Meeting called to order at 8:00 P. M. Honorable Mayor Harry V. Custer presiding.

Minutes of meeting held on September 7, 1954 were read and approved.
COMMUNICATIONS: it
REFUND, R. S. CURTSINGER:
Mrs. Curtzinger requests refund on Business License application in the amount of
$5.00 account license not issued; Curtsinger moved to Richland. Motion made by
Avery, seconded by Combs authorizin City Treasurer to issue refund. Motion
carried by roll call vote of seven �7).
WELCH'S SERVICE GARAGE, 1415 E. ALVINA:
A letter was read from James J. Molthan, Attorney for James E. Welch, claiming
discrimination account other violators -are being tolerated by the Council, showing
bad faith in moving and enforcing its ordinance only against Mr. Welch's business.
City advised that unless this matter of the enforcement to Mr. Welch is reconsid-
ered the case will be appealed to equity court; and further requests that the City
of its own motion move the court to extend time allowed Mr. Welch in moving his
business or that the City take -immediate steps to enjoin violators of Ordinance
No. 435• Motion made by Avery, seconddd by Connell to turn this to the City
Attorney for opinion of procedure against other violators of Ordinance No. 435•
Motion carried.
LIGHT REQUESTED AT 213 No. 2nd STREET:
Minnie Buchanan requests that a Street Light be installed at the alley on North
2nd adjacent -to the above mentioned location: Motion made by Avery, seconded by
Bonnett to turn to Light Committee for study. Motion carried.
PUBLIC HOUSING ADMINISTRATION: I'
A letter was read from E. Stanley Foster stating Housing Project Wash -45201 has
been relinquished to the Housing Authority of the City of Pasco on June 30, 1954 and
Project Wash -45152 Is'to be relinquished to the Housing Authority of the City of
Pasco on September 30, 1954. Notice is hereby given, in accordance with :Section
4, that said contract will terminate as of September 30, 1954• It is requested
that a final meter reading betaken on September 30, 1954 and final bill rendered
for the account of the Government. Motion made by Avery, seconded by Connell to
turn to the Water Superintendent. Motion carried.
INDUSTRIAL WASTES CONVENTION:
Arthur J. Reisdorph requests permission to attend the Northwest Sewage and
Industrial Wastes Convention on October 21, 22 and 23 at Eugene, Oregon, at an
approximate cost of $49.50. Motion made by Avery, seconded by Bonnett to turn
this to the Water Committee for recommendation. Motion carried.
BUILDING INSPECTORS LETTERS:
A letter was read from J. L. Chatterley on a proposed change in Ordinance No. 789,
Article 9, Section 81 adding "or wrought iron galvanized pipe where above ground
6" or more". Tnis change would -make the Ordinance comply with standard practice
of plumbing that appears to be quire universal. Motion made by Bonnett, seconded
by Avery that the City Attorney be requested to draw an Ordinance making the
correction. Motion carried.
SIDEWALK CONSTRUCTION:
A letter was read informing the Council on notices given property owners to comply i!
also list of owners fsdling to comply. He suggests that a date be set for comp-
letion. Motion made by Bonnett, seconded by Milne to turn to Street Committee for
study and report. Motion carried.
MURPHY MOTORS PROPERTY RENTAL AGREEMENT:
An agreement was read as submitted by Lester P. Murphy. Motion made by Bonnett,
seconded by Avery to -accept the agreement and 1200.00 check for rent covering
August and September, 1954- Motion carried.

Report submitted by the Park Department was read.
REGULAR ORDER OF BUSINESS.SET ASIDE BY UNANIMOUS CONSENT:
CASCADE BROADCASTING COMPANY, YAKIMA:
Mr. Tom Bostic spoke to the Council relative to serving this area with "live
television", operating a station from near -by Badger Mountain on UHF Channel
19; they have applied to the Federal Communications Commission for authority
to operate.
At this time Mr. Bostic requests that the Council urge the Commission to give
favorable and prompt attention to this application. Motion made by Milne,
seconded by Connell authorizing the Mayor to write to Federal Communication
Commission requesting prompt attention to application on development of Channel
1,9 presented by the Cascade Broadcasting Company. Motion carried,.
Write Hal Holmes and Warren G. Magnuson also.
WEST LEWIS PARKING, "TOYLAND" A. B. CARTER:
Mr. Carter requests that the City grade alley through between Lewis and Columbia
and 8th and 9th streets. Signatures of adjoining property owners was suggested
and Carter stated that they are in favor. Motion made by Milne, seconded by
Craig that the request be.granted with approval of the City Engineer and,petition
to be ,presented. Motion carried.

ARMY ENGINEERS: CITY CLAIM $120000.00:

A discussion was entered into with the City Atto=rney relative to collecting
this amount. Two Army Engineers were in the City and conferred with the City
Engineer and the City Attorney. Patrick states he should have the Federal Code
to proceed. Several suggestions were made. Motion made by Milne, seconded by
Craig to turn to claims committee, Connell, Bonnett and Avery for consultation j
with another Attorney and report. Motion carried.

HEARING ON GAS FRANCHISE:
A public hearing will be held jointly with Pasco. -Kennewick and Richland on
September 23, 1954 at 7:30 P. M. in the City Hall, Pasco. Announcement made
by C. S. Milne.
STEAM ENGINE:
Mayor Custer states he may be able to acquire one of the small steam engines
no longer in use by the Northern Pacific for display in the Volunteer Park.
Motion made by Connell, seconded by Craig to accept the offer and that -same be
placed in Volunteer Park. Motion carried.
BUDGET REPORTS:
City Clerk furnished each member with a budget report for the month of August.
