ROLL CALL: By Clerk. Councilmen present were C. R. Combs, H. C. James, C. D. Kilbury, K. E. Moore and Ed Thompson.. Absent George A. Grant and T. R. VanHoy. City Attorney Richard G. Patrick and City Superintendent G. R. Fisher were present. APPROVING THE MINUTES: BIDS: Minutes of meeting held September 6, 1960 were approved. Motion so made by James, seconded by Kilbury and carried. Motion carried. BIDS ON VIBRATING POWER ROLLER: One bid was received, opened and read. Motion carried. COMMUNICATIONS: NEW YORK LIFE INSURANCE COMPANY (J. L. MAST): A letter was read from Special Agent J. L. Mast requesting action by the Council body for minute records the following: "To resolve that the City Clerk is authorized to make payroll deductions from the pay of Policemen and Firemen for the purpose of purchasing Group Life Insuranceb9overage from New York Life Insurance Company': Motion made by James, seconded by Moore that/request of Mr. Mast the City Clerk is hereby authorized to make payroll deductions from the pay of Policemen and Firemen for the purpose of purchasing Group Life Insurance Coverage from the New York Life Insurance Company. Motion carried. ASSOCIATION.OF WASHINGTON CITIES - 5% SALES TAX: A letter was read from the Association stating that candidate Lloyd Andrews gave full endorse- ment to the proposal of sharing 1/20 or 5% of the income from the retail sales tax be returned to the Cities and Towns to help with thkir financial problems. Governor Rosellini states he would ask the next legislature to grant Cities financial aid through this proposal of 5% of the sales tax revenue or its equivalent. Chester Biesen urges all Mayors and Councilmen to write the legislators in an, effort to secure passage of the bill at the 1961 legislature. K.- PASCO, WASHINGTON REGULAR MEETING COUNCIL CHAMBERS SEPTEMBER 20, 1960 !i LIBRARY: A letter was read from Librarian Mr. R. S. Burrill stating that the Library Board of Trustees passed two resolutions at their meeting September 19, 1960 as follows: "Resolved.to request the City Council to request Library Building Consultant service from the Washington State Librarian, Miss Maryan Reynolds, to assist the Library Board in solving its Library building design problems And: Be it resolved that when a library building is designed and built that t-:1 the Pasco Library Board recommend to the City Council the service of Victor Wulff be retained as architect. Furthermore, that a suitable agreement be arranged between the City of Pasco and Victor Wulff, architedt." The consultant's services furnished by the State of Washington Library is free. No action taken on letter. Library Bond Ordinance to follow. Mr. Burrill reports on an oral vote taken regarding location of the new Library Building, 70% or better did not approve of the City property east of the Memorial Park. He feels that a desired location can be worked out. L. I. D. #65: A letter was read from City Supervisor George R. Fisher advising the Council that the construction of L. I. D. #65 by L. W. Vail Company has been completed according to plans and specifications and would recommend that the project be accepted and the Tax Commission notified. Motion°made by Kilbury, seconded by Thompson to accept the contract of L. W. Vail Company on the construction of L. I. D. 465 as complete. Motion carried by roll call vote of five (5). LIGHT BITUMINOUS STREET SURFACE TREATMENT (ACME PAVERS INC.) A letter was read from City Supervisor George R. Fisher stating that the construction has been completed according to the specifications and recommends that -the project be accepted, and the Tax Commission notified. Motion made by Thompson, seconded by Kilbury to accept the contract of Acme Pavers Inc. on Street surfacing as completed. Motion carried by roll call vote of five (5). CONVENTION - H. A. WYMAN: Mr. Wyman requests permission to attend the Regional Turf Conference in Seattle on September 28, 29 & 30th, 1960. Would like to use the Park Department vehicle. Motion made by Thompson, seconded by James that the request be granted. Motion carried. REGULAR ORDER OF BUSINESS SET ASIDE BY UNANIMOUS CONSENT MRS. R. W. COOK spoke to the Council relative to the.need of a stop light at the intersection of Lucas & W. Court as this location is very hazardous for the school children. Motion made by Moore, seconded by James to turn this to the Police and Street Committee for study and report at next regular meeting. Motion carried. REGULAR ORDER OF BUSINESS RESUMED BY UNANIMOUS CONSENT REZONING LOT 11, BLOCK 10, COLUMBIA ADDITION FROM R-1 TO C-1: A letter was read from the Planning Commission submitting -petition from owners of property above mentioned.for rezoning. Following a public hearing and study of the petition the commission recommends that the request be granted. Motion made by James, seconded by Thompson accepting the recommendation of the Planning Commission and that a public hearing be held on Tuesday, 8:00 P. M., October 4, 1960. Motion carried. PURCHASES: The following requests for purchases were submitted: CITY HALL JANITOR: Wax, soap -,powder, ammonia, towels, tissue and deodorant blocks $ ";124.14 PARK DEPARTMENT: Roof coating, grass seed, fertilizer, sprinklers, adding machine & roof repair 1,633.04 GOLF COURSE: Heaters 478.40 WATER DEPARTMENT: Hand tools and meter repair'parts 396.87 Motion made by Thompson, seconded by Kilbury authorizing the purchases as submitted. TRUCKS - STREET DEPARTMENT: Street Committee Chairman reports that the bid on two dump trucks was awarded to the lowest bidder, Smith Truck & Tractor Company. CIVIL DEFENSE: No report CEMETERY TRUCK: Cemetery Committee Chairman states that the Committee awarded Smith Truck & Tractor Company the bid. They submitted the only bid. ASSOCIATION OF WASHINGTON CITIES REGIONAL MEETING: Councilman James reminded and urged that everyone that possible could to attenithe meeting on September 21, 1960. LABOR AGREEMENT: Kilbury states that the Labor Agreement is ready to present and will come up under the reading of ordinances. and resolutions. TRADE STIMULATORS: The City Clerk reports that she and Chief of Police McKibbin have -decided that a small decal placed on the face of the stimulators would be convenient and eas3t'to police. They cost $14.00 per thousand. Section 9, 10, 11 & 12 of Ordinance 989 would have to be amended in order to use decals. Motion made Oy Thompson, second6d by Kilbury that this be referred to the City Attorney for an ordinance to amend. Motion carried. . LIBRARY: Mr. Burrill is of the opinion that the Library site property will be acquired before anything else is done. BOOKKEEPING MACHINE: The City Attorney spoke regarding this operation and thought the help of the State Auditor's Office on posting accounts and allocatinn would be fine. The Burroughs Company is going to instruct the operation phase starting the change over on January 1, 1961 was also suggested. Motion made by Kilbury, seconded by Moore authorizing the Mayor to write the State Auditor's Office relative to obtaining an Auditor's services. Motion carried. . CALL FOR BID AWARD: _ The City Attorney advised that authority to act given the committees when bids are open is frequently used and should be awarded at a regular meeting. The bids may be called and opened at a meeting so set by the Council but should be awarded at a regular meeting. READING OF ORDINANCES: ORDINANCE NO. 1906: AN ORDINANCE OF THE CITY OF PASCO, WASHINGTON, PROVIDING FOR THE CONSTRUCTING AND EQUIPPING OF A CITY LIBRARY IN- CLUDING THE ACQUISITION OF NECESSARY BOOKS THEREFOR, ON A SITE PRESENTLY OWNED BY THE CITY OR ON A SITE TO BE ACQUIRED; DECLARING THE ESTIMATED COST THEREOF AS NEAR AS MAY BE; PROVIDING FOR THE BORROWING OF NOT TO EXCEED $350,000.00 AND ISSUING AND SELLING NEGOTIABLE GENERAL OBLIGATION BONDS IN SUCH AMOUNT TO PAY THE COST THEREOF, WITHOUT LIMITATION AS TO RATE OR AMOUNT; DECLARING AN EMERGENCY; AND PROVIDING FOR THE SUBMISSION OF THE PROP- OSITION OF THE INCURRING OF SAID INDEBTEDNESS AND ISSUING OF SAID BONDS TO THE QUALIFIED ELECTORS OF THE CITY AT A SPECIAL ELECTION TO BE HELD IN CONJUNCTION WITH THE STATE GENERAL ELECTION TO BE HELD THEREIN ON NOVEMBER 8, 1960 , 2 00 24 REGULAR MEETING PASCO, WASHINGTON COUNCIL CHAMBERS SEPTEMBER 20, 1960 Motion made by Kilbury, seconded by Combs to read Ordinance No. 1006 by title. Motion carried. Ordinance No. 1006 was read. Motion made by Kilbury, seconded by James that Ordinance No. 1006 has been read by title. Motion carried. Motion made by James, seconded by Kilbury to adopt Ordinance No. 1006. Motion carried by roll call fote of five (5). ORDINANCE NO. 1007: AN ORDINANCE DECLARING AN EMERGENCY IN THE CEMETERY DEPARTMENT OF THE CITY OF PASCO AND APPROPRIATING THE SUM OF $2,828.00 FROM THE CURRENT EXPENSE FUND TO PURCHASE A TRUCK FOR THE CEMETERY DEPARTMENT Motion made by Kilbury, seconded by Thompson to read Ordinance No. 100q by title only. Motion carried. Ordinance No. 1067 was read. Motion made by Kilbury, seconded by Thompson that Ordinance No. 1007 has been read by title. Motion carried. Motion made by Kilbury, seconded by Thompson to set a public hearing for Tuesday, 8:00 P. M., October 4, 1960. Motion carried. RESOLUTION NO. 472 - LABOR AGREEMENT: Motion made by Kilbury, seconded by Thompson that Resolution No. 472 be read. Motion carried. Resolution No. 472 was read. Motion made by Kilbury, seconded by Thompson that Resolution No. 472 has been read. Motion carried. Motion made by Kilbury to adopt Resolution No. 472. A discussion followed. Councilman Combs states that this was not bo be acted upon until all members of the Council were present. Thompson was of the same opinion. Moore seconded the motion. Roll call vote was three (3) for the adoption and two (2) against. City Attorney states that the motion lost account not having the supporting vote of the Council. Mr. Kenville of Spokane, a Representative of the Union disagfeed with the Attorney. However, the City Attorney referred to the law supporting his decision. RESOLUTION NO. 471: A RESOLUTION ADOPTING THE PRELIMINARY BUDGET FOR 1961 Motion made by James, seconded by Kilbury to read Resolution No. 471 in its entirety. Motion carried.. Resolution No. 471 was read. Motion made by Thompson, seconded by James that Res- olution No. 4711has been read. Motion carried. Motion made by Thompson, seconded by James to adopt Resolution No. 471. Motion carried by roll call vote of five (5). NEW BUSINESS: JOINT PLANNING STAFF AGREEMENT: An agreement creating a regional planning commission consisting of Franklin County, Franklin County P. U. D., Pasco School District No. 1 and the City of Pasco with seven (7) voting members. Three (3) official members representing the City and one (1) each from the other organizations. Motion made by James, seconded by Kilbury authorizing the Mayor to sign the agreement with the other bodies. Motion carried. CLAIMS: EUGENE H. SMITH, AUGUST 9, 1960 AT THE PASCO AIRPORT: A claim presented by Lynch & Lynch for Mr. Staith, received by mail on September 19, 1960 in the amount of $15,000.00 covering injuries received at the Airport was read. Motion made by James, seconded by Kilbury to turn this to the City Attorney. Motion carried. APPOINTMENT -CIVIL SERVICE COMMISSION: The Mayor appointed David 7_ier to succeed M. N. Smyth on the Civil Service Commission. Motion made by James, seconded by Thompson approving the appointment of David Zier. Motion carried. Zier's term will expire on February 17, 1964. GOLF COURSE REPORT FOR AUGUST 1960: Report for the month of August, 1960 submitted as follows: August receipts $ 1,960.50 tax 55.52 Total receipts to date $ 9,530.64 (including tax) Report ordered filed. 0"i" j PASCO, WASHINGTON REGULAR MEETING COUNCIL CHAMBERS SEPTEMBER 20, 1960 LIBRARY AGREEMENT WITH VICTOR WULFF: Discussing further Mr. Biurrill's•letter regarding the Library Boards Resolution that a suitable agreement be arranged between Victor Wulff and the City of Pasco, the City Attorney states that no action can be taken on this until the agreement is presented. Regarding the services of the State Library motilin made by Kilbury, seconded by Moore to concur with the Library Board relative to the Consultant Services from the Washington State Librarian. Motion carried. ADJOURNMENT: ° Motion made by Combs, seconded -by Moore to adjourn to next regular meeting, Tuesday, 8:00 P. M. October 4, 1960. Motion carried.
