HomeMy WebLinkAbout05-03-1977 MinutesMINUTES PASCO CITY COUNCIL REGULAR MEETING MAY 3. 1977 CALL TO ORDER: Meeting called to order at 8:00 PA by Jan Tidrick, Mayor. ROLL CALL: By Deputy City Clerk. Councilmen present were: S.K. Adams, David Sheeley, E.A. Snider, Jan Tidrick and Bill Wilkins. Councilman Schuelein was absent due to being out of town on business and Councilman Bailie was ill. Also present were: George Smith, City Manager; Patrick Roach, outgoing City Attorney; Michael Cooper, newly appointed City Attorney; James Ajax, City Engineer; Ted Johnson, Associate Engineer; Al Tebaldi, Chief of Police; Webster Jackson, EEO Officer; Richard Erickson, Director of Parks/Recreation and Michael Corcoran. City Planner. CONSENT AGENDA: Mr. Sheeley moved that Consent Agenda be approved. Seconded by Mr. Snider. Motion carried by roll call vote of five (5). Consent items are as follows: a) Approval of Minutes. Minutes of regular meeting, held April 19, 1977. b) General Claims in the amount of $141,432.91; Claim Warrant Nos. 11989 through 12082. c) Payroll Claims in the amount of $158,255.21; Claim Warrant Nos. 14765 through 19176. d) Resolution No. 1087: A Resolution commending Mrs. Barbara Olson for her devoted service to the City of Pasco. e) Resolution No. 1088: A Resolution commending Mr. Stuart Nelson for his devoted service to the City of Pasco. f) Butler Annexation, 76-20-A: Meeting set for May 17, 1977, 8.00 P.M. g) Lawrence Rezone, 77-11-Z: Meeting set for May 17, 1977, 8.00 P.M. h) CBD Utility Undergrounding, Authorizing City of Pasco to enter into an Interlocal Memorandum of Understanding with the Franklin County Public Utility District to provide that all trenching work in connection with the undergrounding of utilities in the Central Business District would be included in and a part of the Franklin County Public Utility District Contract for undergrounding. i) Award of Bid - Cemetery Road, Award bid for improvement of cemetery road to G.B. Erickson & Son Construction, Yakima, Washington, in the amount of $17,631.00. PUBLIC HEARINGS: MAYOR TIDRICK DECLARED THE PUBLIC HEARING OPEN REGARDING THE CITY OF PASCO'S INTENT TO CREATE A QUARTER SECTION L.I.D., BOUNDED BY 14th, COURT, 5th AND THE BYPASS HIGHWAY. It was reported that the Hearing had been duly published and posted. Mr. Jim Ajax, City Engineer, acknowledged large delegation in attendance and stated the proposed L.I.D. was approximately $45,000 lower than last year due to eliminating the sidewalks in driveway areas for some 285 property owners. Under the present proposed L.I.D., if you don't want driveways replaced, you don't have to. Further, he outlined area on map and explained that storm drains were going to have to be put in some areas and these, too, were shown to the people. Mr. Lloyd Hammerstad, Yakima, Washington, vigorously opposed proposed L.I.D. as he felt he has already paid for the street once. Mr. Ajax responded that there had never been an L.I.D. in this area before and most of the streets had had some form of 2 -shot oil fifteen to twenty years ago and had served well beyond their natural life; therefore, were worn out. In response to Mr. Hammerstad's objection to $5,000 assessment, he stated that the market determined the cost. 1 1 1 MINUTES PASCO CITY COUNCIL REGULAR MEETING PUBLIC HEARING - Continued: MAY 3, 1977 Mr. Edward Paulson expressed concern for people on fixed incomes and didn't think that people with a corner lot should have to pay more. Mayor Tidrick concurred with Mr. Paulson in relation to people on fixed incomes, but at this time, he did not have a solution to the problem. Mr. Ajax explained method of assessing L.I.D.'s by using a block drawing. He said that a corner lot is felt to have more value, but in any event, the value of the land should be increased by the amount of the assessment. Mr. Lee Combs questioned width of 14th Street, Mr. Ajax replied that the City will contribute more on 14th Street because it serves an arterial street function. Mr. Bob Higginson asked, "if this goes down to defeat, how long before it will come up again?" Mayor Tidrick responded by stating that it would probably be several years before the opportunity would come up again as there are other areas in Pasco who deserve a turn at an L.I.D. Herb Wheeler was opposed to 60% figure needed to defeat L.I.D. and asked why it didn't take 60% to pass it? He felt the Council was "beating around the bush." Mayor Tidrick took exception with accusation and stated the Council had attempted to answer every question as honestly as possible and had not dodged any issue. As far as the 60% needed to defeat an L.I.D., this is clearly defined in the State Statute for L.I.D. procedures and not a Council action or decision. Mr. Wheeler then asked who was going to do the inspection. The reply was staff. Mr. Stan Hunstein defended 2 -shot oil treatment for all the residential areas in Pasco as he traveled over a 2 -shot oil road every day to go to work at Hanford and this road is 31 years old. Mr. Ajax then explained what asphaltic concrete was and stated that, for instance, County roads would last longer than City streets due to County having high speed traffic as opposed to slower moving City traffic with its constant starts and stops. RECESS: 9:00 RECONVENED: 9:10 (Petition was made available for persons wishing to protest during break time). Mr. Wilkins stated that the City of Pasco was not in the real estate business, we do not want your property, but we would like an impressive looking community with good streets and neighborhoods - in other words a nice place to live. Mr. Floyd Sandoval felt it was a City's responsibility to maintain the streets. He, too, felt he had already paid for it once. He concurred that new developments should put in adequate streets but he did not agree with that theory in existing neighbor- hoods. He disagreed with L.I:D. logic, stating that some would pass and some would not; therefore, areas -would --be inconsistent. He ­suggested some form of taxation for all citizens of Pasco so that funds would be available for street maintenance. Mayor Tidrick responded by stating that it would be an inequitable situation to tax everyone to pay for your street when they had already paid for their own. Further, under taxation method, it could be possible to pay approximately $2,500 and still not have a street because the City would have to set up a maintenance program and it would depend on when they were scheduled for a particular area. Mr. Sheeley reiterated that this was the most economical method available, and "why should someone who's already paid for his street help pay for yours?" Mrs. Evelyn Dorndorf asked, "won't our taxes increase after streets are improved?" Staff replied affirmative. She then replied, "that's a rip-off." Mr. Artie Williams wasn't totally opposed to L.I.D, as yet, but asked if a cumulative total is available so that residents of the area know where they stand. Staff agreed to have a cumulative total available every Tuesday. Mr. Daron Tate favored L.I.D. as he would like to have nice streets to drive over while he is living in the area. He felt that his property value would go down if something wasn't done soon. Mrs. Margaret Wood reiterated that owner/occupant opinion should weigh more heavily than out of town owners. Mayor Tidrick concurred Mrs. Wood had a valid point; however, MINUTES PASCO CITY COUNCIL REGULAR MEETING. MAY 3, 1977 under current State Statutes for L.I.D, procedures, each owner was given a "vote" regardless of their residency. vs. proponents Mr. Bob McFarland asked if oppositionAbecame a "fine line" issue under the 60/40 ratio, would the City withdraw their assessment and remain neutral?. The City concurred, in that event, they would remain neutral. Mr. Lloyd Hammerstad reminded the Council that he had built houses in Pasco for United Builders some twenty years ago and they built the streets to City 11 specifications - "now, why hasn't money been set aside to maintain these streets? Mr. Ajax responded that tax dollars do not go toward improving City streets, it's an individual's responsibility. Mr. Ed Ash stated he had to drive these streets every day to go to work and strongly favored going ahead with the L.I.D. Mr. Dennis Overman favored L.I.D. as he felt the Council had treated all people fairly; however, he questioned status of 5th Street. Staff replied that 5th Street would have extra oil on it due to heavy traffic and the City would bear that expense. Mr. Larry Dickinson strongly supported L.I.D, because, "thank God, we are getting another chance to get decent streets at a decent price - right now, you have a hard time getting any type of emergency vehicle through the ruts and holes existing in the streets at this time." Mr. Floyd Sandoval asked what affect this L,I.D. would have if you sold your property. Staff replied that FHA/VA loans would require that the lien be paid off; however, if you sold your property on contract, the lien could go with the property. Mr. Herb Wheeler expressed his views that the people who opposed the L,I.D. last year are in the minority this year. Mr. Bob McFarland asked if husband and wife constituted two signatures. Staff replied that husband and wife was regarded as one signature, Mr. Jim Sisk favored L.I.D. and urged Council to proceed. Mr. Charles Carson stated his opposition to L.I.D. Mr. Harold Mettling stood and asked the record to show that he favored L.I.D. Following three (3) calls from Mayor Tidrick for further comments from the floor, either for or against, the Public Hearing was declared closed. ORDINANCE NO. 1860: AN ORDINANCE AMENDING ORDINANCE NO. 1347 AND PASCO MUNICIPAL CODE S.9.68.010 RELATING TO DISCRIMINATION IN HOUSING WITHIN THE CITY OF PASCO; DECLARING CERTAIN CONDUCT TO BE CRIMINAL AND PRESCRIBING PENALTIES. Ordinance No. 1860 was read by title only. Mr. Sheeley moved that Ordinance No. 1860 be adopted. Seconded by Mr. Snider. Motion carried by roll call vote of five (5). ORDINANCE NO. 1861: AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE No. 1839, BEING AN ORDINANCE SETTING FORTH THE PROJECTS TO BE FUNDED FROM FUNDS RE- CEIVED UNDER TITLE II OF THE PUBLIC WORKS ACT OF 1976. Ordinance No. 1861 was read by title only. Mr. Snider moved that Ordinance No. 1861 be adopted. Seconded by Mr. Sheeley. Motion carried by roll call vote of five (5). MINUTES PASCO CITY COUNCIL REGULAR MEETING ORDINANCES - Continued: MAY 3, 1977 ORDINANCE NO. 1862: AN ORDINANCE AMENDING THE PASCO MUNICIPAL CODE BY DELETING SECTIONS 22.36.020(.4), 22.36.020(_6), 22,40,010(1) and 22,48,030(1); ADDING SECTIONS 22.40.010(1), 22,441010(1), 22,48.030(1), 19.12,2159 19.12.035 AND 22.68.020(1) (.Mobile Home Ordinance), Ordinance No. 1862 was read by title only, Mr, Sheeley moved that Ordinance No. 1862 be adopted. Seconded by Mr, Snider, Motion carried by roll call vote of five (5). NEW BUSINESS: CHANGE OF COUNCIL MEETING: Mr. Wilkins moved that the regular meeting of the City Council scheduled for 8:00 P.M. Tuesday, June 21, 1977 be changed to 8:00 P.M. Monday, June 20, 1977. Seconded by Mr. Adams. Motion carried. (All news media to be notified). RIVERVIEW ANNEXATION: Mr. Snider moved that the City Manager and staff be authorized to work with citizens in Riverview to explore the feasibility of annexing portions of the Riverview Area to the City of Pasco. Seconded by Mr. Wilkins. Motion carried. BLOCK GRANT APPLICATION: Mr. Wilkins moved that the City Manager be authorized to execute the City of Pasco's fiscal year 1977 Block Grant Application, as set forth in the City's proposed program, dated April 21, 1977, and to submit it to H.U.D. for approval. Seconded by Mr, Snider. Motion carried by roll call vote of five (5). (Mayor Tidrick asked staff to look into what alternatives the City has in the event our application gets denied). DISCRETIONARY FUNDS: Mr. Sheeley moved that the City of Pasco withdraw from the Consortium and apply for the entire amount on our own. Seconded by Mr. Snider. (_Discussion) Mr. Sheeley reported that after a lengthy meeting with representatives of Benton and Franklin Counties and smaller communities to plan applications for Federal Discretionary Funds, he had never been to a meeting of elected officials where there were so many closed minds and unwillingness to work on a compromise situation. Further, in his opinion, the City of Pasco had been insulted on numerous occasions; therefore, it was his recommendation that the City withdraw from the Consortium and apply for the total amount 'of funds available. Since Pasco's project has priority, he felt we had a good chance of getting the funds. Mr. Snider supported Mr. Sheeley's views by stating that Pasco was legally entitled to apply for funds, and after trying to compromise with Consortium, it had failed. Mr. Sheeley then stated that he would stay as long as possible to work out an equitable basis. It was learned that Richland and Kennewick were not eligible for discretionary funds. Mr. Ajax replied that had Pasco applied on their own merits for the last two years, we probably would have gotten it all. Main motion carried by roll call vote of four (4). Mayor Tidrick voting no. SUGGESTIONS FROM COUNCIL - GENERAL DISCUSSION: Mr. Sheeley reported that plans and proposed site for new retardation center will be discussed at next workshop meeting on May 10th.
