ROLL CALL: By Deputy City Clerk. Councilmen present were: S.K. Adams, J.C. Bailie, Vernon Schuelein, David Sheeley, E.A. Snider, Jan Tidrick and Bill Wilkins. CONSENT AGENDA: Mr. Sheeley moved to approve Consent Agenda. Seconded by Mr. Snider. Motion carried by roll call vote of seven (7). Consent items -are as --follows (Minutes of 12./5/7-7-. corrected to show Larry Tobin as a pilot for TWA instead of Hughes Air West). a) Approval of Minutes. Minutes of regular meeting, held December 5, 1977. b) Bills and Communications. Approve General Claims in the amount of $296,051.80, Claim Warrant Nos. 13714 through 13848. c) Date for Public Hearing. Ferryman Annexation, January 3, 1978, 8:00 P.M. PUBLIC HEARINGS: MAYOR TIDRICK DECLARED THE PUBLIC HEARING OPEN ON CITY OF PASCO ANNEXATION NO. 77-27-A: It was reported that the Hearing had been duly published and posted. There was one written communication from Richard Ryder, protesting proposed annexation plus a petition with 4 signatures in opposition. Mr. Mike Johnston, Attorney for Mr. Ryder and Mr. Martinolich, voiced opposition on behalf of his clients and stated that if people did not wish to be annexed, it was a futile effort on the part of the Council to, initiate it. Staff replied that Council has this option when an area is surrounded by 80% of City area; therefore, State authorized the City to initiate annexation without a vote of.the•)peopl,e: �U The City Attorney reiterated that the annexation Ordinance has to be published twice in a local newspaper and is not in effect for 45 -days. Following three (3) calls from Mayor Tidrick for further comments from the floor, either for or against, the.:Public Hearing was declared closed. MAYOR TIDRICK DECLARED THE PUBLIC HEARING OPEN ON CITY OF PASCO ANNEXATION NO. 77-28-A: It was reported that the Hearing had been duly published and posted. The following letter of protest was received from Richard Ryder: "I am the owner of property commonly known as 2508, 2510 and 2512 Sylvester Street. This property contains 4 mini warehouse buildings, one-6unit office rental building. I also am the owner of property commonly known as 509 Rd. 26, 2609 W. Yakima and 2604 W. Irving. These are three old houses the first of which fronts on Lewis Street. I see by notices posted on telephone poles that the City will attempt to annex this property as well as change the zoning. I wish to protest the annexation. I am opposed to annexation by the City of Pasco." Mr. Mike Johnston reiterated his previous statement. Following three (3) calls from Mayor Tidrick for further comments from the floor, either for or against, the Public Hearing was declared closed. MINUTES PASCO CITY COUNCIL REGULAR MEETING PUBLIC HEARINGS - Continued: J DECEMBER 19, 1977 MAYOR TIDRICK DECLARED THE PUBLIC HEARING OPEN ON CITY OF PASCO ANNEXATION NO. 77-29-A: (Continuation of Hearing of November 21, 1977) It was reported that the Hearing had been duly published and posted. There were no written communications. Staff stated that an industrial warehouse development was being proposed for area. Mr. Evan Hawker, Columbia Engineers Service, representing Gafford & McDonald, showed scale model of what they anticipate developing in Pasco. He stated they would work with Police for security, Fire Department for fire rating requirements and City Building Department for necessary Code requirements. He reminded the Council this would bring increased revenue, jobs and tax base to the City. They were also willing to landscape to City requirements. A brief film was shown of development they built in Portland, Oregon. On behalf of the Council, Mayor Tidrick thanked Mr. Hawker for his presentation and urged him to work closely with staff as he could foresee no problem as far as the Council was concerned. Mr. Adams questioned traffic flow and staff replied there was no definite plan. Mr. Snider commented that it was a definite advantage not to have Ainsworth a through street. To this, Mr. Sheeley replied, "we haven't got enough money to make this a through street." Mr. Ira Schmidt expressed concern over traffic congestion on "A" Street. Mr. Hawker replied that approximately 100 train cars per year cross and this was generally done early in the morning or late at night to avoid congestion. Mr. Harry Moore favored zone change and stated this was improving "A" Street like it had been envisioned 15 years ago. Following.three (3) calls from Mayor Tidrick for further comments from the floor, either for or against, the Public Hearing was declared closed. MAYOR TIDRICK DECLARED THE PUBLIC HEARING OPEN ON•POST OFFICE ALLEY VACATION, LYING BETWEEN LOT 16 AND LOTS 1,2,3 and 5.10 FEET OF LOT 4, BLOCK 2, NORTHERN PACIFIC PLAT OF PASCO: It was reported that the hearing had been duly published and posted. There were no adverse communications. The City Planner pointed out area on map and described present ingress and egress. Mr. Harry Moore opposed the vacation as he stated the area was minimal now for trucks going through and this would create traffic congestion. Mr. William Wombacher opposed vacation as this was the only exit for his trucks and it was tight. Mr. Earl Warren stated that people who park at 1st & Lewis cause impairment of traffic but they should be allowed to park in front of their own businesses. Mr. Howard Crippen reminded the Council that if they granted this request, they were actually blocking off two alleys and it would create an impossible situation for semi trucks to make turns. Mr. Bailie stated that if this vacation were granted, it would force some small businesses and trucking firms out of business. Mr. Harry Moore asked, "is there a law against the City charging for vacations?" Staff replied that a City can charge for vacations. Following three (3) calls from Mayor Ti.drick for further comments from the floor, either for or against, the Public Hearing was declared closed. 1 1 1 MINUTES PASCO CITY COUNCIL REGULAR MEETING PUBLIC HEARINGS - Continued: DECEMBER 19, 1977 MAYOR TIDRICK DECLARED THE PUBLIC HEARING OPEN ON SIEGEL ALLEY VACATION, NO. 77-38-V: It was reported that the Hearing had been duly published and posted. There were no adverse communications. The City Planner pointed out area in question and identified it as Block 5, O'Keefe's 2nd Addition. Mr. Siegel favored vacation as it was being used to stockpile dirt now and approximately 75% of adjacent property owners favored the vacation. Following three (3) calls from Mayor Tidrick for further comments from the floor, either for or against, the Public Hearing was declared closed. VISITORS: None Recess: 9:00 P.M. Reconvened: 9:10 P.M. APPOINTMENTS: The City Council interviewed A.M. Killingsworth, Linda•:Allen and Jim Weyers for vacant positions on the Park Board. Mayor Tidrick thanked them for coming and advised them an official appointment would be made after the first of the year. MAYOR TIDRICK TRANSPOSED REGULAR ORDER OF BUSINESS TO RECEIVE INPUT ON LEWIS STREET ACCESS: The City Manager reported on progress of Lewis Street access via the following memorandum: "On Wednesday, December 14th, I received a call from Mr. David Yates of the State Department of Transportation in Olympia, who advised me that the Department would be discussing in more detail our request of October 4th, at a meeting with their Attorney, Mr. Thomas Garlington, on December 15th. He indicated that he would either call me Friday or the first thing Monday morning on the Department's final position. It appears they have a legal question yet to be resolved with Mr. Garlington. As of December 14th, it was their position and apparently the Regional Office of the State Highway Administration, that the only way they could approve lifting the limited access designation would be to•have the property appraised, and the owners pay the City the Fair Market Value of the property originally conveyed to the State. Apparently, their position is that lifting the limited access designation without receiving just compensation would constitute a gift which is prohibited by the State Constitution. I hope by the Monday Council Meeting, I will have a more final position from the State and Federal Highway Administration." This will be discussed further at workshop meeting on January 9, 1978. ORDINANCES: ORDINANCE NO. 1908: ORDINANCE FOR CITY OF PASCO ANNEXATION 77-27-A. Ordinance No. 1908 was read by title only. Mr. Sheeley moved that Ordinance No. 1908 be adopted. Seconded by Mr. Schuelein. Motion carried by roll call vote of seven (7). ORDINANCE NO. 1909: ORDINANCE FOR CITY OF PASCO ANNEXATION 77-28-A. Ordinance No. 1909 was read by title only. Mr. Sheeley moved that Ordinance No. 1909 be adopted. Seconded by Mr. Schuelein. Motion carried by roll call vote of seven (7). MINUTES PASCO CITY COUNCIL REGULAR MEETING ORDINANCES - Continued: ORDINANCE NO. 1910: ORDINANCE FOR CITY OF PASCO ANNEXATION 77-29-A. DECEMBER 19, 1977 Ordinance No. 1910 was read by title only. Mr. Sheeley moved that Ordinance No. 1910 be adopted. Seconded by Mr. Snider. Motion carried by roll call vote of six (6). Mayor Tidrick abstained as he has property in area. ORDINANCE NO. 1904: (No. previously assigned) AN ORDINANCE VACATING AINSWORTH STREET, LYING BETWEEN WEST "A" STREET AND THE EASTERLY BOUNDARY OF THE RAILROAD RIGHT OF WAY, APPROXIMATELY 565+ LINEAR FEET. Ordinance No. 1904 was read by title only. Mr. Snider moved that Ordinance No. 1904 be adopted. Seconded by Mr. Wilkins. Motion carried by roll call vote of seven (7). ORDINANCE NO. 1911: (Siegel) AN ORDINANCE FOR SIEGEL ALLEY VACATION, 77-38-V. Ordinance No. 1911 was read by title only. Mr. Snider moved that Ordinance No. 1911 be adopted. Seconded by Mr. Schuelein. Motion carried by roll call vote of seven (7). ORDINANCE NO. 1912: (Post Office Vacatiod t AN ORDINANCE VACATING NORTH/SOUTH ALLEY, NORTHERN PACIFIC PLAT. Ordinance No. 1912 was read by title only. Mr. Sheeley moved that Ordinance No. 1912 be adopted. Seconded by Mr. Snider. Motion FAILED by roll call vote of seven (7). ORDINANCE NO. 1898: (NW Developers) AN ORDINANCE RELATING TO ANNEXATION AND ANNEXING TRACT OF LAND TO THE CITY OF PASCO. Ordinance No. 1898 was read by title only. Mr. Sheeley moved that Ordinance No. 1898 be adopted, as.�amended.- Seconded by Mr. Snider. Mr. Helmer Basso, Land Manager for the Department of Natural Resources, opposed Ordinance as there was only 9 years of agricultural lease left. Further, he asked if reservoir was in City limits. Staff replied affirmative. He then asked if all property owners were notified. Again, staff replied affirmative. Mr. Sheeley's amendment was repeated as follows: "To amend Section 1 of Ordinance No. 1898 by amending the property description contained therein to include, in addition to the property already specified, the north 30 feet of Section 23, T9N, Range 29 EWM, lying between Roads 36 and 52. Amendment carried by roll call vote of seven (7). Main motion, as amended, carried by roll call vote of seven (7). ORDINANCE NO. 1905: AN ORDINANCE RELATING TO ZONING AND AMENDING TITLE 22 OF THE PASCO MUNICIPAL CODE BY ADDING THERETO A NEW CHAPTER TO BE KNOWN AND DESIGNATED AS CHAPTER 22.70 AND ENTITLED PLANNED DENSITY DEVELOPMENT. Ordinance No. 1905 was read by title only. Mr. Sheeley moved to amend Ordinance No. 1905 by amending in Section 1 thereof, "Site development within the designated areas may be constructed in phases; provided, however, at no time shall the average density of that portion of the overall development with dwelling units thereon exceed the density of the underlying zone by deleting sub -paragraph 2b of 22.70.60 and add, the minimum distance between structures shall not be less than Uniform Building Code requirements, and by deleting sub -paragraph 5 of 22.70.080. Seconded by Mr. Snider. Motion to amend carried by roll call vote of seven (7), REGULAR MEETING ORDINANCES - Continued MINUTES PASCO CITY COUNCIL (Ordi.nance No. 1905) DECEMBER 19, 1977 Mr. Snider moved to adopt Ordinance No. 1905, as.amended. Seconded by Mr. Sheeley. Motion carried by roll call vote of seven (7). Mr. Snyder moved to approve merit payments, as authorized by the 1977 Budget and as recommended by the City Manager with respect to the Department Heads, and as recommended by the City Council for the City Manager. Seconded by Mr. Sheeley. Motion carried by roll call vote of five (5). Councilmen Adams and --Bailie voting no. RESOLUTIONS: RESOLUTION NO. 1136: A RESOLUTION RELATING TO RATE FOR USE OF CITY AMBULANCE SERVICE. Resolution No. 1136 was read by title only. Mr. Sheeley moved to adopt Ordinance No. 1136. Seconded by Mr. Snider. Motion carried by roll call vote of six (6). Mr. Adams voting no. RESOLUTION NO. 1137: A RESOLUTION FOR HUMANE SOCIETY AGREEMENT. Resolution No. 1137 was read by title only. Mr. Sheeley moved that Resolution No. 1137 be adopted. Seconded by Mr. Snider. Motion carried by roll call vote of seven (7). RESOLUTION NO. 1138: A RESOLUTION RELATING TO RICHARDSON PARK STORM DRAIN ACCEPTANCE OF CONSTRUCTION. ORDINANCE NO. 1913: AN ORDINANCE RELATING TO PARKS AND RECREATION, NO. 1819 BY SETTING NEW RATES FOR THE AMENDING ORDINANCE GOLF COURSE AND SWIMMING POOLS. Ordinance No. 1913 was read by title only. Mr. Sheeley moved that Ordinance No. 1913 be adopted. Seconded by Mr. Snider. Motion carried by roll call vote of seven (7). ORDINANCE NO. 1914: AN ORDINANCE RELATING TO THE CITY VIEW CEMETERY AND AMENDING SECTIONS 2.48.160 THROUGH 2.48.240 OF THE PASCO MUNICIPAL CODE. Ordinance No. 1914 was read by title only. Mr. Sheeley moved to adopt Ordinance No. 1914. Seconded by Mr. Snider. Motion carried by roll call vote of seven (7). ORDINANCE NO. 1915: AN ORDINANCE ADOPTING THE 1978 BUDGET. Ordinance No. 1915 was read by title only. Mr. Snider moved to adopt Ordinance No. 1915, as corrected. (Police - 895,350 and Misc. 315,650). Seconded by Mr. Bailie. Motion carried by roll call vote of seven (7). ORDINANCE NO. 1916: AN ORDINANCE ADOPTING THE 1978 SALARY SCHEDULE. Ordinance No. 1916 was read by title only. Mr. Sheeley moved to adopt Ordinance No. 1916 and to insert on Schedule I, "In addition to other compensation, all Department Directors and City Manager shall be eligible for merit payments not to exceed ten (10) days. Such merit payments shall be made upon an evaluation and recommendation of the City Manager and confirmation by the City Council, with the exception of the City Manager who will be evaluated by the City Council. Such payments shall be made to eligible Department Directors in December of each year." Seconded by Mr. Snider. Motion carried by roll call vote of six (6). Mr. Adams voting no. Mr. Snyder moved to approve merit payments, as authorized by the 1977 Budget and as recommended by the City Manager with respect to the Department Heads, and as recommended by the City Council for the City Manager. RESOLUTIONS: RESOLUTION NO. 1136: A RESOLUTION RELATING TO RATE FOR USE OF CITY AMBULANCE SERVICE. Resolution No. 1136 was read by title only. Mr. Sheeley moved to adopt Ordinance No. 1136. Seconded by Mr. Snider. Motion carried by roll call vote of six (6). Mr. Adams voting no. RESOLUTION NO. 1137: A RESOLUTION FOR HUMANE SOCIETY AGREEMENT. Resolution No. 1137 was read by title only. Mr. Sheeley moved that Resolution No. 1137 be adopted. Seconded by Mr. Snider. Motion carried by roll call vote of seven (7). RESOLUTION NO. 1138: A RESOLUTION RELATING TO RICHARDSON PARK STORM DRAIN ACCEPTANCE OF CONSTRUCTION. A RESOLUTION RELATING TO QUARTER SECTION L.I.D. NO. 97, PROJECT NO. 76-3-02 ACCEPTANCE OF CONSTRUCTION. Resolution No. 1139 was read by title only. Mr. Sheeley moved that Resolution No. 1139 be adopted. Seconded by Mr. Snider. Motion carried by roll call vote of seven (7). (Mr. Ajax reported that final figures would be approximately 10% less than preliminary). RESOLUTION NO. 1140: A RESOLUTION RELATING TO I.A.O.F. LOCAL NO. 1433 AND THE CITY OF PASCO RE: COLLECTIVE BARGAINING SESSIONS. Resolution No. 1140 was read by title only. Mr. Sheeley moved that Resolution No. 1140 be adopted. Seconded by Mr. Snider. Motion carried by roll call vote of seven (7). rr::> RESOLUTION NO. 1141: A RESOLUTION RELATING TO PASCO POLICE BENEFIT ASSOCIATION AND THE CITY OF PASCO - RE: COLLECTIVE BARGAINING SESSIONS. Resolution No. 1141 was read by title only. Mr. Snider moved that Resolution No. 1141 be adopted. Seconded by Mr. Sheeley. Motion carried by roll call vote of seven (7). UNFINISHED BUSINESS: APPRAISAL OF CITY OWNED PROPERTY: Mr. Sheeley moved that the City Manager be authorized to enter into a contract with Mr. Ross Mellor, a Real Estate appraiser, in an amount not to exceed $3,000 for the purpose of making a feasibility study and appraisal of 76 acres of City -owned property immediately east of the Pasco Municipal Golf Course. Seconded by Mr. Snider. Motion carried by the following roll call vote: YES: Schuelein, Sheeley, Snider and Tidrick. NO: Adams, Bailie, Wilkins. PRELIMINARY PLAT OF RIVERVIEW HEIGHTS: Mr. Sheeley moved to approve preliminary plat of Riverview Heights. Seconded by Mr. Snider. Motion carried by roll call vote of seven (7) PRELIMINARY PLAT OF DESERT PLATEAU: Mr. Sheeley moved to approve preliminary plat of Desert Plateau. Seconded by Mr. Snider. Motion carried by roll call vote of seven (7). FUNERAL ESCORT SERVICE BY POLICE DEPARTMENT: Mr. Snider moved that the Pasco Police Department discontinue its policy of providing funeral escort service on January 1, 1978. Seconded by Mr. Sheeley. Councilmen Adams and Wilkins protested this as they felt it was a small amount for -,the City to consider and should be continued out of respect for families and their welfare in congested traffic. Mr. Ira Schmidt, newly elected councilman, stated if he were voting tonight, he would leave it the way it is. Mr. Sheeley stated the Funeral Homes were liable for motorcade safety and they should be paying for their own escort service, thus freeing up our officers for duties they should be performing. Main motion FAILED by the following roll call vote: NO: Adams, Bailie, Tidrick and Wilkins. YES: Schuelein, Sheeley, Snider. 1 1 1 MINUTES PASCO CITY COUNCIL REGULAR MEETING NEW BUSINESS: DECEMBER 19, 1977 STREET L.I.D. PROGRAM FOR 1978: Mr. Sheeley moved that staff be authorized to proceed with initiation of L.I.D. Program for area north of Court and from 14th to 26th Avenues. Seconded by Mr. Snider. Motion carried. AWARD OF TRACTOR BID: Mr. Snider moved to accept bid of Pasco Farm Center for one Massey Ferguson 20-C tractor, with trade in, at a net cost of$8,245.31. Seconded by Mr. Schuelein. Motion carried by roll call vote of seven (7). SUGGESTIONS FROM COUNCIL - GENERAL DISCUSSION: A special council meeting for final hearing on L.I.D. 97 quarter section will be held at 8:00 P.M., January 17, 1978. Mr. Snider asked that ambulance study and means of financing it be placed on Workshop session of the City Council. ADJOURNMENT: Meeting adjourned at 10:30 P.M.
