ROLL CALL: By Clerk. Councilmen present were 0. C. Adams, C. R. Combs, G. A. Grant, H. C. James, Ed Thompson, T. R. VanHoy and David Zier. City Attorney Richard G. Patrick was present. APPROVING OF THE MINUTES: Motion made by VanHoy, seconded by Adams approving minutes of meeting held December 2, 1958. Motion carried. BILLS: Current bills against the City were read as follows. Motion made by VanHoy, seconded by Thompson that all vouchers properly signed and approved be paid. Motion carried by roll call vote of seven (7). Motion carried. PASCO, WASHINGTON REGULAR MEETING COUNCIL CHAMBERS DECEMBER 16-1958 BIDS - LAMPS. No bids received. Motion made by Grant, seconded by Adams authorizing the Purchasing Agent to negotiate and report.at the next regular meeting. Motion carried. COMMUNICATIONS: NORTHERN PACIFIC RAILWAY COMPANY LEASE #74552: This lease covers warehouse well and pump house site for year ending December 14, 1959. By' letter October 21, 1958 the Company is by agreement raising the annual rent from $100.00 to $200.00 effective December 15, 1958. Motion made by VanHoy, seconded by Adams accepting the proposal and authorizing the Mayor to sign agreement. Motion cariied by roll call vote of seven (7). STATE HIGHWAY COMMISSION STUDY ON PROPOSED BY-PASS: A letter from R. H. Pyle requesting available data from the City on comprehensive plan of the existing or future streets which would cross or be effected by the State's proposed develop- ment plan. This letter was answered by the Mayor and data furnished by the City Engineer. WASHINGTON CO-OPERATIVE FARMER'''S ASSOCIATION BUILDING ON SOUTH 12th & A: Needed information regarding locations of wooden and iron water pipes also description of easement if one exists. Letter answered and information furnished. ALLEY, BLOCK 18, GERRY'S ADDITION: A letter was read from Alice Hogan West stating a bad condition exists here whereby water drains in the basement of store building. A discussion followed; street committee of the opinion that something could be done right away. Motion made by Adams, seconded by Thomp- son to get this done soon as possible. Motion carried. AIRPORT FLIGHT ASSISTANCE SERVICE SPACE CONTRACT C4CA-5306-A, SUPP AGREEMENT NO. 1: A letter was read from E°. R. Main, Office of the CAA requesting ratification of signature on document executed on behalf of the Government. Motion made by GrZE4�t, seconded by James authorizing the Mayor to sign supplement agreement No. 1 to oc reeect C4CA-5306-A, covering Flight Assistance Service Space at the Airport Terminal Building, Pasco, Washington with the United States of America. Motion carried. McNARY LOCK & DAM, C@NTRACT NO. DA-45-164-CIVENG-57:51: City Engineer requested to check property description on this contract; same was submitted for review at this meeting. In conclusion motion was made by Adams, seconded by Thompson that the Mayor be authorized to sign and the City Clerk authorized to attest the quit claim deed from the City of Pasco to the United States, dated December 2, 1958 in accordance with the terms of Relocation Contract No. DA-45-164-CIVENG-57-•51. Motion carried unanimous. REZONING LOTS 21 THROUGH 30 INCLUSIVE, BLOCK 5, SYLVESTER PARK ADDITION FROM R-2 TO C-1: A letter was read from E. P. Erwen, Chairman of the Planning Commission, submitting data on petition and public hearing as requested by C. L. & Berta Shelton for the erection of a medical clinic at the above address. The Commission approved the petition and submitted for appropriate action of the City Council. Motion made by Adams, seconded by James approv- ing the action on petition and concurring with the Planning Commission. Motion carried. GUENTHER TRACTOR COMPANY INC. 313 SO. 4TH AVENUE: A letter was read from Planning Commission Chairman E. P. Erwen approving the construction of a Cuckler Steel Span Building 'for'hrection in fire zone no. 2 as requestdd,lby Duane Guenther. This is permissable by the code when approved by the Commission and City Council and is hereby submitted for concurrance. Motion made by VanHoy, seconded by Zier to concur with the Planning Commission and issuance of a building permit. Motion carried. AIRPORT RENT IN ARREARS: Airport Manager H. W. Parkinson reports that the Tri -City Mattress Company is three months behind in their rent in the amount of $105:00. Motion made by Adams, seconded'+by Zier to turn this to the City Attorney for action. Motion carried. REGULAR ORDER OF BUSINESS SET ASIDE BY UNANIMOUS CONSENT. BUILDING CODE VARIANCE REQUESTED BY C. L. SHELTON: Mr. C. L. Shelton spoke to the Council about type of construction of.r,building to be constructed for Medical Dental Clinic on Margaret between 4th and Arthur Streets. He wishes to have veneer construction in this C-1 zone in order to make changes as need be for renters. Amendment to fire zone ordinance•requested;he drew a sketch of building and how i•t would be placed on the property; open spaces on all sides, therefore would like to use a less fire resisting wall and askdd that the City Ordinance be amended to fit his particular situation. Motion made by Adams, seconded by Thompson that permission be granted. Motion withdrawn. Motion made by Adams, seconded by Zier that this be turned to Committee of James, Zier and Thompson, Building Inspector and Fire Chief for decision and action by next meeting January 6, 1959, including the necessary ord- inance if recommended. AIRPORT LEASES FOR RENEWAL: Lyle Neff West Coast Airlines Motion made by VanHoy, seconded by Thompson authorizing the Mayor to sign the foregoing leases. Motion carried. AIRPORT LEASE RELEASE: Virgil Anderson desires to be released from his rental lease account ill health. Motion made by VanHoy, seconded by Grant that the request be granted. Motion carried. CLAIMS: EARL L. STANDLEY, 719k W. COURT: The following claims have been filed against Mr. Standley's 15% retained flee: Employment Security Department $ 67.54 E. Herschel Kidwell 1,009.01 Hugh B. Horton 550.00 City Attorney has copies in his files. CEMETERY LOTS - REFUND REQUESTED: Regarding Mrs. Leslie Dewey's request the Cemetery Committee would like more information from Mrs. Dewey. Motion made by Thompson, seconded, by James to obtain from Mrs. Dewey a copy of deed or receipts or aphotostatic copy of both. Motion carried. This to ascertain who received the payment and price of same. (Clerk to write) READING OF ORDINANCES: ORDINANCE NO. 949: AN ORDINANCE PLACING THE CONTROL OF PARKING METERS UNDER THE POLICE DEPARTMENT, ABOLISHING THE OFFICE OF SUPERINTENDENT OF PARKING METERS, AND TRANSFERRING FUNDS FROM THE PARKING METER DEPARTMENT TO THE POLICE DEPARTMENT Motion made by Grant, seconded by Adams to turn this to the Police Committee for study and recommendation. Motion carried. ORDINANCE NO. 950: AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 595 AND PASCO CITY CODE 5-9.12 AND 5-9.16, AND BEING AN ORDINANCE CHANGING THE ZONE CLASSIFICATION OF PROPERTY WITHIN THE CITY OF PASCO FROM RESIDENTIAL R-2 TO COMMERCIAL C-1 Motion made by VanHoy, seconded by James to read Ordinance No. 950 by title. APPOINTMENTS: Mayor Hicks submitted for appointment Lawrence Mabrey to the Planning Commission and Ralph Ecker to the Housing Commission. Motion made by Grant approving appointments. Motion died for the lack of a second. REPORTS: Monthly budget report furnished each member of the Council body covering November, 1958. ADJOURNMENT: Motion made by Adams, seconded by Combs to adjourn to next regular meeting, Tuesday, 8:00 P. M., January 6, 1958. Motion carried.
