HomeMy WebLinkAbout08-20-1979 MinutesMINUTES PASCO CITY COUNCIL REGULAR MEETING CALL TO ORDER: AUGUST 20, 1979 Meeting called to order at 8:10 P.M. by the Honorable J.C. "Chet" Bailie, Mayor. ROLL CALL: By City Clerk. Councilmen present were: S.K. Adams, J.C. Bailie, Charles Grigg, Ira Schmidt, Gary Clark, E.A. Snider and Bill Wilkins. Also present were: Lee Kraft, City Manager; Dennis De Felice, City Attorney; James Ajax, City Engineer'.; and Gary Crutchfield,.City Planner. CONSENT AGENDA: Mr. Snider moved that Consent Agenda be approved. Seconded by Mr. Wilkins. Motion carried by roll call vote of seven (7). Consent items are as follows: a) Approval of Minutes. Minutes of regular meeting, -held August 6, 1979. b) Bills. To approve General Claims in the amount of $1,316,488.79; claim warrant nos. 20630 through 20793. c) Old Bridge Removal. To confirm, for the record, that the advisory ballot question as presently stated meets with the approval of the City Council, and that the question is to be voted on at the primary election on September 18, 1979. d) Proposed Parking Elimination 10th Avenue ("A" to "B" Streets) and Court Street (14th to 17th): To direct staff to notify all affected property owners along 10th Avenue and Court Street that the City Council will be considering eliminating parking in front of their property at the regular September 4, 1979 Council Meeting, and to solicit the input of the affect ed property owners. e) Agreement Regarding Temporary Water Booster Station. To authorize the Mayor to execute the proposed Agreement for a temporary booster station to serve portions of the Riverview Heights Phase I Subdivision and the Desert Plateau Subdivision. f) Intercity Bridge Loan Retirement. To authorize staff to pay the State of Washington Pasco's share (45%) of the outstanding balance of the construction loan on August 29, 1979. PUBLIC HEARINGS: MAYOR BAILIE DECLARED THE PUBLIC HEARING OPEN FOR THE PURPOSE OF REZONING LOT 14, BLOCK 2. ACRE PARK ADDITION, FROM C-1 to C-3: (JOHN CLARK) It was noted that the hearing had been duly published and posted. There were no cI. adverse communications received. The City Planner outlined area in question and described it as located at the corner of Sycamore and East Lewis. Following three (3) calls from Mayor Bailie for further comments from the floor, either for or against, the public hearing was declared closed. MAYOR BAILIE DECLARED THE PUBLIC HEARING OPEN FOR THE PURPOSE OF REZONING LOTS 1 to 10 INCLUSIVE, BLOCK 1, AVERY'S ADDITION, FROM C-1 to C-3: (MARQUEZ) It was noted that the hearing had been duly published and posted. There were no ad#rerse communications received. The City Planner outlined area in question and described it as land fronting on East Lewis Street. Following three (3) calls from Mayor Bailie for further comments from the floor, either for or against, the public hearing was declared closed. MINUTES PASC,O' CITY CQUNCIL REGULAR MEETING PUBLIC HEARINGS - Continued: AUGUST 20, 1979 MAYOR BAILIE DECLARED THE PUBLIC BEARING OPEN TO CONSIDER PLANNING.COMMISSION'S RECOMMENDATIONS ON THE.SRO REZONE: It was noted that the Hearing had been duly published and posted. There were no adverse communications. A letter was received from David Schooler, Real Estate Division for Sterling Recreation Organization, requesting a continuance until October 1, 1979, as he would be unable to attend on August 20th. Mr. Snider moved to continue the public hearing for the SRO Rezone to 8:00 P.M., Monday, October 1, 1979. Seconded by Mr. Wilkins. - Rev. Donald Freichs, Pastor of Trinity Lutheran Church, reminded the Council that traffic was impassable now and wanted to know, on behalf of his congregation, what was planned for the street and placement of screens? He cited problems of a disturbing nature and asked if their letter of opposition had been received. The City Planner acknowledged that their letter had been received and assured Rev. Freichs that before a zone change would be approved. sufficient screening must be provided by means of concomitant agreement. Main motion carried by roll call vote of seven (7). MAYOR BAILIE DECLARED THE PUBLIC HEARING OPEN TO CONSIDER PLANNING COMMISSION'S RECOMMENDATIONS ON THE TIPPETT STREET VACATION: It was noted that the Hearing had been duly published and posted. There were no adverse communications. The following alternative was received from Gary Crutchfield, City Planner. "Since the vacation of the streets and alleys, as requested by the petitioner would place the City in the position of having to purchase additional right of way at such time as Oregon Avenue is to be extended southerly to the port property, it would appear prudent to vacate said streets and alleys only in concert with dedication by the petitioner of that land area necessary for the extension of Oregon Avenue within the boundaries of the proposed vacation." Councilman Snider stated he would favor vacation if the petitioner 4.6uld givd�.alear access to Ainsworth. Mr. Tim Tippett was unable to commit his firm at this time, but felt something satisfactory could be worked out. Mr. Adams moved to continue the public hearing on the Tippett Street vacation until 8:00 P.M., Monday, September 17, 1979. Seconded by Mr. Snider. Motion carried by roll call vote of seven (7). MAYOR BAILIE DECLARED THE PUBLIC HEARING OPEN TO CONSIDER THE PLANNING COMMISSION'S RECOMMENDATIONS ON THE ASH STREET VACATION: (DNR, 79-15-V) It was noted that the hearing had been duly published and posted. There were no wiritten communications received. The following comment was received from Jim Ajax, Director of Community Development. "Fair value 2.00 + per sq. ft. Area is 12,500 sq. ft. x $2.00 = $12,500. The rational behind the charge is not intended as -a policy charge, but rather the fact that in 1973, the City asked DNR for Oregon Street right of way immediately adjacent, and three years later, they - after a tremendous bureaucratic process, sold it to the City at full price and damage to their adjacent property." C?uncilman Snider was personally opposed to State of Washington owning mass amounts l Wilkins supported Mr. Snider in this logic. Mr. Fred Richmond, DNR representative, stated their primary role was to manage land to its highest and best use. Further, he didn't feel that any inequities had transpired between the City of Pasco and State of Washington. Following three (3) calls from Mayor Bailie for further comments from the floor, either for or against, the public hearing.was declared closed. MINUTES PASCO CITY COUNCIL REGULAR MEETING ORDINANCES: ORDINANCE NO. 2061: (Pasco Meat Packers) AUGUST 20, 1979 AN ORDINANCE VACATING A PORTION OF ELM STREET AND A PORTION OF HUGO STREET IN THE PLAT OF ELLIOTT'S ADDITION TO PASCO. Ordinance No. 2061 was read by title only. Mr. Snider moved that Ordinance No. 2061 be adopted. Seconded by Mr. Adams. Motion FAILED by roll call vote of six, one abstention (Clark). ORDINANCE NO. 2081: (Reeder Rezone) AN ORDINANCE RELATING TO ZONING AND CHANGING THE ZONE CLASSIFICATION OF CERTAIN REAL PROPERTY WITHIN THE CITY OF PASCO FROM I-1 to I-2 Ordinance No. 2081 was read by title only. Mr. Snider moved that Ordinance No. 2081 be adopted. Seconded by Mr. Adams. ]lotion carried by roll call vote of seven (7). ORDINANCE NO. 2082: (Clark Rezone) AN ORDINANCE RELATING TO ZONING AND CHANGING THE ZONE CLASSIFICATION OF CERTAIN REAL PROPERTY WITHIN.THE CITY OF PASCO FROM C-1 RETAIL BUSINESS TO C-3 GENERAL BUSINESS, AS CONDITIONED BY CONCOMITANT ZONING AGREEMENT. Ordinance No. 2082 was read by title only. Mr. Schmidt moved that Ordinance No. 2082 be adopted. Seconded by Mr. Clark. Motion carried by roll call vote of seven (7). ORDINANCE NO. 2033: (Marquez Rezone) AN ORDINANCE RELATING TO ZONING AND CHANGING THE ZONE CLASSIFICATION OF CERTAIN REAL PROPERTY WITHIN THE CITY OF PASCO FROM C-1 RETAIL BUSINESS TO C-3 GENERAL BUSINESS, AS CONDITIONED BY CONCOMITANT ZONING AGREEMENT. Ordinance No. 2083 was read by title only. Mr. Clark moved that Ordinance No. 2083 be adopted. Seconded by Mr. Snider. Motion carried by roll call vote of seven (7). RESOLUTIONS: RESOLUTION NO. 1276: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DECLARING ITS INTENTION TO ORDER THE CONSTRUCTION AND INSTALLATION OF WATER MAINS, TOGETHER WITH APPURTENANCES TO SERVE THE VICINITY OF THE MARINE TERMINAL OF THE PORT OF PASCO. Resoluti6h N6;--1276 was read by title only. Mr. Adams moved that Resolution No. 1276 be adopted. Seconded by Mr. Grigg. Motion carried by roll call vote of six (6) _Cotincilma� SEhmidt voting -no. y RESOLUTION NO. 1277: A RESOLUTION REGARDING THE ANNEXATION OF AN UNINCORPORATED ISLAND. Resolution No. 1277 was read by title only. Mr. Snider moved that Resolution No. 1277 be adopted and set date of Public Hearing as November 5, 1979. Seconded by Mr. Wilkins. Motion carried by roll call vote of seven (7). 1 1 1 MINUTES PASCO CITY COUNCIL REGULAR MEETING UNFINISHED BUSINESS: AUGUST 20, 1979 LEWIS STREET AND SYLVESTER STREET LIGHTING: Mr. Grigg moved to authorize the staff to notify the Franklin County P.U.D. to proceed with the street lighting on Sylvester Street (20th to 28th) and Lewis (8th to 18th and 20th to 28th), and further direct the next supplemental budget allocate presently unbudgeted revenue to these projects in a maximum amount of $65,000.00. Seconded by Mr. Schmidt. Motion carried by roll call vote of seven (7). NEW BUSINESS: BID RESULTS: ROAD 24 (Lewis to Sylvester) STORM DRAIN AND HOPKINS STREET (Road 28 to Road 24 to Lewis) STORM DRAIN: Mr. Snider moved to award the construction contract for the Hopkins Street and Road 24 Storm Drains to the low bidder, Sharpe & Preszler, in the amount of $72,375.00 and, further, authorize the Mayor to execute the contract documents. Seconded by Mr. Adams. Motion carried by roll call vote of seven (7). MISCELLANEOUS - INCLUDING SUGGESTIONS FROM COUNCIL: Mr. Snider moved to hold a Special Meeting of the City Council on August 27, 1979, to award bids for construction projects. Seconded by Mr. Clark. Motion carried. Mr. Ed Hendler announced that there will be a public hearing at the City Library, on August 29, 1979 with officials from Whisler-Patri on proposed convention center. He urged all councilmen to attend if possible. Mr. Snider read the following letter of commendation from Michael C. Kinnie, Deputy Prosecuting Attorney to the City Manager: "In April of this year, the Prosecutorts Office charged Michael Anderson with assorted rapes, robberies and kidnappings that occurred in Franklin County in 1978. A change of venue was granted to Spokane County and in July, 1979, the State of Washington tried Michael Anderson in Spokane County. Of the thirteen counts actually taken to trial, the State gained convictions on eight; each of the eight convictions carries a life sentence. None of the convictions would have been possible if it were not for the cooperation of local law enforcement personnel. I wish to call to your attention the fine work done by DETECTIVES PITTMAN, MONTELONGO, DICKINSON, SGT. CLIFF NELSON AND EVIDENCE TECHNICIAN, CHARLOTTE SUPPLEE. Without their help and cooperation in all aspects of these cases, the State is confident it would not have succeeded in gaining any convictions. I also wish to take this opportunity to single out and thank individually, the excellent work done by LT. of DETECTIVES, GLENN BUTNtR. A multiple. count information and trial is a difficult matter for a Deputy Prosecutor to handle; especially, when you are talking about a Change of Venue where the witnesses are all from out of town. It is imperative that the Deputy Prosecutor has the help and cooperation of his Investigating Detective and the other staff personnel. I can say without.hesitation that LT. BUTNER kept the entire thing together. He was helpful throughout. In fact, he took many responsibilities upon himself that required work above and beyond that which would normally have been required of him. His work in coordinating various aspects of these cases was admirable. His expertise., professionalism and training are a credit to the City of Pasco and to the Pasco Police Depart- ment. I can honestly say that if it were not for the fine work of LT. BUTNER that the prosecution of Michael Anderson would not have been. possible." The City Manager expressed his appreciation for fine work done by our officers and stated he was going to,personally commend the officers. ADJOURNMENT: Meeting adjourned at 9:00 P.M. J.C.
