HomeMy WebLinkAbout04-06-1965 MinutesPASCO, WASHINGTON COUNCIL CHAMBERS REGULAR MEETING CALL TO ORDER: APRIL 6, 1965 Meeting called to order by the Honorable G.E. Carter, Mayor at 8:04 P.M. ROLL CALL: By Clerk. Councilmen present were G.E. Carter, J.G. Bailey, R.L. Greenlee, C.F. Griggs, Fred Robinson, George Stork and Russ Wiseman. Also present were Horace Menasco, City Manager; George Fisher, City Engineer and D. Wayne Campbell, City Attorney. APPROVAL OF MINUTES: Motion made by Greenlee, seconded by Robinsonthat the minutes of the March 16, 1965 Regular Meeting be approved. Motion Carried. CORRESPONDENCE: GILBERT PARKER requested a.refund in the amount of $12.50 under Treasurer's Receipt No. 1754 for an incorrect license fee paid and not used. Motion made by Greenlee, seconded by Bailey that this refund be authorized. Motion carried by roll call vote of seven (7). PUBLIC HEARING: REZONING - HUSKY OIL COMPANY: The Mayor declared the public hearing open and requested comments for the rezoning of this property (Lots 29, 30, 31 and 32, Block 5, Gerry's Addition to Pasco according to plat thereof recorded in volume B of Plats, page 17.) Clyde Hathaway, District Representative for Husky Oil spoke --favoring the rezoning for the reason that rezoning would allow them to build a modern station to replace the one they have at this address which they are now restricted on improvements or rebuilding. Discussion was entered into between Mr. Greenlee, Mr. Griggs and Mr. Hathaway on a question - answer basis. Mr. Kilbury also spoke favoring the rezoning of these lots --indicating that the comprehensive plan provides that these four lots shall be commercial. Mayor Carter requested comments against the rezoning. There were none. No written protests were received. The Mayor declared the Public Hearing closed. VACATION OF A PORTION OF GRACE STREET - P.U.D. PETITION: The Mayor declared the public hearing open and requested comments favoring the vacation of Grace Street. Harry Hudlow from the P.U.D. spoke favoring the vacation of this street which has never been cut through and as is now platted seems to be unecessary. The vacation of Grace would provide better parking and building facilities for the P.U.D. Mayor Carter requested comments opposing the vacation. There were none. No written protests have been received. The Mayor declared the Public Hearing closed. BY UNANIMOUS CONSENT, REGULAR ORDER OF BUSINESS WAS SET ASIDE AND PROGRESSED TO OLD BUSINESS, ITEM A. OPENING OF BIDS ON CONSTRUCTION - L.I.D. #69. Six bids were received, opened and read as follows: 1. Mansfield Concrete Com any(No bid bond or cashier's check enclosed.) Unit price, $3.30 per lineal foot; Extended price, $7,425 plus State Tax of $297.00 for a total of $7,722.00. 2. Marchand (5% bid bond enclosed). Unit price, $4.40 per lineal foot; Mtended price, $9,900.00 plus State Tax of $396.00 for a total of $10,296.00. 3. Kimball (5% bid bond enclosed) Unit price, $3.12 per lineal foot; Extended price, $7,020.00 plus State Tax of $280.80 for a total of $7,300.80. Gregory Brothers (5o bid bond enclosed) Unit price, $3.65 per lineal foot; Extended price, $8,212.50 plus State Tax of $328.50 for a total of $8,541.00. 5. Willie Vaughn (No bid bond or cashier's check enclosed) No unit price; Extended price $6,625.00 plus State Tax of $265.00 for a total of $6,890.00 6. Herman Lapp ($325.00 Cashier's check enclosed) Unit price, $2.78 per lineal foot; Extended price, $6,255.00 plus State Tax of $250.20 for a total of $6,505.20. Mr. Fisher was requested to tabulate bids and report later in the meeting. ORDINANCES: Ordinance No. 1186: AN ORDINANCE CHANGING THE ZONE CLASSIFICATION FROM RESIDENTIAL R-1 TO COMMERCIAL C-1 ON CERTAIN REAL PROPERTY LOCATED WITHIN THE CITY OF PASCO, AND MORE PARTICULARLY DESCRIBED IN SECTION 1 OF THIS ORDINANCE. Motion made by Greenlee, seconded by Robinson to read Ordinance No. 1186. Motion Carried. Ordinance No. 1186 was read in its entirety. Motion made by Robinson, seconded by Wiseman that Ordinance No. 1186 has been read. Motion Carried. Motion made by Stork, seconded by Bailey to adopt Ordinance No. 1186. Motion carried by roll call vote of seven (7). Ordinance No. 1187: AN ORDINANCE VACATING THAT PORTION OF GRACE STREET IN PASCO, FRANKLIN COUNTY, WASHINGTON LYING NORTH OF THE NORTH LINE OF CLARK STREET AS IT NOW EXISTS AND .SOUTHWESTERLY OF THE WEST LINE OF 13TH AVENUE AND LYING EAST OF THE NORTH 250 FEET OF THE SOUTH 950 FEET OF THE EAST 230 FEET OF THE WEST 270 FEET OF THE WEST HALF OF THE WEST HALF OF THE SOUTHWEST QUARTER OF THE SOUTHEAST QUARTER OF SECTION 30, TOWNSHIP 9 NORTH, RANGE 30 EAST WILLAMETTE MERIDIAN EXCEPT ANY PORTION THEREOF THAT LIES WITHIN 13TH AVENUE. Motion made by Bailey, seconded by Griggs that Ordinance No. 1187 be read by title only. Motion Carried. Ordinance No. 1187 was read by title. Motion carried by roll call vote of seven (7). CLAIMS AGAINST THE CITY: ROBERT M. HULL . submitted a claim in the amount of $18.72 which they say resulted as a result of the main sewer being plugged on Pearl Street which' resulted in backup in the basement. a51 Motion made by Wiseman, seconded by Bailey that this be turned to the insurance committee. Motion Carried. RESOLUTIONS: Resolution No. 641: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DECLARING ITS INTENTION TO INSTALL AN 8" SANITARY SEWER LINE TOGETHER WITH MANHOLES ON THAT PORTION OF SYCAMORE STREET COMMENCING AT A STREET LYING WITHIN KURTZMAN'S FIRST ADDITION TO PASCO ACCORDING TO THE PLAT THEREOF RECORDED IN VOL. "B" OF PLATS, PAGE 29, RECORDS OF FRANKLIN COUNTY, WASHINGTON, AND TO CREATE A LOCAL IMPROVEMENT DISTRICT TO ASSESS THE COST AND EXPENSE OF SAID IMPROVEMENT AGAINST PROPERTIES IN SUCH DISTRICT SPECIALLY BENEFITED THEREBY; AND NOTIFYING ALL PERSONS WHO DESIRE TO OBJECT TO SAID IMPROVEMENT TO APPEAR AND PRESENT THEIR OBJECTIONS AT A MEETING OF THE CITY COUNCIL TO BE HELD ON May 4 , 1965. Motion carried by roll call vote of seven (7). PETITIONS, APPEALS, COMPLAINTS, VISITORS: At this point, Mayor Carter requested comments from the audience. (There were none). OLD BUSINESS: CHANGE ORDER - GRAY & OSBORNE: This concerns change orders for work on Clark Street from 2nd to 4th and on 3rd Street from Columbia to Clark. Cost quoted as follows: $3,158.00 for 'the --two �-block s..by City: ;Hall and $537Q.Clark Street, 2nd to 4th (Cost of 3rd from Lewis to Columbia would be $3,990.00). Following discussion, motion made by Wiseman, seconded by Stork that the street between 2nd & 4th on Clark and the street on 3rd from Lewis to Clark be developed by acceptance of this change order in the amount of $3,158.00 and $5,370.00. (Mr. Wiseman qualified his motion by stating he omitted Lewis to Columbia because of the fact this is not in the arterial street program). Motion carried by five (5) "yes" votes and two (2) "no" votes. (Carter, Bailey, Greenlee, Stork and Wiseman voting yes and Griggs and Robinson voting no). APPOINTMENT: At this time, Mayor Carter appointed Councilman to work with neighborEooa improvement councils for closer liason between the citizens and administration. Greenlee - East; Griggs - South; Robinson - Central Business District; Stork - West and Wiseman - North. Mayor Carter requested each one of these councilmen to select five (5) citizens from their area as committee for that area. Mayor Carter, Mr. Bailey, Mr. Fisher and the City Manager will attend all meetings. PROPOSED RIGHT OF WAY PURCHASE(ARTERIAL STREET PROGRAM): Two proposed option agreements were submitted: 1. Wright & Howard in the amount of $1,155.00. 2. Adam Zacher in the amount of $10,500.00. These were presented for the Council's action. Following discussion, motion 5 PASCO, WASHINGTON NOW COUNCIL CHAMBERS REGULAR MEETING APRIL 6, 1965 OLD BUSINESS - CONTINUED: made by Griggs, seconded by Brailey that we forget (Take no action) the acquisition of right of way for the present on these two properties. Motion Carried. MISCELLANEOUS: BID REPORT: Mr. Fisher, having tabulated the bids on L.I.D. #69 construction proposal, recommended the acceptance of the low bid submitted by Herman Lapp in the amount of $6,505.20. Motion made by Griggs, seconded by Stork that the contract be awarded to Mr: Lapp. Motion carried by roll call vote of seven (7). ARTERIAL STREET PROGRAM: "Before we get into the Manager's Report, I would like to commend Mr. Stork for talking to Mr. Zacher and I would like to give Mr. Zacher a bad time publicly --when the City and the populace as a whole is willing to spend a million dollars just to build these streets and this one man stands in the way of the progress of this city to the tune of two and one-half feet there on the front of that lot, I think it's a pretty sad state of affairs; I 1 PASCO, WASHINGTON COUNCIL CHAMBERS REGULAR MEETING APRIL 6, 1965 ARTERIAL STREET PROGRAM - CONTINUED: and I want to toss it right back in his lap that the rest of the City is not happy about it at all."
