REGULAR MEETING COUNCIL CHAMBERS NOVEMBER 761
CALL TO ORDER:
Meeting called to order at 8:00 P.M. by Honorable Mayor Raymond Hicks.
ROLL CALL:
By Clerk; Councilmen present were George A. Grant, Robert L. Greenlee, H. C. James, C. D. Kilbury,
K. E. Moore and T. R. Van Hoy. Absent, C. R. Combs.• City Attorney Richard G. Patrick and City
Supervisor G. R. Fisher were present.
APPROVING OF MINUTES:
Minutes of meeting held Tuesday, October 17, 1961. Motion made by James, seconded by Kilbury
approving minutes as written. Motion carried.

PUBLIC HEARING:
CONTINUED PUBLIC HEARING ON REZONING LOTS 1 & 2, BLK 22, PETTIT'S ADDITION FROM R-1 TO R-2:
The Mayor declared theHearing open. A letter was read from Rex Phillips stating that he and
R. D. Latture were withdrawing their objections on the strength of a letter to them from Dillingham
and Gallant, Inc., stating they intended to erect a building of masonry construction, two story,
"garden type" apartments, approximately 6 units, with provisions to be made for off-street parking.
No sketch or plan was submitted. Mr. Phillips states further that he and Mr. Latture are trusting
that the Code and Inspector will see that the type of structure allowed will be such as not to
lower the surrounding property's value. No other objections were received or voiced. Motion made
by Kilbury, seconded by Grant that the Hearing be declared closed. Motion carried. Motion made by
Grant, seconded by Kilbury that the Rezoning be allowed as requested by petition and the City
Attorney authorized to draw Ordinance covering the change. Motion carried.
COMMUNICATIONS:
RIVERVIEW PARK PONY & COLT LEAGUE BASEBALL ASSOCIATION:
A letter was read from the Northern Pacific Railway Company, Properties and Industrial.Development
Department manager, S. G. Merryman, stating that the City's request to acquire an additional strip
of land 100 feet in width along the East boundary of the present Park has been given careful con-
sideration. However, in view of the industrial potential of this land, the Company does not wish
to sell any more for park purposes. Clerk to mail a copy of both letters to Royce H. Walters,
president of the Association.
AMERICAN MAYORS VISIT BERLIN:
A letter was read from Willy Brandt, Mayor of Berlin, relative to the American Mayors visit to Berlin,
expressing interest and gratitude from the Berliners, best wishes and thanks from himself.
THE WHITE HOUSE:
A letter was read from Frederick G. Dutton, special assistant to the President, expressing appreciation
for support given the President in this Berlin crisis.
GOVERNOR ALBERT D. ROSELLINI:
On behalf of President John F. Kennedy, requests the honor of Mayor Hicks presence and participation
in a White House Regional Conference on Domestic Programs and Future Needs on Monday, November 20,
1961, at the University of Washington, Seattle. Motion made by Grant, seconded by James, authorizing
the Mayor to attend the Seattle meeting November 20, 1961. Motion carried.
AIRPORT - TRI CITY JUNK COMPANY:
A letter was read from Airport Manager, H. W. Parkinson stating the Tri City Junk Co. has completed
their contract for removal of underground steam piping and recommends acceptance of the project.
Motion made by Kilbury, seconded by Moore that the completion of the Tri City Junk Company's contract
be accepted as of this date. Motion carried.
A. R. SIME LEASE TERMINATED:
A letter was read from Airport Manager H. W. Parkinson requesting the termination of Mr. Sime's lease on
Building #68 as of November 15, 1961. Motion made by Van Hoy, seconded by Kilbury accepting the
cancellation of Mr. Sime's lease as recommended. Motion carried.
REGULAR MEETING
PASCO, WASHINGTON
COUNCIL CHAMBERS
UNSAFE SIDEWALK 414 W. COLUMBIA THUNDERBIRD MOTEL:
NOVEMBER 7,_1961
A letter was read from Assistant City Engineer, Robert J. Bruce, stating that Don Avery was
notified on October 2, 1961 that the sidewalk was unsafe for public use and giving him until
October 31, 1961 to notify the City Engineer's office of his proposed plan. As he failed to
soido, this letter is submitted to the Council with copy of letter to Don Avery attached.
Motion made by Kilbury, seconded by Grant to turn this to the Street Committee for report at
next meeting. Motion carried.
WATER LINE EXTENSION - LEWIS ADDITION & ROAD 22:
A letter was read from Water Superintendent, C. F. Whetsler, stating that front footage was
cKa-rged on four lots @ $2..00 per foot; 6r..,$480.00. It was discovered later that.they used
only Lots 1, 2, 3 and the East 20' of Lot 4, Lewis Addition, whereby the Oil Company .is due
a refund in 4the amount of $80.00.
MR LEONARD LEWIS-paid for the water on Road 22 from Court to Ruby Sts..with an agreement that
he:would be due a refund when services were established on the East side of Road 22, up to
$466:.]12;,th;i:s,.'dated�backe,to.Deceihbe�` 31, 1956. Now, the problem is, what property should the
money Mr. Lewis paid be assigned to, as front footage. Motion made by Kilbury, seconded by
Moore, that this be turned to the Water Committee. Motion carried.
TRANSFER:
C. F. Whetsler, Water Superintendent, states it has become necessary to transfer $2000.00 from
the Reservoir and Maintenance budget item; $1000.00 to Maintenance of Electric Pumps and
$1000.00 to Utility Equipment Maintenance. Motion made by Kilbury to turn this to the City
Attorney. At this time the City Attorney explained the new statutes and has an Ordinance provid-
ing procedure for transfers. Kilbury's motion was not finished. Motion made by Moore, seconded
by Kilbury allowing transfer as requested and complying with R.C.W. 35.33.120. Motion carried.
CITY TREASURER NEEDS $340.00:
A letter was read from City Treasurer Mary Ellison. One clerk -steno was leaving and she was
hiring another and would need $340.00 more than is left in the Budget. Motion made by Kilbury
seconded by Moore to turn this to the Finance Committee and City Attorney for proper action
by next meeting. Motion carried.
L I B,RARY LIGHT POLE :
A letter was read from City Supervisor, George R. Fisher, stating the Franklin County P.U.D. No. 1
is moving light poles in Hopkins St. adjacent .to the new library building so pole will be behind
the,curb line. Now does the City want to install steel poles and flourescent fixtures as used.
in the Business District, or wooden poles as Residential District and Residential type lights
retained? M -r. Murray has held up pouring sidewalk for Council discussion. Motion made by Moore,
seconded by James that the improved type mercury vapor lamp like ones installed at the High School'
and' steel pole be used. Motion carried.
CITIZEN'S COMMITTEE REPORT FOR STREETS:
A letter was read from City Supervisor, George R. Fisher, attached to the Citizen's Committee
Report. It is .recommended that the Council study this .report, then either concur or revise as
a Public Hearing is required before their -six year program can be submitted to the Highwaay
Department. He suggests that the Public Hearing be set for the first week in December, 1961 to
allow for any revisions that may result from such Hearing and in the event a second Hearing may
be necessary or advisable.
THE CITIZEN'S COMMITTEE REPORT attached to submittal letter and signed by their six members was
read. Motion made by Kilbury that a Public Hearing be -held the first Monday in December, 1961.
Motion died for want of a second. Following a short discussion, it was decided to hold a study
meeting Tuesday, November 14, 1961. Motion made by Grant, seconded by Kilbury, that the Mayor
callr.a meeting of the Citizen's Committee and City Council for November 14, 1961. Motion Carried.
ORDINANCE NO. 1039:
AN ORDINANCE PROVIDING THAT THE OFFICES OF CITY
CLERK AND CITY ATTORNEY SHALL BE APPOINTIVE
Passed by the Council October 17, 1961 and vetoed by the Mayor October 24, 1961.
A letter to the Council members, dated October 24, 1961 and signed by Mayor Raymond Hicks, was read,
stating that in conformance with the provisions of R.C.W. 35.24.210, Ordinance No. 1039 is being
vetoed and returned to the Council. He objects to making -the City Clerk and City Attorney positions
appointive as he states "I sincerely believe that the citizens of a city should have the right to
select -the officers to serve them at an election held for that purpose." Motion made by Kilbury,
seconded by James to override the Mayor's veto and that Ordinance No. 1039 become a law without
the -Mayor's signature. By Roll Call vote, the Mayor's veto was sustained; the motion did not
receive the affi-rimative vote. Grant, Greenlee, James and Kilbury voting •"Yea",; K.E'.Moore and
Van Hoy voting "No".

CLAIMS:
WATER DEPARTMENT -- OMAH J. EPPERLY. $25.00:
A claim was presented agaihst the City of Pasco November 1, 1961 by Pars, Omah J. Epperly, 928 W. Court
to cover cleaning, by reason of sewer backing up in their basement on September 14, 1961. Motion
made by Van Hoy, seconded by Grant, that -claim be .a_)lowed as per recommendation of the Water
Superintendent. Motion carried by roll call vote of six (6). .
AIRPORT -- E. -H: SMITH, $15,000.00:
Summons served by the Franklin County Sheriff's office on the City of Pasco, defendant, at the hour
of 10:15 A.M., October 25, 1961, received by the City Clerk, Adah M. Perry. Served for plaintiff,
Eugene H. Smith, who claims that on August 9, 1960, he sustained injuries at the Pasco Airport
Terminal by slipping and falling on a highly waxed and uneven floor, causing a ruptured spleen, which
resulted in surgery, severe loss of blood, suffering both physical and mental and loss of earnings in
the amount of $15,000.00, together with costs of this action. Motion made by Moore, seconded by James
that summons be turned to the City Attorney to take proper action in behalf of the City of Pasco,
defendant. Motion carried.
REPORTS:
COUNCILMAN GREENLEE ASSIGNED DUTIES:
At this time Kilbury.stated he would like to make a motion that Councilman Robert L. Greenlee be
assigned to Committees and duties previously .held by his predecessor, Ed Thompson, which includes
Purchasing Agent duties also. Motion seconded by Moore and carried.
AIRPORT LEASES:
Five (5) Airport leases submitted as follows:
MACKEY BROTHERS (Bob & Jim) dba Tri -City Limousine Service:
Limousine operating privileges at Airport Terminal Building; June 1961 to May 31, 1962
on a month to month basis; $1.00 per passenger seat per month (option to cancel on 30
dayswr.itten notice by either party).
PASCO JUNIOR CHAMBER OF COMMERCE:
Building #108 and outside area and room in West leanto of Bldg #142.; November 1, 1961
to October 31, 1962; $35.00 per month, first and last month paid; for woodworking business.
A.R. SIME Ahd7or. SIME CONSTRUCTION CO. R. H. GILLETTE:
Bldg #73 and outside area; November 16, 1961 to November 15, 1962; $200.00 per month,
first and last month paid; for storage of contractor's equipment and supplies.
TRI -CITY AIRWAYS:
Area in Hangar ;142; November 10, 1961 to November 9, 1962; $.180.00 per month, first
and last month paid; for storage of airplanes and aeronautical equipment.
CLIFF UNGERECHT:
15,000 sq. ft. fenced area for storage of construction equipment and material; September 1,
1961 to August 31, 1962; $50.00 per month, first and last month paid.
Motion made by Van Hoy seconded by Kilbury authorizing the Mayor to sign leases. Motion carried.

The following purchases requested:
Airport Department: Tractor tire, 10 chair seats recovered, doors,
electric heaters, venetian blinds, paneling, celotex, cooler
duct, floor.tile, felt, adhesive, lights, m6lding, nails, hinges,
stair treads, stair material, etc., plus tax $1,405.30
Cemetery Department: 5 rolls galvanized wire, 2 rolls mesh, cement
blocks, 60 sacks cement 424.26
Clerk's Department: 500 budget ledgers, tax 29.40
Fire Department: 48 uniform Shirts, tax 224.64

Treasurer's Department: General fund ledgers, tax 35.71

Motion made by Kilbury, seconded by James authorizing purchases to be made. Motion carried by roll
call vote of.six (6).

Councilman Kilbury read Golf Course report and Park usage report.

TRAFFIC COUNT:
City Superv,i•sor furnished each Council member a copy of Tabulation of Traffic Counts. This information
to be used wherever needed.
CAST IRON PIPE for Water Department is beginning to arrive.
WATER COMMITTEE MEETING:.
Moore states a Committee meeting will be held at 3:30 P.M., Friday, November 10, 1961 to consider
water problems along with Haystad's request.
FLU SHOTS:
Water Superintendent Whetsler spoke to the Counci.l about sponsoring flu shots for his crew to prevent
absenteeism. Councilman Grant feels that they should be available for all Departments. Motion made
by Grant, -seconded by Moore that this be studied further at the Friday meeting. Motion carried.
Kilbury voting "No." Shots can be obtained at 83C each.
CIVIL DEFENSE:
Councilman Moore -spoke about setting up a Civil Defense Council with one member from each incorporated
town (approximately 9 towns), two (2) counties and the School District; .th;i:s:.would be twelve (12) on
the Council. They would like to hold a meeting at 7:30 P.M. November 13, 1961. Councilman Kilbury
complimented Councilman Moore for his effort in this movement. Motion made by Kilbury, seconded by
Greenlee appointing Moore to represent Pasco. Grant thought the Mayor should do the appointing. At
this time, the Mayor appointed Councilman Moore to represent the City of Pasco on the Civil Defense
Council, or coordinating body. The motion was never placed.
FALL OUT SHELTERS:
No charge for building permits was suggested. Building inspectibm-A s necessary.
BRUCE LEE, CIVIL DEFENSE DIRECTOR stated the films on shelters, etc. should be received any t1ime now.
ASSOCIATION OF WASHINGTON CITIES:
Harold James spoke on the, -meeting held October 25, 1961. He thought it a well attended meeting. Some
valuable information was obtained. Voting on Cities receiving 1/20 of the 5% sales tax will be
studied and ballots are to be turned back to the Association of Washington Cities as soon as possible,
STREET LIGHTING PROGRAM: To be studied at the next study meeting.
CLARK -COLEMAN'S PHASE 1 REPORT:
The City Council is interested in knowing if copies of this report could be made available to interested
parties or potential development interests. James to check this out.
ZOO SIGNS:
Counclaman Kilbury states the Zoo situated up the River, approximately seven miles, would like to place
directional signs within the City Limits, especially one at Empire Way and North Fourth --just a regulation
sized sign. Motion made by Kilbury, seconded by Moore that one sign be erected at North Fourth and
Empire Way, similar to Golf Course sign. Motion carried.

City Clerk furnished each member a copy of all Department October, 1961 Budgetreport.

ORDINANCE NO. 1040:
AN ORDINANCE PROVIDING PROCEDURE FOR TRANSFERS
BETWEEN ITEMS WITHIN ANY CLASS IN THE BUDGET
Motion made by Grant, seconded by Kilbury that Ordinance No. 1040 be given the first reading in full.
Motion carried. Ordinance No. 1040 was read. Motion made by Grant, seconded by Kilbury that Ordinance
No. 1040 has been given the first reading in full. Motion carried. Motion made by James, seconded
by Kilbury to adopt Ordinance No. 1040. Motion carried by roll call vote of six (6).
RESOLUTION NO. 492:
A RESOLUTION 'COVERING THE PROCEDURE FOR DISBURSEMENT OF THE FUNDS OF THE FRANKLIN
COUNTY REGIONAL PLANNING COMMISSION HELD BY THE CITY OF PASCO AS A PUBLIC DEPOSITORY
FOR THE FRANKLIN COUNTY REGIONAL PLANNING COMMISSION.
Motion made by. James, seconded by Kilbury to read Resolution No. 492 in full. Motion carried.

No., 492 has been gi•ven'a reading in full. Motion carried. Motion made by James, seconded by
Kilbury to adopt Resolution No. 492. Motion carried by roll call vote of six (6). .
FRANKLIN COUNTY IRRIGATION DISTRICT:
Duane Taber spoke for the group that just arrived from the Irrigation District meeting. They requested
a letter from the City stating they are willing to go along with an agreement that will be worked out
whereby the Irrigation District can furnish water West of Chase by gravity flow, across the streets
and alleys. The request from Duane Taber is that a letter over the Mayor's signature be written,
cohfirming the intent of the City Council to enter into an agreement with ,the Irrigation District.
Motion made by Grant, seconded by Kilbury that the City Attorney prepare a letter for the Mayor to sign.
MOtion carried.

Motion made by Grant, seconded by Kilbury to adjourn to next regular meeting 8:00 P.M. on Tuesday,
November 21, 1961. Motion carried.
