HomeMy WebLinkAbout12-19-1972 MinutesI MINUTES PASCO CITY COUNCIL REGULAR MEETING CALL TO ORDER: 435 DECEMBER 19, 1972 Meeting called to order at 8:00 P.M. by the Honorable Donald D. Linton, Mayor. ROLL CALL: By Clerk's representative. Councilmen present were: S.K. Adams, M.R. Denney, Sam Hunt, Larry Larsen, Donald Linton, Al Schor and Bill Wilkins. Also present were: City Manager., M; 6;. 'Wirne,gar; City Attorney D. Wayne Campbell; Finance Director Harry Kinzer; City Engineer Sandra Stanley; Chief of Police Al Tebaldi; Urban Renewal Director Webster Jackson and Recreation Director Richard Erickson. APPROVAL OF MINUTES: Mr. Wilkins moved that minutes of regular meeting, held December 5, 1972, be approved as written. Seconded by Mr. Schor. Motion carried. COMMUNICATIONS: PLANNING COMMISSION: Correspondence was received from City Planning Commission, requesting a public hearing to rezone a portion of Block 22, Helm's Second Addition from R-1 to R-3. Mr. Larsen moved that a public hearing be held January 2, 1973 to hear this request. Seconded by Mr. Wilkins. Motion carried. PLANNING COMMISSION: Correspondence was received from City Planning Commi:ssfon, requesting a public hearing to rezone a portion of Block 3, rep,lat of Kurth's Addition from R-1 to R-3. Mr. Hunt moved that a public hearing be held January 2, 1973 to hear this request. Seconded by Mr. Schor.- Motion carried. PLANNING COMMISSION: Correspondence was received from City Planning Commission, requesting a public hearing to rezone B1ock'3;-;Gray's East Riverside Addition from R-2 to R-3. Mr. Schor moved that a Public hearing be held January 2, 1973 to hear this request. Seconded by Mr. Hunt. Motion carried. PLANNING COMMISSION: Correspondence was received from City Planning Commission, requesting a public hearing to rezone a portion of SE quarter Section 17 and portion of NE quarter Section 20, T9N, R30 EWM. Mr. Wilkins moved that a,public hearing be held January 2, 1973 to hear this request. Seconded by Mr: Denney. Motion carried. PLANNING COMMISSION: Correspondence was received from City Planning Commission, requesting a public hearing to approve preliminary sub -division (Columbia East II). Mr. Hunt moved that -a public hearing be held January 2, 1973 to hear this request. Seconded by Mr. Larsen. Motion carried. PUBLIC HEARING: ORDINANCE NO. 1557: (Supplemental Budget), Mayor Linton declared the public hearing open on Ordinance No.�1557. There were no written adverse communications received. The City Manager reported -we had received $132,000.00 in revenue sharing funds, and in response to Mr.. Pitts,;gave.-the following breakdown: Increase in General Fund of $10,800 to offset intern-p;rogcap and firemen on disability; $132,000 used in Street Fund�to offset prior debt; $17,800 to offset E.E.A. Program; $850 in Library Fund for miscellaneous; $5,000 in Parks and Recreation for Youth Involvement Program; $132,000 Federal Revenue Sharing; $5.00 '62 Golf Revenue Bond; $500 Capital Project - U.A.B. Chase; $2,000 Enterprise Golf ($1,900 to offset taxes where budget insufficient); $2,300 Finance Operation Fund and $9,750 Firemen's Pension Fund(reimbursable item for firemen on disability leave). 436 MINUTES PASCO CITY COUNCIL REGULAR MEETING PUBLIC HEARING (Continued) DECEMBER 19, 1972 Following three (3) calls from Mayor Linton for further comments from the floor, either for or against, the public hearing was declared closed. ORDINANCE NO. 1557: AN ORDINANCE APPROPRIATING THE ADDITIONAL AMOUNT OF $313,005.00 IN REVENUE FUNDS; MAKING ADDITIONS IN THE GENERAL FUND FOR $10,800.00; CITY STREET FUND FOR $132,000.00; E.E.A. PROGRAM FUND FOR $17,800.00; LIBRARY FUND for $850.00; PARKS AND RECREATION FUND FOR $5,000.00; CREATING THE FEDERAL SHARED REVENUE FUND FOR $132,000.00; DEBT SERVICE 1.962 GOLF REVENUE FUND FOR $5.00; CAPITAL PROJECT U.A.B. CHASE FOR $500.00; ENTERPRISE GOLF FOR $2,000.00; FINANCE OPERATION FUND FOR $2,300.00; FIREMEN'S PENSION FUND FOR $9,750.00; MAKING CERTAIN BUDGET ITEM ADDITIONS TO ACCOMPLISH THE PURPOSE SET FORTH HEREIN, AND DECLARING AN EMERGENCY. Ordi nanceyNo: 4557 was read by title only. Mr. Denney moved that Ordinance No. 1557 be adopted. Seconded by Mr. Wilkins. Motion carried by roll call vote of seven (7). VISITORS: A.E. PITTS presented a petition, bearing signatures of approximately 377 persons, protesting mandatory garbage collegtion. Mr. Pitts stated he represented the Concerned Taxpayers Association who were interested in better Government at less cost. He frankly admitted that his group were after the Council's "hide" if they didn't reverse their decisions on mandatory garbage, open burning and spending binge. 1 Mayor Linton supported present Garbage Ordinance and stated he realized there were some inequities; however, the Council was going to consider an amendment which should resolve some of the problem. Councilmen.Schor and Denney reiterated that cleaning up Pasco had been a No. 1 priority with most citizens of Pasco and the No -Burning Ban had been handed down to us from a Federal level. Mr. Schor then gave a brief presentation as background information leading up to passage,of present Garbage Ordinance. He cited that it had been the request of most citizens he had talked to -and that many months had been spent in the preparation of said Ordinance. Further, during that time, there had been no public input even though it had been publicized on numerous occasions. Secondly, it had been brought to Mr. Schor's attention the possibility of a group meeting secretly, whose only purpose was to twist the intent of elected officials and degrade them in the public eye. He stated these individuals would not serve, only maneuver, and if such a group did exist, he publicly challenged them to come forth, state their names and purposes as any elected Councilman would be expected to do. Thirdly, he commended Mr. Pitts for his sincerity; however, challenged him to cooperate with the present City Council to help find a sensible solution for Pasco's growth instead of fault finding. MR. THORPE asked the Council which was worse - litter or garbage? Secondly, he didn't come to meetings for a lecture, just to get the facts. MR. G. ROSS,.complained of alley between 8th & 9th Street as full of debris, etc. The City Manager read section of Ordinance relative to a spring clean-up and stated that possibly the City should also have one in the fall to take care of leaves, branches, etc. Mr. Wilkins also responded by assuring Mr. Ross that this particular alley was in his district, and if he would give the new Ordinance a chance, he could be assured the alley would be cleaned up. MR. OLSON stated that the City Council would have had no trouble if they had left the word "mandatory" out. MR. HENDLER defended the Council's action and commended them -for taking a positive step forward. Mr. Denney then related to the audience the number of Kennewick residents using our free Franklin County dump, and.'eventually, there Would have to be a charge there or closed up. MINUTES PASCO CITY COUNCIL REGULAR 'MEETING VISITORS (Continued) 437 DECEMBER 19, 1972 BOB McKEE ehpressed concern that everyone gets something out of universal garbage collection for a cleaner City but primarily, sanitation and health. - BARRY SAMPSON, owner of local drive in, stated his rates had tripled due to compulsory garbage collection and no -burning ban. The City Manager responded by stating that proposed amendment to present garbage Ordinance would give Mr. Sampson the right to negotiate directly with Dietrich's for removal of solid waste. PAUL LAWRENCE, president of Apartment Owner's Association, enlightened the Council as to his -views on.the inequities of our present Ordinance relative to income producing property. He firmly believed in a cleaner City, and as a condition of rental, he directed -that all his tenants subscribe to garbage service; however, protested the "per unit" price. Mr.,Winegar invited Mr. Lawrence to sit in on negotiations with himself and Dietrich's at the earliest convenience. TAMARA PIDGEON commended the City Council for passing a compulsory garbage Ordinance and cleaning up our City. IRA SCHMIDT asked if the City could legally break agreement with Dietrich's relative to rates and conditions. The City Manager replied that the contract can be amended if mutually agreed upon by the City and Contractor. MIKE PUTNAM expressed disappointment in petition submitted by A.E. Pitts as it had a forged signature of Governor Daniel Evans of Olympia; therefore, was wondering how many more of the signatures were not bona fide registered voters. GARY MANSON asked if the Council would refuse a negotiated rate he might get from Dietrich's. The reply was negative. BRIAN MORGAN asked if the City could legally set rate for over 60 years of age as opposed to under 60 years of age and on welfare. The answer was affirmative. ;LAIMMAYOR LINTON DECLARED A;?BRIEF RECESS WHICH WAS RESUMED AT 9:45 P.M. CLAIMS AGAINST THE CITY: Claim of William Johnson re: alleged confiscation of motorcycle was referred to City Attorney and insurance carrier for disposition. ORDINANCES: ORDINANCE NO. 1560: AN ORDINANCE ADOPTING THE BUDGET FOR THE YEAR 1973 Ordinance No. 1560 was read by title only. Mr. Hunt moved that Ordinance No. 1560 be.adopted. Seconded by Mr. Larsen. Motion carried by roll call vote of seven (7). ORDINANCE NO. 1561: AN ORDINANCE AMENDING ORDINANCE NO. 962, 1350 AND 1364, SECTION 49.2 AND PASCO MUNICIPAL CODE 13.40.040, SEWER CHARGES - UNOCCUPIED UNITS, AND BEIN G AN ORDINANCE ESTABLISHING PROCEDURES FOR WAIVER OF SEWER CHARGES FOR SINGLE FAMILY DWELLINGS, MULTIPLE DWELLINGS AND COMMERCIAL ESTABLISHMENTS. l Ordinance No. 1561 was read by title only. ORDINANCE NO. 1562: AN ORDINANCE AMENDING SECTIONS 3 AND 10 OF ORDINANCE NO. 1537, AND BEING AN ORDINANCE RELATING TO HEALTH AND SANITATION; PROVIDING FOR AND REGULATING THE COLLECTION, TRANSPORTATION AND.DISPOSAL OF SOLID WASTE IN THE CITY OF PASCO; PROVIDING FOR RATES AND CHARGES THEREFOR; CREATING A "SOLID WASTE FUND"; PROVIDING FOR THE VIOLATION THEREOF. SUGGESTIONS FROM COUNCIL - GENERAL DISCUSSION: Councilman Denney requested that his chair be oiled Councilman Hunt suggested that the City Council look into the various committees and determine if they are worthwhile or should be abandoned. Councilman Wilkins suggested that some of the problems of overflowing garbage cans be -referred to John Dietrich for pickup. Peanuts is often seen pushing his cart, picking up litter and hand- ing out candy to children in down- town . Pasco. Before gift certificates were presented to Peanuts Tuesday, he- passed out candy to the audience at the council meeting. Page 4.
