HomeMy WebLinkAbout01-17-1978 MinutesMINUTES PASCO CITY COUNCIL PUBLIC HEARING CALL TO ORDER: Januar_y_.:1:7_:, -:'19 7 8 . Meeting called to order at 8:00 p.m., by Mayor Chet Bailie. ROLL CALL: By Clerk's Representative the following Councilmen were -present: S.K. Adams, J.C. Bailie, Charles F. Grigg, Ira Schmidt and Bill Wilkins. Councilman David Sheeley stated that since.he.was a property owner in this LID and apart of the assessment roll that he felt it best to disqualify himself from the hearing. Councilman E.A. Snider was absent due to being out-of-town. Also present were: George Smith, City Manager; Leo E. Olney, Finance Director; Michael E. Cooper, City Attorney; James Ajax, City Engineer; Ted Johnson, Assistant City Engineer; and Cheryl Marcotte, a staff member of the Engineering Department. PUBLIC HEARING: Mayor Bailie opened public hearing to consider the Final Assessment Roll on L.I.D. #97. Mr. M.J. Hanson, Leola Street, asked if the value of the property tax would be increased since the property owner is paying more money on the property through L.I.D. #97? Jim Ajax, City Engineer, stated that the City does nothing concerning the Franklin County Tax Records; but the County Assessor every four (4) years is obligated to assess a property's market value and the improvements which are done by an L.I.D. undoubtedly increases the property value. The property value does not rise.automatically,according.to the,Asssessor's office records because an L.I..D. is done:., Mr. Harry Moore, 2203 N. 7th, wanted to know what the difference was between the taxes the public already pays, i.e. street and gasoline taxes, and with the taxes the public pays through an L.I.D.. 1 Jim -Ajax stated that the half cent..gas-tax.could only be used for the construction of arterial streets.. He explained that there were a few streets that gas tax was used that were in L.I.D. #97. He explained that the property owners who live on these streets were assessed the same amount as the other owners because extra work was'done on these major neighborhood arterials. Jim Ajax also.stated that the regular 6 7/8 cents per gallon tax is,__.used strictly for street maintenance. Mr. Moore also wanted to know why the manhole covers are set an inch lower than the street surface. He also wanted staff to realize that there was a problem on Lincoln Drive because water was not draining properly off the street and it looked as if it were a lake. Jim Ajax stated that the manhole covers are set 3/4 of an inch lower than the street surface because in time the streets will settle and.the.surface.of the.street and the manhole will be even -which hopefully will -.create a smooth surface. Mr. Robert Higgins, 1918 N. 9th, wanted to know why his driveway had an abrupt edge and why it was not sloped down into the roadway as the other properties' driveways were. Jim Ajax stated that the property owners were asked if they wished to have their driverway repoured at an additional cost to'the property owner. The driveways were considered to be not a part of the improvement and the property owners were not assessed for any costs of this natural. Mr. Ajax stated that if this was quite a problem for Mr. Higgins that it could be taken care of at the expense of Mr.:.:Higgins. MINUTES PASCO CITY COUNCIL PUBLIC HEARING January 17, 1978 Mr. Tom Bowlan, 1917 N. 14th, wanted to know what the interest rate will be on the 10 year plan in L.I.D. #97 and also he was wondering if the interest paid would be eligible as a deduction on a -tax return with the Internal Revenue Service. Jim Ajax stated that the interest rate on L.I.D. #97 will be 7%. He stated that he thought it would be best for Mr. Bowlan to obtain legal counsel on the matter of the deduction of the interest rate on the tax return. Elisa Haste wished.for`someone to explain to her how the -amount assessed on her property was computed. Jim Ajax and staff assisted her. Arthur Halley, 724 West Jay, was wondering if there was anything being done on the alleys being paved in the area of #97. Jim Ajax explained that some citizens in the area wished for their alleys to be paved so the cost was computed and the citizens in the area were assessed this additional cost. Mr. Halley recommended to staff that before another L.I.D. is commenced in the construction aspect of the matter that the City staff..advise the property owners that this is a possibility for their neighborhood and explain the procedure to them so that the property owners are aware of having this done. Jim Ajax said that -he felt that it was a good suggestion and that it would be kept in mind. Jim Sisk wanted to mentioned that they did have their alleys paved and wanted to second Mr. Halley's recommendation about notifying the property owners of the possibility of having this done. Roscoe Sapp, 944 Opal, stated that he was dissatisifed with his sidewalk and would appreciate staff looking into the matter. Ted Johnson stated that the matter would be looked into. Steve Busche stated that he did not receive notice of this public hearing. He stated his address is 1909 11th. Cheryl Marcotte stated that according to the County Assessor that he wa`s not the property owner. Mr. Busche thanked for the assistance and would take care of correcting the Assessor's records. The assessment._roll was corrected to indicate this. Mr. Bill Currie from Three Rivers_Investment Trust, who are owners of the property at 1713, 1715, 1719 and 1721 N. 10th, presented to the meeting a letter of dissatisfaction with a dirty sidewalk. Along with the letter he present pictures of the problem. It is noted that the letter and pictures will be kept on file with the Clerk's records. Jim Ajax stated that the matter is being dealt.with and that certain money is being withheld until the matter is rectified. It is noted that six (6) written objections were filed with the Clerk's records, to -wit: (1) James Sisk, 1747 N. 7th; (2) M.J. Hanson, Leola Street; (3) Roscoe W. Sapp, 944 Opal; (4) Rosalio & Carmen Armijo, Lot 2, Block 7, Replat of Foster.'s Addition, Pasco, Franklin County; (5) Mr. and Mrs. Homer Maas, 1711 N. 6th; and (6) Bill Currie from Three Rivers :Investment Trust, 1713,"1715, 1719 and 1721 N. 10th. Councilman Grigg stated that he felt that the minor problems which the property owners were in attendance at the meeting about could be taken care o,f. -..He also wanted the.property owners in.attendance to know that the L.I.D. process was the most economical way to improve the value of property. He commended the property owners in the area and thanked them for their efforts in improving the look of the City of Pasco. Mayor Bailie asked for further.comments from.the floor, either for or against, the Public Hearing was,declared closed. Ordinance No. 1935 was read by title only. Mr. Grigg moved that Ordinance No. 1935 be adopted. Seconded by Mr. Wilkins. Motion carried by roll call vote of five (5).
