CALL TO ORDER:
Meeting.called to order at 8:00 P. M. Honorable "`ayor Harry V. Custer presiding.

Minutes of meeting held April 6, 1954 were read and approved.

VACATING BROADWAY: i

Application presented by R. A. McPeak was read requesting that Broadway, running
through Block -146, Pasco Land Company's First Addition be vacated of all public
use. Motion made by Avery, seconded -by Milne to turn -this to the Street Committee
for investigation and recommendation. Motion carried.

RESIGNATIONS:
A letter was read from Arley H. Hanson tendering his resignation from the Pasco
Police Department as ofaM rch 31, 19 Motion made by Bonnett, seconded by

Avery accepting the resignation. Motion carried.
!� A letter was read from E. T. Lindner tendering his resignation from the Planning !'
Commission. Motion made by Combs,seconded by M1:lne to accept the resignation.

ADMISSION TAX WAIVER:
A letter was read from Glenn Sickels requesting the Council to waive admission
tax on dance -tickets sold by Police Officers Benefit Association for the dance
given on March 31, 1954. Motion made by Bonnett, seconded by Avery granting
the requast. Motion carried.
YACHT BASIN (BIDS):
A letter was read from Harold A. Wyman, Superintendent of Parks & Recreation,

requesting the City Clerk be authorized to call -for bids on excavating and a
scope of worktD be done by the bidder for development of said Yacht Basin.
Motion -made. by Craig, seconded by Avery to call for bids on Tuesday, 8:00 P. M.,
May 18, 1954- Motion carried.

MID -COLUMBIA BANK - DEPOSITORY:
A letter was read from -City Treasurer-, 'Mary E. Clarke stating that upon the
majority vote its governing body instruct its Treasurer to designate one or
more banks in the County or City as -depository or depositories of moneys re-
quired to be kept by said Treasurer. Motion made by Avery, seconded by Milne
authorizing the City Treasurer to use Mid -Columbia Bank of Vasco for additional
deposits. Motion carried by roll call vote of seven (7). Laws'of Chapter
35.38.030 Revis$d Code of Washington.
NORTHERN PACIFIC LEASE No. 77461:
Submitted by J. T. Moore; in duplicate, Lease No. 77461, covering sewer crossing
west of Ainsworth Avenue, which terminates Lease No. 74698 issued to the Govern-
ment. Motion made by Bonnett, seconded by Avery to turn -this to the City Eng-
ineer for recommendation. Motion carried. City Engineer reports that Lease
No. ��461 in order. Motion made by Avery, seconded by Bonnett authorizing the
ayor to sign. Motion carried.
LIQUID LEVEL TRANSMITTING & RECORDING DEVICE:
A letter was read from H. A. Cornell requesting. that the douncil call for bids
on installation of a water level transmitting and receiving device to transmit
water level information from the new reservoir to the filter plant. Motion
made by Avery, seconded by Milne to call`for bids on recording device on Tues-
day, 8:00 P. M., May 4, 1954. Motion carried.

TRAILER VIOLATION (C. HALDERMAN):
A letter was read from Mr. Halderman with attached notice of violation to
Ordinance No. 489 from Police Department. Motion made by Avery, seconded by
Bonnett to extend time from April 22, 1954 to May 4, 1954. Building Committee
to investigate -and make recommendation. olice Department to be so notified.

Mr.'Miller was present and referred to his resignation from the Civilian Defense;
he was.informed that his resignation had been accepted..

Mr. Erickson"was interested in getting a sign. Motion made by Avery, seconded
by Connell to turn this -to the Street Committee for investigation and recommend-
ation. Motion carried.
REGULAR ORDER OF 5USINESS RESUMED BY UNANIMOUS CONSENT
PUBLIC HEARINGS:
Vacating -North & South Alley, Block 4, O'Keefe's Addition.
Notice of Public Hearing on petition set for this time and place was read.
No objections registered by letter or in person. 'City Engineer states this
alley not needed for utilities. Motion made by Avery, seconded by Milne that
City .Attorney draw up an Ordinance to cover vacation as requested. Motion
carried.
VACATING NORTH & SOUTH ALLEY, BLOCK 1, HELM'S ADDITION:
Notice of public hearing on petition set for this time and place was read.
No objections registered by letter or in person. City Engineer Oxus for
vacating. Motion made by Avery, seconded by Connell that City Attorney
draw up an Ordinance to so vacate as requested. Motion carried.

i Request to lease portions of streets, alleys and gores in College Addition,
Riverside Addition and Gantenbein's Addition for occupancy and use of Housing

City Attorney requested to write Attorney John Horrigan instructing him to
install sidewalk on 10th between Lewis &.%lark as per Ordinance No. 688.

EASTSIDE SEWER:
Plans underway.
VACATE PHRTION OF WEST CLARK, BLOCKS 3, 4 & 5, PETITT'S ADDITION:
III Petition submitted by Mr. Basil Maib & Richfield Oil Corporation. Following an
inspectionaand investigation by the City Engineer and Street Committee, they
recommend that the petition be denied. Motion made by Milne, seconded by Craig
accepting the committees recommendation. Motion carried.
CAMPBELL'S MARKET:
Sidewalks should be installed at the south east corner of Nixon & Adams. Motion
made by Bonnett, seconded by Avery to turn this to the Street Committee for
investigation and report. Motion carried.
912 WEST PARK:
�! City Attorney to notify property owner'at North west corner of Aurelia & Nixon,
William Kirchner, to install sidewalks. Motion so made by Bonnett, seconded by
Connell and carried.
PARTITION IN TREASURER'S OFFICE:
A letter was read from City Engineer George R. Fisher requesting permission to
install a partition in the City Treasurer's Office segregating the Treasurer
and Water Department. Cost estimate is $300:00. Motion made by Connell, sec-
onded by Avery authorizing expenditure as requested. Motion carried by roll
call vote of seven (7).
PURCHASES.
The following purchases requested. Motion made by Connell, seconded by Avery
authorizing purchases. Motion carried by roll call vote of seven (7).
STREET DEPARTMENT: Traffic paiht,'pipe, patch mix & street signs $1,166.00
FIRE DEPARTMENT: Fire -Hose $468.00
WATER DEPARTMENT: Lead, valve boxes, nipples, battery, alum,
tractor repair, misc. supplies, (approx) 4,789.23
BILLING, HOUSING AUTHORITY FOR WATER SERVICE:
Housing Authority water bills questioned. Billing not in accord with Ordinance.
Housing Authority contract calls for $2.00 per unit minimum. Reverting to the
contract is favored. Motion made by Bonnett, seconded by Avery that Water Comm-
ittee be empowered to draw up contract to co -inside with former contract. Motion
carried. -
AGREEMENT, P. U. D. #1:
With reference to proposal to purchase City Electrical Distribution facilities
at the Pasco Airport for the sum of $4,000.00, designated as surplus property.
Motion made by Craig, seconded by Connell that the Mayor and City Clerk be
authorized to enter into an agreement -conveying to the Franklin County Public
Utility District #1, for the sum of $4,000.00, the electrical distribution system
situate at "asco Municipal Airport which system -'as heretofore acquired by the
City of Pasco from the United States Government under its war surplus program,

and in support thereof the following findings be, and are hereby madex
1. That the City of Pasco does not have the proper facilities and
personnel to operate said system;
2. That the City of Pasco is unable to obtain a lessee to effic-
iently operate said system;

3. That the inventory and appraisement made and established
by the re resentative of the Franklin County Public Utility
District 1 and the Airport Manager of the City of Pasco,
and approved by the Airport Committee of the City of Pasco,
be accepted and the fair market value of said electrical
distribution s stem and property comprising said system is
hereby set at 4,000.00;
4. That it is for the best interests of the City of Pasco to
sell and convey said prope'rty to the Franklin Comity Public
Utility 14strict No. 1, the only agency able to operate
said -system and supply electricity to Pasco Municipal Air-
port.

GARBAGE ORDINANCE NO. 785 & DOG WARDEN CONTRACT:
Motion made by Bonnett, seconded by Avery that a public hearing be held on the
garbage ordinance 785'and Dog Warden Contract at 8:00 P. M., Tuesday, May 4,
1954• Motion carried.

REPORTS FROM OFFICERS:
ESQUATZEL CANAL FOR WASTE WATER:
Bonnett proposed that Councilman Avery be nominated as a member of this committee
to represent the 01ty. Motion made by Bonnett, seconded by Connell that n6min-
ations be closed and J. A. Avery*be-appointed to represent the City. Meeting
to be held on Thursday at 3:00 P. M., April 22, 1954- Motion carried unanimous.

BUILDING INSPECTOR:
At this time Mayor Custer appointed J. L. Chatterley as Building Inspector.
Motion made'by'Avery,'seconded by Bonnett concurring with the "ayor's appoint-
ment. Motion carried.
Civil'Servide'Board has approved Assistant Fire Chiefs name as being eligible
for appointment to Fire Chief position.
The Mayor at this time appointed Lyle Cooney to the position of Fire Chief.
Motion made by Avery,; seconded by Craig concurring with appointment. Motion carried.
SEWAGE DIcP OSAL PLANT:
City Engineer recommends that -the Council consider acceptance of the Sewage
Disposal Plant at -their next meeting'. Would like action taken on release of
10% withheld on equipment purchases. Motion made by Avery, seconded by Milne
to release 10% withheld on equipment purchases. Motion carried by roll call
vote of six (6). Co R. Combs had been excused from the meeting.
SALARY OF ASSISTANT'FIRE CHIEF:
Motion made"by Craig, seconded by Milne relative to precedent long followed,
that deputy, assistant or junior serve at his regular salary. Motion carried.
Mayor concedes. Adjustment discussed.
Motion made by Connell, seconded by Avery for reconsideration of the previous
motion. Motion carried. Milne voting "No". Motion made by Avery, seconded by
Connell that salaries of Acting Fire Chief and Assistant Fire Chief be retained
as submitted on_pa7yroll of February, March & April, 1954 and policy of City Council
hereafter, deputy, assistant or juniors salary remain as per their regular position
while acting in capacity of their superior. Motion carried unanimous.
JAMES E. WEECH GARAGE:.
City Attorney reports that Mr. Welch has agreed,to settle without court hearing;
will move business out of R-2 zone by October 1, 1954• Motion made by Avery,
seconded by Connell approving proposed consent decree. Motion carried by roll
call vote of six (6)_. Each party to bear his own cost of action.

CLAIM -RAYMOND &'GMBAUGH:
A claim filed with the City Clerk April 15, 1954 against the City of casco Water
Department -to cover damage to basement floor and contents thereof in the amount
of $125.00,'account sewer line being blocked off and backed up in basement on
"arch 22, 1954..
Motion made by Avery, seconded by Connell to turn to Insurance Company for consid-
eration. Copy of letter to City Attorney. Motion carried.
PETITTS'2nd ADDITION,, PROPERTY LINES:
With reference to irregular property lines. Motion made by Connell, seconded by
Milne to turn to Street Committee for further study and recommendation. Motion
carried.
BASIL MAIB'S REFUND:
With reference to Ordinance No. 650, Mr. Maib has -paid $150.00 on vacating
alley and requesting vacation of streets on west Clark. Following deduction for
legal requirements and data, there will be a refund due in the amount of $82.83
Motion made by Milne, seconded by Avery authorizing refund-. Motion carried by
roll call vote of six (6) .

City Clerk furnished each member a monthly budget report of all departments.
