Honorable Mayor Raymond Hicks presiding. ROLL CALL: By Clerk. Councilmen present were H. C. James, Ed Thompson, T. R. VanHoy and David Zier. Absent were 0. C. Adams, C. R. Combs and G. A. Grant. City Attorney Richard G. Patrick was present. APPROVING MINUTES: Minutes for Meetings held July 23rd and August 5th, 1958 were not in order to be presented at this time. COMMUNICATIONS: R. W. ROBINSON DRAINAGE PROBLEM, SOUTH QUEEN STREET: A letter was read from the Northern Pacific Railway Company to City Engineer George R. Fisher, stating that this house is located on railroad property without permission and when the en- croachment is cleared up you will be advised. STORM SEWERS, WETER, ROBERTS & SHEFELMAN: A letter from James Gay was read relative to approving general obligation bonds to finance a storm sewer system thus increase the general indebtedness of the city above 5% of the assessed valuation of the taxable property but within 10%. Gay's opinion is that the word "Sewers" in Amendment 27 of the Washington State Constitution, permitting the incurring of indebtedness in an additional amount of 5% of the assessed valuation, where the "Sewers" are owned and controlled by the city is brodd enough to include storm sewers as well as sanitary sewers. LAMP POLES: Harry A. Lee offers to remove street lights and poles at $40.00 per pole, to deliver poles to Street Department yard and fill holes and pour cement. AMENDING ORDINANCE NO. 886, RECOMMENDED BY PLANNING COMMISSION: A letter was read from the Planning Commissionssubmitting copy of public hearing notice on amending Ordinance No. 886 regulating service stations and garages which sets out changes recommended; this for appropriate action of the council body. Motion made by Thompson, seconded by,James to hold a public hearing on recommended changes by the Planning Commission to Ordinance No. 886, Tuesday,.8:00 P. M., September 2, 1958. Motion carried. NEW LIBRARY BUILDING: A letter was read from the Library Board following July 22, 1958 meeting requesting the Mayor and City Council to take necessary steps to start legal proceedings toward the building of a new library,building. STREET SIGNS - CARTMELL STREET: Karl Kayama requested by letter that street signs be installed on Cartmell Street, also expressed appreciation of pirompt action taken on installati6n of fire hydrant at Meridian and Cartmell. PORT DISTRICT AGREEMENT - JULY 16, 1957: A letter was read from John Horrigan, Attorney for the Port District. This agreement involved grading and leveling of property south of Ainsworth, East of Ninth and West of Sixth, Riverside Addition. The Port would appreciate being advised of the citys intention In regard to fulfilling the contract. SERVICE STATION ORDINANCE NO. 472: A letter from Charles Kilbury was read stating there are 21 service stations on Lewis Street and eleven on Fourth and suggests that the construction of more stations and garages be curbed and the business district area remain contiguous as this has the greatest potentialities for future business develppment. BOILER AT SEWAGE DISPOSAL PLANT: A letter was read from C. F. Whetsler, Water Superintendent to clarify his letter of August 5, 1958; he states that when using a boiler to create steam for a radiator the steam does not escape but in this case it does,l making it necessary to continually add water to the boiler and the solids are of a character that leaves a hard scale which adheres to the tubes. The State Inspector found this condition and submitted recommendations. AIRPORT COMMITTEE REPORT: Building No. 35, 58 and 69, Roll Roofing. Committee recommends this work be contracted account skilled nature of the work. Lowest pricedreceived was from L. W. Vail Company for this work in the amount of $1,935.00. The Committee also recommends the purchase of 4000 lin. ft. of various width gravel -stop to be applied with the new roofs; five (5) rolls of patching fabric at -.'$20.85 per roll. Motion made by VanHoy, seconded by James accepting the recommendation of the Committee for L. W. Vail's price and the purchase of gravel -stop and patching. Motion carried by roll call vote of four (4). 27 -LB PASCO, WASHINGTON REGULAR MEETING COUNCIL CHAMBERS AUGUST 19, 1958 GOLF COURSE, SEED & FERTILIZER: Harold A. Wyman requests that the City call for bids on grass seed and fertilizer. Motion made by VanHoy, seconded by Thompson grantingarequest and calling for bids on Tuesday, 8:00 P. M., September 2, 1958. Motion carried b} roll call vote of four (4). SERVICE STATION CURB CUTS - PETITION: Amending Ordinance No. .472, Section 5, pertaining -to'.curb cuts was discussed. A petition was presented signed by approximately 40 signers.;protesting the change of Ordinance No. 472. Property owners present protested. Dr. Nelson spoke of hazards involved by speed. Mrs. Cartmell protested as did several others. Alice Hogan West also protested, then requested that the amendment be tabled for further study. Service stations are disrupting an orderly development of shopping and business districts thus devaluating property that could be potential business property was the expression of some. PETITION - ALLEY, CITY VIEW REPLAT, BLOCK 3: A petition signed by six (6) property owners petition for the development of a T alley in Block 3, City View.Addition to Pasco. The request is to have this alley put in shape for use so garbage service can be obtained by the alley. Motion made by Zier, seconded by James that this be turned to the City Engineer for inspection and recommendation. Motion carried. CLAIM - ROSE B. & FRANCIS E. DRAKE: Mrs. Drake claims a manhole cover at West Court and North 4th Avenue flew up under their car causing damage to the right front fender of the car in the amount of $16.00. Motion made by Zier, seconded by VanHoy to turn claim to the. City Attorney. Motion carried. CLAIM - FLOYD STANDLEY: City Attorney advises claims presented against Floyd Standley are in error. E. Standley has a contract with the City not Floyd. City Attorney is checking with Russell R. Ridenour, Plaintiff Attorney. Acme Welding and Lee Morton Tire Service applied writ of garnishment. Council Committee Thompson, James & Grant authorized to award to lowest bidder, subject to approval of the City Attorney and City Engineer. Motion carried unanimous. VACATE EAST AND WEST ALLEY, GRAY'S AMENDED ADDITION, BLOCK 3: Notice of public hearing was read. Mayor declared the hearing open. No protests rendered by letter or in person. Hearing declared closed. Motion made by Zier, seconded by James that the City Attorney prepare the necessary ordinance. Motion carried. P. U. D. AGREEMENT -STREET LIGHTING INSTALLATION: Mayor, Councilmen and City Attorney have reviewed the agreement and find same in order. City Attorney has no objection. Motion made by VanHoy, seconded by Zier authorizing the Mayor to sign agreement with the P. U. D. No. 1 as presented. Motion carried by roll call vote of four (4). City Attorney reports that where new standards are being installed a short post or pipe is creat- ing a stumbling object. City Clerk to write the P. U. D. in regard to.this condition. REPORTS FROM COMMITTEES: PURCHASES: WATER: Sleeves, valves, fittings, skill saw, lab. supplies, meters, clean and adjust machines; fire hydrants $ 2,346.41 FIRE: Hose 834.43 GOLF COURSE: Fertilizer spreader, tractor and jeep 2,581.27 Motion made by Thompson, seconded by James that purchases as requested be authorized. OREGON: Desires to change location from 501 So. Oregon,to 128 W. Lewis on Recreation License covering pool tables, etc. The license on Card Tables was not approved for change by the Chief of Police. No objections to recreation change. Motion made by VanHoy, sec- onded by Thompson that transfer of card table license be denied. Motion carried. TRANSFER - CURRENT EXPENSE TO AIRPORT TO REPAY LOAN: As per Ordinance, 1958 Budget allowing return by transfer on $15,900.00 which is balance of loan in the amount of $30,000.00. This was held up for checking by the Finance Committee. INDUSTRIAL INSURANCE AND MEDICAL AID: A letter was read from the Department of Labor & Industries stating that in order to continue using classification 48-1 the City will have to report and pay on all office workers or change classification for park and cemetery. It is now compulsory to insure all occupations according to the Attorney General's ruling. Motion made by VanHoy, seconded by James to concur with the ruling affecting compulsory coverage with the Department of Labor & Industries. Motion carried. READING OF RESOLUTIONS & ORDINANCES: YACHT BASIN (RESOLUTION NO. 421): A RESOLUTION TRANSFERRING $505.63 FROM THE PARK DEPARTMENT TO THE YACHT BASIN FUND Motion made by Thompson, seconded by VanHoy to read Resolution No. 421. Resolution No. 421 was read. Motion made by Thompson, seconded by VanHoy that Resolution No. 421 has been read. Motion carried. ORDINANCE NO. 938: AN ORDINANCE VACATING THE NORTH AND SOUTH ALLEY IN BLOCK 7, O'KEEFE'S SECOND ADDITION TO PASCO, ACCORDING TO PLAT THEREOF RECORDED IN VOLUME "B" OF PLATS, PAGE 36, RECORDS OF FRANKLIN COUNTY, WASHINGTON Motion made by VanHoy, seconded by Thompson to read Ordinance No. 938 by title. ORHINANCE NO. 939: AN ORDINANCE AMENDING SECTION 5 OF ORDINANCE NO. 472 AND PASCO CITY CODE 9-2.20, AND BEING AN ORDINANCE REGULATING THE CONSTRUCTION AND REPAIR OF VEHICULAR DRIVEWAYS ACROSS AND ALONG THE SIDEWALKS OF THE CITY OF PASCO, PROVIDING CERTAIN CONDITIONS, PROVIDING PERMITS FOR THE CONSTRUCTION AND REPAIR THEREOF, AND PROVIDING PENALTIES Motion made by VanHoy, seconded by Zier to table Ordinance No. 939 for action when more Council;r::3. members will be present.
