REGULAR MEETING COUNCIL CHAMBERS SEPTEMBER 3, 1963
CALL TO ORDER:
Meeting called to order by the Honorable Ed Hendler, Mayor Pro -Tem, at 8:04 P.M.
ROLL CALL:
By Clerk's representative. Councilmen present were as follows: G. E. Carter, L. R. Diemond, Ed Hendler,
H. C. James, Chas. D. Kilbury, and Allen D. Stanley. T. R. VanHoy, Mayor, was absent, Councilman Greenlee
arrived at 8:07 P.M. D. Wayne Campbell, City Attorney and George R. Fisher, City Engineer -Supervisor were
also present.
APPROVING MINUTES:
Motion made by Kilbury, seconded by James, that the minutes of the meeting of August 20, 1963 be approved
as written. Motion carried unanimous.
BILLS:
Bills against the City were presented as follows:

Motion made by James, seconded by Stanley, that all bills properly signed and approved be paid. Motion
carried by roll call vote of six (6). [Greenlee being absent at this time.]
COMMUNICATIONS:
DEPARTMENT OF COMMERCE & ECONOMIC DEVELOPMENT (H.H.F.A.):
This letter was dated August 21, 1963, signed by Robert E. Rose, Director. Pasco's application for an
Urban Planning Assistance grant has been approved. (H.H.F.A.) Procedures for getting Pasco's program
under way will be sent by this department within a few days. N/A
DEPARTMENT OF HIGHWAYS: Right -Of -Way:
Letter dated September 3, 1963, signed by W. E. Schussler, Right -Of -Way Agent, P. 0. Box 52, Yakima,
Washington: Attached to this letter was a warranty deed and voucher form for the consideration of the
City of Pasco. (Voucher coversaadditional right-of-way required for the improvement of PSH No. 3 where
same runs along the southerly side of the existing golf course. Involves 7.30 acres of land and the re-
location of certain improvements -- State had this appraised, and offers the City of Pasco $16,570.00.
Motion made by James, seconded by Diemond, that this matter be turned to the Council as a whole for re-
consideration and study. Motion carried, unanimous.
CHANGE OF NAME ON BUSINESS LICENSE (McMullen):
In his letter, Mr. McMullen requests permission to change name from: "Appliance & Refrigeration Service"
-- 3rd and Clark Street, Pasco to: "TRI CITY APPLIANCE SALES & SERVICE" -- 218 W. Lewis Street, Pasco,
Washington. Motion made by Kilbury, seconded by Carter, that this be approved -- the City Clerk's office
to grant the request, subject to any additional fee for square footage if this be necessary. Motion
carried, unanimous.
MARY CARPENTER, CITY TREASURER: L.I.D. No. 66 INSTALLMENT NOTE:
This letter dated August 21, 1963, signed by Mary Carpenter: "The City Finance Committee approves and
recommends the purchase of the Local Improvement District No. 66 installment note in the amount of
$40,131.13, by the Firemen's Pension Fund." -- This will come up later under ordinances - this meeting.

C. F. WHETSLER, WATER SUPERINTENDENT: MEETING, SEPTEMBER 16, 17 & 189 1963:
Letter dated September 3, 1963: Very concerned about attending this meeting. "I would at this time like
+: to take vacation to enable me to fulfill my previous commitments and attend the short school." [attached
was program: "Water Works School Staff - C. F. Whetsler, Water & Sewer Supt. Water Department
P. 0. Box 293, Pasco, Washington.]
Motion made by Stanley, seconded by James, that the council concur with this request, as recommended
by Mayor Pro -Tem. Motion carried unanimous.
C. F..WHETSLER, WATER SUPERINTENDENT: P.N.W. Section A.W.W. Trustees Conference October 25 & 26, 1963
in Portland, Oregon.
As program chairman for the 1964 conference to be held in Spokane, May 6, 7, 8th, I have to report the
outline of program to the board of Trustees, and will also report for the local area meeting of which I
am Chairman. City transportation requested. Letter from Hendler approving this request also read.
Motion made by Stanley, seconded by Carter, that the Council concur with the request, and the recommenda-
tion of Mayor Pro -Tem. Motion carried, unanimous.

PUBLIC HEARINGS:
PUBLIC HEARING -- REZONE LOTS 11 thru 20 INCLUSIVE, BLOCK 7, RIVERSIDE ADDN. TO PASCO AND BLOCK 99
RIVERSIDE ADDITION -- R1 to M-1:
Mayor Pro -Tem declared the Public Hearing open.
Fisher read the Notice of Public Hearing. Comments were requested.from anyone wishing to speak in
favor of the rezoning -- none. Comments were requested from anyone wishing to speak in opposition
to this zone change. -- none. No protests were received in writing.
Mayor Pro -Tem declared the Public Hearing closed.
This will come up later under ordinances (Ordinance No. 1122).
VISITORS:
Mayor Pro -Tem Hendler invited comments from the audience.
MR. ARTHUR C. DE WITT addressed the council, and requested permission to read a letter which he
stated Ne 5ad sent to the Mayor and (permission granted) he read.the-following:
"To the Pasco Mayor and City Council:
Sir, as a citizen and an editor, I wish to state my position as regards the east Pasco situation. For
six weeks my news sheet 'Tri -Cities Today' has carried comments on sordid conditions existing in east
Pasco. It is a matter of Police Department record, that I appealed to the Attorney General for out-
side help. I take particular exception to Prosecutor Rabideau's statement that.a short-staffed Police
force was partly responsible. I believe that Mr. Rabideau is subject to further examination. It is
my thought that the heads of the Pasco Police Department, Chief McKibbin and Captain Sickels, are pri-
marily responsible -- and I believe it's the duty of today's city council to ask for resignations from
Chief McKibbin and Captain Sickels at once. Thank you. -- Arthur C. DeWitt" (discussion followed)
Hendler states he has not received his letter. Mayor's letter received, not opened, addressed to Mr.
VanHoy.
WAYNE CAMPBELL, City Attorney suggested that he report on the matter that was turned to him on the
evening g of August 20, 1963 at the regular council meeting of that date, following a complaint from
Mr. E. M. MAGEE with reference to Mr. Arthur C. DeWitt and his publication "Tri -Cities Today."
Both Mr. Magee and Mr. DeWitt being in the audience at this time] Mr. Campbell reported that he had
made extensive research of the City Ordinances, and could find nothing in them to indicate that Mr.
DeWitt had violated any of the City Ordinances. If anyone has any personal action against Mr. DeWitt,
it should be their duty to carry it out according to the provisions and the opportunities that are
afforded them by law. There is nothing he (Mr. DeWitt) has violated as far as the city is concerned.
EAST PASCO RAID 8-31-63:
A. L. McKIBBIN, Chief of Police, spoke and requested permission to read into the record a letter
signed by the Mayor Pro -Tem relating to the matter of the raid which occurred on the East Side of
Pasco on the night of August 31, 1963. Permission was granted, by the Mayor Pro -Tem, for Chief McKibbin
to read:
"(This is a copy of the letter which was written to the Prosecuting Attorney, Mr. C. J.
Rabideau, 117 S. Third and dated August 31, 1963.)
"Dear Mr. Rabideau: This is your authority to appoint as many deputies as you may require
in the function of your office. It is further understood that you may require the services of
our Pasco Police Department both on duty and off; therefore, this letter upon presentation to
any police officer, on or off duty, is a directive to cooperate with you and at your direction.
Sincerely, Ed Hendler, Mayor Pro -Tem"
(discus§ion was held) Mayor Pro -Tem Ed Hendler read a statement for the record in this same reference,
(raid of 8-31-63):
"We, the Pasco City Council, the Franklin County Prosecuting Attorney, feel it should be
clarified that all innuendo, rumors, and other speculations currently being published by
news media to the effect that Chief McKibbin or any other member of the Pasco Police De-
partment, is suspect or not trusted and thus was not notified in advance of the raid con-
ducted by the forces from the Attorney General's Office is entirely false. There is no evi-
dence in the possession of either the City Council or the Office of the Prosecuting Attorney
to in any way cast suspicion upon these individuals. Full information as to the results of the
raid, available at this time, has been disclosed to the news media and any further information
will be released at such time as the investigation is completed. In the mean time, the
specu-lative charges being published are only needlessly harming all concerned."
N.A.A.C.P. COMPLAINT:
MR. MAGEE made the statement that there were no negroes employed by the City. Mr. Hendler answered
him- That in the City of Pasco there are certain requirements which must be met as to education,
job qualification, physical abilities, etc. Anyone - regardless of race, creed, or color who meets
those specifications will be hired to fill a need. There is nothing in our application that asks a
man what color he is, or what religion he is. Also, Mr. Hendler pointed out that he had personally
suggested to some of the people on the East side who happen to be colored to make application at the
City, and this has not been done. He pointed out to Mr. Magee that it was unfair to try to label the
City "prejudice" when we have done everything in our power, to improve the standards of your people
and will continue to do so. This publicity which we're now getting is of absolutely no help.
MR. PRUITT: spoke. He indicated that he had resided in Pasco for 15 - 16 years. Last year in Septem-
ber he was laid -off after working for the water department for a year and six months, and that he had
not been hired back - and he doesn't know why. (discussion)
MR. STANLEY: Councilman, said that there are certain peak -periods of employment in the Water Depart-
ment, the summer months being the busy months - when the activity of the water department starts to
taper off there are quite a few people in the same (unemployed) position. Mr. Pruitt said he would
leave his address to enable the Mayor Pro -Tem to let him know more about his lay-off etc.
PASCO, WASHINGTON
EAST PASCO RAID (8-31-63) AND MATTERS PERTAINING THERETO:
Discussion was held on this entire matter, and those who entered into the conversation were as follows:
Arthur C. DeWitt, Ed Hendler, Wayne Campbell, E. M. Magee, Chief McKibbin, H. C. James,_ A. D. Stanley,
Bob Young, R. E. Greenlee, Jim Hughes, Pugnetti, Ken Hutton, Mrs. Cloy and Mr. Wherry. (in'a round-
table -type discussion.)
ROAD 28 & HIGHWAY:
BRUCE LEE states this is a very dangerous corner, and requests that aid be sought from the.Highway
Department to eliminate some of this danger. He was informed that the Highway Department has been
working on this and it will be taken care of soon.
(CLAIMS AGAINST THE CITY:
DWIGHT M. LEDFORD: Has submitted a claim, which Mr. Fisher read to the council. While traveling east
on Lewis Street, about 10:30 P.M. on August 5, while under the overpass, he struck a box filled with con-
crete blocks, causing damage to the front end of his automobile. Due to poor light this box was not
visible. The claim was filed with the Clerk on the 29th of August. Mr. Ledford has not filed a report
at the Police Department. The amount of claim is $14.00. Motion made by Kilbury, seconded by Stanley,
that this be turned to the Finance and Special Claims committee of the council Motion carried unanimous.
DAVE BUTCHER CLAIM: Had been turned to the City Attorney at last meeting for his recommendation. At this
time,, Mr. Campbell recommended that this claim be denied. Motion made by James, seconded by Kilbury,
that this claim be denied. Motion carried unanimous. (Clerk's office to write Mr. Butbher to this effect)
IREPORTS FROM COMMITTEES:
KILBURY: (Claims, Finance):
OFFICE STUDY: The Committee has studied the recommendations and proposals of the two consultant firms
and as decided at this time we should not take advantage of either offer.
KIWANIS CLUB: ICE VOGUES: Relative to the Ice Vogues being held at this time -- this being held speci-
fically for the purpose of benefit of all of Pasco (improving the stadium) - Motion made by Kilbury, set-.-,
conded by James, that the license and admission taxes on this be waived. Motion carried by roll call
vote of six (6). Hendler abstained.
JAMES;, (Planning-, Legislative, Building):
ASSOCIATION OF WASHINGTON CITIES: On October 4, 1963, 7:30 P.M. at Richland (Desert Inn) the City
of Ric land.an IM Mayor will ost the 16th Legislative District meeting of the A.W.C. Councilmen
to keep this in mind and plan to attend.
GREENLEE.:. (Fire Light):
PURCHASES: Requests to purchase were read as follows: Water Department: angle meter valve iron pipe
& meter flange (12) $284.13. Motion made by Greenlee, seconded 3Jy Carter, that these be approved.
Motion carried unanimous, no "no" votes.
STANLEY: .(Sewer Water):
F. C.I.D.•
The F.C.I.D. is still working on the counter -proposal to our request from the last report.
P.U.D. &.WATER COMMITTEE (Haystad refund):
The P.U.D. and Water Committee was to have set a meeting with the PUD Attorney, and the City Attorney
relative to the Haystad refund matter presented 8-20-63. Mr. Hudlow of the P.U.D. being out of town,
this has been impossible. During the week of 9-9-63 this will take place.
H.H.F.A.:
Mr. Whetsler has received a letter from Cornell, Howland, Hayes & Merryfield relative to the H.H.F.A.
relative to the application for the sewer planning. HHFA advises CHHM that they have received all infor-
mation and have completed their review and are writing a summary of the application preparatory to for-
warding same to Washington, D.D. for final approval.

Re: Grey & Osborne Engineering Study, September 10, 1963 at 7:30 P.M. in the Committee room, the
Council as a whole will meet with Mr. Grey and this will be studied carefully. At this same time,
the Committee (Council as a whole) will discuss the Maitland Street matter.

R. B. LOVELACE BUILDING INSPECTOR: submitted a report -of the activities of the Building Inspector's
Offiee or the month of August 1963:
55 permits issued, total valuation $345,206.00 (one commercial $239,400.00); Fees collected in the
amount of $990.13 (this includes building permits, gas installations, plumbing installations and
fitter's license renewal and exam.) Total building valuation -to date this year: $1,796,449.00
Total fees collected to date this.year: 70243.63
1964 PROPOSED BUDGET FOR CITY OF PASCO (with Mayor's recommendation) was submitted to each councilman.

ORDINANCE NO. 1121:
AN ORDINANCE PROVIDING FOR THE ISSUANCE OF AN INSTALLMENT NOTE PAYABLE
FROM THE "LOCAL IMPROVEMENT FUND, DISTRICT NO. 66" OF THE.CITY TO BE
EXCHANGED FOR THE REVENUE WARRANTS PAYABLE FROM THAT FUND NOW .HELD BY
THE FIREMEN'S RELIEF AND PENSION FUND.

ORDINANCE NO. 1123:
AN ORDINANCE ESTABLISHING TEMPORARY REGISTRATION FACILITIES, PROVIDING
FOR THE APPOINTMENT OF DEPUTY REGISTRARS AND INSTRUCTION IN REGISTRATION
PROCEDURE AND PROVIDING PENALTIES FOR FRAUDULENTLY REGISTERING UNQUALIFIED
PERSONS, AND REPEALING ORDINANCE NO. 1003 BEING AN ORDINANCE PROVIDING FOR
ADDITIONAL TEMPORARY REGISTRATION FACILITIES IN ACCORDANCE WITH THE PRO-
VISIONS OF R.C.W. 29.07.105.
Motion made by Kilbury, seconded by Diemond, that Ordinance No. 1123 be read by.title only. Motion

Ordinance No. 1123 has been read by title only. Motion carried. Discussion follows. Hendler, as
councilman requested that Ordinance No. 1123 be read in its entirety. This was done.
Motion made by Kilbury, seconded by Carter, to adopt Ordinance No. 1123. Motion carried by roll call
vote of six - "yes" 1 - "no" -- Hendler voting "no".
RESOLUTIONS:
RESOLUTION NO. 553:
RESOLUTION APPROVING APPLICATION FOR PRELIMINARY LOAN FOR LOW -RENT PUBLIC HOUSING AND APPROVING
THE FORM OF COOPERATION AGREEMENT BETWEEN THE CITY OF PASCO, WASHINGTON, AND THE HOUSING AUTHORITY
OF THE CITY OF PASCO, WASHINGTON AND AUTHORIZING ITS EXECUTION.
Motion made by James, seconded by Diemond, that Resolution No. 553 be read. Motion carried. Resolution
No. 553 was read in its entirety. Motion made by James, secondedbby Diemond, that Resolution No. 553
has been read. Motion carried. Motion made by James, seconded by Diemond, to adopt Resolution No. 553.
Motion carried by roll call vote of seven (7).
NEW BUSINESS:
1964 PROPOSED BUDGET: Motion made by Kilbury, seconded by James, that the Council as a whole meet
as committee on the 9th of September, 7:30 P.M. to start work on the 1964 budget. Motion carried
unanimous.
ADJOURNMENT:
Motion made by James, seconded by Diemond, to adjourn to ext r ular �ouncil meeting date September 17,
