SECTI:C!I? 10. All connections made by any Licensed "Ir-rigation Water Connector"
with in the limits of any street, alley, avenue, or pther public place shall be
protected by said 8onnector both by night and by'aay by proper gnarls and by the
display of proper signals and lights, and the Connector shall be liable for all
accidents caused by his negligence in this or any other respect.
SICTOIOIT 11. All work_ within the limits of any street, all-ey, or other
public place must be prosecuted with and completed with due diligence and if in
the judgement of the City of Pasco, the C�ty Clerk, or other official thereof, any
excavation shall be left open beyond a reasonable time, the City Clerk shall cause
the same to be refilled and the street or opening restored forthwith, end any
cost incurred in such work shall be charged to the Connector in char^e of such
work, and must be paid before he shall receive any future permit from the City Clerk.
SECTION 12. It shall be huhlawf1111 for an;;, person Licensed as Connector under
the provisions of this Ordinance to allow his name to be used by any other _person,
firm or corporation, either for the purppose of obtaining a permit or for doing the
work Ancter his license, and it shall be the duty of evey such licensed connector
to have his name ..nd place of business on file with the City clerk.
SECTION 13. Any person who shall violate or faol to comply with any of the
provisions of this Ordinance, shall be deemed guilty of a misdemeanor and uo_,n
conviction thereof, shall be punished by a fine of not less than Ten Dollars and
not to exceed One Hundred Dollars, or by imprisonment in the City Jail for a term
of not less than Three days nor Exceeding Thirty days, or both fine and imprisonment.
SECTION 14. For any violation of any of the provisions of this Ordinance
on tl)e p,2rt of any licensed "Irrigation hater Connectir" the City Comlcil shall ,
in addition to the -penalty heretofore provided for, revoke any license granted Linder
the i)rovisions of this Otdinance.
Before such revocation the -person holding the license must be notified at
least five days before action theremn that the City CoLuhcil has under consideration
the revocation of his license and if the holder of such license desires he may
a -pear and show cause why his license shall not be revoked. The revocation of a
license as Therein provided for shall bo by resolution and the City Clerk shall notify
in writing the person whose license has been revoked, of such revocation, and upon
such notice the privalidge and license shall be at an end, and no license shall
thereafter be granted to any person whose license has been -revoke_, for the same
Purpose, with in one ,,-ear from the (late of such revocation. Evey license issued
under the provisions of this Ordinance shall express on its face that it is
subject to revocation by the Cit Council.
