ROLL CALL: By Clerk. Councilmen present were G. E. Carter, L. R. Diemond, R. L. Greenlee, Ed Hendler, H. C. James, C. D. Kilbury and A. D. Stanley. City Attorney R. G. Patrick and City Supervisor G. R. Fisher were present. APPROVING MINUTES OF MEETING HELD DECEMBER 49 1962: Motion made by James, seconded by Diemond approving the minutes. Motion carried. Motion made by Kilbury, seconded by Hendler, to make corrections by amendment -- set out as follows: "Washington State Department of Highways C.S. #1102 P.S.H. No. 3 6 11 City of Pasco, Street Improvement, Drainage Facilities -- Fourth 6 Lewis: *[see page 31611 In the motion: After the words "Street Committee" delete the word "Chairman". Motion made by Hendler, seconded by Kilbury, to accept the low bid of Columbia Basin News (Benton -Franklin Publications, Inc.) Motion carried unanimous. LAMPS: Four (4) bids received, opened and read as follows: LORD ELECTRIC CO. INC.: Incandescent and flourescent type building lamps as follows: 43.5% plus 2% plus 4.7 discount Federal Excise Tax. The above discount would be for six cases or more per delivery. Ken -Rad (Westinghouse) brand lamps. Discount prices would apply toward list price. CADET ELECTRICAL CONTRACTORS:, Westinghouse Ken -Rad lamps -- Forty-six (46) percent discount from the catalog list price less two percent (2%) for cash payment within forty days from date of delivery. This quote is based upon an anticipated volume of not less than three thousand dollars ($3,000.00) during 1963. COMMUNICATIONS: EIGHT HOUR WORK DAY FOR FIRE CHIEF AND ASSISTANT: 1a A letter was read from Fire Chief Cooney, requesting an amendment to Resolution No. 442, Section 2, allowing the Assistant Fire Chief to work an eight (8) hour day. Motion made by Kilbury, seconded by Greenlee, to turn this to the Fire Committee. Motion carried. Motion made by Hendler, seconded by Kilbury to include the City Attorney. Motion carried. TRANSFER FROM EMERGENCY ORDINANCE OF 1962 to CURRENT EXPENSE FUND: A letter was read from the City Treasurer requesting the City Clerk be authorized to issue a transfer order to place $11,120.74 in the Current Expense fund in compliance with Ordinance No. 983 and 993. Motion made by Kilbury, seconded by Stanley, authorizing transfer as requested. Motion carried. PARK BOARD CLUB HOUSE NEEDS: A letter was read from the Park Board requesting that $1,000.00 be allowed for lockers which would be purchased from the Basin Typewriter Co. at $12.50 each also $195.00 for fireplace wall in addition to original contract and $200.00 for landscaping plans for club house area; $1,375.00 for lounge furniture to be ordered through Mark Pence, Architect; Motion made by Hendler, recommending the purchase of furniture, landscaping and fireplace wall deleting lockers; Motion didd fpr:;wantlof a second. Motion made by Greenlee, seconded by Kilbury, to turn this to the Park Committee cif the Council for further action price quotations submitted on furniture. Motion carried. Park Commissioner Worley was present and spoke for the Park Board. Motion made by Hendler, seconded by Carter.for approval of the plans on landscaping for $200.00 and fireplace wall in the amount of $195.00. Motion carried. VOLUNTEER AND MEMORIAL PARK LIGHTING: A letter was read from the Public Utility District. They recommend four (4) lights be installed, they would be four hundred (400) watts (21,000 lumen) mercury vapor will cost $4.25 per month each. Motion made by Greenlee, seconded by Kilbury, that this be turned to the light committee for study and recommendation. Motion carried. Sketches showing light locations attached to letter. VETO: ORDINANCE NO. 1072: AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 1043, AND PASCO CITY CODE 3-16.08, BEING AN ORDIN- ANCE RELATING TO AND PROVIDING FOR A LICENSE OR OCCU- PATION TAX UPON CERTAIN BUSINESS OCCUPATIONS, PURSUITS AND PRIVILEGES, DEFINING OFFENSES AND PROVIDING PENAL- TIES THEREFOR. A letter was read from Mayor T. R. VanHoy dated December 6, 1962, stating that, in conformance with R.C.W. 35.24.210 he was returning Ordinance No.,1072 to the Council with his Veto thereon, and stating his reason for so doing. (" Pasco, Washington December 6, 1962 The City Council City Hall Pasco, Washington Re: Ordinance No. 1072 Gentlemen: In conformance with the provisions of R.C.W. 35.24.210 I am hereby returning Ordinance No. 1072 to the City Council and am putting my VETO thereon. I am doing so because I object to this ordinance for the following reason: This proposed Ordinance 1072 making a 1% increase in the Occupation Tax would cost the ppwer-using tax -paying citizens of the City of Pasco approximately $28,000.00 a from which the City would re- ceive approximately" $5,000.00. At the present time, the P.U.D. is paying to the City approximately $21,000.00; with the proposed increase this would be raised to approximately $28,000.00 -- a difference of $7,000.00 (but of that, the city is also applicable to the same tax on its power bills and this would cost us approximately $2,000.00) making a gain in the occupation tax from the P.U.D. to the City of approximately $5,000.00 Taking into consideration the fact that the P.U.D. has up to this time been absorbing the present 3% occupation tax, and when the increase is effective, the P.U.D. will then bill the individual power - user the entire 4%, I feel that the $5,000.00 which the City would realize from this does not justif each and every citizen to be' -obligated the 4% -- or approximately $28,00.0.00. Motion carried. Motion made by Kilbury, seconded by Carter, to reconsider Ordinance No. 1072. Motion carried. Motion made by Hendler, seconded by James that: REGULAR ORDER OF BUSINESS BE SET ASIDE TO HEAR FROM THE PUBLIC -- In case any one wished to oppose or favor Ordinance No. 1072. Motion carried. No one present spoke, a short discussion was entered into by Council Members and the Mayor. REGULAR ORDER OF BUSINESS RESUMED. Motion made by Kilbury, seconded by Carter to adopt Ordinance No. 1072. Motion carried by roll call vote of seven (7). WATER SERVICE TO LOT 8, BLOCK 1, HULL -LEE ADDITION: The water Superintendent requests this service for Mr. Ralph Sullivan from Road 32 and Opal, they agree to pay an amount equal to City Cost plus meter and lay their own small line from Opal. They will obtain written permission from the County to excavate in Road 32. C. F. Whetsler recommends that this be allowed. Motion made by Stanley, seconded by Hendler, that the request as presented be allowed. Motion carried. CASCADE NATURAL GAS COMPANY -- 111 North Third: A letter was read from Architect Wm. N. Ross with drawings attached, and stating that they (Ross & Pence) have been retained to execute specifications for remodeling the Gas Company's offices at 111 North Third Avenue, a drive-in and pay window is proposed to be placed in the alley; therefore, they request a variance be allowed for the drive up payment window and the alley traffic be limited to one-way. A letter was read from the Building Inspector, R. B. Lovelace, calling attention to the uniform building code Section 4502 "No part of any structure or appendage thereto shall project into any alley." Section 4504 deals with clearance above grade. Chief of Police and Fire Chief are opposed to variance requests. A representative of the Gas Company supported the architect's request. Motion made by Greenlee, seconded by Carter, to turn this to the.Street and Police Committees. Motion carried. CONTINUED PUBLIC HEARING -- REZONING K. K. SARGENT'S PROPERTY -- COLE`S ADDITION ON WEST COURT & LUC Mayor VanHoy declared the Hearing open for discussion. Lee Bonnett spoke in behalf of Mr. Sargent's petition. Letter was read from Pasco Planning Commission, reiterating their recommendation for app proval of the zone change; City Code consulted by Councilman Stanley. Following a short discussion and with no opposition present, no letters received opposing or favoring the change,. Mayor declared the hearing closed. Motion made by James, seconded by Kilbury, that K. K. Sargent's property be rezoned from R-2 to C-1. Motion carried by roll call vote of seven (7). WENATCHEE SEWAGE TREATMENT PLANT MEETING: Water Superintendent C. F. Whetsler requests two water department personnel attend this meeting December 20, 1962 with transportation allowed. Motion made by -Stanley, seconded by James, that the request be allowed. Motion carried. N. A. A. C. P. REPRESENTATIVE -- E. M. MAGEE: Mr. Magee asked the City Attorney what action if any had been taken on the Resolutions and sug- gestions presented by the N.A.A.C.P. for adoption by the Council. This was turned to the Council as a whole for consideration during the work meetings and will be answered soon as the Council gets it out of the work sessions. REPORTS: OFFICE PERSONNEL AND OFFICE PROCEDURES: Councilman Kilbury -- No report at this time. LEGISLATIVE: Councilman James reports on important implications for City Government -- Retirement System, Joint Fact -Finding Committee on Highways, Streets and Bridges; Joint Committee on Urban Area Government; Liquor Revenue and Liquor Profit Tax; also, three (3) Resolutions were made a part of the report. Cooney and Rickenbach protested on Pension. Motion made by James, seconded by Kilbury, that the Mayor write to the Association of Washington Cities in regard to the.Council being in full accord with Resolutions as adopted by the Association of Washington Cities at their meeting November 28, 1962. Motion carried. WATER SERVICE TO TWELVE (12) HOUSES ON WEST NIXON: Councilman Stanley reports on December 4, 1962's meeting whereby Water Superintendent requested permis- sion to extend a 6" C.I.P. line between Road 37 and Road 39 when request is received, Council action will be necessary. Motion made by Stanley, seconded by Greenlee, that when request is received, permission be granted for installation. Motion carried. (Kilbury voting "No"). STORM SEWER SEPARATION: Councilman Stanley reports on sewer separation:znd letter from Roger James, Supervising Public Health Engineer. Obtaining funds from the Pollution Control Commission was turned down. A bill was intro- duced in the Congress identified as H.B. 13186 which died when congress adjourned. Copy of letter submitted to assist with another request to Senators and Representatives. Water Committee to study bill preparatory to drafting request for aid. BIDS: L.I.D. #66 -- SEWER CONSTRUCTION: Nine (9) bids received, opened and read at 2:00 P.M. December 18, 1962 as per legal advertisement, then turned to City Supervisor to check, make extensions and with committee make recommendation: 1. Erwen Construction Co. - 215 E. Rental units not paying - how and what to do about it. CIVIL DEFENSE AGREEMENT: A joint proposal between the County and the City operation was discussed. Bruce Lee spoke in favor of the proposal, which would end his function as Civil Defense Director for the City. Motion made by Carter, seconded by James approving the agreement for the Mayor's signature. Motion carried. Motion made by Greenlee, seconded by Kilbury, that the Mayor write a letter to Bruce Lee commending him for services rendered with this program. Motion carried. COUNCILMAN DIEMOND REPORTS ON STREETS: Widening "A" at 10th and "A" has been completed. Widening at Fourth and "A" a program being worked on is not ready to be presented at this time. PASCO$ WASHINGTON GROUP INSURANCE: The report on Group Insurance shows 90% insured 80% taking advantages of extra benefits. Some em- ployees retaining two policies. Finance Committee plans payroll deductions. Motion made by Hendler, seconded by Kilbury,.that salary deductions for employee insurance be turned to Finance Committee for study and report. Motion carried. PARK BOARD AND PARK COMMITTEE PROCEDURE: Park Board favors John Severson operating the Golf Course. He would like to be assisted by Harry Wyman. (Correction 1-2-63: Last sentence should read ,It is understood the John Severson in operating the Golf Course is under the supervisor of Harry Wyman, Supt of Parks & Recreation.") I Lighting a driving range was favored: this to be worked out. CITY PROPERTY -- BLOCK "C": Motion made by Hendler that a plat be drawn and street dedicated in.Block "C". City Attorney sug- gested that title action and street dedication be done at one time. Motion died for want of a second.' Motion made by Hendler, seconded by Greenlee that the records show the Corujcil's intent to formally dedicate that portion C. G. Griggs has requested for street purposes after city has completed quiet title action as per meeting of December 4, 1962, and that C. G. Grigg be allowed to go ahead with necessary street improvement. Motion carried. Motion made by Hendler, seconded by James, amending motion that committee study loading zone for recommendation also. Motion carried. Original motion carried. (Correction 1-2-63:"Delete third paragraph except for 'Original motion carried'.") WORK HOURS OF ASSISTANT FIRE CHIEF (Resolution): Proposed Resolution amending Resolution No. 442. Greenlee suggests that the recommendation of Fire Chief Cooney be accepted and that a resolution be submitted at next meeting. Motion made by Greenlee, seconded by Carter, that Resolution No. 442 Section 2, be amended to read: "All firemen with the exception of the Chief and the Assistant Chief shall be employed on a 24 -hours on and 48 -hours off work schedule." Motion carried. READING OF ORDINANCES AND RESOLUTIONS: RESOLUTION NO. 525: A RESOLUTION PROVIDING FOR LONGEVITY PAY FOR CIVIL. SERVICE EMPLOYEES AND REPEALING RESOLUTION NO. 409. Motion made by James, seconded by Diemond, to read Resolution No. 525. Motion carried. Resolution No. 525 was read. Motion carried by roll call vote of seven (7). u ORDINANCE NO. 1073: AN ORDINANCE ESTABLISHING THE CHANGES FOR ENDOWMENT CARE AND THE USE OF ENDOWMENT CARE PROCEEDS, AND RE- PEALING SECTION 5 OF ORDINANCE NO. 933 AND PASCO CITY CODE 4-1.53 AS IT NOW EXISTS. Motion made by James, seconded by Diemond, to read ordinance No. 1073 by title only. Motion carried. Ordinance No. 1073 was read by title. Motion carried by roll call vote of seven (7). AIRPORT TRANSFER: Mayor VanHoy advised by the City Attorney to hold a meeting on Airport Transfer Agreement. PARK E RECREATION - C - GOLF COURSE: Operations separated for Bond purposes. Council to consider division as to cash on hand by January 1, 1963. BUDGET REPORTS: Budget Reports for November, 1962 for all departments were presented by the City Clerk to all councilmen and Department managers.
