HomeMy WebLinkAbout10-17-1961 Minutes3023 PASCO, WASHINGTON REGULAR MEETING COUNCIL CHAMBERS OCTOBER 17, 1961 CALL TO ORDER: Meeting called to order at 8:00 P.M. by Honorable Mayor Raymond Hicks. ROLL CALL: By Clerk. Councilmen present were C. R. Combs, G. A. Grant, H. C. James, C. D. Kilbury, K. E. Moore, and T. R. Van Hoy. COUNCILMAN ELECTED: Motion made by Kilbury, seconded by James to set aside the regular order of business to elect a Councilman to fill the vacancy created by Ed Thompson's resignation. Motion carried. Councilman Kilbury nominated Robert L. Greenlee. Motion made by Moore, seconded by Kilbury that nominations be closed. Robert L. Greenlee was elected by roll call vote of six (6). At this time Robert L, Greenlee took the Oath of Office administered'by the City Clerk, then was duly seated at the Council table. The Mayor.returned the meetii.ng to Regular Order of Business. APPROVING OF MINUTES: Minutes of meetings held October 2 and October 3, 1961.. Motion made by James, seconded by Kilbury, approving minutes as written. Motion carried. PUBLIC HEARING --REZONING LOTS 1 & 2, BLK 22, PETTIT'S ADDITION FROM R-1 TO R-2: Legal Notice of Public Hearing was read. Mayor declared the Hearing open. Rex Phillips, 412 N.Ninth wished to be ihformed as to what this property would have constructed on it and expressed a desire to see the plans as to building, occupancy and off-street parking provisions. Mr. R. D. Lat.ture, 403 N. Ninth and E. S. Budig, 414 N. Ninth were also interested in having available the same informa- tion. They feel that certain building;construction would or could be detrimental to their property value. Mr. Henry Che:zem states he has nothing to say at this time other than that off-streetparking is in the plan. Motion made by Van Hoy to turn this to the proper Committee of the Council for study. Other questions came up; Van Hoy withdrew his motion. Motion'made by James, seconded by Grant to continue Public Hearing to November 7, 1961, at which time plans, etc. will be presented for review and study. Motion carried. The Council requested that plans be furnished in time for the Council to study them at their study meeting on Tuesday, October 24, 1961. Mr. Chezem agreed to this.. COMMUNICATIONS: NORTHERN PACIFIC RAI-LWAY COMPANY'S PROPERTY ADJACENT TO RIVERVIEW PARK --RECREATION, PONY LEAGUE: A letter was read from S. G. Merryman, Manager of Timber & Western Lands, 1008 Smith Tower, Seattle, Washington, stating afield examination will be scheduled as soon as possible in this' area and their representative will contact City officials for additional information. STATE HIGHWAY COMMISSION, LOCATION AND ACCESS FEATURES OF PRIMARY STATE HIGHWAY NO. _3: -A letter was read from R. N. Pyle, District Engineer, attached were twelve (12) copies of a report to be presented to the governing body of the City in compliance with Chapter 235, laws of 1957.A1so, arrangements have been made for a Public Hearing on this project at 10:00 A.M. November 20, 1961 at the Pasco Community Center. He would like to be advised as soon as possible if this time and place meets the_,approval of the Council body. Additional copies of the report are available. Mayor to answer letter. Meeting time and place are OK. AIRPORT FUNDS, F.A.A.: A letter was read from Robert C. Wing stating that, since Congress has authorized funding for two years (1962 and 1963), it would seem quite obvious that a call for applications for 1963 participating monies will likely be issued early in 1962. Communities which have taken preliminary steps to arrange local financing will be in a better position to submit applications. Airport Manager, H. W. Parkinson, states he will be unable to finance a program for a couple more years. Mayor to answer letter. 16TH LEGISLATIVE DISTRICT: A letter was read from Joyce R. Kelley, Mayor of Richland, stating that he and other members of the City Council will attend the dinner meeting at the Pancake House October 25, 1961. ' EARL WARREN EXCAVATION, SEWER ON MARGARET ST.: A letter was read from City Supervisor recommending acceptance of contract on Margaret St, sewer line East from Third, which has been completed in accordance with specs. Motion made by Kilbury, seconded by Moore accepting contract as completed this date. Motion carried. WATER SERVICE REQUESTED, L.C. HAVSTAD: A letter was read from Water Superintendent C. F. Whetsler stating Mr. Haystad has requested a water line to service Blks 4 and 9, Pfierret's sub -division, estimated costs itemized in the amount of $4,459.75• He also requests a 6" line down Road 40, South from Sylvester at an estimated cost of $2,923.13, materials itemized. Motion made by Moore, seconded by' Grant that this be turned to the water committee. Motion carried. REGULAR MEETING STATE HIGHWAY DEPARTMENT, N. FOURTH: PASCO, WASHINGTON COUNCIL CHAMBERS 30;30 OCTOBER 17, 1961 A letter was read from Water Superintendent C. F. Whetsler stating that the State Highway Department asked for costs on a 1" meter and.a 1'—z" meter installation to serve the E z of the N 1/3 of their lot where the office building is located. 209' front footage charges would be $418.00. Installation of 1" meter $130.47; 1'-2" meter $268.19 from the 16" main in Arthur St. Motion made by Moore, seconded by Kilbury approving proposition as submitted. Motion carried. BUILDING OFFICIAL SCHOOL: A letter was read from Building Inspector R. B. Lovelace requesting permission to attend this school in Pullman November 6 through November 10, 1961 and use the City car for transportation. Motion made by James, seconded by Kilbury granting permission as requested. Motion carried. INLAND EMPIRE WATERWAYS ASSOCIATION: Meeting will be held in Spokane on October 22,23 and 24,.1961 at the Davenport Hotel. Motion made by Grant, seconded by James authorizing the Mayor to attend. Motion carried. BOAT BASIN LEASE, MEMORANDUM AGREEMENT, JOHN B. OWSLEY: For the purpose of financing, the City of Pasco and the Department of the Army, U.S. Engineering District of Walla Walla, Corps of Engineers agree to a sub -lease between John B. and Mary Jane Owsley and the Phillips Petroleum Company. "Exhibit A", Marina Lease -Agreement, by reference is made a part hereof as though set out in full in the memorandum agreement. REFUND --JAMES A. McLEOD, 1027 W. PARK: A letter was read from C. F. Whetsler, Water Superintendent setting out record of occupancy and sewer charges which indicate that Mr. McLeod has $100.90 allowable refund. This is recommeded by Whetsler. Motion made -by Moore, seconded by Grant that refund be granted. Motion carried by roll call vote of seven,!(7) . REFUND --;REX DAVIS: A letter was read from Water Superintendent C. F. Whetsler recommending that the City Treasurer be authorized to refund $12.00 overcharge on a paving cut. Motion made by Moore, seconded by Kilbury that refund be allowed and Treasurer so authorized. Motion carried by roll call vote of seven (7). REFUND --EUGENE MOORE, 630 S. OREGON, CARD TABLE LICENSE APPLICATION; ORDINANCE NO. 677: Motion made by Grant, seconded by Kilbury authorizing $15.00 refund as operator cannot comply with Ordinance. Motion carried by roll call voteof seven (7). VISITORS: Mollie Hall commended the Councilmen on their election of Robert L. Greenlee to the Council: CLAIMS: J.D. BROODER: Stanley D. Taylor, attorney, presented a claim for Mr. Brooder against the City i.n the amount of $933.00 for services rendered as Assistant Engineer, and unpaid to Plaintiff. Answer to Plaintiff, J.D.Brooder, by Defendant City of Pasco denies the allegations contained in paragraphs II and III of the Plaintiff's complaint. The claim and answer were read in full. Motion made by VanHoy, seconded by Grant that the _ claim be turned to the City Attorney for appropriate action. Motion made by Van Hoy, seconded by Kilbury authorizing Mayor to sign answer prepared by the City Attorney. Motion carried. REPORTS: AIRPORT LEASE: One (1) lease was submitted by Smith Truck and Tractor. Motion made by Van Hoy, seconded by Combs authorizing Mayor to sign. Motion carried. AIRPORT CAR BIOS: Councilman Van Hoy reports on car bids, recommending that the low bid of Farley Chevrolet be accepted. Motion made by Van Hoy, seconded by James accepting the low bid of Farley Chevrolet in the amount of $2,192.90. Motion carried. ' AIRPORT550LD PANEL CAR: Council will have to decide on minimum price before this can be disposed of. Wyman interested and needs this panel but is short on funds. This matter will be brought up at the work meeting Tuesday, October 24, 1961. PURCHASES: The follow1ng purchases requested: Water Department: Packing for sewer pumps, lab supplies, meter yokes, meter repair parts, tools, meter cleaner $1,028.29 City Engineer:. Typewriter ribbon, pencils, stationery, file clips 26.79 Total $1,055.08 Motion made by Kilbury, seconded by James authorizing purchases as requested. Motion carried by roll call vote of seven (7).„ PASCO, WASHINGTON REGULAR MEETING COUNCIL CHAMBERS OCTOBER 17, 1961 COUNCILMAN KILBURY reported on Library Dedication. He also states that the Y.M.C.A. are anxious to get the slab in place for the Recreation building in Kurtzman Park. Motion made by Kilbury that the slab be put in with allowance for plumbing. Plans were discussed. Motion died for want of a second. Councilman Grant feels that plans should be revised as suggested in January, 1961 and a slab constructed to plan. Architect can, no doubt, submit another copy of the the corrected plan. Basketball black top courts are being used in Memorial and Kurtzman Parks, reports Wyman. -BUSINESS LICENSE APPLICATIONS: Two applications submitted as follows: W. GORDON PINTLER Sahara Motel Solicit -Americana SPUDNUT SHOP 926 W. Lewis Spudnut shop Kathryn E. Layton Motilin made by Grant, seconded by James that::the same be issued. Motion carried. With reference.to dancing at the Sage Tavern with live music, motion made by Grant, seconded by James that the committee and Chief of Police have no objection if requirements of the State and City laws are complied with. Motion carried. STREET TRAFFICS: This will be discussed at the meeting on Tuesday, October 24 at which time the traffic count should be completed. Councilman Combs has no report. WATER --BID ON CAST IRON PIPE: Motion made by Moore, seconded by James to accept the low bid of U. S. Pipe and Foundry in the amount of $26,581.59. Motion carried. jr 1111 1--QFE ENSE: Bruce Lee, Civil Defense Director reported on meeting he attended in Olympia on September 26, 1961. This is a nine page report and a li.ttde complicated to discuss during a regular meeting. City Clerk to furnish copies to all members and others desiring same. Further study will be applied Tuesday October 25, 1961. Bruce Lee also submitted prices on survival kits and supplies and where to obtain same. CITIZENS ADVISORY COMMITTEE ON CIVIL DEFENSE: Motion made by Moore, seconded by Kilbury that the Mayor appoint a citizen's adV1sory committee on Civil Defense, consisting of fifteen members. Motion carried. More discussion on this at the work meeting October 24 so that the advisory committee can meet Tuesday, at 7:30 P.M., October 31, 1961 at the City Hall. Committees of three cities and two counties will be present to discuss fall out shelters. Council members will assist the Mayor in comp'il'ing_ the names of appointees. NUISANCE ORDINANCE: Councilman James reports the Planning Commission will "soon be coming up with an Ordinance amending or expanding the Nuisance Ordinance. LEGISLATIVE DISTRICT NO. 16, MEETING OCTOBER 25, 1961: Councilman James also reminded members of the chicken dinner meeting at the Pancake House. GOLF COURSE: Councilman Kilbury reports on Golf Course, stating receipts to date are $30,000.00 WATER: Councilman Moore reviewed the waterworks program. BY-PASS HIGHWAY: Councilman Van Hoy thinks the Council body should meet before the Hearing and have a speaker to express the desires of the Council and make suggestions and requests when and if need be. He definitely feels that bottle -necks are going to show up in places. Interchange at Chase should be studied before the Hearing. Tuesday,.October 24, would be a good time to start this study. READING OF ORDINANCES: ORDINANCE NO. 1038: AN ORDINANCE CREATING AND PROVIDING FOR THE OPERATION OF A.FRANKLIN COUNTY REGIONAL PLANNING FUND Motion made by Grant, seconded by James to read Ordinance 1038 by title only. Motion carried. Ordinance No. 1038 was read by title. Motion made by Grant, seconded by James that Ordinance No.1038 has been read by title. Motion carried. Motion made by Grant, seconded by James to adopt Ordinance No. 1038. Motion carried by roll call vote of six (6). Combs out of the Chamber. I PASCO, WASHINGTON REGULAR MEETING COUNCIL CHAMBERS OCTOBER 17, 1961 ORDINANCE NO. 1039: AN ORDINANCE PROVIDING THAT THE OFFICES OF CITY CLERK AND CITY ATTORNEY SHALL BE APPOINTIVE Motion.,made by Kilbury, seconded by James that Ordinance No. 1039 be read in its entirety. Motion carried. Ordinance No. 1039 was read in full.. Motion made by Kilbury, seconded by James that Ordinance No. 1039 has been given a full reading. Motion carried. Motion made by Kilbury, seconded by James to adopt Ordinance No. 1039. Motion carried by roll call vote of four (4). Grant, James, Kilbury and Greenlee voting "Yes"; Moore and Van Hoy voting "No". Combs out of the Chamber. Mayor Hicks was not pleased with this Ordinance and he intends to give it some thought before doing anything about it.
