Councilmen present were J. A. Avery, L. E. Bonnett, C. R. Combs, S. A. Connell, Lee J. Craig, C. S. Milne and T. R. Van Hoy. City Attorney Richard G. Patrick was also present. READING OF THE MINUTES Minutes of meeting held march 1, 1955 were read and approved. Motion carried. REGULAR ORDER OF BUSINESS SET ASIDE BY UNANIMOUS CONSENT, to hear from the public. EROSION, CATHOLIC SCHOOL (LUCAS & HENRY): Fred E. Huber, Jr., reported to the Council that a bad erosion condition exists in their area caused by sand blowing from the school area account wester not being applied or grass established. Pictures were presented showing sand drifts and mounds. ALBERT YENCOPAL: Albert Yencopal representing the school stated that their well was about ready to be used; P. U. D. to connect pumps in the next day or -two. Monday March 21st was date mentioned as dead line to have over -head sprinkling system in operation. UNION OIL PLAT NO. Y: Mr. R. S. Bond, construction supervisor for Union Oil Company of California, spoke to the Council relative to Union Oil Company Plat No. P and dedication of 101 on Lucas Street not being dedicated by the Company. Discussion followed. They do not intend to use this strip, only for ingress and egress. Motion made by TMilne! t. seconded by Bdnnett')t'hat plat be rejected. Motion carried. Motion made by Milne, that request for building permit be issued, no building to be constructed on 10' of property on Lucas. Motion withdrawn. Letter to be written to Union Oil Company. 2303 PASCO, WASHINGTON CITY OWNED PROPERTY NORTH OF MOUND BETWEEN 13th & LUCAS. John Miller requests that no lease be entered into or contract let of any descript- ion without public hearing. David Clancy wished to know if disposition or re- striction will be considered at public hearing before bids are called. He was ad- vised that a public hearing will be held before action of any kind will be taken by the Council. WATER SERVICE: A property owner is interested in water service beyond Road 44, Riverview District. This to be taken up again with reports. GRAVEL PIT, AINSWORTH & SO. 4th: L. W. Vail interested in purchasing this site for asphalt mix and equipment storage. Wanted to know conditions and agreements required by the City and in effect with Central Sand & Gravel Company. This would be subject to mortgage, bond and deed held in escrow. Fill to be two fent below Panama spur track elevation to Ains- worth Avenue. Vails willing to fill above water line. He has purchased eleven lots from Harold Blanton. He was advised it would be necessary to rezone. Motion made by Bonnett that City .Engineer investigate and make report. Motion died for want of a second. REGULAR ORDER OF BUSINESS RESUMED BY UNANIMOUS CONSENT: COMMUNICATIONS: UNDERPASS CORRECTIONS: A letter was read from the Chamber of Commerce recommending three corrections or improvements for the underpass. 1) Flood lights. 2) Reflecting paint, reflectors or scotch -lite stripping. 3) Larger wattage bulbs in pedestrian walk. Motion made by Bonnett, seconded by Avery t -o turn to Street Committee for investigation and report. Motion carried. PETITION TO VACATE: Two (2) alleys and 12th Street, Blocks 7 and 8, Pettit's 2nd .Addition presented by Wendell P. Brown not read at this time. SENATE BILL NO. 104: A letter was read from Al Henry reporting on this bill. CIVIL DEFENSE DIRECTORS LETTER NO. 104 A letter was read from A. D..Widdows with attached letter No. 104 relative to liability for personal injury or death to persons and damage to,property in authorized civil defense drills and civil defense emergencies. ALBERT U. SAND, 1023 Nixon: Mr. Sand damaged a sign at 5th & Yakima to the extent of $5.00 which has not been paid. Motion made by Combs, seconded by Craig authorizing the Mayor toosign the release when $5.00 damage claim has been paid. Motion carried. 1955 CENSUS: City Clerk requests opinion of the Council on the taking of the Census again this year. Motion made by Bonnett, seconded by Combs that the Census not be taken this year. Motion carried. 0 REPORTS: WATER COMMITTEE: Water service extension to L. C. Haystad property and recommend to extend a 12" line from Court to Sylvester down Road 36. Motion made by Avery, seconded by Con- nell to accept the recommendation. Motion carried. ROAD 0: Motion msde by Connell7that a 12" line be emtended down Sylvester to Road 40 - Motion died for want of a second. Mr. Luhman spoke to the Council on County Planning and their thinking on several pieces of property. ORDINANCE NO. 823: AN ORDINANCE TO AMEND SECTION 3 of ORDINANCE NO. 628 AND CODE CHAPTER 9-5.16, APPROVED APRIL 27, 1948, RELATING TO THE PLANTING, TRIMMING AND RE- MOVAL' OF TREES ON THE PARKING= STRIPS OF THE CITY OF PASCO Motion made by Avery, seconded by Craig to give Ordinance No. 823 the first reading. Motion carried. 2304 G PASCO, WASHINGTON COUNCIL CHAMBERS MARCH 15. 19 UNION OIL COMPANY PLAT NO. 1: The subject of 10' of property on Lucas Street was opened up again. Motion made by Milne, seconded by Craig that Building Permit be granted for construction of a Service Station with restrictions, that no improvements be placed on the west- erly 101; subject to their executing a sidewalk waiver on Lucas Street. Motion carried. (Black top only ) BLANKET FRANCHISE FROM COUNTY.,UTILITY INSTALLATIONS: Motion made by Avery, seconded by Craig that the Council ask the County for a permanent blanket franchise to take care of water and sewer extensions in County roads and easements. Motion carried. SHELL OIL STATION, WEST COURT: Motion made by Avery, seconded by Craig to extend water to Shell Station on West Court from Arthur Street East 400', 1210 line to 4t.h. Motion carried. SUPPLEMENT TO NORTHERN PACIFIC RAILWAY CO'S LEASE NO. 74552: . Approximatelyy 4.13 acres between Washington and the Rider, 12th and 13th, Gov- ernment Lot 8, at a rental fee of X100.00 per year. Motion made by Avery, sec- onded by Combs authorizing the Mayor to sign lease at $100.00 per year. Motion carried. SUPPLEMENT TO PERMIT NO. 68877, NORTHERN PACIFIC RAILWAY: The Northern Pacific Railway Company prefers that bothepermits be maintained in effect, so it is proposed to add the new crossing to Permit No. 75873 and to add the pipe line along the county road to Permit No. 68877. This is considered necessary because we have the right to terminate.Permit No. 68877 and we might later require relocation of the pipe line along the road in the event that the road is relocated to make room for our yard. While it may never be necessary to relocate the present pipe line along the road, you may not want it to be located under and along a yard track or under a warehouse. Motion made by Avery, seconded by Combs to accept supplement leases. Motion carried. INLAND .EMPIRE SEWAGE WORKS SCHOOL: The Fourth Biennial short school will*be-held April 4; 1955 at Pullman, Washington. Motion made by Avery, seconded by Milne that the Sewage Plant Superintendent Art- hur Reisdorph be allowed to attend. Motion carried. CITY ENGINEER REQUESTS MORE HELP: Water Committee Chairman states that the -City Engineer needs another man to be able to wohk and survey`,' crew. Motion made by Avery, seconded by Bonnett grant- ing the request. Motion carried. CHARLES STREET VACATED TO SCHOOL: Motion made by Milne, seconded by -Craig that if and when this property is no longer used for school purposes that Charles Street be deeded back to the City of Pasco. Motion carried. ADMISSION TAX WAIVER, POLICEMAN'S BALL.: CHAIRMAN of the Police Committee requests that the admission tax be wAived. Motion made by Bonnett, seconded by Avery to so do. Motion carried. CEMETERY MOWER T3IDS : Motion made by Craig, seconded by Avery to call for bids on Cemetery Power Mower on Tuesday, April 5, 1955• Sexton to furnish specifications. Motion carried. 2305 PASCO, WASHINGTON COUNCIL CHAMBERS MARCH EMERGENCY ORDINANCE -LIBRARY: - Condition of Library funds discussed. Motion made by Bonnett, seccaonded by Avery that an emergency ordinance be drawn. Amount to be established following audit. Motion carried. NORTHWEST DISTRICT RECREATION CONFERENCE„ BOISE, IDAHO: The Park Board recommends that the Park Superintendent be allowed to attend the conference. Motion made by Craig, seconded by VanHo,y that the request be denied. Motion carried. GENERAL ELECTION 14ARCH 8, 1955: Absentee ballots presented. Motion made by Craig, seconded by Avery authorizing the City Clerk to count ballots and enter records of the general election in these minutes. Motion carried. Motion made by,Milne, seconded by Connell that City Attorney draw ordinance. Motion carried. BUILDING INSPECTOR'S REPORT: Report for February 1955 was ordered files. APPOINTMENT -FIRE CAPTAIN: Mayor Harry V. Custer appointed Francis Z. Rickenbach to the position of Captain in the Fire Department as per Civil Service Commissions availability list. Motion made by Combs, seconded by Milne approving the appointment. Motion carried. 23 PASCO, WASHINGTON FIRE ENGINE (AIRPORT): Purchasing a used fire truck for the Airport was discussed. Motion made by Connell, seconded by Bonnett'to'call for bids on one used fire truck on Tues- day, April 5, 1955 at 8;00 P. M. Specifications to be furnished by Airport Manager, Fire Chief and City Attorney. Motion carried. ENGINEERING DEPOT SURPLUS EQUIPMENT: Motion made by Bonnett, seconded by Milne instructing the Mayor to notify, by letter, the Engineering Depot that the City is interested in purchasing a fire engine when declared surplus. Motion carried. PLANNING COMMISSION & COUNCIL JOINT MEETING: A joint meeting of the Planning Commission and City Council on (Land Use) re- zoning ordinance was discussed. Motion'made by Avery, seconded by Craig to appoint Bonnett as Chairman of the Council Committee to work with the Planning Commission and let'him appoint his co-workers. Motion carried. VanHoy and Connell were named. Entire council invited to -attend. Meeting set for Tuesday at 8:00 P. M., March 22;'1955. City Clerk to notify all members of the Planning Commission and City Council. BOAT CLUB: Connell reports on improvements to Bert'and'Road at the Yacht Basin by the Yacht Club in the amount of approximately $600.00. CITY HALL HEAT:iNG SYSTEM: H _ City all has been without heat for over two weeks''account furnace conditions being beyond repair. -Temporary wiring had to be installed for heading in order to keep the offices open. i, ADJOURNMENT: Motion made by Avery, seconded by Combs to adjourn to next regular meeting on Tuesday, April 5, 1955 at 8:00 P.
