REGULAR MEETING COUNCIL CHAMBERS JUNE 4, 1963
CALL TO ORDER:
Meeting called to order at 8:00 P.M. by Honorable T. R. VanHoy, Mayor.

Kilbury and Allen D. Stanley-. Councilmen L. R. Diemond and R. L. Greenlee were absent at time of roll
call. D. Wayne Campbell, City Attorney and George R. Fisher, City Supervisor -Engineer were present.
Councilman Greenlee arrived at 8:03.
APPROVAL OF MINUTES:
Motion made by James, seconded by Hendler, that the minutes of the meeting held May 21, 1963 be
approved. Motion carried.

"* * * State Highway Commission authorized the issuance of Permit No. U5-220 to the City of Pasco to
construct, operate and maintain a temporary sewer line crossing on the referenced section of highway
at Highway Engineer's Station A4+57."
Enclosed were original and three copies of the permit, requesting that all signed copies be mailed to
Yakima Office of State Highway Commission for execution. (fully executed original will be returned to
the City of Pasco) Also attached, was their receipt No. E3008 for the $10.00 basic overhead fee re-
ceived by City Warrant No. 3469.
Motion made by Hendler, seconded by James, that the Mayor be authorized to sign. Motion carried.
FEDERAL AVIATION AGENCY -- WESTERN REGION (P. 0. Box 90007 Airport Station, Los Angeles, 9, California
dated May 17, 1963)

Dear Mayor VanHoy:
There is enclosed a fully executed instrument of release on land which was conveyed to the City of Pasco,
Washington, as a part of the Pasco Municipal Airport and which is presently being used for municipal
golf course purposes by the City of Pasco.
The tender of this release constitutes consent by the Federal Aviation Agency to the transfer of the
remainder of the airport to the Port of Pasco, Washington, subject to the terms, conditions, restric-
tions and reservations of the original instruments of transfer.
The City of Pasco is also relieved of all obligations, in connection with the Pasco Municipal Airport,
created by those Grant Agreements between the United States and the City of Pasco identified as:
Project No. 9-45-060-5701 accepted on June 27, 1957
Project No. 9-45-060-5902 accepted on August 5, 1958
Project No. 9-45-060-6103 accepted on May 2, 1961
with the exception of certain portions of the water and sewer systems and related easements which the
City will retain.
The Conditions imposed in the release will require some revisions in the proposed transfer agreement
presented as a part of your request but should present no great difficulty.
As soon as the pertinent resolutions and transfer agreements have been made effective, the City shall
furnish the District Airport Engineer, Mr. Richard T. Puckey, with three copies of all such instru-
ments.

Instrument of Release was passed around the table at this point for councilmen to study for later in
the meeting.
PASCO, WASHINGTON
REGULAR MEETING COUNCIL CHAMBERS JUNE 4, 1963
WATER RIGHTS: DEPARTMENT OF CONSERVATION (Glen'H. Fiedler, Dep. Supv. DIVISION OF WATER RESOURCES):
Relative to application for permit (50 million gallons per day). A statement of additional examina-
tion fee due was enclosed together with signed voucher in the amount of $144.00.
That office has no record as to the extent of the water rights which the City of Pasco may enjoy
through an appropriation initiated prior to the enactment of the 1917 Surface Water Code. "Although
the 1917 Act preserved rights in existence at that time, such rights can only be defined through adjudi-
cation proceedings. We shall consider that by your application for appropriation permit you in no
way waive rights which may be vested by prior use."
Discussion was held. Campbell pointed out the calculated risk of losing the 50 million gallon a day
rate should we not use that amount. Considering the growth of the area, and the new water system of
the P.U.D. making additional demands on our water supply -- the council in setting the figure feel that
the state will also consider these items in the examination. Voucher was in with bills acted on pre-
viously.
HOUSING 6 HOME FINANCE AGENCY -- (Office of the Regional Administrator, 989 Market Street; San Francisco
California dated May 27, 1963)
To Mayor VanHoy -- Suggests week of June 17 - 21 for conference in answer to Mayor's request in letter
of May 14. Attached was agenda of similar conference held in Mountain Home, Idaho for background infor-
mation as to procedure.
Motion made by Kilbury, seconded by'James, that the Mayor be authorized to send H.H.F.A. SanFrancisco
letter and a copy of the comprehensive plan, pahse two -- indicating in the letter that we desire to
meet with them on June 20 and 21. Motion carried.
CASCADE NATURAL GAS CO. (Gerald Carlson, Manager, Pasco): [Parking Meters]
Letter dated May 89 1963 -- request consideration by the Council to establish a policy for parking
their company service trucks in legal parking areas, and metered zones (through city permit or license)
-- they suggest the issuance of either windshield sticker or card or a canvas bag which would be placed
over the meter head during parking.
Motion made by Carter, seconded by Hendler, to turn this to the Police Committee for consideration and
report to council. Motion carried.

Expressing appreciation to the Mayor and Mr. Hendler for presentation made on behalf of the Mayor's
Office at the area conference banquet on May 4, 1963.
M. ROSS DOWNS ASSOC. INC. (414 White -Henry -Stuart Bldg.; Seattle 1, Washington):
.(dated 5-22-63 and signed by M. Ross Downs) Thanked the City for the comprehensive plan, pahse two,
submitted to him. He feels that Pasco has tremendous potential, and assures us of their deep interest.

C. F. WHETSLER - Water Superintendent (REQUEST FOR TRANSFER $2,500.00 6-4-63):
"It has become necessary for the Water Department to transfer $2,500.00 from budget item 'Utility
Equipment' to 'Meters'. These items are in the same capital Outlay division of the budget. Due to
unforseen meter installations this spring, this transfer will ber.necessary."
Motion made by Hendler, seconded by James, that this request be granted. Motion carried unanimous.
BLOCK "C" PETTIT'S ADDITION (Charles G. and Frankie L. Grigg):
Mr. Fisher reported that $22,659.59 (check number 12374, Walla Walla Federal -- Treasurer's Receipt
Number 2290) has been paid for the sale of Block "C" Pettit's Addition to Pasco, according to the of-
ficial plat thereof recorded in the office of the Auditor of Franklin County, Washington. SUBJECT to
right, title and interest of the Northern Pacific Railway Company in and to that portion of said block
lying within 200 feed of the centerline of the "Old Incline Track". SUBJECT TO easements, reservations
and restrictions of record.
Motion made by Kilbury, seconded by James, that the Mayor and Clerk be authorized to. sign the deed and
return deed with the Bid Deposit Check on file in the amount of $1,500.00. Motion carried by roll call
vote of six (6).
PUBLIC HEARINGS:
VACATION OF ALLEY IN BLOCK 2 - PETTIT'S ADDITION:
Mr. Fisher read the Notice of Public Hearing -- Mayor VanHoy declared the Public Hearing open. Discus-
sion was held relative to sewer and water lines: The Walker's sewer line runs across the Grigg property
to the alley. The sewer lines and water lines in this property will be the responsibility of Mr. Grigg
subsequent to vacating alley. No protests to the vacation were received, either by letter or verbal.
Mayor declared the hearing closed.
Motion made..by Hendler, seconded by James, that the City Attorney be directed to draw necessary Ordinance
for vacation of alley, Block 2, Pettit's Addition. Motion carried.

L.I.D. #66 -- FINAL ASSESSMENT ROLL:
Mayor declared the Public Hearing open. Mr. Fisher read three (3) written protests:
1. W. G. Kellie - 439 N. Beech Street: "This is to object to paying for sewer on Lot 20 Block 29,
in Highland Park Homes. The amount is $198.94 and the lot has no buildings of any sort, nor do
we intend to build on the property. Also the sewer only was put half way through our alley. We
will pay for the sewer on Lot 1, Block 29, Highland Park Homes, but object to paying _such a high
amount for a vacant lot as Lot 1, Block 29. (signed: Mrs. W. G. Kellie)
2. Robert L. Young - S. 5' of Lot 9 Block 32, Highland Park Homes $16.60 and Lot 10 Block 32
Highland Park Homes $198.94. "I am against the assessment on the above described land. Regis-
ter my protest at the meeting June 4, 1963. (signed: Robert L. Young)
3. Economy Finance Co. Inc. Re: Local Improvement Dist. #66 Lot 11, Block 2, Highland Park Homes
"Please accept this as our protest against the captioned Local Improvement Dist. #66 for certain
improvements to the property described." (signed: K. E. Williamson)
FROM THE AUDIENCE:
Mr. W. W. Sargent spoke in favor of the L.I.D.
Mr_Donald Ferguson: questioned the charges and amounts of risers for his assessment (Lot 1, Block 5,
Wehe s First Addition). City Engineer to investigate and recheck -- Mr. Ferguson is not objecting to the
L.I.D. but does ask for an adjustment on the footage and charges if this is in order.
W. W. Sargent: Requests that the alley between A and B and Vine and 8th, be put back in good condition,
as it was before the sewer installation.
Mr. Chalcraft: 823 S. Vine Street, questioned the amount of his assessment, and was informed the rea-
son for the sewer line being placed as it was -- because of the 18" water line on the east side of that
street. -He is not objecting to the L.I.D.
Don Norvell: (L.I.D. #66): Mr. Fisher read letter from Don Norvell, which was checked out with the
bonding attorneys and they approved the inclusion:
"From: Brown Excavation Company to George Fisher, City Supervisor, Pasco, Washington
Dear Mr. Fisher: Please add the S 6' of Lot 3 all of lots 4 thru 10 inclusive, lots 11 thru 17 and south
6' of lot 18, Block 15 Riverside Addition to the City of Pasco to the Local Improvement District now be-
ing completed. Very truly yours, (signed: Don Norvell)."
That was a portion of the area that the city was assuming the cost -- Mr. Norvell subsequently acquired
title to the property and requests that he be assessed for that property.
After discussion, Motion made by Hendler, seconded by James, that the Council as a whole be a committee
to study this and report at next council meeting. Motion carried.
Mayor declared the Public Hearing on L.I.D. #66 Final Assessment Roll closed.
VISITORS:
Mr. Mills, 9th grade class, Washington State History and Government (Isaac Stevens Jr. High) were recog-
nized by the council. There were 44 students present.
The Mayor invited questions from any of the students. Questions were presented relative to Park and
Recreation; Golf Course Club house and street problems as well as "Water Follies". The individual
councilmen answered all questions presented. At the close of the discussion period, Mr. Mills thanked
the Council for the opportunity of visiting the Council and mentioned he would like to return next year.
Mr. 0. E. Bauman, 1010 S. Maitland, registered a complaint relative to the Police Department -- Discus-
sion was held. Motion made by Kilbury, seconded by Carter, that this matter be turned to the Police
Committee for report at next meeting. Motion carried.
CLAIMS AGAINST THE CITY:
Leonard J. Newell: Damage to car in the amount of $98.00 (claim states due to loose manhole cover.)
Mr. Newell's Address: 1720 N. Illinois.
Motion made by Carter, seconded by Greenlee, to turn to Insurance Committee of Council. Motion carried.
REPORTS FROM COMMITTEES:
KILBURY: (Claims, Finance)
No report on the Committee meeting. Announcing: No committee meeting June 5th.
JAMES: (Planning, Legislative, Building):
Reminding the council members again of the AWC convention June 12, 13 and 14 at Longview, Washington.
GREENLEE: (Fire and Light)
The following request to purchaseaawait your approval:
Water Department -- $3,145.61
Motion made by Greenlee, seconded by Carter, that these be allowed. Motion carried by roll call vote of
six (6).
VANHOY: Reported on the matter of the trees at the Cemetery in immediate need of spraying. Mr.
Shaw has received a quotation of $411.00 for two applications. Prices were obtained by Mayor VanHoy
from two other firms which were both higher. Discussion was held as to the financial status for this
item.
Motion made by Kilbury, seconded by James, that this be turned to the Finance Committee of the City for
action, and subsequently to the Attorney for drawing up the Resolution. (Cash on Hand under estimated
at beginning of year.) Motion carried. (Council agreed the spraying should be done at once.)

STANLEY: (Water and Sewer)
At the last meeting, we had moved to authorize the Water Superintendent to call for bids on pipe on
June 26, 1963 at 2:00 P.M. -- We didn't name the location for opening of bids, pending the investi-
gation by the City Attorney -- considering the possibility of calling for bids jointly. The P.U.D.
has already advertised their call vor bids to be opened at the P.U.D.
Motion made by Stanley, seconded by Kilbury, to open bids at the City Hall Council Chambers at the time
and date and amounts of pipe as per last meeting. Motion carried.

Motion made by Carter, seconded by Kilbury, that these applications be accepted. Motion carried.
DIEMOND: (Streets, Engineering)
Kilbury at this time, brought up the matter of excessive speed through Navy Homes. Motion made by
Kilbury that this be turned to the Police Committee. Campbell requested that this be detained until
he could check on the jurisdiction of those streets (whether or not they constituted public highway).
[Kilbury's motion died for second]
One -Way Streets: Motion made by Kilbury, seconded by James, that the Mayor be authorized to write
letter to the Director of the State Highway Department requesting their permission to go ahead with
the one-way Third and Fourth and Lewis and Clark (contingency request). Motion carried.
Mayor VanHoy: Inquired about the dips which had beenlinstalled on several streets. City Engineer
states that these are being corrected to prevent any personal or property damages.
HENDLER: (Parks, Library, Cemetery)
One item held over -- capital outlay for the tack coat and overlay for Sylvester Park (asphalt concrete)
also for Richardson Park (Basket Ball Courts) total cost $1,323.00 plus tax. This is recommended by
the Park Board and the Park Committee.
Motion made by Hendler, seconded by Kilbury, that this be approved. Motion carried by roll call vote
of six (6).
Water line has been extended to the triangle by Sylvester Park -- it is hoped that this can now be
beautified.
Report from Park Board and Park Committee: Some firm suggestions put forth as to proposed improvements
and extended facilities for the next five years -- this was covered earlier in the meeting.
[Hendler reported to Students earlier: The Park Board and Park Committee recommends additional swim-
ming pools, location not determined, at least two additional outdoor swimming pools and perhaps an
indoor -outdoor type pool; a pony league and grid -kids field; three playgrounds in addition to what now
exist; three more tennis courts; three handball courts and two picnic shelters - one in Volunteer park
and one in Memorial Park -- all this incorporated in the five year over-all plan]
June 30th will be open -house at the Golf Course Club House.
REPORTS FROM OFFICERS:
R. B. LOVELACE, BUILDING INSPECTOR: Report from Building Inspector was read: This included 78 Permits
having been issued in a total valuation of $234,455.00. Total permit fees collected were $1,091.06
(60 building; 10 gas installations; 8 plumbing permits and 2 gas fitter's license renewals). The 78
permits covered 60 building permits and 18 gas and mechanical installations. There were six 1 -family
dwellings and 3 multiple units -- May, 1963.
GOLF COURSE REPORT FOR MAY: Number of players for May: 2,841, Receipts $4,319.25 In addition to the
above mentioned daily -play, there were 27 season tickers sold $1,937.76. Total receipts for May $6,257.01
-- total receipts to date: $25,700.56.
SHOPPING CENTER: Mayor VanHoy reported that he had just received a call from Mr. Locher, of Locher
Construction Co. requesting representation of the City Government, be at the site June 5, 1:30 P.M.
DST for ground breaking ceremony.

AN ORDINANCE REPEALING SECTION 3 OF ORDINANCE NO. 1102
REBATING TO THE COST AND INSTALLATION OF BACK -CHECK VALVES,

CITY CODE 4-3.174 AS IT NOW EXISTS, RELATING TO CROSS -CONNEC-

A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK
TO ATTEST THE QUIT CLAIM DEED, TRANSFER AGREEMENT AND EASEMENT
RELATIVE TO THE TRANSFER OF AIRPORT TO THE PORT OF PASCO.

AIRPORT PROPERTY (removal of a hill on property the City is to
retain).

NEW BUSINESS:
Stanley: Suggested that small scale city maps be acquired -- one for each councilman's place at the
council table for ready -reference.
The subject was brought up relative to the legal status of the Columbia Basin News and our legal adver-
tising therein. City Attorney is to check this out.
