ROLL CALL: OCTOBER 4, 1960 By Clerk. Councilmen present were C. R. Combs, G. A. Grant, H. C. James, C. D. Kilbury, K. E. Moore, Ed Thompson and T. R. VanHoy. City Attorney R. G.'Patrick was present also City Supervisor George R. Fisher. APPROVING THE MINUTES: Minutes of meeting held September 20, 1960 were approved. Motion so made by Combs, seconded by Thompson and carried. BILLS: Current bills presented for payment as follows: Current Expense Water Department Park Department Cemetery Department Golf Course Yacht Basin Street Department Airport Department Library Department L. I. Motion carried by roll call vote of seven (7). PUBLIC HEARING - VACATE 8' OF CARTMELL STREET AND PORTIONS OF ALLEYS IN BLOCK 1, STAR ADDITION: Legal notice of public hearing was read also. a letter from Harry Hudlow of the P. U. D. stating that their estimate for moving a utility pole is $225.00. Mayor Hicks declared the hearing open. Following a discussion on the alley replacements and changes including the cost on change of location of the utility pole it was decided to look into the alley situation further. Motion made by Grant, seconded by Kilbury that the hearing be closed. Motion carried. No protests were received by letter or in person. Motion made by VanHoy, seconded by Kilbury to turn this to the Street Committeeeand the Engineer for study in solving the situation and then report back. Motion carried. PUBLIC HEARING - REZONE LOT 11, BLOCK 10, COLUMBIA ADDITION FROM R-1 TO C-1: Legal notice on Public hearing was read. Mayor declared the hearing open. James Williams was anxious to be assured that a less desireble type of business would not be allowed if and when the property changed hands; he lives across the alley. Lloyd Kestin spoke of not favor- ing spot zoning and was interested in having the south side of two blocks from Chase to Illinois rezoned - six (6) lots in Block 9 are not in the City - Mr. Weige owns this property. Richard Winship objects to spot zoning. Restrictive covenants in Columbia Addition were discussed. Motion made by Moore, seconded by Thompson to turn this to the Plamming Committee of the Council and the City Attorney to attempt to work out a solution with parties concerned. Motion carried. Plblic hearing declared closed. No protests were received by mail. City Attorney informed Mr. Beeler that he could have his name removed from the petition through a request by mail. VACATE THE SOUTH HALF OF ALLEY IN BLOCK 25, HELM'S SECONDDADDITION: Notice of public hearing was read. Mayor declared the hearing open. No protests submitted by letter and no one present to protest. Mayor declared the hearing closed. Motion made by Kilbury, seconded by Grant that the request by petition be granted and an ordinance be drawn declaring the alley closed. Motion carried. PUBLIC HEARING - EMERGENCY ORDINANCE NO. 1007, $2,828.80: Notice of public hearing was read. No objections rendered. Public hearing declared closed. COMMUNICATIONS: YACHT BASIN GRAVEL REMOVAL $3,000.00: A letter sari read from Senator Warren G. Magnuson stating he had received Richard G. Patrick's letter of September 7, 1960. He suggested that the details be submitted to his Washington, D. C. office to the attention of Glenn Colyar who will in turn take the problem up with the Corps of Engineers and report to him. If possible he will be in the Tri City Area before November 8, 1960. f9"5 PASCO, WASHINGTON PERPETUAL EASEMENT - ARMY ENGINEERS NO. DA45-164-CIV ENG 61-36: McNary Lock & Dam Project Easement commencing September 15, 1960, fulfilling conditions of the Department of the Army Contract No. DA -164 -CIV ENG 57-51 submitted by Max K. Tysor, Chief Real Estate Division, Walla Walla. George R. Fisher requests that the Easement be Recorded at the Court House. JAY STREET DUST CONDITIONS: A letter was read from Mrs. T. W: Evans, 1835 Jay, reporting on dust conditions between Chase and Meridian on Jay. City Engineer states that this street is being surfaced -at this time. POLLUTION CONTROL ASSOCIATION: A letter was read from C. F. Whetsler, Water & Sewer Superintendent, requesting permission for he and Ray Morrow to attend the Pacific Northwest 27th Annual meeting on October 20, 21 and 22, 1960 in Walla Walla; also requests transportation. Motion made by James, seconeed by Thompson granting the request. Motion carried. CONVENTION - AMERICAN PUBLIC WORKS ASSOCIATION: City Supervisor George R. Fisher requests permission to attend this convention in Bellingham on November d, 1960 and transpoitation. Motion made by James, seconded by Grant authorizing the Bequest. Motion carried. STATE DEPARTMENT OF CONSERVATION - GOLF COURSE WELL: Certificate of Ground Water Right received and recorded at the Court House. HEARING FROM VISITORS: LABOR UNION AGREEMENT: Sam Kinville, representing the Union for City and County Employees, urged the Council to sign the agreement. A discussion with the Council followed. Every one desiring to speak was heard. REPORTS: PURCHASES: The following purchases were presented: WATER DEPARTMENT: Sludge pump, meter, truck repair, tractor repair, mtnce contract, & mi,sc parts PARK DEPARTMENT: Galvanized pipe CITY ENGINEER: Antifreeze for all departments CEMETERY: Cement, wire, lumber, rollers, guides & stops AIRPORT: Mat'l to repair Bldg # 58 and bondex STREET: Six tons Salt $ 1,716.94 76.20 106.70 584.97 634.38 249.60 Motion made by Thompson, seconded by James authorizing the purchases as submitted. Cronin Materials $2,036.97 ' Tax 81.47 $2,118.44 VanHoy states that the Committee recommends that Williams Sheet Metal Price be accepted. • Motion made by VanHoy, seconded by Thompson that Williams Sheet Metal price of $1,944.80 including tax, be accepted and the Mayor authorized to sign contract. POLICE COMMITTEE REPORTS ON COURT & LUCAS PETITION: Councilman Grant states that this particular intersection was observed on several different occasions and it was noted that there is a very, definite pedestrian and motor vehicle problem approximately one hour before school takes up in the morning and also one hour after it is dismissed in the afternoon. There seems to be rather heavy vehicular traffic during the noon hour, but the pedestrian factor is very slight at this time. Due to thennuuiber of residences north of Court and on both sides of Lucas Street and the locations of the Senior High School and the two Grade Schools, this causes a large number of school children to cross Court Street at this intersection. There are no side -walks on Lucas Street where it intersects with Court Street, either north of Court Street or south of Court Street. Children walldng south on Lucas Street walk on the sidewalk until they get approximately one block from Court Street and then the sidewalks end and the street narrows down and due to a Wire fence and the absence of sidewalks it is necessary for the children to walk in the street. It appears that the quickest and best remedy to this situation would be the addition of sidewalks to,the intersection rather than a traffic signal. In reference to the intersection at 4th & Court Street and the foot traffic that does not use the existing crosswalk; the officers have been instructed to take measures to correct this situation. The problem at this particular intersection seems to arise from people parking their autos on the west side of 4th Street and walling across the street to the Drive In. There are sidewalks on three sides of this intersection, but the absence of one of the northwest corner of this intersection has and always will create a hazardous condition for both vehicular and pedestrian traffic. STREET SWEEPER: The need of a street sweeper was discussed. Motion made by Combs, seconded by VanHoy to call for bids to be opened on Tuesday, October 25th at 1:00 P. M. with specifications to be furnish- ed by George R. Fisher. Motion carried. LIBRARY & CEMETERY COMMITTEE to report later. PARK BOARD to have a meeting at a later date and report. JAMES REPORTS ON PLANNING: - Legislative Committee of the 16th District will meet on Thursday, October 6th at 7:00 P. M. at the City Hall. Garbage ordinance has been presented for action. BUILDING INSPECTOR'S REPORT: Building Inspector's Report was read by the Mayor. READING OF ORDINANCES AND RESOLUTIONS: ORDINANCE NO. 1007: AN ORDINANCE DECLARING AN EMERGENCY IN THE CEMETERY DEPARTMENT OF THE CITY OF PASCO AND APPROPRIATING THE SUM OF $2,828.60 FROM THE CURRENT EXPENSE FUND TO PURCHASE A.TRUCK FOR THE CEMETERY DEPARTMENT Motion made by Thompson, seconded by Kilbury that Ordinance No. 1007 be read by title. ORDINANCE NO. 1009: AN ORDINANCE AMENDING SECTIONS 9, 10 AND 11, AND REPEAL- ING SECTION 12 OF ORDINANCE NO. 989, BEING AN ORDINANCE RELATING TO TRADE STIMULATORS, PROVIDING FOR THE LICENS- ING THEREOF, DEFINING OFFENSES AND PROVIDING PENALTIES, AND REPEALING SECTION 11 OF ORDINANCE NO. 394 AND PASCO CITY CODE 3-12.72, AS IT NOW EXISTS, AND ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH Motion made by James, seconded by Kilbury that Ordinance No. 1009 be read by title. S PASCO, WASHINGTON REGULAR MEETING CITY COUNCIL OCTOBER 4, 1960 ORDINANCE NO. 10'10: AN ORDINANCE PROVIDING FOR A DOG WARDEN, SETTING FORTH HIS DUTIES AND THE PAYMENT FOR HIS SERVICES 2927 Motion made by James, seconded by Grant that -Ordinance •No.- 1010 be read by title. Motion carried. Ordinance No. 1010 was read. Motion made by James, eeconded by -Thompson that Ordinance No. 1.010 was read by title. Motion carried. Motion made by James, seconded by Kilbury;to adopt Ord- inance No. 1010. Motion carried by roll call vote of seven (7). RESOLUTION NO. 473: A RESOLUTION ADOPTING A LABOR AGREEMENT Motion made by Kilbury, seconded by Moore to read Resolution No. 473. Motion carried. Resolution No. 473 was read in full. Motion made by Kilbury, seconded by Moore that Resolution No. 473 has been read in full. Motion carried. Motion made by Kilbury, seconded by Moore to adopt Resolution No. 473 by roll call vote. Combs, Grant, Thompson and VanHoy voting "No". James, Moore & Kilbury voting "Yes". Motion lost by majority vote. AGREEMENT SIDEWALK WAIVER: R. J. Gholar requests to black top at 512 So. Sycamore for the.Baptist Church instead of installing sidewalk at this time. Motion made by James, seconded by Kilbury to accept the agreement,authorizing the Mayor to sign. Motion carried. HARRY McCALL expressed his dislike to the Council voting "No" on Resolution No. 473. 1961 BUDGET: Account time running out another meeting would be necessary. ADJOURNMENT: Motion made by Kilbury, seconded by VanHoy to adjourn meeting until Wednesday, 8:00 P. M., October 5, 1960 to work on the 1961 Budget.
