ROLL CALL: By Clerk's Representative. Councilmen present were: G. E. Carter, L. R. Diemond, Ed Hendler, H. C. James, Chas. D. Kilbury and Allen D. Stanley. Councilman Greenlee was absent. George R. Fisher, City Supervisor -Engineer and Richard G. Patrick, City Attorney were also present. APPROVING MINUTES: Motion made by James, seconded by Hendler, that minutes of the meeting of April 2, 1963 be approved. Motion carried. COMMUNICATIONS: Catherine -Max: (Airport Transfer) Letter read.from the Honorable Catherine May in answer to the Mayor's letter of the 29th, confirming date and time of meeting on the date of April 18th. An interim reply from FAA to Mrs. May, stating that this will be handled through the Los Angeles Regional Office and that she would be advised. (No Action) [date of letter April 31 Heennpy_ M. Jackson: (Airport Transfer) Letter was read from the Honorable Henry M. Jackson in answer to correspondence on the City's wishes in transfer of the Airport, Interim report from the FAA, signed by Cole Morrow, containing the same information as letter enclosed with Mrs. May's letter. (No action) [date of letter, April 51 HenryM. Jackson: (Storm Sewer Separation Projects) Letter was read from the Honorable Henry M. Jackson relative to the matter of Federal Grants to aid cities with storm sewer separation projects. He has contacted the Department of Health, Education 6 Welfare and the Housing and Home Finance Agency on this and enclosed various materials concerned with federal loans and grants, along with a Public Health Service application for federal grant for sewage treatment works. Also copies of S.649 and H.R.3166. These bills are still pending. He assures us of his every consideration if this should come up before the Senate (He is not a member of the Com- mittee on Public Works.) (No Action) [Date of letter April 4, 19631 Warren G. Magnuson: (Airport Transfer) Letter read from the Honorable Warren G. Magnuson, acknowledging receipt of our letters to him regard- ing Airport Transfer. He assures us of his continued support, he is in continuous touch with FAA in this regard, but nothing further has developed. He will keep us advised. (No Action) [Date of letter April 3, 19631 W. M. Foster, District Engineer: (C.S. 1102, P.S.H. No. 3, Pasco By -Pass) Letter dated April 2 from Mr. W. M. Foster: "Your letter of March 28th, wherein you request informa- tion regarding the construction of pedestrian walks on the overcrossing structure at Chase Street, has been received. Please be advised that this office concurs with you in your opinion that walks will be necessary and that at the time the bridge design is accomplished will so recommend." (No action) W. M. Foster,'District Engineer: (C.S. 1102, P.S.H. No. 3, Columbia River to Snake River RW 1443) Form letter dated April 8th. Necessary for State to acquire additional rights-of-way so as to permit a needed improvement of the above mentioned highway. This will affect City property, as well as others. (No action) �I W M. Foster, District Engineer: (C.S. 11019 P.S.H. No. 11, Jct. P.S.H. No. 3 to North Corporate Limits of Pasco) Letter dated April 2, 1963 from W. M. Foster, the purpose to advise us that thethe plan for relocation and the reconstruction of P.S.H. No. 11 from a point north of Pasco to the junction of the new by-pass route because;of our recent annexation some of this would be within the corporate limits of Pasco. When a limited access facility is being planned within the corporate limits of any city, that a public hearing be held. Because of the fact that this has been completely discussed in open meetings, all those concerned with this planning being completely aware of its nature, and that a hearing would only be time consuming and costly and would not serve any purpose as intended under the legislation, the Highway Department is contemplating deferring such a hearing until such time as it is specifically re- quested by an individual or individuals directly involved. (Two maps submitted.) Motion made by,James, seconded by Carter, that the Mayor write letter to Mr. Foster informing him it is not necessary to hold public hearing. Motion carried. I' Franklin Co. Democratic Central Committee: (Recommendations to Council) Letter dated the 10th of April, 1963 addressed to the Pasco City Council, and signed by T. B. Jackson, Chairman, Civic Affairs Committee and Charles D. Kilbury, Chairman, F.C.D.C.C. "At the last regular meeting of the Franklin County Democratic Central Committee, the Civic Affairs Com- mittee recommended, and.the Central Committee passed, the following program for Civic Improvement: 1. Beginning of urban renewal, specifically in South East Pasco. 2. A new dog ordinance with teeth in it. 3. A new garbage ordinance. 4. A nuisance abatement ordinance. 5. Improvement in service at City Hall. 6. Implementation of an arterial street program. 7. Information on job openings in City Government. 8. Engineering." I i I PASCO, WASHINGTON REGULAR MEETING COUNCIL CHAMBERS APRIL 16, 1963 Hendler requests that he be permitted to submit question to Mr. Kilbury. He asked Mr. Kilbury if he had informed Mr. Jackson and the others of what the Council has done. Mr. Kilbury answered, yes he had to some degree. Hendler: Party politics is a serious matter when becoming involved in City Govern- ment and it doesn'.t belong in City Hall. (more discussion) Hendler requested that he beppermitted to read a written statement: "Partisan politics doesn't belong in City Hall. Those who tend to mingle politics with city government are doing -a vast injustice to their communities. Mr. Kilbury, being both a council- aman and Franklin County Democratic Central Committee Chaifman, should know better than to have had this letter submitted. He should know that every city elective office is non-partisan. He should know that we are very limited as to what we can do, and con only do what the state law allows. Local problems are not partisan - should not be partisan and we are all Pasco-ites first, and politicians second. Any man who wears two hats should be careful that they are not inter -changed at the wrong time. It is difficult enough to encourage citizens to cooperate for community development without bringing partisan politics into the picture. This council has been working night and day, night after night, developing sound and progressive solutions to the prob- lems Pasco has and faces. Mr. Kilbury knows this. The 8 points mentioned by Mr. Kilbury's letter have either been started, are in the process of completion, or have been completed. In addition to those mentioned, other serious matters have received this council's consideration and are also in the process of completion." Kilbury answered: "Mr. Mayor, at this time I would like to disqualify myself in any action the Coun- cil might take in this matter. Mr. Hendler has made an attack upon me due to the fact that I am Chairman of the Franklin County Democratic Central Committee and also a councilman. It is my duty as chairman of the FCDCC to take the action required by the Central Committee, and in this case the Civil Affairs Committee of FCDCC moved and.the Central Committee passed a program for service improvements to be sent to the Council. Mr. Hendler has stated that partisan politics has no part in City Govern- ment, yet we have read four letters here tonight, 2 from one democratic senator, one from another democratic senator and one from a Republican congresswoman to the City of Pasco in regard to Pasco's problems. The Democrats who comprise the Central Committee are representatives (elected representa- tives) of the people of Pasco and as such they certainly have every right to bring any matter they de- sire to the attention of any governmental body be it county, city, state or national. Ed, we have disagreed on some things -- we are entirely opposed in this matter, and I feel that the FCDCC has every right to bring these things to the attention of the Council. Mr. Jackson is present tonight, and I am sure that if you wanted to hear him, he would have something to say in this matter. Hendler, as a point of clarification stated that the letters from the Senators and Representatives stated nothing about the political party. More discussion was held, Carter, James and Stanley, all along the lines that they were being di- rected to take action on things which have alveady been taken care of, or in the process of completion. Van Hoy and Jackson had conversation with the Mayor pointing out those things .which are being worked on. It was also suggested.that this letter as presented should have contained more specific construc- tive suggestions. "If this letter is presented with the intention of giving support to the council for what they have done and what they are doing, this is one thing, and I certainly give my whole hearted support, but if it is the party recommending that things be done, when they are being done or have been done, then this is another thing." -- James. City Supervisor: (Actuarial study of the Firemen's Pension Fund) Letter read from Mr. Fisher, dated April 4, 1963: "I wish to recommend that consideration be given at this time to authorize_ an actuarial study of the Firemen's Pension Fund. This recommendation is made at this time to insure receipt of the completed study prior to Budget preparation time." Motion made by Kilbury, seconded by James, that we authorize an actuarial study of the Firemen's Pension Fund. Discussion followed -- Mayor asked the City Attorney Patrick: Do we have to get the approval of the Firemen's Pension Board before we authorize this? Patrick:. I think it would be a good practice -- perhaps they could just ratify, doesn't need to be approved. Motion carried. City Supervisor: (L.I.D. #66 -- John Keltch) Letter dated April 15, 1963 from George R. Fisher recommending that the construction work on L.I.D. #66 under the contract with John Keltch be accepted and the State Tax Commission be so notified. This work has been completed in accordance with the specifications. Motion made by Hendler, seconded.by Carter, that we aecept the recommendation of the City Supervisor. Motion carried. George Plescher: (Second Phase Report) Letter read from Mr. Plescher, Planning Director, stating that Mr. Bob Clark of Clark, Coleman & Rupeiks, Inc. has informed him that the second phase report will be completed April 26. The presenta- tion of this report has been set for Tuesday, April 30, 1963 at 7:30 P.M. if this meets.with the approval of the Council, if not please suggest the time and date. Motion made by Hendler, seconded by Stanley, that the Council as a whole attend this meeting of April 30th to go over this with Mr. Plescher. Motion carried. Water Su2erintendent: (Refund, Haystad $440.00) Letter read from Mr. Whetsler, Water Superintendent, requesting authority for the City Treasurer to refund $440.00 to L. C. Haystad; Rt. 1, Walla Walla, (Application #10262 dated 12-4-61 for an extension of a 6" water line on Road 40, south from Sylvester. Application #11525 dated 4-15-63 the money to be refunded was paid for lot 16, block 3, Riverhaven Addn.) Motion made by Stanley, seconded by James, that this request be granted. Motion carried by roll call vote of six (6). PASCO, WASHINGTON C_. -L. -Booth (property between Highway 6 Airport) Letter from Mr. C. L. Booth, 2715 Sunset Drive, Lewiston, Idaho dated April 15, 1963. His concern is having his property effectively cut off from the city and the stoppage of development in that area. He is aware of the meeting to be held Wednesday, April 17th. (No action.) Mayor.VanHoy: (City Attorney appointment) Letter from Mayor VanHoy to City Council dated April 16, 1963 read as follows: "I hereby appoint D. Wayne Campbell as City Attorney sub4ect to confirmation -by the City Council. The salary shall be $6,000.00 per year as set forth in Ordinance numbers 981-A and 1079. The appointment shall not be j for a definite term." Motion made by Kilbury, seconded by James, to accept resignation of Richard G. Patrick as City Attorney with the thanks of the Council. Motion carried. Motion made by Kilbury, seconded by James, to concur with Mayor's appointment of D. Wayne Campbell as City Attorney as set forth in letter. Hendler: I concur with the Mayor's appointment of D. Wayne Campbell as City Attorney but I cannot -concur with salary arrangements and therefore will have to vote "no". Motion carried by roll call vote of 5 -yea; 1 -no (Hendler). Wayne Campbell) At 8:47 Oath was administered by Mayor T. R. VanHoy to D. Wayne Campbell. Campbell was seated as City Attorney. Patrick addressed the Council, He stated he had injoyed working with the City Government Body and only because of his increased private practice does he find it necessary to make this change. Both his own work load and the work load of the City has increased over the past year. The increase of City work is certainly some ividence that the Council is doing a good job and a lot of work. In his association with City Government over the years, Patrick has worked with four Mayors (Beck, Custer, Hicks and VanHoy). Patrick wishes Campbell well in his office of City Attorney. At this pmint, Patrick joined the audience. Quit Claim Dedd -- Block "C" Pettit's Addition: Patrick has prepared an original and two carbon copies of Quit Claim Deed for Block "C" Pettit's j Addition to Pasco, so that they are available for closing the sale. It was mentioned that Mr. Grigg would rather not pay for this property until he can take possession. (No action) S. S. Jilek: (Waiver Agreement, Sidewalk) 1 Waiver Agreement (A Street 6 Mayne - Block #3 Oakley's Addition) presented to the Council. Motion made by James, seconded by Diemond that this waiver be granted and the Mayor be authorized to sign. Motion carried. K. E. Moore: (Vacate alley Block 17, Helm's Second Addition) K. E. Moore presented petition to the City Council to vacate the north -south alley of Block 17, Helm's Second Addition, City of Pasco, State of Washington. (signature of 75% abutting property thereon). Motion made by Stanley, seconded by Kilbury, that a public hearing on this vacation be called for 8:00 P.M. May 21, 1963. Motion carried. Highway Department: (RESOLUTION NO. 588) Mr. Tony Andrus of the Highway Department presented a Resolution to the Mayor and Council relative to limited access on Primary State Highway No. 11 within the corporate limits of the City of Pasco as follows: RESOLUTION NO. 538: Portion of Primary State Highway No. 11 Pasco: Jct PSH 3 to North Corp. Limits -- City of Pasco acting through its officers and authorities, does hereby consent to the establishment of limited access on the following described portion of Primary State Highway No. 11 within corporate limits of the City of Pasco: (Between Highway Engineer's Station LR 21+m0 in the Northwest Quarter, Northeast Quarter, Section 20 and Highway Engineer's Station LR 111+21.98 on the north corporate limits of the City of Pasco in Section 8, all in Township 9 North, Range 30 East, W.M.) [Print of Plan is thereto attached and made a part of the Resolution] Motion made by Hendler, seconded by James, that Resolution No. 538 be read. Motion carried. PUBLIC HEARINGS: RESOLUTION NO. 535: A RESOLUTION FIXING A TIME -FOR PUBLIC HEARING ON A PETITION TO VACATE Jay St'. Saxton to Chase; Ella St. Saxton to Chase; Franklin St. South of Ella; and alleys in Block 1,§, 16, 17 and 18 Headlight Addition to Pasco according to plat thereof Volume "B" of plats page 26, Records of Franklin County, Washington. (Public Hearing set for 8:00 P.M. April 16th, 1963) PASCO, WASHINGTON REGULAR MEETING COUNCIL CHAMBERS APRIL 16 1963 Notice of Public Hearing was read. Mayor VanHoy declared the hearing open. No formal protests either from the audience or by letter. Mr. Cooney on behalf of the School District spoke favor- ing the vacation. Motion made by Hendler, seconded by James, that the Attorney be instructed to draw the necessary Ordinance on this vacation. Motion carried. ORDINANCE.NO. 1089: AN ORDINANCE DECLARING AN EMERGENCY IN THE GOLF COURSE FUND, APPROPRIATING THE SUM OF $49212.00 TO MEET THE EMERGENCY, AND PROVIDING THE FUNDS THEREFOR. Mayor VanHoy declared the hearing open. Called for comments either for or against the passage of this ordinance. No protests either from the audience or by letter. Kilbury: in regard to the proposed ordinance,,excerpts from the City Finance Committee meeting April 3, 1963 ahould be read into the records at this time: "Kilbury moved to approve a temporary loan to the Golf Course from Current Expense at 4% interest, in the amount of $4,212.00. This loan to be repaid over a two year period, in.1864aadd 1965 to be provided for by Emergency Ordinance No. 1089. Seconded by Ted VanHoy." Motion made by Hendler, seconded by James, that Ordinance No. 1089 be read by title. Motion carried. Ordinance No. 1089 was read by title. Motion carried by roll call vote of 5 -yeas; 1-no($tanley voting "No") Hendler: read letter from Park Board "If Ordinance No. 1089 is approved and passed, the Park Board requests that the Golf Course parking lot be paved as soon as possible." -- in view of the action above taken: Motion made by Hendler, seconded by James, to authorize the City Supervisor to proceed with the work as soon as possible. Motion carried by roll call vote of 5 -yes; 1 -no (Stanley voting "No"). VISITORS: Mayor invited comments from the audience. J. A. MARKS, 1704 Lynda&e statedhhe had a camper trailer parked on the street on the side of his property and had been object of a complaint. Requested information as to whether or not this was legal parking. Mr. Marks was advised by the Council that according to ordinance he would have to put his trailer.either in his own side yard or rear yard or a proper storage facility. REPORTS FROM COMMITTEES: KILBURY -- (Claims, Finance) The Finance Committee in the meeting of last week after due deliberation, and legal opinion, recom- mends that the City Opeupation tax be paid at 4% this year's tax on the basis of 1962's receipts. We recommend a meeting date be set for those interested utilities who wish to meet with the coun- cit to discuss the aspects of this occupation tax, and to hear their recommendations as to how they may be paid. Request suggestions as to time and date of this meeting. (discussion) Motion made by Kilbury, seconded by Stanley, that the Mayor be authorized to write letters to the various utilities instructing them with the committee's recommendation that the tax be paid at the rate of 4% on a basis of 1962 revenues. (more discussion) Motion carried by roll call vote of six (6). Motion made by Kilbury, seconded by James, that iobeting be held on the 15th of May and all titiilities be so notified. Time 7:30 P.M. Motion carried. Ordinance No. 1012: Relative to this ordinance, it was explained that the current expense fund is currently sufficient in the black to enable the following motion. Motion made by Kilbury, seconded by Stanley, that the Treasurer and Clerk be authorized to go off of procedure required by Ordinance No. 1012. Motion carried. JAMES -- (Planning, Legislative) Dog Ordinance is prepared and will.be presented under "ordinances". It is the feeling of the com- mittee that this is what the people of Pasco have been requesting. Association of Washington Cities: Attention is again called to the dates of this annual conference June 12, 13 and 14 in Longview. Accommodations are limited, if you are planning to attend reserva- tions should be made early. Two double accommodations have been reserved and veridied. Nuisance and Abatement: is prepared and will come up under "ordinances". Planning Report: Will be completed on the 26th of April (second phase). Planning Commission meets every Tuesday night with one rggular session on the second Tuesday of the month. A favorable report should be forthcoming from this Commission. Motion carried by roll call vote of six (6). f PASCO, WASHINGTON COUNCIL CHAMBERS P.U.D. lighting proposal for Volunteer and Memorial Parks has been submitted. The Committee has not had the opportunity to study this, so is being returned to the committee. Fire District No. 3: Nothing has been submitted from the Fire District #3 Attorney on this as of this time.discussion was held as to liability etc.) Motion made by Hendler, seconded by James, that we request the Fire District #3 to notify us by writing as to whether or not they wish to ac- cept this agreement, and authorize the Mayor to write the necessary letter. Motion carried. STANLEY: -- (Water and Sewer) Water Superintendent wishes permission to extend 1000' of 6" water main north from the Fire hydrant, north of the Recreation Building in Volunteer Park, on Third Street and then on north 4th to connect on the 12" line at 4th and Court Streets. Approximate cost $3,000.00. Motion made by Stanley, seconded by Diemond, that this request be granted and water superintendent be authorized to make improvement as requested. Motion carried. F.C.I.D. Ordinance No. 1087 has been passed and approved granting permit for the Franklin Co. Irri- gation District to cross over, and under public streets in Lewis Addition for purpose of furnishing irrigation water -- this was to have been accepted 30 days after adoption or it would be null and void. The Irrigation District has requested informational meeting with the Water Committee and have requested more time for acdeptance. This will have to be taken care of by Ordinance and will come up under "ordinances" in this meeting. Meeting date has not been set. P.U.D.: In our agreement with P.U.D. for extension of water service: We have had several meetings with the P.U.D.'s attorney -- there are still several points to be worked out. It would appear that their problem revolves around their bonding situation. Meeting set up for Thursday, April 25, 1963 7:30 Water Committee and council as whole with P.U.D. Angle Parking: With reference to the several complaints we have received on angle parking at the corner of Court and Arthur: This corner has been painted yellow for an appropriate distance both ways, and signs have been erected "Parrallel Parking Only". It is our hope that this will take care of the situ- ation. (discussion held relative to the evergreen tree on the corner, etc.) DIE` MONDr: -- (Streets, Engineering) Street Committee met with four engineer firms the third of April. It is the recommendation of the Committee that we employ Gray and Osborne of Yakima, to submit proposal. Motion made by Carter, seconded by Kilbury, that we accept the street committee's recommendation. Motion carried. Angle Parking, 7th and Columbia: At this particular location, people have been parking angle for years. Motion made by Di.emond, seconded by Carter, that in view of the recommendation of the Street Committee, the present ordinance ordinance be amended to allow angle parking on the west side of 7th between Lewis and Columbia dnd Columbia and south to the railroad spur track. Motion carried. New Location: Street Department: Since the selling of the street department ground, we are going to have to loo; for a new location. All members being aware of this, ideas of locations are invited. Loader: We are getting a new loader from Modern Machinery. Shall we transfer the old one to the Cemetery Department for use out there? Discussion was held on this matter. Motion made by Hendler, seconded by Carter, that the transfer be made to the Cemetery Department from the Street Department until such time as other arrangements may be made. Motion carried. PASCO, WASHINGTON REGULAR MEETING COUNCIL CHAMBERS APRIL 16. 1963 HENS DDLLE_R_ -- ( Parks , Library 6' Cemetery ) Pipe, Park Department: "The Park Department has removed approximately 700 feet of 4 inch pipe, which was originally installed in Volunteer Park. Since this.pipe has no resale value, I request permission to give this pipe away to whomever will haul it from the park." -- This is letter submitted by Mr. Wyman, Park Superintendent. Motion made by.Hendler, seconded by Carter, than in view of the facts pre- sented in the.letter, Mr. Wyman be granted permission as requested. Motion carried. Neighborhood Swimming Pools: Still waiting for report from the Board on this project.
