HomeMy WebLinkAbout04-07-1970 Minutes124 CITY OF PASCO MINUTES OF THE PASCO CITY COUNCIL REGULAR MEETING CALL TO ORDER: APRIL 7, 1970 Meeting called to order at 8:00 P.M. by the Honorable G.E. Carter, Mayor. ROLL CALL: By Clerk's Representative. Councilmen present were: G.E. Carter, Hilda Campbell, M.R. Denney, Robert Greenlee, Ed Hendler and Sam Hunt. Councilman George Stork was absent from the meeting. Also present were: City Manager, City Attorney, City Attorney, Director of Urban Renewal and Police Chief. APPROVAL OF MINUTES: Mr. Greenlee moved that the minutes of March 17, 1970 be approved, as corrected. (Mr. Alford's name corrected). Seconded by Mrs. Campbell. Motion Carried. PUBLIC HEARINGS: MAYOR CARTER DECLARED THE PUBLIC HEARING OPEN FOR IMPROVEMENT OF CHASE AVENUE FROM LEWIS STREET TO COURT STREET. The City Manager reported the Hearing had been duly published and posted. One communication was read from Robert & Jean Kelly, 1828 W. Nixon, protesting the zone and termini method of assessment. James Carter asked what his "special assessment" was. The City Engineer explained' to Mr. Carter that it was for a sidewalk running across.an easement on his property. Betty Yeaman asked if the County paid a proportionate share. The City Manager reported that the City and County each paid approximately $30,000 and the balance came from gas tax monies and Urban Arterial funds. Marie Scheel stated she was still paying for street on Nixon Street, but would like to pay more than one yearly payment, and asked why she could not. The City Engineer explained laws governing L.I.D. assessments and invited Mrs. Scheel to come into City Hall and talk to City Treasurer. Following three (3) calls from Mayor Carter for further comments from the floor, either for or against,.the Public Hearing was declared closed. ORDINANCE NO. 1414: AN ORDINANCE ORDERING THE IMPROVEMENT OF CHASE AVENUE FROM LEWIS STREET TO COURT STREET WITHIN THE CITY OF PASCO, WASHINGTON, TO ARTERIAL STANDARDS BY GRADING, CONSTRUCTING, AND INSTALLING STORM SEWERS, CURBS, GUTTERS, NECESSARY SIDEWALKS, ASPHALT TREATED BASE COURSE, ASPHALT CON- CRETE SURFACING, TRAFFIC CONTROL DEVICES AND ALL INCIDENTAL WORK, ALL IN ACCORDANCE WITH RESOLUTION NO. 813 OF THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON; ESTABLISHING LOCAL IMPROVEMENT DISTRICT NO. 82; PROVIDING THE METHOD OF ASSESSMENT IN SAID DISTRICT; PROVIDING THAT PAY- MENT FOR SAID IMPROVEMENTS BE MADE BY SPECIAL ASSESSMENTS UPON THE PROPERTY IN SAID DISTRICT, PAYABLE BY THE MODE OF "PAYMENT BY BONDS"; AND PROVIDING FOR THE ISSUANCE AND SALE OF LOCAL IMPROVEMENT DISTRICT WARRANTS REDEEMABLE IN CASH AND LOCAL IMPROVEMENT DISTRICT BONDS. 1 CITY OF PASCO MINUTES OF THE PASCO CITY COUNCIL REGULAR MEETING ORDINANCE NO. 1414 - Continued: APRIL 7, 1970 125 Ordinance No. 1414 was read by title. Mr. Greenlee moved that Ordinance No. 1414 be adopted. Seconded by Mr. Denney. Motion carried by the following roll call vote. YES: Carter, Campbell, Denney, Greenlee and Hunt. ABSTAIN: Hendler. (Had property in area). PUBLIC HEARING: MAYOR CARTER DECLARED THE PUBLIC HEARING OPEN FOR PURPOSE OF REZONING LOTS, 17, 18, 19 and 20, BLOCK 1, GERRY'S ADDITION FROM RESIDENTIAL R-3 to COMMERCIAL C-1. The City Manager reported the Hearing had been duly published and posted. There were no adverse communications. A letter was read from the Planning Commission, recommending proposed zone change. Capt. Gleyn E. Bledsoe, Jr., co-owner of Hallmark Building, showed a detailed graph of the commercial area of building and stated unless the zone change were granted, he would lose tenants because of restrictions such as signs, etc. He pointed out that surrounding area was zoned commercial and felt this building area should be too. Councilman Greenlee questioned off-street parking provision and urged strict enforcement of off-street parking for each rentable unit. Following three (3) calls from Mayor Carter for further comments from the floor, either for or against, the Public Hearing was declared closed. ORDINANCE 10. 1415: AN ORDINANCE CHANGING THE ZONE CLASSIFICATION OF CERTAIN REAL PROPERTY WITHIN THE CITY OF PASCO FROM RESIDENTIAL R-3 TO COMMERCIAL C-1. ;s Ordinance No. 1415 was read by title only. Mr. Greenlee moved that an Ordinance changing the zone classification of certain real property within the City of Pasco from Residential R-3 to Commercial C-1 be adopted, provided all of the off-street requirements as set forth by City Ordinance are met. Seconded by Mrs. Campbell. (Prior to question, Mr. Hendler pointed out that Planning Commission had recommended zone change; therefore, they had probably checked area for zone compliance, and asked Mr. Greenlee to modify his motion. Mr. Greenlee declined). Main motion carried by the following roll call vote. YES: Carter, Campbell, Denney, Greenlee, Hendler and Hunt. NO: None. PUBLIC HEARING: MAYOR CARTER DECLARED THE PUBLIC HEARING OPEN FOR THE PURPOSE OF HEARING ANNEXATION REQUEST OF DALE MATHES FOR PROPERTY LOCATED NORTH OF COURT STREET, WEST OF ROAD 28, AND EAST OF BY-PASS HIGHWAY. The City Manager reported the Hearing had been duly published and posted. There were no written comments; pro or con. The' Mayor reported that the Annexation Review Board had met, reviewed the nine points as required, and approved said annexation. Following three (3) calls from Mayor Carter for further comments from the floor, either for or against, the Public Hearing was declared closed. 126 CITY OF PASCO MINUTES OF THE PASCO CITY COUNCIL REGULAR MEETING ORDINANCE NO. 1416: APRIL 7, 1970 AN ORDINANCE PROVIDING FOR THE ANNEXATION OF A TRACT OF LAND TO THE CITY OF PASCO. ' Ordinance No. 1416 was read by title only. Mr. Hendler moved that an Ordinance providing for the annexation of a tract of land to the City of Pasco be adopted. Seconded by Mr. Hunt. Motion carried by the following roll call vote. YES: Carti, Campbell, Denney, Greenlee, Hendler and Hunt. NO: None. There were no visitors wishing to address the Council at this time. OLD BUSINESS: BILLS: FIREMEN'S PAY SCHEDULE, 1970: The City Manager presented two firemen's pay schedules, one for 1969 and the other 1970. It was his recommendation that 1970 scale be approved by the Council as this was the culmination of several negotiation meetings with the firemen. Mr. Hendler moved that the Firemen's Pay Scale be ratified, as presented, subject to initiation of pay period, effective July 1, 1970 for a minimum of one year, with the understanding that the Council further rejects Kelly days, collection of dues and Close Shop. Seconded by Mrs. Campbell. Motion carried by the following roll call vote. YES: Carter, Campbell, Denney, Greenlee, Hendler and Hunt. NO: None. BURROUGHS EQUIPMENT CONTRACT: The City Manager requested permission to enter into an Agreement to lease the -E 99 Electronic Computer, which is presently in the City's possession and being programmed to handle the entire City operation i.e., budget control, vendor's ledgers and cash receipts. Later, we will add payroll and utili accounting. Mr. Hunt moved that the City Manager be authorized to enter into agreement with Burroughs Company to lease the E6499 Electronic Computer. Seconded by Mr. Greenlee. Motion Carried. ORDINANCES: ORDINANCE NO. 1417: AN ORDINANCE AMENDING AN ORDINANCE ADOPTING CALENDAR YEAR, 1970. SECTION I OF ORDINANCE NUMBER 1402, AND BEING THE ANNUAL BUDGET OF THE CITY OF PASCO FOR THE Ordinance No. 1417 was read by title only. Mr. Hendler moved that an Ordinance amending Section 1 of Ordinance No. 1402, and being an Ordinance adopting the annual budget of the City of Pasco for the calendar year, 1970, be adopted. Seconded by Mr. Carter. Motion carried by the following roll call vote. YES: Carter, Campbell, Denney, Greenlee, Hendler and Hunt. NO: None. BUSINESS LICENSE ROSTER: The following business license applications await approval of the Council: ALMA'S DOLL & GIFT SHOP, Alma Peterson, Gift Shop., 2011 E. Lewis. Mr. Carter moved that all business license applications be approved. Seconded by Mr. Hendler. Motion Carried. NEW BUSINESS: URBAN RENEWAL VACATION REQUEST: A letter was read from Ray MacDonald, Executive Director of the Dept. of Urban Renewal, requesting vacation of California Avenue between Columbia Street and Hagerman Street; and the alley between California Avenue and Wehe Avenue. Mr. Carter moved that a Public Hearing be held May 5, 1970, for the purpose of hearing this request. Seconded by Mr. Hendler. Motion Carried. 128 CITY OF PASCO MINUTES OF THE PASCO CITY COUNCIL REGULAR MEETING NEW BUSINESS: JOB 69-10, TRAFFIC SIGNAL INSTALLATION: A letter was City Engineer, advising tat Power City Electric, INc. pleted Job No. 69-10, Traffic Signal Installation, and be accepted and proper entities be notified. Mr. Hendler moved that recommendation of the staff be Labor & Industries and Washington State Tax Commission Mr. Carter. Motion Carried. APRIL 7, 1970 read from Sandra Stanley, had satisfactorily com- recommended that the job accepted, and Department of be notified. Seconded by CITIZEN'S ADVISORY COMMITTEE: Mayor Carter read the following response in answer to allegations made March _2T,_ 1970: In regard to the demands that were presented to the Pasco City Council on Tuesday, March 24th, at Whittier School, and in response to those questions, the City Council of the City of Pasco responds in the following manner: 1. ALL CHARGES AGAINST ROBERT ORANGE BE DROPPED. Response: Any charges that were made against Robert Orange by the proper and duly authorized law enforcement agency is a matter for the judicial system of our society; and therefore, this body is not authorized to act any further in any manner concern- ing the Robert Orange case. 2. THE REMOVAL OF CITY MANAGER MAX POPE AND OFFICERS GLEN BUTNER AND RON MORGAN FROM THEIR RESPECTIVE POSITIONS WITH THE CITY OF PASCO. Response: The City Manager was hired by this body, and this body alone has sole responsibility for his continuance in his present position. We find that thereha not been any malfeasance in office or any neglect in the carrying out of his du tie as directed by this Council. In fact, Mr. Pope's performance to date has been one that has been entirely satisfactory to the City Council, especially in view of the many serious problems that he was immediately faced with upon acceptance of his position. In regard to Officers Morgan and Butner, this body is not the authority that can act upon any verbal complaint as to the conduct of two police officers, but do suggest that any citizen who has any valid information concerning the conduct of these officers, and/or others, be filed in the proper manner, first through their employer, which is the Chief of Police, and then the City Manager. If the grievance is not abated by the above action, then legal action can be taken against these and others through the proper legal channels of either private counsel and/or the Prosecuting Attorney's Office. We further suggest that any complaint against any of our City employees should be substantiated that it would be admissable in a court of law and could be verified. 3. THE INTEGRATION OF THE PASCO POLICE DEPARTMENT. Response: It is a known fact that thislCity has been endeavoring to do so and a policy of an integrated Police Department has been in force and long sought after. Since we have been unsuccessful to date in accomplishing our mission, we are planning on making a further effort to accomplish this goal. However, we need help; and we respectfully request names and addresses of.people of the East Pasco community and others who would be interested in working with the City to accomplish this mission in finding qualified applicants who are black and who will be willing to take the test and meet the necessary qualifications to become law enforcement officers. 4. THE IMPLEMENTATION OF AN AWARENESS AND HUMAN RELATIONS PROGRAM FOR ALL CITY OFFICIALS AND EMPLOYEES, SPECIFICALLY THE CITY COUNCIL AND POLICE DEPARTMENT. CITY OF PASCO MINUTES OF THE PASCO CITY COUNCIL REGULAR MEETING [WE APRIL 7, 1970 Response: Many of our City employees have already taken, and are continuing to take, such programs. Some members of the Pasco City Council have already participated. Information is being gathered by our staff as to possible future programs that may be implemented in behalf of all City employees. 5. A COMMUNITY RELATIONS DEPARTMENT BE ESTABLISHED TO BRIDGE THE GAP BETWEEN THE MINORITY COMMUNITIES AND THE POLICE DEPARTMENT. Response: A request for a Resolution creating a Police Department Advisory Committee is being made by the Pasco City Council and such details as to its membership and function are being worked out by the staff to be presented at the next official council meeting. Further, we have been recently advised by our Staff that we will be eligible for financial assistance to implement a Community Relations Department within our law enforcement agency. This is being implemented as quickly as possible. 6. THE URBAN RENEWAL PROJECT DIRECTOR BE REPLACED BY A BLACK MAN. Response: The services of Mr. Ray MacDonald have been satisfactory, and we find no area of,malfeasance or inadequacies. Mayor Carter asked Chief Leary to explain function of Citizen's Advisory Committee. Chief Leary reported that he and the City Manager had attended a meeting in Olympia with Glen Hudspeth, James O'Connor, James Shaw and Secretary of State Lud Kramer in an effort to obtain funds to establish a Community Relations Program. There was the possibility that the original $13,000 grant could be increased to $25,000, and it was their recommendation that a Citizen's Advisory Committee be formed, comprised of a 15 -man board to advise the City of problems and subsequent solutions. Chief.Leary recommended that one member be selected from the following bodies to attend a meeting on April 20, 1970, in an effort to alleviate problem: - Pasco Senior High School Staff, Pasco Chamber of Commerce, East Pasco Neighborhood Council, Community Action Committee, East Pasco Self Co -Op, Pasco Ministerial Association, Columbia Basin College (staff), Tri City Latin American Association, School District Administration, Pasco Soul Sisters Action Committee, Local Press, Pasco Retail Merchants Association, Student Body of Pasco High School and League of Women Voters. Mr. Hendler moved that the Staff draft the necessary Resolution to create the Citizen's Advisory Committee and Community Relations Department within the Law Enforcement Agency. Seconded by Mr. Carter. Motion Carried. Wallace Webster, Director of Community Action Committee, challenged the Council by reiterating he didn't feel there was proper representation of blacks on this Committee. His statement was substantiated by E.M. Magee, N.A.A.C.P., who stated his group didn't have a member on the committee. The Council retorted by stating that there were many organizations in the area who had been left out, but it was felt the list submitted represented a cross-section of the community. Councilmen Hendler and Carter explained what funds were available and what could be accomplished, of which Mr. Webster disagreed. Mrs. Campbell stated to Mr. Webster that if we were going to communicate, we would have to listen; without listening, we would be unable to communicate. 130 CITY OF PASCO MINUTES OF THE PASCO CITY COUNCIL REGULAR MEETING APRIL 7, 1970 CITIZEN'S ADVISORY COMMITTEE: (Continued) Mr. Hunt moved that the City of Pasco launch an exhaustive effort to integrate the Pasco Police Department as soon as is possible. Seconded by Mayor Carter. Motion Carried. Mr. Hunt moved that the City of Pasco specifically recognizes the need to begin its own Human Relations Program as soon as a constructive proposal can be formulated and adopted. Seconded by Mr. Greenlee. (Prior to question, Mr. Hendler asked Mr. Hunt if his motion could be modified to include "within its limitations" due to present Budgetary capabilities - Mr. Hunt declined). Motion Carried. (Mr. Hendler voting no). SUGGESTIONS FROM COUNCIL - GENERAL DISCUSSION: Mr. Hendler read the following words of wisdom which reflected his own feelings during this time, and hopefully, the sentiments of citizens he represents. "It is our belief that most all of our black citizens, our neighbors and friends, feel as we do about Law and Justice; the servitude of government to all the people and the principles of which our government is founded upon. Each person has a right to life, liberty and the pursuit of happi- ness; however, these rights do not extend to the intimidation and harrassment of another person. Further, it is our mutual belief that Law Enforcement Agencies are there for the protection of the people it serves, and to this end, our local Police Department is so dedicated. Grievances should be heard and abated when possible. However, in order to realize a just and proper end to any grievance, it must be through respect and acceptance of the authority vested in our duly authorized constituted bodies, Judicial System and Law Enforcement Agencies. There are those who are on the path of destroying our system without offering any substitution for evaluation, and are using means foreign to our system. To those groups or individuals, whoever they may be, may I offer a word of wisdom that my mother used to tell me, "When you dig a hole for someone else, you usually fall in yourself."
