PASCO CITY COUNCIL
REGULAR MEETING DECEMBER 5, 1977
CALL TO ORDER:
Meeting called to order at 8:00 P.M. by Jan Tidrick, Mayor.
ROLL CALL:
By Deputy City Clerk. Councilmen present were: S.K. Adams, J.C. Bailie,
Vernon Schuelein, David Sheeley, Jan Tidrick and Bill Wilkins. Councilman
E.A. Snider was absent from the meeting. Also present were: George Smith,
City Manager; Leo Olney, Finance Director; Michael Cooper, City Attorney;
James Ajax, City Engineer; Al Tebaldi, Chief of Police; John Hager, Fire Chief;
Webster Jackson, EEO Officer; Richard Erickson, Director of Parks/Recreation and
Michael Corcoran, City Planner. Also present were newly elected councilmen,
Charles Grigg and Ira Schmidt.
CONSENT AGENDA:
Mr. Sheeley moved to approve Consent Agenda. Seconded by Mr. Bailie. Motion
carried by roll call vote of six (6). Consent items are as follows:
a) Approval of Minutes of regular meeting, held November 21, 1977.
b) General Claims in the amount of $168,885.30; Claim warrant nos. 13622
through 13712.
Payroll Claims in the amount of $166,972.38; Payroll warrant nos. 15696
through 16045.
c) Request for Water Line Extension Outside City Limits. To. service property
owned by Mr. Claude Newton.
PUBLIC HEARINGS: (TAPES OF FOLLOWING HEARINGS ARE BEING KEPT FOR PERMANENT RECORD)
MAYOR TIDRICK DECLARED PUBLIC HEARING OPEN ON PRELIMINARY 1978 BUDGET:
It was reported that the Hearing had been duly published and posted. There were
no written communications.
Mr. Claude Thompson, Business Agent for Operating Engineers, stated he represented
32 loyal employees who were concerned about proposed lay-off and method of reduction.,
He stated we had the best Golf Course in the Tri City area, but it is operating at
50% less rates and if we would increase the rates, we would not have to be concerned
about laying off people. Mr. Thompson started to elaborate on seniority rights when
Mayor Tidrick reprimanded him for bringing up Union negotiations and this was a
Public Hearing on 1978 Budget.
Mr. Bill Clifford, Business Agent for Operating Engineers, reminded the Council that
he had never heard of a reduction in force in Administration. If you are going to cut,
you should start'from the top down. He cited the number of Administrative Assistants
or supervisors in the City and then asked why we weren't doing our own negotiating with
Public Works people when administrators in the past had done so. He then rem•i-nded-the
Council that Cabot Dow doesn't work cheap and his salary would save someone's job.
In summation, he stated that these.people shouldn't be subsidising the City of Pasco,
but in fact, the City of Pasco should be subsidizing them for worki:ng:here.
Mr. Dennis Todd was disturbed over the fact that he had worked for the City for
over 7 years and he was one, he felt, that would be laid off. He didn't think it
was right to lay off men who had worked over seven years for the City and replace
them with part time help for $2.50 to $3.00 per hour.

COMPREHENSIVE PLAN AMENDMENT:
It was reported that the Hearing had been duly published and posted. There were no
•-adverse written communicati-ons. The City Engineer pointed out area in question.for
benefit of council and audience in attendance.

Mr. Larry Tobin, pilot for Hughes Air West expressed great concern for flight
pattern and noise problems. He stated the airplanes were getting bigger,.not
smaller; therefore, they put out more noise. He further reiterated that runways
were getting longer and could attract bigger aircraft, in fact, the only passenger
craft which could not fly out of Pasco now is the 747. He was concerned over
potential lawsuits as a result of noise environment and felt the taxpayers could not
afford them. He favored a definite buffer zone.
Mayor Tidrick asked if a study had been made in regard to noise conditions. The
reply was affirmative.
Mr. Lee Richardson, Manager of Airport for Port of Pasco, gave a brief history of
plans starting in November, 1975. He felt the greatest impact would be on human
�. --..values such as talking•on telephone, watching T.U. and all outdoor activities.
Mayor Tidrick asked if the Environmental Impact Statement was correct or incorrect.
Mr. Ajax replied that staff did not consider themselves experts on the subject
because their actions were guided by the Port's Master Plan which they considered -
factual.
Mr. Sheeley asked Mr. Richardson why the Port didn't buy.up the entire area because,.
in his opinion, some day where he lives it wouldn't be safe (Lincoln DrivO I He
reiterated that he got more noise from railroad yard.
Mr. Adams didn't feel this development would affect the safe operation of airport
because airplanes were supposed to be getting quieter, not noisier.
Jim Sargent stated that noise was greater in the Riverview area than it would be
over their development; in fact, their proposed development was much safer than
new one just completed on Road 36. Further, no where in plan does it say that this
area is bad.
Mr. Gary Bosch, one of the developers, reminded the City Council that if this
development were built, it would bring a $30,000,000 tax base to the City and an
area of truly fine homes which would be a definite asset to the community.
Mr. Richardson rebutted by stating that the Port wasn't objecting to the development,
their concern was density.

Mr. Lee Richardson called attention to Impact Statement for the record. It was
agreed the Statement would remain a permanent record for the City.
Mr. Jack See talked of conversations held with Tom Kidwell in 1974 or 1975, and
based on information received, Mr. See purchased 90 acres immediately north of
proposed development. He further stated that if the report was incorrect, they
have deceived the public.

MAYOR TIDRICK DECLARED PUBLIC HEARING OPEN ON NORTHWEST DEVELOPERS ANNEXATION:
It was reported that the Hearing had been duly published and posted. There were no
written communications received.
Mr. Gary Bosch requested that the Council accept proposed annexation request.
Mr. Adams asked if Master Plan could be attached as an exhibit. Mr. Bosch had
no objection.
Mr. Mike Zarrachoa, read the following excerpt from FAA letter. "This development
would act as a catalyst for future development." Mr. Zarrachoa further stated that
according to master plan, their development is not affected by noise.

MAYOR TIDRICK DECLARED THE PUBLIC HEARING OPEN ON RIVERVIEW HEIGHTS PRELIMINARY
PLAT:
It was reported that the hearing had been duly published and posted. There were
no written communications.
Mayor Tidrick asked what was being planned in regard to Planning Commission's
recommendations for Road 36. Staff replied there would be two good ways into
development, one at Road 36 and the other at Road 44. The roads would be improved
to a width of 32' and covered with asphalt concrete. He then drew a picture of
proposed bridge and its dimensions.
Mr. Larry Tobin asked why we have a Boundary Review Board if we are going to proceed
anyhow. The City Attorney replied that it is a requirement to have a public hearing
which we are doing tonight.
Following is a verbatim transcript of staff recommendation:
"Please accept the following as the City Engineer's report, as required by Code
for the subject preliminary plats. Also attached to this report as background
information is a copy of a letter addressed to the principals involved in these -
two plats, dated May 27, 1977, together with a memorandum to the Planning Commission
and City Council, dated August 10, 1977.
Subject to policy decisions beyond the level of staff authority which the City
Attorney can address relating to the City's authority to proceed at this time prior
approval by the.F.ran,kl>.in County Boundary-Rev.iewzBoard as City Engineer -
preliminary plat approval is recommended based on as follows:
SANITARY SEWER: All lots be served by sanitary sewer. If lift stations are -
required within the developments, they are to be constructed at the developers
expense except if the City desires to oversize the line and place it deeper for
future purposes. Such cost will be borne by the City.
WATER: Council authorization in an amount up to $75,000 to construct a water
booster station. It is recommended that either the developers pay any and all
costs associated with designing and constructing the booster until such time as a
final plat is filed at which point the City would purchase the booster at actual cost.
STREETS: In accordance with attached Exhibit A within subdivision Exhibit B outside
subdivision (Road 36 and 44) Exhibit C for bridge.
LAYOUT: The lots immediately south of the reservoir be dedicated to the City for
park purposes. The street west of the reservoir be moved east adjacent to the
reservoir site or the present row of lots dedicated. That the most southerly east
west street extend west to the west boundary of the Desert Plateau Subdivision.
The most westerly north south street extend north to the north boundary of the
Desert Plateau Subdivision."

PLAT:
It was reported that the Hearing had been duly published and posted. There were
no written communications.
Mr. Gary Bosch urged acceptance of plat with recommendations of staff incorporated.
Mr. Pat Roach, law firm of Campbell, Johnston & Roach, felt another access road should
be put in as this is a 20 -block area and if you wanted to travel north of Argent, the
only two accesses are Roads 44 and 68.

For the record, the following letter is transcribed verbatim:
"The State of Washington
Department of Natural Resources
The State of Washington by and through the Department of Natural Resources
owns the SW quarter of Section 14, T9N, Range 29 EWM, within the City limits
of Pasco.
The State hereby objects to the annexation of said SWI/4, Section 14, T9N,
Range 29 EWM, within the City limits of Pasco.
The land has been inspected by duly authorized representatives and was found
that the annexation will not benefit this parcel of .State owned land. The
parcel of land is leased for a 10 -year period. The lessee will not benefit
from the inclusion of this land within the above City limits. We do not feel
the State land is particularly adapted for the use proposed. We do not wish
to object to the annexation of the other lands involved. /s/ Helmer W. Basso "

Mr. Michael Johnston, attorney for Peoples Bank, urged acceptance of Comprehensive
Plan amendment.

It was reported that the hearing had been duly published and posted. There were no
written communications.
Mr. Michael Johnston, attorney for Peoples Bank, again urged acceptance of.propo§ed
zone change.
Mr. Robert Dahl asked what consideration had been given to children attending
Longfellow school? Staff replied that the School District had no objection to
rezone request as they felt traffic flow would not have a significant affect on
them.

MAYOR TIDRICK DECLARED THE PUBLIC HEARING OPEN ON REBER REZONE, LOTS 30, 31 & 32,
BLOCK 6, SYLVESTER'S 2ND ADDITION FROM R-1 to R-2:
It was reported that the hearing had been duly published and posted. There were
no written communications.
Mr..Carl Reber was in attendance and favored rezoning as he wished to build a
duplex on property.

MAYOR TIDRICK DECLARED THE PUBLIC HEARING OPEN FOR AINSWORTH STREET VACATION:
It was reported that the hearing had been duly published and posted. There were
no adverse communications.
Mr. Evan Hawker, representing -,developers, stated that --due to the lateness of -the- -_,g
hour, they would be willing to delay their presentation for another two weeks.
Ainsworth Street Vacation hearing is continued until December 19, 1977 at 8:00 P.M.
ORDINANCES:
ORDINANCE NO. 1905: (Transposed from regular order of.business -tape on file)
AN ORDINANCE RELATING TO ZONING AND AMENDING TITLE 22 OF THE PASCO
MUNICIPAL CODE BY ADDING THERETO, A NEW CHAPTER TO BE KNOWN AND
DESIGNATED AS CHAPTER 22.70 AND ENTITLED PLANNED DENSITY DEVELOPMENT.
Mr. Sheeley moved that Ordinance No. 1905 be adopted. Seconded by Mr. Bailie.
Mr. Sheeley asked what prevented a developer from breaking up land into smaller
lots. Staff replied.that it would have to be approved by council first and the
number of dwellings on plat would'.be in writing.
Numerous questions and concerns arose over density,•underlying zoning, and!il.4nguage
in Ordinance. Rather than proceed with an Ordinance.they had concerns over, and
after learning that a 2 -week delay would not hinder developer's progress, they agreed
to refer Ordinance No. 1905 to'a workshop session and invited the developers to attend.
ORDINANCE NO. 1897:
AN ORDINANCE RELATING,TO THE CITY OF PASCO AND AMENDING ORDINANCE N0.
1120 AND THE CITY OF.'PASCO COMPREHENSIVE PLAN. (Riverview Heights)
Ordinance No. 1897 was read by title only. Mr. Sheeley moved that Ordinance No.
1897 be adopted. Seconded by Mr. Schuelein.. Motion carried by .roll call vote of
six (6).
ORDINANCE NO. 1898:
AN ORDINANCE RELATING TO ANNEXATION AND AMENDING TRACT OF LAND TO THE
CITY OF PASCO. (Northwest Developers).,
Mr. Sheeley moved that Ordinance No. 1898 be adopted. Seconded by Mr. Schuelein.
The City Attorney again stated that Boundary Review Board did not have jurisdiction
in this matter because they did not invoke it in allotted time; however, there
was the possibility of litigation.
Mr. Bosch expressed concern that delaying the Ordinance could cause problems
for him in bidding'and starting construction but he did not wish to expend any
more money until they were assured of annexation.
Mr. Jim Sargent asked, "could you go.ahea'd with annexation subject to approval by
Boundary Review Board?" Council concurred' they would rather have full support of
all bodies prior to approval.
Mr. Sheeley moved to table Ordinance No. 1898 until next regular meeting of the
City Council on December -•,19 •1977. Seconded by Mr. Adams. Motion carried..
Council assured developers by voice vote that they approved of annexation.

AN ORDINANCE RELATING TO BUSINESS LICENSES AND REGULATIONS AND AMENDING
TITLE 5 OF THE PASCO MUNICIPAL CODE BY AMENDING SECTION 5.04.120,
5.04.140, 5.04.160, 5.04.170, and 5.04.180 OF CHAPTER 5.04; BY
REPEALING SECTIONS 5.04.130 and 5.04.210 OF CHAPTER 5.04; BY AMENDING
SECTIONS 5.08.040 and 5.08.050 OF CHAPTER 5.08; BY ADDING TO CHAPTER

Ordinance No. 1907 was read by title only. Mr. Sheeley moved that Ordinance No.
1907 be adopted subject to following amendment. "Strike last sentence of
title starting with "providing for a mandatory review by the council..." and
insert the following language: "The rates mentioned in the above Ordinance will
expire on December 31, 1978. At that time, the 1977 Business License rates
will be reinstated." Seconded by Mr. Schuelein.
Amendment passed by roll call vote of six (6).
Main motion, as amended, passed by roll call vote of five (5). Councilman
Bailie voting no.
UNFINISHED BUSINESS:
APPRAISAL OF CITY OWNED PROPERTY: Mr. Sheeley moved that the City Manager
be authorized to enter into a contract with Mr. Ross Mellor, a Real Estate
Appraiser, in an amount not'to exceed $3,000, for the purpose of making a
feasibility study and appraisal of 76 acres of City -owned property immediately
east of the Pasco Municipal Golf Course. Seconded by Mr. Schuelein. Motion
FAILED by the following roll call vote. YES: Schuelein, Sheeley & Tidrick.
NO: Adams, Bailie & Wilkins.
It was requested that this item of business be on the December 19, 1977
agenda when a full council would be present.
