ROLL CALL: By Clerk. Councilmen present were J. A. .Avery, C. R. Combs, S. A. Conn ell, C. S. Milne and T. G. Overlie. Absent were L. E. Bonnett and Raymond Hicks. City Attor- ney R. G. Patrick was present., READING OF THE MINUTES: Minutes of meetings held December 29, 1952, January 6th and 20th, 1953 were read and approved. REGULAR ORDER OF BUSINESS SET ASIDE BY UNANIMOUS CONSENT. f ORDINANCE N0. i7 7: Ordinance No. 74,7 was up for third reading. Public Notice was -advertised for this date. Petitioners and opposition were present. Action of Planning Commission was discussed. Records show change of opinion on immediate decision. Motion made by Milne, seconded by Combs that this be referred back to the Planning Commission. Mayor and City .Attorney wish to acquaint themselves with this situation and petit- ion. Letter to be submitted to Planning Commission. E. E. MATHESON LOCATION: Parties interested in action taken on petition. Advised by City Attorney that he i•s waiting for opinion from the Attorney General's Office. LOT 80 BLOCK "D", Mr. Peot: Desiring information on action taken on request of front footage charge on sewer and water service. Motion made by Combs, seconded by Avery that charges be based on 50' lot front footage charge. Motion carried. CEMETERY ORDINANCE NO. 751: (Ray B. Lee) Mr. Lee questioned portions of Ordinance No. 751. • AN ORDINANCE AMENDING ORDINANCE NO. 687 AND ORDINANCE NO. 573 AND BEING AN ORDINANCE PROVIDING FOR THE USE OF METAL • BOXES OR VAULTS, OR CONCRETE BOXES OR VAULTS, AND FURTHER AUTHORIZING THE CEMETERY SUPERINTENDENT TO PROVIDE CONCRETE BOXES OR VAULTS, AND MAKING CERTAIN RULES AND REGULATIONS WITH REFERENCE TO THE CHARACTER, KIND, AND LOCATION OF MARK- ERS AND MONUMENTS OR GRAVE STONES THEREIN, AND PROHIBITING SUNDAY7FUNERALS IN CITY VIEW CEMETERY, AND REPEALING ALL FORMER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH Motion made by Overlie, seconded by Avery to give Ordinance No. 751 the first read- ing. Following a lengthy discussion in which Mr. Lee d4sires to sell grave liners instead of the City. He thinks cost of markers, -opening and closing graves needs adjusting; no funerals on Sunday, epidemic and man hour loss mentioned as factors and other items. Motion made by Milne, seconded by Combs to table this for future reference. Motion carried. A letter was read from City Engineer George R. Fisher requesting action by the Council as to billing procedure on 15 water users not definately covered by Ord - finance. Motion made by Avery, seconded by Connell that this Ve turned to the Water Committee for recommendation. Motion carried. GUN CLUB:. A letter was read from the Gun Club President L. M. Cronin assuring the Council that when the Club is r6 -located it will be in or near Pasco, within Franklin Co. and that the $6,000.00 condemnation money will be spent in acquiring a site and improvements. Wm. HARPER & SONS & COMPANY: A letter was read from Willard B. Vadman stating they would be in Pasco on Wed- nesday to gather information for proposed bond issue. FINANCIAL EXAMINATION OF WATER UTILITY: A letter was read from A. M. McLean submitting statement for $1,000.00 for report made in September and October 1950. Motion made by Avery, seconded by Milne author- izing payment. Motion carried by roll call vote of five (5). STATE PATROL FATALITY LIST: This report was reviewed. Pasco had no fatalities during the year 1952• ORTHERN PACIFIC PERMIT NO. 76005, SEWER PIPE LINE S: A letter was read from J. T. Moore submitting permit in duplicate. City Engineer to answer letter and retugri signed permits. NORTHERN PACIFIC SUPPLEMENT TO PERMIT NO. 50110: (Water line West A & 11th) City copy was returned signed. This was approved for filing which was the opinion of the City Attorney that recording at Court Hous, was necessary. PASCO, WASHINGTON i' I� REFUND, CLARENCE MILLER: Mr. Miller requests refund on $5.00 paid for Chauffeur's License which has not been issued. Motion made by Connell, seconded by Avery authorizing refund. Motion carried. REFUND:, SHERWOOD & ROBERTS: A letter was read from J. David Clancy requesting a $35.00 refund account Sherwood & Roberts and Fairway Finance Company. One is considered a Department of the other. This was referred to the City ;Attorney. REFUND, SEWAGE DISPOSAL PLANT BID DEPOSITS: City Clerk requests permission to return deposit on plans and specifications to firms returning same. Motion made by Overlie, seconded by Avery authorizing return of deposits as requested. Motion carried. PURCHASES: PARK DEPARTMENT: Garbage cans J25.75 AIRPORT DEPARTMENT Skill saw $85.00; Electric Drill $79.00; miscellaneous Radio tubes WATER DEPARTMENT: Portable generator with wire cable $358.40;Water pump '$106.70. STREET DEPARTMENT: One 28" gas engine chain saw '$393.00 WATER DEPARTMENT: Miscellaneous repair parts $281.41 Motion made by Connell, seconded by Avery authorizing the above purchases. Motion carried by roll call vote of five (5). SEWER SERVICE ARMY ENGINEER DEPOT: Draft of contract between the City and the Army Engineers, a document of fourteen pages, was studied. A discussion on the purchase of a measuring meter was entered into and definately.decided that the City should own the meter and locate it where it can be serviced.readily. Motion made by Connell, seconded by Avery to purchase f1pw Meter and accept the bid as recommended by John W. Cunningham Representative from the call for bids. Motion carried by roll call v ote of five (5). Motion made by Milne, seconded by Combs to refer draft of contract to,City Attorney. Motion carried. Water Committee will also make a study of Governments proposition. BOAT -BASIN: A letter was read from Merle E. Lietzke granting permission for immediate right -of - entry to balance of Pasco Bbat Basin, revocable at will of writer, permission subject to six (6) itemized conditions: 1) not to interfere with Dam construction; 2) to be kept clean and presentable; 3) City assumes responsibility for any prop- erty damages or personal injuries; 4) work in accordance with plans approved by the Corps of Engineers and building construction will be floor .level above 356 msl; 5) work done below 340 elevation is in accordance with "permit for -work in navigable waters"; 6) investments made at this time solely at the City's risk. Motion mdde by Connell, seconded by Combs to accept right -of -entry. Motion carried. BIDS, PARK DEPARTMENT: (FENCE) Two bids were received, opened and read as follows: Cyclone Fence Company $648.00 plus tax Uneco Construction Company 723.79 plus tax Motion made by Connell, seconded by Avery to contact the Airport Committee relative to (CAA release for some Airport fencing. Motion withdrawn by Connell and Avery. Park Board or Supervisor to check with Game Department to trade the Doe for a Buck. BUILDING AT SYLVESTER PARK: One bid received. Uneco Construction Company for $2,854.80 - Motion made by Milne, seconded by Connell to reject Uneco's bid and authorize the Park Supervisor to negotiate. Motion carried. BIDS ON DRIVEWAY, -MEMORIAL PARK: No bids were received. Motion made by Overlie, seconded by Avery for Park Supervisor to negotiate for work. ORDINANCE NO., 746: City Attorney suggests that an amendment be made on Page 59 Section 4, line four, "expense of the City" be changed to expense of "Terry Thompson'. Motion made bT Overlie, seconded by -Connell to amend Section 4,. line 4 to read "Terry Thompson instead of "the City". Motion carried. _ ORDINANCE NO. 746: AN ORDINANCE FIXING THE AMOUNT, FORM, DATE, INTEREST RATE, MATURITY AND DENOMINATIONS FOR LOCAL IMPROVE- MENT DISTRICT NO. 61 BONDS, AND DIRECTING THE ISSU- ANCE AND SALE OF SAID BONDS TO TERRY THOMPSON IN ACCORDANCE WITH HIS OFFER HERETOFORE ACCEPTED Motion made by Overlie, seconded by Connell that Ordinance No. 746 be given the second reading by title only. RESOLUTION NO. 314: Retaining the Law Firm of Water, Roberts & Shefelman to furnish legal advice and legal instruments.- Section 2 states that the City will pay Water, Roberts & Shefel- man $500.00 whereby Ordinance No. 707, Section 6 states that Terry Thompson will pay Water, Roberts & Shefelman. Motion made by Milne, seconded by Overlie to amend Section 21 Resolution No. 314 to read that the City will pay the sum of $250.00 and Terry Thompson $250.00. Motion carried. ORDINANCE NO. 749: AN ORDINANCE PROVIDING FOR THE ANNEXATION TO THE CITY I' OF PASCO, ALL OF THE SOUTH HALF OF THE SOUTHWEST QUAR- TER OF SECTION 21, TOWNSHIP 9, NORTH, RANGE 30 E.W.M., CONSISTING OF 80 ACRES MORE OR LESS Motion made by Overlie, seconded by Combs to give Ordinance No. 749 the third read- ing. Motion made by Avery, seconded by Milne that the City Engineer invite several engineering firms to meet with the Council on May 19, 1953 for the purpose of submitting pro- posal on study of water system. Motion carried. PARKING ON WEST LEWIS: Mr. Milnefeels that the parking on West Lewis should be the responsibility of the City.; he thinks that the island blocks traffic. City Attorney to write letter to the State Department regarding this situation. Motion made by Milne, seconded by Combs that -the council go on record as being -opposed to giving up authority to control parking on West Lewis, State to review island situation. Motioia carried. 'CONVENTION, ASSOCIATION OF WASHINGTON CITIES: I City Attorney made inquiry regarding expense for convention purposes. No action taken.
