PASCO CITY COUNCIL.
REGULAR RECONVENED MEETING
CALL TO ORDER:
APRIL 24, 1978
Reconvened meeting called to order at 8:00 P.M. by the Honorable J.C. Bailie, Mayor.
.:ROLL CALL:
By Finance Director. Councilmen present were•: S.K. Adams, J.C. Bailie, Charles
Grigg, Ira Schmidt, David Sheeley and Bill Wilkins. Mr. E.A. Snider was absent
from the meeting. Also present were: Lee Kraft, City Manager; Patrick Roach,
Acting City Attorney; James Somborovich, Acting Finance Director; James Ajax, City
Engineer; Lewis Smathers, Acting Police Chief; Webster Jackson, EEO Officer;
Richard Erickson; Director of Parks & Recreation; Ted Johnson, Assistant City
Engineer and Paul Whitemarsh, Asst. Director of Parks/Recreation.
VISITORS:
There were no visitors wishing to address the Council at this time.
PUBLIC HEARING:
MAYOR BAILIE DECLARED THE PUBLIC HEARING OPEN ON DISCRETIONARY BLOCK GRANT
APPLICATION: (TAPE ON FILE)
It was reported that the Hearing had been duly published and posted. There were no
adverse communications.
Mr. Kraft, City Manager, reported this had to do with discretionary pre -application,
not the regular block grant the council had acted upon before.
Mr. Jackson stated that discretionary terminology is called Small Cities Grant this
year. Further, there are five (5) criterias that the project must address; 11 it
must support realistic and attainable strategies for expanding low and moderate income
housing opportunities and promote deconcentration of low income. housing, promote
more rational land use, provide increased economic opportunities for low and moderate
income persons, and correct deficiencies in public facilities which affect the public
health and safety.
There are two (2) types of grants; 1) a single purpose grant and, 2) comprehensive
grant. Mr. Jackson reiterated the need for rehab program in the low and moderate
income level. He stated there was no problem with this type of program. Other
areas included possible L.I.D. in East Pasco area, improvement to Highland Park
and other programs. Approximately 35% will be allocated to single purpose grant
and 65% to comprehensive programs.
*c -----,Mrs•. Kathryn Smith asked if this was the only public hearing to be held and -if
they were going to accept recommendations of Block Grant Coordinator? Further,
what percentage of people in low income bracket benefits from Comprehensive and
Single Purpose Grant? Mr. Jackson replied that another public hearing will be held
l� May 1, 1978 for public input.
Following three (3) calls from Mayor Bailie for further comments from the floor,
either for or against, the Public Hearing was declared closed.
ORDINANCES:
ORDINANCE NO. 1956:
AN ORDINANCE RELATING TO ZONING AND PLANNING AND AMENDING TITLE 22
OF THE PASCO MUNICIPAL CODE BY AMENDING SECTIONS 22.08.010, 22.88.020,
AND 22.88.030 AND BY ADDING TO CHAPTER 22.88 -NEW SECTIONS TO BE KNOWN
AND DESIGNATED AS SECTION 22.88.040, 22.88.050, 22.88.060, 22.88.070,
22.88.080 and 22.88.090. (CONTRACT ZONING)
Ordinance No. 1956 was read by title only. The City Attorney pointed out changes .
as recommended by the Planning Commission; 1) Allowing an individual who is petitioning
for a rezone to come in more than once during a.year, but he could only come in once
during that year to change it to a particular zone - if he's denied that, then he could
come in later in the year to change it to a different zone but not the one he requested
the first time; 2) termination of concomitant agreement - this provides that if a
person is granted a rezone subject to some restrictions that are set forth in a
concomitant agreement, and at some later date because of changes within the City or
whatever, the person wants to relieve himself of the terms, restrictions, or conditions,
then he can proceed under this 22.88.100 by simply going through the same procedures;

3) Allow any person to petition for a rezone subject to concomitant agreement
who had any sort of interest whatsoever in the property.
Mr. Sheeley moved that Ordinance No. 1956 be adopted, subject to changes. Seconded
by Mr. Grigg. Motion carried by roll call vote of six (6).
ORDINANCE NO. 1957:
AN ORDINANCE RELATING TO ZONING AND CHANGING THE ZONE CLASSIFICATION
OF CERTAIN REAL PROPERTY WITHIN THE CITY OF PASCO FROM R-1 LOW DENSITY
RESIDENTIAL TO R-3 HIGH DENSITY RESIDENTIAL.
Ordinance No. 1957 was read by title only. Mr. Sheeley moved that Ordinance No.
1957 be adopted subject to the following language incorporated into Ordinance No.
1957. "...the same is hereby changed from R-1 Low Density Residential to R-3
High Density Residential; and as conditioned by the concomitant agreement which
is attached hereto and is identified as Exhibit 1...." Seconded by Mr. Wilkins.
Mr. Grigg expressed concerns over future zone changes of which Mr. Frank Thomsen,
Manager of the Chamber of Commerce, disagreed. He reiterated that it sounded like
we were becoming a Police State.

Mr. Ajax stated the Council received a petition at the last regular meeting, voicing
their protest of R-3 change; however, the change would not be protested if the party
,,j—„asking for said zone change".guaranteed to the Planning Commission, in writing, that
any building or buildings would not exceed 1 -story above ground level. The
Concomitant Agreement which Mr. O'Connell has proposed to you, does, in fact, meet
the condition of this petition so I would treat it no longer as a protest.
Motion carried by roll call vote of six (6).
