Meeting called to order at 8:00 P.M. DST by Honorable T. R. Van Hoy, Mayor.
ROLL CALL:
By Clerk's representative. Councilmen present were: G. E. Carter; L. R. Diemond, Ed Hendler,
H. C. James, Chas. D. Kilbury, and Allen D. Stanley. City.Attorney D. Wayne Campbell and'City

APPROVAL OF MINUTES:
Motion made by James, seconded by Kilbury that minutes of meeting held July 2, 1963, be approved
as written. (Pages 3247 thru 3251 of Minute Book 13.)
COMMUNICATIONS:
WASHINGTON STATE POLLUTION CONTROL COMMISSION

Letter of July 15, 1963 from Charles R. Ogden, District Engineer, requesting the City undertake an
immediate study on methods of complete separation of the storm and sanitary sewers, and that they be
informed of the Council's action on the problem. Motion made by Hendler, seconded by Carter that a
letter be written to the Washington State Pollution Control Commission by the City Clerk informing
them of the concern of the City of Pasco over this problem for many years, and that we have and are
currently working on a solution and I further move that a copy of this letter be sent to Mr. W. M.
Foster; who is the District Engineer of the State Highway Department, indicating that -this problem.
is becoming acute and we would like to have hiss response as to what he intends to do with his
streets that are now located within the City of Pasco.. Motion carried.
WASHINGTON STATE HIGHWAY COMMISSION REGARDING REVISED & EXTENDED COMPREHENSIVE
STREET PROGRAM
Letter of July 15, 1963 from L. H. Mackey, District State Aid Engineer, reminding all City Engineers
or:City Clerks they are required after public hearing to.adopt a revised and extended comprehensive
street program, and to file two copies with them. Motion made by Hendler, seconded by Stanley to
turn this matter to the Street Committee. Motion carried.
REGIONAL PLANNING COMMISSION
Letter from George Plescher, Director Franklin County Regional Planning Commission July 15, 1963,
recommending that request for further assistance on establishing citizen organization be delayed
until after the workable program has been adopted. Motion made by Kilbury, seconded by Hendler
requesting the letter which was requested at the last Council Meeting be sent as quickly as
possible. Motion carried.
CITY CLERK HAD AGREEMENT LEASE RECORDED
Letter of July 12, 1963 stating agreement between the City of Pasco and Charles G. and Frankie L.
Grigg relative to sewer line in Block 2, Pettit's Addition has been recorded in records of Franklin
County, Volume 117, Page 236, of Deeds, June 26, 1963.
CITY PLANNING COMMISSION REQUESTS ORDINANCE 953 AMENDMENT
Letter of July 12, 1963 requesting City Council to amend Ordinance 953, Section 2, permitting the
Council and Commission to grant variances.
KIWANIS CLUB OF PASCO EXEMPTION OF ADMISSION TAX REQUEST
Letter of July 15, 1963 read requesting exemption of City Admission Tax for Kiwanis sponsored Ice
Revue at Edgar Brown Stadium, September 1, 2, 3, 4, 1963. Money received to be used for youth work
and the development of public facilities in Pasco. Motion made by. Kilbury, seconded by James that
no City Tax be charged for this activity. Motion carried.
AMERICAN LEGION U.N. FLAG
Letter of July 11, 1963 read with attached resolution, requesting the City to deny the privilege to
any party or organization who petitions the City.to fly the U.N. flag during U.N. week. (October 24,
1963). -No action taken.
PASCO CHAMBER OF COMMERCE
Letter of July 12, 1963 read requesting the City to allow free parking during the annual Pasco Crazy
Daze promotion, July 19, 1963. Retail organization of the Chamber of Commerce to reimburse the City
a sum not to exceed $50.00 to replace the revenue from the meters for this time. Motion made by
Carter, seconded by Kilbury that the proposal of the Chamber of Commerce be accepted. Motion carried.
D. WAYNE CAMPBELL LEGAL PUBLICATIONS
Letter from City Attorney D. Wayne Campbell, read regarding legal publications. Dee to the fact that
many of our ordinances and other legal notices require timely publication before they have legal effect,
it is the opinion of the City Attorney that publication of ordinances cannot be held up due to,the
failure of the Columbia Basin News.
I.' On advice from the City Attorney, the Mayor should inform the Tri -City Herald that we wish
to engage their services for legal publications due to the failure of the Columbia Basin
News.
2.- We should publish immediately any ordinances, etc., which we now have ready for publication.
3. The Council, by motion, at its next meeting, should ratify the Mayor's act and the minutes
should so state.
Motion made by Hendler, seconded by Carter to ratify the Mayor's actions. Motion carried.
Request -by Hendler that we immediately write to the Tri -City Herald and request that they give us a
letter of confirmation pertaining to the bid prices that were presented to the City last December,
and to concur with those prices for the balance of the year. Mayor Van Hoy stated that has already
been done, verbally.

pertaining to road sign at Road 28 and Highway 410. Motion made by Kilbury, seconded by Stanley to

WASHINGTON STATE HIGHWAY COMMISSION
Letter of transmittal July 9, 1963 from David P. Swanson, District Location Engineer read regarding
one fully executed copy of Agreement Nos. GC -143-X and GM -315-X, which concerns the maintenance of
certain facilities to be constructed in conjunction with the Pasco By -Pass.

Letter of July 12, 1963 from Holly Cornell to C. F. Whetsler regardinng procedure to be followed for
HHFA application for Sewer Planning Advance. Motion made by Hendler, seconded by Carter that the nec-
essary agreements and papers that have been submitted, be signed by the Mayor and attested by the
City Clerk for application to the HHFA for Sewer Planning Advances. Motion carried by roll call vote
of six (6) .
CITY CLERK REGARDING JAMES HINSON REFUND
Letter from Adah M. Perry, City Clerk with Treasurer's receipt attached, requesting refund of $15.00
i. paid by James Hinson for Business License, as Health Department has denied permit. Motion made by
Hendler, seconded by Carter to approve request. Motion carried by roll call vote of six (�).
C. F. WHETSLER WATER SUPERINTENDENT PERMISSION TO SELL SCRAP
Letter of July 16, 1963 requesting permission to sell approximately 600 pounds of brass fittings and
meter repair parts as scrap. Motion made by Kilbury, seconded by James that Mr. Whetsler's request
�. be granted with the assumption that the scrap is valued at less than $200.00. Motion made by Hendler,
seconded by James to amend the above motion with the provision that prices be secured from two or more
dealers to ascertain the value before sale. Motion on the amendment carried. Mayor placed vote
on the original motion as amended. Motion carried.
C. F. WHETSLER, WATER SUPERINTENDENT EDWARD JACKSON REFUND
Letter of July 16, 1963 read requesting authorization for the City Treasuree to refund $88.00 to Mr.
Edward Jackson, 630 S. Oregon, Pasco, Washington. $88.00 constitutes a duplicate payment for water
front footage assessments on Lots 3 and 4 of.Block 11, Kurtzmans Park Addition. Motion made by
Kilbury, seconded by James that refund be granted. Motion carried by roll call vote of six.(6).
PARK BOARD REGARDING FREE PLAY AT GOLF COURSE
Letter of July 15, 1963 recommending the following policy in regard to free play at the Pasco
Municipal Golf Course:
1. No free play except for Golf Pro. and Head Greenskeeper.
2. Visiting VIPs by arrangement with the Golf Pro., would be
granted free play.
3. School District would be allowed free play as part of the school physical education
program or golf team. The City has a reciprocal agreement with the school district for
the use of school facilities.
Motion made by Hendler, seconded by Kilbury that this be turned to the Park and Recreation Committee
of the Council for consideration and recommendation. Motion carried.
PUBLIC HEARINGS:
VACATION OF THE OUTSIDE 10 FEET OF BOTH SIDES OF ILLINOIS STREET FROM BONNEVILLE TO SYLVESTER II
Notice of Public Hearing was read. Mayor declared the Public Hearing open. No objections were
submitted by writing, or from the audience. James Tolman spoke in favor of vacation, also Art
Illian and a Mr. Fulwyler. Mayor declared Public Hearing to be closed. Motion made by Kilbury,
seconded by Stanley that the attorney be instructed to draw up a resolution vacating the east and
west 10 feet of Illinois Avenue, the necessary fees for recording title, to be charged to the property
owners, receiving title to the property. Motion carried by roll call vote of six (6).
HEARINGS OF PETITIONS,.APPEALS, COMPLAINTS, VISITORS:
COMPLAINT FROM DEWITT
Mayor Van Hoy reported on complaint received from a man named Dewitt, who said we were misusing
taxpayers funds to have the Fire Department water the shrubs, which have been placed on the sidewalks.
Mayor reported he was sorry he had been wasteful in having three Firemen water the shrubs and will
try to do better the next time.
Mayor Van Hoy reported after a talk with Sid Carl, Mr. Carl would take the matter of watering the
street shrubbery up with the Chamberof Commerce, the business men and see if they wouldn't take care
of the shrubs.
COMPLAINT CARTER
Carter requested the Chief of Police to watch S. 9th St. more carefully in regard to wheat trucks
using it as a regular thoroughfare, going and coming and it is not a truck route.
HENDLER JOE BAILEY
Hendler advised Mr. Joe Bailey that he might go to the Planning Commission and ask for variance for
a fence between property, providing he get permission of his neighbor. Motion made by Kilbury,
seconded by Stanley to turn the matter to the'City Attorney for study and recommendation. Motion
carried. City Attorney rendered his legal opinion as "Yeah", provided he comply with that ordinance.

COMPLAINT
6COMPLAINT BY JOE BAILEY
Mr. Bailey complained of garbage being burned in the neighborhood, and requested proper procedure to
be followed. Mr. Bailey was advised to speak with his neighbor, asking him to refrain from burning
garbage, and that failing, he would have to sign a complaint.
DAVID ROSSI
Inquired as to what action had.been taken at the last council meeting in regard to the Lewis Addition.
Irrigation. The Chairman of the Irrigation District advised Mayor Van Hoy that their attorney was out
of town, -on vacation at this time,. and for this reason no further action has:been taken at'this time.
Meeting to be set up as soon as FCID Attorney returns.
REPORTS FROM COMMITTEES:
KILBURY RELEASE OF ALL CLAIMS CLARENCE ALVIS
Motion made by Kilbury, seconded by Stanley to accept $141.57 as the amount of the damage. Motion
carried. Motion made by Kilbury, seconded by James to further move that the Mayor be authorized to
sign upon receipt of the check in the amount of $141.57. Motion carried.
OFFICE STUDY
Booz, Allen & Hamilton has submitted a prospectus, no action taken until Griffin, Hagen & Kmoeger have
also submitted a prospectus --this is the recommendation of the Committee.
REPORT OF THE FIREMEN'S PENSION BOARD ACTUARIAL REPORT VOUCHER $315.00
Motion carried authorizing Chairman to sign voucher presented by Mil,liman and Robertson, Inc., for
making report. Voucher signed and placed in line for payment. Ten copies of the report.were received,
one retained by the Pension Board. One copy to the Fire Department.
FIREMEN'S PENSION BOARD INTENT TO PURCHASE LID NO. 66 BONDS
Motion carried expressing the intent of the Pension Board to purchase all of the LID No. 66 Bonds.
Secretary to write the Association of Washington Cities, relative to the Pension Board purchasing Pasco
LID bonds from the Pension Fund.
LEONARD J. NEWELL CLAIM
Recommendation of the Committee to deny $98.00 claim. Motion by Kilbury, seconded by Hendler that the
Committee recommendation be approve. Motion carried by vote of five to one, Stanley voting "No".

PLANNING COMMISSION
Has set Public.Hearing on the Comprehensive Plan for July 23, 1963, and the Council acceptance of the
of the Comprehensive Plan will follow the Public Hearing set by the Planning Commission and their
approval and recommendation of the Comprehensive Plan.
GAS CODE CHANGES
Ordinance:1112 to come up later in the meeting.
KILBURY USED CAR BODIES
Request from Thomas B. Jackson that the City determine a place for used car bodies. East Pasco
Improvement Association would like to remove these old car bodies. Motion made by-Kilbury, seconded
by Stanley that this matter be turned to Planning Committee for study and recommendation at the next
regular meeting. Motion carried.

Motion made by Carter; seconded by Kilbury to accept this application. Motion carried.
Motion made by Hendler, seconded by Carter that the license that has just been granted to.the Fraternal
Order of Eagles for $125.00 be rescinded and a new request be made for a full years license. Motion
carried.
Request by Carter that City Clerk and Police Chief determine whether or not trade stimulators have been
used in the FOE prior to July 3, of this year.

Motion made by Kilbury, seconded by Carter that the City Attorney be instructed to draw up.an ordinance
making Third Avenue from Columbia to the junction of Fourth, one way north bound; and Fourth Avenue
from Columbia to the junction with Third Avenue south bound, effective September']. Discussion followed,
Carter withdrawing his second.

Greenlee called meeting of the Fire & Light Committee, for July 17, 1963, at 7:30 P.M. DST.
STANLEY WATER COMMITTEE
Letter of July 16, from C. F. Whetsler, Water Superintendent, requesting permission to attend Water
Works Certification meeting in Spokane, July 24, 1963 and also on July 25, 1963 there is to be a meeting
of the program chairman and the local arrangements group for the PNWS meeting to be held in Spokane
next May. Mr. Whetsler is the Program Chairman for the 1964 meeting. City transportation is requested,
which has been allowed for in the present budget. Motion made by Stanley, seconded by James that this
request be granted. Motion carried..
HENDLER RESERVED PARKING AT CITY HALL
Discussion was held pertaining to the setting aside of three or four parking areas directly in front of
City Hall or in the City Hall parking area at the west side of the building. This is to accomodate the
citizens who must use City parking meters in order to transact business with the City. Motion made.by
Stanley, seconded by James to turn.this to the Police Committee. Motion carried. Kilbury voting "No".
Motion made by Kilbury, seconded by Hendler to remove the matter from committee and take it up now.
Motion carried. Two (2) voting "No". Motion made by Kilbury, seconded by Hendler that three parking
spaces in front of City Hall be reserved for customer parking for ten minutes only. Motion carried.
Diemond voting "No".
PUD AGREEMENT
Motion made by Stanley, seconded by James that we ratify the Mayor's signature with the PUD Agreement
for furnishing water to the Riverview District. Motion carried.
DIEMOND STREETS
Ninth and A grading problem, committee still working on problem, nothing to report. Oregon -Street By -Pas
committee feels this be discussed with the.Highway District Engineer at the same time we discuss the
storm drainage for the City and the Road 28 By -Pass problem. Street Committee meeting called by Diemond
for July 22, 1963 at 8:30 P.M., DST. Street Committee has right of way for Maitland Street truck route.
Street Department is working on routing. Street Committee is also working on the location -for our Street
Department.
HENDLER PARKS, LIBRARY, CEMETERY
Hendler reported for the Park Board on the availability of property for a new City Park on North Lucas,
south of the By -Pass, which they call Tract "B", and also of six lots east of Lucas St., and south of the
highway. The Park Board recommended that this property be secured for a park site, playgraund area site.
The Park and Recreation committee concurred with their findings, and according to the realator in questio
he has submitted a formal price of this property which amounted to $14,662.50, for the property in
question. I negotiated with the realator and got a firm committment from him for both properties for
$13,400.00. The committee also recommends that the GOB be issued by Council action for the total sum of
$20,000.00 and of this $20,000,00,$13,400.00 be allocated toward the purchase price of the property and
the balance of $6,000.00 be used for that property development as a park. Motion made by Hendler,
seconded by Carter that the Council authorize the Mayor to hire the firm of Roberts, Shefelman, Gay and
Moch to draw up the necessary prospectus, ordinances and other legal material to effectuate the issuance
of a General Obligation -Bond in the amount of $20,000.00 for two purposes cited. Motion carried.
Motion made by Hendler, seconded by Greenlee to curb the triangle of land east of Sylvester Park at a
cost of approximately $600.00. Motion carried.
Motion made by Hendler, seconded by James that the additional $900.00 that is currently in the Street
Department fund be allowed for the curbing development around Memorial Park Swimming Pool. Motion
carried. Motion made by Hendler, seconded by Carter to send Mr. Anthony a copy of the Park Committee's
recommendation for theproperty that was proposed for City Park by him. Motion carried.
Motion made by James, seconded by Kilbury for the Mayor to write a letter to the Kiwanians thanking
them for the covered bleachers they have put at the Swimming Pool. Motion carried.
Hendler set Committee Meeting for the Park and Recreation Committee for July 25, 1963 at 7:30 P.M. DST.
Carter called a Police Committee Meeting immediately following thePark meeting of the same night.
