ROLL CALL: NOVEMBER 4, 1964 By Clerk. Council members present were: G. E. Carter, J. G. Bailey, R. L. Greenlee, C. F. Griggs, George P. Stork and Russ Wiseman. Fred Robinson was absent (patient in Walla Walla Hospital at this time). Horace E. Menasco, City Manager; George R. Fisher, City Engineer and D. Wayne Campbell, City Attorney were also present. John Severson was present in the audience. Motion carried by roll call vote of six (6). OPENING OF BIDS: (pipe and pump for Golf Course) Sealed Bids which were submitted for pipe were opened and read as follows: (7 in number) 1. Western Materials; Pasco 3,507.16 Mr. Fisher was given the opened bids which had been read, to take to the office for tabulation and report back at a later time in the meeting. COMMUNICATIONS: TREASURER: (L.I.D. No. 68): Letter was read as follows: "The total assessment for L.I.D. #68 was $13,851.36. The thirty (30) day pae-pay period ended on October 21, 1964 and $3,993.65 was collected. The balance to be financed by an Installment Note from the Fireman's Pension Fund is $9,857.71. After the tempor- ary transfer loans, plus interest, are paid I will have a balance in the fund of $1,079.91 and request permission to transfer this balance to the Current Expense Fund for services. I will also need an Installment Note made to the Firemen's Pension Fund." Motion made by Griggs, seconded by Bailey, authorizing the Treasurer to transfer $1,079.91 from the L.I.D. #68 Fund to Current Expense Fund for administrative services. Motion carried. CITY ENGINEER: (Request for refund, E. M. Magee, $5.00) Letter was read as follows: "Permission is hereby requested to have the City Treasurer make a refund 6f $5.00 to Mr. E. M. Magee for Street Surface Cut #983 issued on October 5, 1964. Brown Excavation Co. later picked up a permit for the same street cut." Motion made by Stork, seconded by Bailey, to grant the issuance of this refund. Motion carried by roll call vote of six (6). CITY CLERK: (Request for Refund, Elmer M. Claphan $5.00) Mr. Claphan was denied a Chauffeur's License, after paying $5.00 license fee under Treasurer's Receipt No. 467. A refund in the amount of $5.00 is requested. Motion made by Greenlee, seconded by Wiseman to authorize the refund of $5.00 to Mr. Claphan. Motion carried by roll call vote of six (6). MR. RAEKES (Civil Service): Mr. Raekes is requesting council review of the Civil Service appointments, Police Sergeants in the Police Department, he is requesting time on the agenda this evening. Mayor asked if Mr. Raekes was in the audience. (no answer) Carter: He doesn't seem to be in the audience, tell him we asked to hear from him as per his request, but he was not here. At another time or place the council will be glad to listen to him. REGULAR MEETING ' PUBLIC HEARINGS: COUNCIL CHAMBERS PASCO, WASHINGTON PUBLIC HEARING: Rezone from R-2 to C-1 (Chamberlin request) 341.7 NOVEMBER 4, 1964 �. Notice of public hearing was read relative to the rezoning of "The North 100 feet of i! South 461 feet of East Half of Southeast quarter of Southwest quarter of Southeast quarter of Section 24, Township 9, North, Range 29, East W.M., Except East 40 feet thereof for County Roads, Franklin County, State of Washington. II Mayor declared the public hearing open. Asked for comments against the rezoning of the above mentioned property. (none) Asked for comments favoring the rezoning of the property. (Mr. Chamberlin offered to answer any questions that were presented.) ' There were no written protests to the rezoning. -- May6rndeelared the public hearing closed. j Mbtion made by Bailey, seconded by Griggs, that the proper ordinance be prepared to amend the ordinance as requested. PETITIONS, COMPLAINTS, APPEALS, VISITORS: SIDEWALK WAIVER AGREEMENT (Frank & Blaine's Body Shop): 1' This was presented for the council's consideration for the property at 1319 West Ainsworth more specifically -noted as Lots 11 and 12 Block 7 Riverside Addition to Pasco, Washington. i{ After discussion, Motion made by Storklcsecondeddbd Bgtil.ey, that this request for sidewalk waiver agreement be granted. Motion carried, 4� SIDEWALK WAIVER AGREEMENT (Convalescent Homes, Inc.) - This sidewalk waiver agreement was presented by -Mr. Hamilton of Convalescent Homes, Inc. for 2112 22nd Avenue more specifically identified as All of block 1 and -the north 1/2 of Block 2, Swanson's Addition Of Pasco. After discussion, motion made by Greenlee, seconded by Stork, to hold this in abeyance until the .City Engineer and the City Manager can study this waiver request and come back to the City Council with recommendation. Motion carried. i! Mayor invited comments from the visitors in the audience. (none) RESOLUTIONS: .I RESOLUTION NO. 615: A RESOLUTION TRANSFERRING THE SUM OF $1,000.00 from "ASSISTANT CITY ENGINEER, PUBLIC WORKS ADM." i SALARY CATAGORY OF THE CITY ENGINEER DEPARTMENT !I TO "TRAVEL EXPENSE &CONVENTIONS" MAINTENANCE & OPERATION CATAGORY OF ADMINISTRATIVE DEPARTMENT -- BOTH UNDER CURRENT EXPENSE OF THE 1964 BUDGET. jMotion made by Greenlee, seconded by Stork, to read resolution No. 615. TRAVEL AND TRANSPORTATION AND THEIR INCIDENCE UPON THE PUBLIC STREETS, BICYCLE PATHS AND OTHER WAYS OPEN TO THE PUBLIC, PRESCRIBING THE POWERS AND DUTIES OF OFFICERS AND OTHERS IN RELATION THERETO, DEFINING OFFENSES AND PROVIDING PENALTIES. �I Motion made by Greenlee, seconded by Stork, to read Ordinance No. 1164. Motion carried by roll call vote of six (6). 341.8 PASCO, WASHINGTON REGULAR MEETING COUNCIL CHAMBERS NOVEMBER 4, 1964 ORDINANCE NO. 1165: AN ORDINANCE PROVIDING FOR THE ISSUANCE OF $1,100,000.00 PAR VALUE OF "WATER -.AND SEWER REVENUE BONDS, 1964," TO OB- TAIN THE FUNDS WITH WHICH TO PAY THE COST OF CARRYING OUT THE SYSTEM OR PLAN FOR MAKING ADDITIONS TO AND BETTERMENTS AND EXTENSIONS OF THE WATERWORKS UTILITY OF THE CITY OF PASCO, INCLUDING THE SANITARY SEWERAGE SYSTEM AND THE SYSTEM OF STORM OR SURFACE WATER SEWERS AS A PART THEREOF, AS SPECIFIED AND ADOPTED IN ORDINANCE NO. 1145; FIXING.THE DATE, FORM, MATURITIES, MAXIMUM INTEREST RATE, TERMS AND COVENANTS OF SUCH BONDS: AND PROVIDING FOR THE CALLING FOR BIDS FOR THE PURCHASE THEREOF AT PUBLIC SALE.. ORDINANCE NO. 1166: AN ORDINANCE PROVIDING FOR THE ISSUANCE OF AN INSTALLMENT NOTE PAYABLE FROM THE " LOCAL IMPROVEMENT FUND, DISTRICT NO. 67" OF THE CITY TO BE SOLD TO THE FIREMEN'S RELIEF AND PENSION FUND OF THE CITY AS AN I-NMESTMENT- FOR SUCH FUND. Motion carried by roll call vote of six (6). Motion made by Stork, seconded by Greenlee, To terminate the interest on the warrants on October 15, 1964. (L.I.D. No. 67). Motion carried., Motion made by Bailey, seconded by Greenlee, that interest be terminated on warrants, L.I.D. No. 68 on November 5, 1964. Motion carried. OLD BUSINESS: SACAJAWEA PARKING LOT (Hallmark Apartments, Mr. Williams owner): Public hearing was held on this at the previous council meeting, and was tabled until this meeting. Mr. Griggs withdrew from this discussion because of Mr. Williams being a client of his firm. Mr. Bailey: We have had at, least two public hearings on this, and we have listened to discussions of various people on this, I think it's time we settle this one way or the other; and I think that whatever we do it's going to be unsatisfactory to one of ther.iparties involved. I think that this might be a good, possibly a good case to test out, at the proper place by the dissatisfied parties in order to possibly set a precedent if such things can be done for similar ,situations. Mr. Wiseman: I think, too, Mr. Mayor, that the entire opinion relies within the province of your thinking of what is best, as we said before, health, welfare and safety of that area;and lawyers can set their ideas, upon which side they are representing, Ihthink it comes down the point where indi- vidual councilmen have to take an opinion in their best judgement. And, consequently, I was the one who originated the motion that we grant (permit) application for parking privileges on Yakima Street and at this time I will make my motion again: Motion made by Wiseman, seconded by Stork, that we grant the application for a parking facility on Yakima Street. Motion carried by roll call vote of 3 -yes; (Z -No; 1 -absent and 1 -abstained by with- drawing from the discussion before the motion was made. Campbell said the motion passed, there being a quorum and the quorum can act for the council. There were five people voting and the vote being 3-2; in his opinion the motion passed. NEW BUSINESS: NORTHERN PACIFIC PERMIT AGREEMENT APPLICATION: Northern Pacific have executed this agreement (permit agreement to authorize the City to establish crossings under two of their railroad tracks) Ainsworth and S. Fourth. Purpose of this permit is to allow installation of the 48" storm sewer. Cost of permit agreement $35.00. Motion made.by Bailey eeecondedebybWisemany, that the Mayor be authorized to execute the agreement on behalf of the City ;and pay the $35.00 permit fee. Motion carried by roll call vote of six (6). STORM SEWER CONTRACT: Contracts were presented for the storm sewer job, (bid openings held October 20, 1964). These have been checked by the C©nsult.Engineer; executed by the Contractor; now await the execution by the City. 1 to be returned to the Contractor. (Schedule 1 and -2). Motion made by Greenlee, seconded by Bailey, that the Mayor be authorized to execute these contract documents. Motion carried. REGULAR MEETING BUSINESS LICENSES: PASCO, WASHINGTON COUNCIL CHAMBERS Business license applications were read as follows: HAND SHOE REPAIR 216 West Leui s Pawn shop Ray R. Hand NOVEMBER 4, 1964 LORD ELECTRIC CO. 1305 Mansfield; Electrical contractor Richland, Wn. Motion made by -Greenlee, seconded*by Bailey, to hold the application of Hand Shoe Repair (pawn shop) in abeyance until the City Council has a report from the Chief of Police. Motion carried. Motion made by Greenlee, seconded by Bailey, that the other license be granted. Motion carried. " MISCELLANEOUS: ;{ Mr. Griggs questioned as to whether or not arrangements have been made for inspections on the �! Storm sewer project.by city personnel. 'Manager<<:,co said that provisions have been made for e4 loying local help in the initial portion of the work probram; and for the contractor to use local help khere necessary and feasible. i Mr. Greenlee requests a tabulation, map etc in connection with the outstanding sidewalk waiver agreements (Fisher and Clerk to furnish the City Council this information if approved by City Manager). BID TABULATION REPORT: On Pumps: The low bid was Western Materials, in the amount of $3,507.16 including the tax; furnish- 'I ing equipment and installation time - 60 days, to furnish 6x5 TSI single stage Allis Chalmers Pump i motor, control panels - meets specifications.' kecommend accepting the low bid. I On Pipe: There were eight (8) bids submitted (7 were listed previously in the minutes as having been read, however there was one from Tri -Co Electric Co'. which was enclosed with their pump bid for $3,278.18) The low bid was Consolidated Supply Company of Spokane who.have-indicated 15 day delivery on material 13' lengths; price bid identical, base bid and alternate - recommend the base bid be accepted together with fittings and tax bid in amount of $2,473.62. Motion made by Griggs, seconded by Bailey, that the low bid of Western Materials for the pump be �# accepted.
