ROLL CALL: By Clerk. Councilmen present were: G.E. Carter, J.G. Bailey, C.F. Griggs, Fred Robinson, George Stork and Russell Wiseman. Councilman Greenlee arrived at 8:04 P.M. APPROVAL OF MINUTES: Motion made by Robinson, seconded by Bailey that -the minutes of the Regular Council Meeting held January 4, 1966 be approved as written. Motion Carried, BID OPENING: (BEECH STREET SIDEWALK, L.I.D. #74) Five (5) bids were received for construction of sidewalk on South Beech Street as follows: 1. Mayor Carter asked Mr. Fisher to tabulate bids and report later in meeting. BID OPENING: (CITY OWNED PROPERTY, LOTS 5 AND 6, BLOCK 11, RIVERSIDE ADDITION) There was one bid from Wallace W. Preston of Preston Truck & Tractor. A certified check in the.amount of $1,855.00 accompanied the bid. Following discussion, motion made by Griggs, seconded by Stork to accept bid of Wallace W. Preston for sale of City Owned Property, Lots 5 and 6, Block 11, Riverside Addition. Motion carried by roll call vote of seven (7). BID OPENING: (TIRES) Mr. MENASCO reported on bids received, and due to quantity and quality needed, it was his recommendation that all tire bids be rejected and the City of Pasco continue in the same manner in which we have been buying. Following discussion, motion made by Stork, seconded by Wiseman that all tire bids be rejected and a letter of thanks be written to the dealers stating that when tires are needed, they will be notified. Motion Carried. 1-70 PASCO, WASHINGTON COUNCIL CHAMBERS REGULAR MEETING BILLS: JANUARY 18, 1966 Bills presented against the City of Pasco were as follows: CURRENT EXPENSE $19167.93 WATER $19830.23 EQUIPMENT RENTAL 76.54 ARTERIAL STREET 8.13 CEMETERY 340.00 STREET 136.03 PARK 60.00 GOLF 60.00 TOTAL: $39678.86 Motion made by Bailey, seconded by Greenlee that all bills properly vouchered and certified be paid. Motion carried by roll call vote of seven (7). COMMUNICATIONS: C.F. WHETSLER requested permission to refund $20.00 paving cut to Mr.. Willis F. Shearer, 1907 N. Poplar as he was charged two paving cuts for service installation, but it was only necessary to make one cut., Motion made by Robinson, seconded by Greenlee to grant Mr. Whetsler's request. Motion carried by roll call vote of seven (7). HAROLD A. WYMAN, CITY CLERK requested authority for the City Clerk to make transfers monthly from Water Department Funds to Bond Redemption, Interest and Reserve Funds. Motion made by,Greenlee, seconded by Griggs, that Mr. Wyman's request be granted. Motion Carried. RUTH MODESKY, CITY TREASURER requested authority for the City Clerk to make transfers, in accordance for payment of Golf Course Club House Revenue Bonds, Interest and Reserve. Motion made by Greenlee, seconded by Wiseman to grant Mrs. Modesky's request. Motion Carried. IMPROVEMENT OF ROAD 28 BETWEEN SYLVESTER 6 LEWIS: Mayor Carter directed the following letter to District Engineer, Yakima, Washington on January 17, 1966. "The City Council was considerably upset to learn that Road 28 from West Lewis Street to Sylvester Street had not been included in the Contract to complete the grade separation at Sylvester Street.and the By -Pass Highway. It was our recollection that at the time the various access plans were being discussed, the City had requested a right turn merging lane for east- bound traffic on Sylvester onto the Bridge approach, as well as other access and egress. After a study by your department, an exit lane was provided for northbound traffic off the bridge onto Sylvester Street and that traffic originating from the area west of the By -Pass heading for the new bridge would be routed over the By -Pass with a free right turn onto Road 28 and a free right turn onto West Lewis S;reet. We now find that there will be a portion of this route (approximately 700 feet) that is to be left un- improved. It seems to us that this vital portion of the traffic loop designed to serve a particular major traffic movement in this area has been omitted --contrary to what we feel was the agreement we had with the Highway Department. We would like to have your Department reconsider this omission in view of our previous discussions and agreement on the provisions for traffic movement in this area." /S/ G.E. Carter, Mayor CJ 1 PASCO, WASHINGTON COUNCIL CHAMBERS REGULAR MEETING JANUARY 18, 1966 IMPROVEMENT OF ROAD 28 - CONTINUED: After discussion, Councilman Greenlee suggested sending a copy of Mayor Carter's letter to the State Highway Commission in Olympia, Washington. PETERSON, TAYLOR 6 DAY (ATTORNEYS FOR MRS. ELSIE LIVERMORE): L.I.D. #73 A letter from Attorney Theodore Peterson was read to the Council as follows: "I represent Mrs. Elsie Livermore. To settle the matter of City of Pasco vs. Livermore, she will accept the sum of $650.00 from the City and will execute a quit claim deed to the City of Pasco for .13 acre of land for the L.I.D. proposal adjacent to her property on Chase Street in the City of Pasco, Washington. She has agreed that she will not challenge the assessment roll as it presently stands." /S/ Theodore Peterson LEAVY 6 TABER (ATTORNEYS FOR EARL 6 DORENE WATTENBURGER) L.I.D. #73 "Reference is made to our previous discussions and correspondence relating to the Chase Street portion of the above LID. The undersigned hereby offers to sell to the City of Pasco, and to convey by quit claim deed, the following described real estate: The east 40 feet of the following described property: That portion of Corrected Plan of O'Keefe's Third Addition to Pasco, Washington, according to the plat thereof recorded in volume "B" of plats, page 37, in Franklin County, Washington, including all vacated streets and alleys, described as follows: The east 406 feet of the southeast quarter of the southeast quarter of Section 25, Township 9 North, Range 29 E.W.M., lying south of the south line of West Hopkins Street as now located, except the south 207.0 feet thereof, and except any portion which lies in that part of Chase Street not vacated. The purchase price to be paid by the City to the undersigned. shall be $1,700.00. This offer is contingent upon the City of Pasco agreeing to move the existing fence and reinstall it along the westerly boundary line of the real estate above described, all at the City's cost and expense. It is understood and agreed that said fence presently encloses a field and that it shall be reinstalled in the same condition it is presently in and reinstalled in such a manner that animals in said field will not escape during the removal period. This offer is further conditioned upon the understanding that the undersigned will continue to have access to Chase Street and with the understanding that the contemplated improvements will be so designed that surface waste waters will not drain upon the property of the undersigned. This offer is further conditioned upon the City of Pasco making an accurate determination of the front -footage.of the under- signed's property on Chase Street and adjusting the front footage assess- ment in accordance therewith. Motion Carried. 172 r PASCO, WASHINGTON COUNCIL CHAMBERS REGULAR MEETING JANUARY 18, 1966 COMMUNICATIONS - CONTINUED: _ LYLE BALDERSON, FRANKLIN CO.. REGIONAL PLANNER (NEWBORNS ZONE CHANGE A letter from Lyle Balderson, addressed to the Mayor and City Councilmen was read as follows: "At the regular meeting of the City Planning Co -mission held January 139 1966, a zone change from I-1 to C-3 was approved and its adoption recommended to your honorable body, for the following described property: Lots 13, 149 149 16 and 17, Block 5, Pasco, according to plat thereof recorded in volume "B" of plats, page -32-A." /S/ Lyle Balderson Motion made by Greenlee, seconded by Griggs to accept recommendation of the Planning Commission and set February 1, 1966 as Public Hearing Date. Motion Carried. VISITORS: % EARL DUTTON, RIVIERA TRAILER COURT: Mr. Dutton voiced his protest over sewer charges for occupied trailer homes from 50C to $1.50. He felt this was a 230% increase in comparison to the water rate. It was his suggestion that a percentage figure of the water bill might be a more fair and equitable way of establishing rate. He stated that the City.of Kennewick bills all trailer ( homes, taverns, etc. on a commercial rate percentage of 40%. Mr. Dutton stated he would like the City Council to reconsider this issue. GARY MANSON, NORTHSIDE TRAILER PARK: Mr. Manson protested the sewer increase as being exhorbitant and that he would be unable to absorb it. He stated that this would force trailer dwellers to move to Burbank or Kennewick where rates were less expensive. ORDINANCES: ORDINANCE NO. 1219 The City Manager recommended tabling this Ordinance (Confirming the Assessment Roll for L.I.D. #73 - A Street & Clark Street) in order to discuss it at a Workshop Meeting in view of Livermore and Wattenburger correspondence. ORDINANCE NO. 1220 AN ORDINANCE CHANGING THE ZONE CLASSIFICATION OF CERTAIN REAL PROPERTY WITHIN THE CITY OF PASCO FROM R-1 LOW DENSITY RESIDENTIAL DISTRICT TO R-3 HIGH DENSITY RESIDENTIAL DISTRICT. Motion made by Robinson, seconded by Stork to read Ordinance No. 1220 by title only. Motion Carried. Ordinance No. ,1220 was read by title only. Motion made by Robinson, seconded by Stork that Ordinance No. 1220 has been read. Motion Carried. Motion made by Griggs, seconded by Bailey to adopt Ordinance No. 1220. Motion carried by roll call vote of seven (7). ORDINANCE NO. 1221 Motion made by Griggs, seconded by Wiseman to delay action on Ordinance No. 1221 until -next Regular Council Meeting. Motion Carried. (Ordinance No. 1221 - amending sewer charges for occupied trailer homes from 50� to 1.50). ORDINANCE NO. 1222 AN ORDINANCE ORDERING THE CONSTRUCTION OF SIDEWALKS IN THE CITY OF PASCO PURSUANT TO RESOLUTION N0, 662, PROVIDING FOR THE LEVY OF A SPECIAL ASSESSMENT UPON THE ABUTTING PROPERTY, AND PROVIDING FOR THE PAYMENT OF COSTS OF SAID IMPROVEMENTS. PASCO, WASHINGTON COUNCIL CHAMBERS REGULAR MEETING 173 JANUARY 18, 1966 ORDINANCE N0. 1222 - CONTINUED Motion made by Greenlee, seconded by Stork to read Ordinance No. 1222 by title only. Motion carried. Ordinance No. 1222 was read by title. Motion made by Greenlee, seconded by Wiseman that Ordinance No. 1222 has been read. Motion Carried. Motion made by Greenlee, seconded by Robinson to adopt Ordinance No. 1222. Motion Carried. OLD BUSINESS: AGREEMENT - DUTTON, RIVIERA TRAILER COURT: Motion made by Greenlee, seconded by Bailey to read Agreement in its entirety. Motion Carried. Mr. Menasco read agreement in its entirety. Following discussion, motion made by Greenlee, seconded by Stork that the City Manager be authorized to sign agreement for the City of Pasco with Mr. Dutton with exception of following changes: I - Thirty (30) days to Sixty (60) days payment date. II - Quit Claim—Deed changed to Easement and City Attorney be instructed to draw up necessary agreement. Motion Carried. CHANGE ORDER - VAIL - TRAFFIC SIGNALS 6 INTERSECTION WORK. CHASE & LEWIS A Change Order in the amount of $4,548.60 was presented by Don Gray of Gray 6 Osborne for Items 20, 21 and 22, for additional intersection work and traffic signals at. Lewis 6 Chase. Motion made by Wiseman, seconded by Stork that Change Order No. 6 be granted. Motion Carried. CHANGE ORDER - GREGORY BROTHERS A Change Order was presented for drainage work at Chase/Lewis and along 9th to Ainsworth as a result of no unit prices for items of work under original contract. Discussion ensued whereby Mr. Campbell, City Attorney stated if the City had a Contract with Gregory Brothers, we could go ahead on Change Order under original contract.. Motion made by Wiseman, seconded by Carter that this Change Order be granted. Motion carried by roll call vote of five (5). (Greenlee and Griggs voting no). NEW BUSINESS: CALL FOR BIDS ROAD 24 SANITARY SEWER EXTENSION: Motion made by Griggs, seconded y Greenlee to Call for Bids on Sanitary Sewer Extension, setting March 1, 1966 as opening date. Motion Carried. CHANGE ORDER - KELTCH CONTRACT - ROAD 28 AND IRVING TO ROAD 28 AND SYLVESTER A Change Order for the extension of sanitary sewer on Road 28 and Irving to Road 28 and Sylvester in the amount of $3,231.76 was presented. Motion made by Greenlee, seconded by Griggs that the City Manager be instructed to sign contract with Keltch for sewer extension. Motion Carried. ANNEXATION: PARALLEL TO ROAD 34 SEWER PROJECT - MOTION TO ESTABLISH DISTRICT AND AUTHORIZE PREPARATION OF PETITIONS: 1. Motion made by Bailey, seconded by Stork that the City Council will accept an annexation petition. Motion Carried. 2. Motion made by Griggs, seconded by Wiseman that the City Council will accept the District as delineated on the map. Motion Carried. 3. Motion made by Bailey, seconded by Greenlee that the area, if annexed, will not be required to participate in paying off City indebtedness incurred prior.to annexation. Motion Carried. 4. Motion made by Wiseman, seconded by Stork that the City Council will accept the area with the zoning most analagous to the present County zoning and as shown on the proposed zoning map. Motion Carried. 174 1j REGULAR MEETING PASCO, WASHINGTON COUNCIL CHAMBERS JANUARY 18, 1966 AGREEMENT CIVIL DEFENSE - COUNTY/CITY AGREEMENT, 1966: A Civil Defense Agreement between the City of Pasco and Board of County Commissioners was read to the Council. Motion made by Wiseman, seconded by Bailey that the Agreement be renewed and that the City Manager be authorized to sign this document. Motion Carried. BUSINESS LICENSE ROSTER The following business license applications were submitted for approval: 149er Drive In Robert George Cafe 1315 N. Chase Pasco, Washington Independent Photo Co. Photo Finishing 507 N. 4th C. Durkin Pasco, Washington Motion made by Greenlee, seconded by Griggs to grant these licenses. Motion Carried. BID TABULATION: (SIDEWALK, SOUTH BEECH STREET) Mr. Fisher reported that the low bid was submitted by Willie Vaughn in the amount of $6,700.00 and recommended acceptance of this bid. Motion made by Griggs, seconded by Greenlee to award bid for construction of South Beech Street Sidewalk to Willie Vaughn in the amount of $6,700.00. Motion Carried. BID TABULATION: (SIDEWALK - HICKORY 6 COURT - MYERS) Mr. Fisher reported that the low bid was submitted by Willie Vaughn in the total amount of $915.80 and recommended acceptance of this bid. Motion made by Greenlee, seconded by Wiseman to accept bid of Willie Vaughn in the amount of $915.80. Motion Carried. ADJOURNMENT: Motion made by Greenlee, seconded by Bailey to adjourn.
