ROLL CALL: Councilmen present were G.E. Carter, J.G. Bailey, R.L. Greenlee, C.F. Griggs, Fred Robinson, George P. Stork and Russell Wiseman. Mr. Menasco, City Manager; George R. Fisher, City Engineer; and D. Wayne Campbell, City Attorney were also present. APPROVAL OF MINUTES: Motion made by Bailey, seconded by Stork that the minutes of the last meeting be amended to include the price $22,500.00 in the motion for Call for Bids on the old library building which is net to the City and_all costs of the sale to be borne by this purchaser, and with that amendment, the minutes be approved. Motion Carried. COMMUNICATIONS: Petition for L.I.D. Street lim rovements Sylvester Addition: Following discussion, motion made by Griggs, seconded by Baileya at the City Manager be given authority to prepare the necessary Resolution to begin the L.I.D. Motion Carried. Request for L.I.D., Street Improvements, 13th E Bonneville-P.U.D. The r P.U.D. is requesting the City to sign this petition for L.I.D. as one of the property owners. Following discussion, motion made by Stork, seconded by Bailey that the Council grant the City Manager authority to sign this petition for the City. Motion Carried. Motion made by Griggs, seconded by Wiseman that the City Manager be authorized to prepare necessary Resolution of Intent for the forma- tion of this L.I.D. for presentation at the next regular Council Meeting. Motion Carried. Petition for L.I.D., Sanitary Sewer Improvement - Kurtzman Addition: Following discussion, motion made by Wiseman, seconded by Robinson that the City Manager be authorized to prepare the necessary Resolution of Intent on this proposed L.I.D. Motion Carried. PUBLIC HEARING: Proposed Arterial Street L.I.D. Before declaring the public hearing open, the Mayor requested the City Manager to explain the Arterial Streets Im- provement Program.-.The.,CityManagerlreported on the Arterial Street Pro- gram, Phase I and Phase II. The Mayor requested comments from the floor -- either protest or favoring the L.I.D. The City Manager explained the improvement program with the aid of two maps and one series of charts. He explained Phase I and Phase II of the Street Improvement. At 8:13, the Mayor declared the Public Hearing open and requested comments pro or con on the proposed L.I.D. 1 r MRS. GERTIZEN - 1504 Dakota Street - asked the question why the property owners were not sent this type of letter before beginning the arterial street program. Answer: This is all set forth in Ordinance No. 1131 and also was widely publicized by newspaper articles, radio, public meetings and brochures distributed house to house. WILLIAM POWELL - N. Oregon & Clark - asked if this assessment covered Oregon Street and also Clark Street. Answer: His assessment was for Oregon Street only. MR. GERTIZEN - stated that because Court & Sylvester were very heavily �. traveled , the individual property owners having property 'abutting thereto were paying a larger portion'. He felt this was unfair because everyone in the City was using this street. Answer: It was pointed out that if it were a street improvement for properties through an L.I.D. initiated by the individual property owner, the property owners would pay the entire cost. .17 38 I PASCO, WASHINGTON COUNCIL CHAMBERS REGULAR MEETING Proposed Arterial Street L.I.D. - Continued MARCH 2, 1965 This $6.00 a foot was based on the°cost of the previous L.I.D. ($18 a lineal foot). The Council has taken half that cost and assessed 2/3 to the individual -property owners. FLOYD WHITWER: 1520 Sylvester, stated that he felt this was not an im- provement to residential property to have an arterial street adjoining. Answer: Sylvester has always been an arterial street - this is now being improved and resurfaced. FRANK MONTGOMERY: Lucas 6 Clark - Mr. Montgomery reported that he had received a preliminary estimate notice in the amount of $690.00. He has a 100' lot and at the rate of $6.00 a foot, he would like clarification on the amount of $690.00. Mayor Carter requested the City Clerk to advise Mr. Montgomery. L. BRECKE: Mr. Brecke filed a written protest with the City Clerk and spoke to the Council stating that although he recognized his responsibilities as a property owner, he did not have a chance to vote on the issue not being a resident of Pasco, but owning property in Pasco. GLADYS PETERS: (Mrs. Don Peters) 1708 Marie - Mrs. Peters stated that her home address was 1708 Marie, that she owned the property at 401 Shoshone. She stated that she also had a written protest on file. She also questioned the Council as to why this could not be assessed in the same manner as L.I.D. #64. She raised the question as to when the City expected to start Phase II of the Street Program. Answer: As soon as possible. MR. JOHNSON: Court & Illinois: Asked the question why he had to pay and is neig or did not. Mr. Johnson faces Illinois. Answer: This assess- ment is on all abutting properties (those properties abutting the arterial improvement). LARRY BARRETT: S. 10th Avenue - questioned why there'was very few streets under the arterial street program which had been surfaced curb to curb and that the assessment was the same whether the street did or did not have surfacing. Ahswer: This is State Highway. MRS. CARTMEL: stated that it was her understanding that the City got cheaper bids for t e work and they anticipated that the assessment would likely be less than $6.00. In that the City did receive a good bid, she questioned why the assessment was not less than $6.00. Answer: This being a City wide Improvement Project, having been voted in by the individuals, any saving by a cheaper than anticipated bid would benefit the G.O.B. portion of the financing rather than the L.I.D. portion. She also questioned the limitation of assessment due to the fact that certain of her properties were also being assessed under L.I.D. #65. The Mayor directed the City Clerk to check this out and answer Mrs. Cartmel's question. It is Mrs. Cartmel's opinion that a four -lane highway does not improve her property. She also questioned the fact that she also has an L.I.D. assessment for L.I.D. #65 from some of this property and was wondering about the ceiling of assessment. Answer: The City Clerk to check into this and inform Mrs. Cartmel by letter. ETHEL CRATER: spoke concerning the pamphlet and requested information as to the gas tax money. Mrs. Barrett, S. 10th, stated that she was in agreement with previous speaker --that it was her opinion that Ed Hendler had made the comment that if the contract was less than anticipated, the cost to the property owner may be less than $6.00 a foot. TOM MORRISON: indicated he felt the City did get a better bid than the $6.00 a foot. He also stated that it was his opinion that the City would use this excess money to pave more streets and that this L.I.D. would pay for it. Answer: By Mayor Carter - The $6.00 assessment for abutting properties is to pave the street abutting these particular properties plus G.O. money. Any saving is G.O. money and this can be used to extend the project. Mr. Wiseman stated that he was on the Citizen's Street Committee and he never heard the remark made relative to the lowering of the $6.00 assessment. 3 9 PASCO, WASHINGTON COUNCIL CHAMBERS REGULAR MEETING MARCH 2, 1965 Proposed Arterial Street L.I.D. - Continued MR. G.K. EPLEY: S. 10th Street, stated he thought the discussion at these .. committee meetings indicated that this money could be used only for arterial streets. Answer: This is arterial street gas tax money which could be used for arterial streets only. MR. AUTEN: S. 10th Street questioned whether this was for sidewalks, streets or curbs. Answer: This project concerns street surfacing, curbs & gutters, and in further explanation to questions raised by Mr. Auten, it was stated that any sidewalks removed would be replaced at the city's expense at no extra cost to the property owner and should curbs be removed, 50� credit would D. be given. MR. KIDWELL: S. 10th Street questioned what the $6.00 a foot was for and what ,. was the 5 1/2 for. Answer: Mayor Carter answered that if Mr. Kidwell was paying $5.50 a foot, this was for credit for curb removed. Mr. Kidwell objected to paying for curb and sidewalk which had been previously installed. It was clarified that sidewalks would be replaced at no extra charge to the property owners and that curbs removed and replaced would then be credited 50C a foot to the assessment ($5.50 assessment). Mr. Menasco: In the case of your property where you have a curb and sidewalk and the street is being widened, that sidewalk will be replaced at no additional charge to you. Where you had the curbing in, you are allowed 50� per foot credit for the fact that curbing was in there. What your $5.50 assessment is, is for the street paving. Mr. Kidwell asked about his assessment for property in the east part of Pasco (Oregon & Lewis Street). He is being charged $6.00 a foot for that improvement. Answer - City Manager: The $6.00 is for Mr. Kidwell's share of the street improvement on North Oregon Street, north of Bonneville rather than install curb and gutter, the design.has been changed to include improved shoulder treatment for the two treatments is the same. WILLIAM NEFF: How do you form an L.I.D? Answer: An L.I.D. may be formed by direct petition of the property owners bearing signatures of 51% of the residents in the affected area or the Council could declare it to be in the T. public necessity to form an L.I.D. and proceed with Resolutions of Intent. Protestence in the amount of 60% of the dollars and cents cost of the entire project. City Attorney: William Neff: Would this be 60% of the people on the L.I.D. or as Mr. Menasco requested the City Attorney to answer this . question. The City Attorney stated that 60% of the total cost of the pro- ject would be necessary to defeat the L.I.D. and protests must be in writing. William Neff: Should there be 60% protests and the street in progress as it is, it appears that the L.I.D. is necessary for completion of the street project, what would happen? Mayor Carter answered the question: Your L.I.D., $362,000.00, would not constitute 60% of the entire project cost. One individual stating that, "In other words, this public hearing was unecessary because the protests were of no value" broyghttthe explanation from the City Manager: There is a valid reason for a hearing, there is a valid reason for anybody to protest at this hearing and one of things that is under consideration is the amount of the proposed assessment. The notice that was sent out is a proposed assessment of $6.00 a foot. This is a basic question that the people would probably be interested in. This is the area of protest that is of interest to the people who are here this evening. LON LEEPER: states that he has property on Oregon Street and that the assess- ment on both lots is 50% of the value of the lots and he would like to go on record as being for this project. d S.S. JILEK: Stated that when he took the position with the Citizen's Street Committee and subsequently elected chairman thereof, there was a lot of time :. and work spent on this project by a large number of citizens and property owners of Pasco. At that time, Pasco had not had a new street in twenty-five years. Three months were devoted to explain the entire project to the people and special efforts were made to not "Hoodwink" anyone. There were individuals who would go out to neighborhood groups of three or four, there were meetings +. at the library, there was radio coverage and also coverage in the paper that members of the committee personally paid for. Special attention and time was devoted to Mrs. Cartmell personally. He stated that he was surprised to find that there were so many people who were not completely informed of the project. 40 PASCO, WASHINGTON COUNCIL CHAMBERS ' REGULAR MEETING MARCH 2, 1965 Proposed Arterial Street L.I.D. - Continued Greenlee: Referred to the petition for Street Improvements presented and s submitted earlier in the meeting and commended those citizens for their .. interest and also pointed out that .this would cost them a great deal more than $6.00 a foot (roughly $12.00 a foot). ROY RANSIER: 117 N. Oregon - requested information as -to the depth of the street --the grading being quite deep. Answer: Approximately 16 inches i from the sub grade. Mr. Ransier also requested commercial curb cut, this information to be given to the engineer. BEN SULLIVAN: Marie 6 Norbart. This is in connection with the new petition submitted for street improvement between Brown and Aurelia. Mr. Sullivan wondered whether he would be charged for North or South or East and West. Bryce.Hall answered the question that it was his impression that it was front footage. C LEROY WIGGINS: 12th 6 Washington states that he has property bordering Oregon Street and that he is tickled that the Council is going to do something there. His property will be valueless until improved and we have to develop to make progress. Pasco is in a wonderful position --everything leads to Pasco, you people are Pasco and make it whatever you want. He is in favor of having progress here. FLOYD COOK: S. 10th, between Ainsworth 6 Washington - requested information relative to the curbs and whether or not it will be commercial so that it can be driven over. Answer to be forthcoming from the City to Mr. Cook. MRS. CHEEK: N. Chase - wonders how long it will be before the L.I.D. Bonds �. are sold. They have their property up for sale and would like to sell it previous to the assessment. Dale Bates: There is no requirement, as such, legally that you would have to pay off the L.I.D. personally before selling. It would depend upon your deal with the purchaser; however, if there is financing by V.A. or F.H.A., they would require that it be paid in full. 3. City Attorney: It is impossible to state an exact time for the selling of the bonds, the engineer would have to formulate a final assessment with actual *. costs and there would then be a public hearing on the final assessment roll where you will again have the opportunity to come back and object to the individual assessment as an individual objection. After that has passed, it will be turned to the City Treasurer's Office for a 39 -day prepaid period. Itis impossible at this time to say whether it will be one month or two. ART ZI.SKA: 1811 Sylvester was thinking on the $6.00 charge, it appears that his charge on the preliminary assessment notice is incorrect. This is to be checked out for Mr. Ziska and he is to -be advised. JIM HOLMAN: N. Chase = I was just wondering, did I understand you correct to say there was nothing we could do to prevent.Mayor Carter: I was hoping you wouldn't say that because I hoped you would want to go along with the program. Holman: Now my question is, what do I do as a property owner to avoid this (avoid paying it) ? Carter: The people of Pasco voted this program in and .although it may be the wrong time for Mr. Holman as an individual, this is a fair•and equitable charge and provided for in the ordinance setting up the election. KEN SARGENT: Court & Lucas - I believe I can answer this man. What I am going to do is (I am assessed about $1,000) when I sell my property, the man who buys it is going to pay for it. Mr. Sargent asked one more question, in 1960, while he was in New York, he received a notice to put his sidewalk 3: in on Court Street -- that this was a City wide project and everyone was _. supposed to install sidewalks. He put his sidewalk in and it appears he is the only one that has done so. Answer: What we would like to see is, without the City asking for it, that the people would install sidewalks. With regard 1, to City -owned property within the last two years, the City has approximately $10,000.00 on cement work. The City has curbed around every park and there i is one small step by Volunteer which will have sidewalks and curbs. As soon as "possible, the City intends to do that. We feel we cannot insist on each r individual installing sidewalks until the City has done so. BATES: It is typical in America that we always go along with the majority, we may not agree with things but when majority rules, we accept it. This goes from electing a president on down. RUDOLPH GUISE: STATES he is pleased to see the street improvements projects. MRS. BROWNING: 412 Nixon requests the City to put some oil on the street .in that location. The Mayor called on Ed Hendler to speak at this point. Mr. Hendler said he would like to comment on a statement that had been made earlier, his name having been used. He stated that the statement had been made that he and Mr. Jilek had sold the program and he is proud of that. With re- gard to Mrs. Cartmell's statement relative to the $6.00 being reduced, it may be that the implication was made but he cannot rectify this --he believes that everyone there will recognize the $6.00 figure as a figure put out for fair and equitable price. For all citizens abutting on all arterial streets improvements, the additional money that the City may gather would be used for an additional mile or two miles.Any additional arterial streetimprovement WOULD be financed in the same manner with $6.00 a foot additional to owners of.abutting property. For further clarification, Mr. Hendler stated that this $6.00 was established by a previous council --nothing prevents this Council or any other future council of reappraising any future work. Mr. Sargent asked whether unplatted, unimproved land was assessed at the same rate as other. Answer: Affirmative. The Mayor declared the public hearing closed. Motion made by Greenlee, seconded by Stork that this be turned to the Fire - mans Fund Insurance Company. Motion Carried. ORDINANCE NO. 1 83: AN ORDINANCE PRESCRIBING RULES GOVERNING VEHICLES, AND REGULATING PASSING ON THE RIGHT WITHIN THE CITY LIMITS OF THE CITY OF PASCO: PROVIDING PENALTIES FOR VIOLATIONS OF THIS ORDINANCE, AND REPEALING SECTION NO. 39 OF ORDINANCE NO. 1180 Motion made by Greenlee, seconded by Wiseman that Ordinance No. 1183 be read. Resolution No. 637: A RESOLUTION ESTABLISHING A POLICY FOR THE CITY OF RASCO IN REGARD TO LOCAL IMPROVEMENT DISTRICTS BY PROVIDING FOR CITY PARTICIPATION WHERE POSSIBLE AND IF IN THE DISCRETION OF THE CITY COUNCIL TO BE EXPEDIENT AND WITHIN THE LIMITS OF AVAILABLE FUNDS. MANAGER'S REPORT 6 GENERAL DISCUSSION: Police & Fire Department Reorganization Code: The City Manager reported that because the Chief of Police is out of town at the present time, he would PASCO, WASHINGTON COUNCIL CHAMBERS REGULAR MEETING MANAGER'S REPORT - CONTINUED: MARCH 2, 1965 like to hold this matter up until his return so that he can review this with him prior to presentation to the Council. Joint Meeting - Planning Commission/Council: There is proposed a joint meeting between Planning Commission and the Council, Thursday evening, 7:00 P.M. in connection with comprehensive plan and proposed changes to the zoning ordinance. Following this discussion, it was proposed that a new date for this meeting be established for mutual convenience of all concerned. Sign Ordinance: As a reminder - there will be an informal discussion type meting between Council and sign companies and merchants relative to the proposed sign ordinance - March 9th at the regular meeting. Purchases: On the 16th of February, an agreement was entered into Pasco, Richland and Kennewick for joint purchase of chlorine. Councilman Greenlee suggested that Mr. Menasco, together with Mr. Winegar and the Purchase Agents of the two towns,explore the possibility of more of this type of joint pur- chase. Damaged Sidewalks: Councilman Wiseman stated that there are several places where sidewa s ave been damaged, have holes in them, are protruding up into the air, etc. and he recommends that these be taken care of.
