Honorable Mayor John Beck presiding. ROLL CALL: By Clerk. Councilmen present, J. A. Avery, L. E. Bonnett, C. R. Combs, C. S. Milne, and T. G. Overlie. Absent, S. A. Connell and Raymond Hicks. City Attorney Orville B. Olson was present., REGULAR ORDER OF BUSINESS SET ASIDE BY UNANIMOUS CONSENT. BUSINESS LICENSE APPLICATION FOR LOUIS B. LONDON: Mr. London spoke in behalf of application to be considered at this meeting, to operate'a scrap metal business of new and'used pipe and steel. Motion made by Bonnett, seconded by Avery to turn this to the Police and License Committee for recommendation. Motion carried. Later in the meeting this applichtion was con- sidered by the Police 'Committee and authorized with restrictions: 1. Material must be kept up off the ground. 2. Fence around property. 3. Positively no machinery wrecking on the premises. New application to be made stating the res- trictions and signed by Mr. London; same will also appear on the License issued. JOHN ARCHER: Mr. Archer is interested in having a portion of alley -vacated between Indiana and A; Lucas and Pacific. He was advised that the Pacific Power & Light Company have an easement in that location for poles. FOSTER'S ADDITION: PLAT VACATION: Notice -of Public Hearing to be held this date was read. No objections were made. Resolution No. 315 does hereby declare that the Plat of Foster's Addition to Pas- co, Washington, according to the Plat recorded in Volume"B" of Plats, Page 81, Records Franklin County, Washington, be, and the same hereby is declared vacated. Motion made by Bonnett, seconded by Overlie that Resolution No. 315 be adopted as read. Motion carried by roll call vote of five (5). ORDINANCE NO. 701: AN ORDINANCE RELATING TO THE VACATION OF FOSTER'S ADDITION TO PASCO, WASHINGTON Motion made by Avery, seconded by Bonnett that Ordinance No. 701 be given the first reading. Motion carried. Ordinance No. 701 was read. Motion made by Overlie, seconded by Avery that Ordinance No. 701 has been given the first reading. Motion carried. Motion made by Overlie, seconded by Avery that Ordinance No. 701 be given the see.ond reading by title only. Motion carried. Ordinance No. 701 was read by title. Motion made by Overlie, seconded by Avery that Ordinance No. 701 has been given the second reading by title only. Motion carried. FOSTER'S ADDITION REPLAT: A replat of Foster's Addition was presented to the Council body by Mr. Wendell Brown and J. Eubanks showing minor changes made. Motion made by Avery, seconded by Bonnett to concur with the Planning Commission on acceptance of the replat of Foster's Addition. Motion carried. McNARY LOCK & DAM PROJECT: Mr. Merle E. Lie_tzke, Mr. Welch and other representatives of the Army Engineers,. Walla Walla, Washington, presented Voucher form No. 1034 in the mount of $22,500.00 to cover the purchase of three parcels of land identified as Tract XX3452, that portion of lots 32 to 42 inclusive, River Block of Riverside Addition, lying north of the line of ordinary high water; tract XX -3457, 400' of Government Block 7, south of Washington Avenue; tract XX -3461, all of Block 11, 12 & 15, Oakley's Riverside Addition; also Voucher form 1034 in the amount of $12,000.00, conveying to the United States Government a perpetual easement and right-of-way for access to the navigable water adjacent to described property in Government Block 8, location of City Pumping Plant identified as XX -3455A. Motion made by Bonnett that the Mayor be authorized to sign. Motion lost for want of a second. The Council recessed from Regular Order of Business by motion without dissent, to study contracts which were read by the City Attorney and discussed with Army Offic- ials. In conclusion, a motion was made by Milne, seconded by Combs that the Mayor be authorized to sign tract 3455A subject to letter of agreement, that the City will reserve the right to build pumping plant on river side of levee. Motion carried by roll call vote of five (5). OPTION OF PURCHASE: Motion nude by Bonnett, seconded by Milne that the Mayor be authorized to sign option to purchase, tract XX -3452, XX -3457 and XX -3461, McNary Lock &'Dam Project. Motion carried by roll call vote of five (5). REGULAR ORDER OF BUSINESS RESUMED BY UNANIMOUS CONSENT. PASCO, WASHINGTON REGULAR MEETING COUNCIL C HAMBERS SEPT FMBER_]._8_,�951 READING OF THE MINUTES: Minutes of meetings held September 4th, 11th, 12th and 13th, 1951 were read and I approved. i VACATING NORTH & SOUTH ALLEY IN BLOCK 19, HELM'S SECOND ADDITION: I Notice of Public Hearing set for this time and date was read. No objections were made. Motion made by Overlie, seconded by Avery authorizing the City Attorney to draw up an Ordinance vacating the north & south alley in block 19, Helm's Sec- ond Addition to Pasco. Motion carried. it BIDS ON 42 TONS BITUMINOUS CEMENT: One bid was received from the -American Bitumuls and Asphalt Company, Portland, i, Oregon•quoting MC -2 liquid -Asphalt @ $24.00 per net ton of 2,000 lbs. f.o.b. Will - bridge, Oregon or Richmond, Washington. Motion made by Bonnett, seconded'by Avery �'! to reject bid. Motion carried. Motion made by Overlie, seconded by Bonnett that i City Engineer be authorized to negotiate a purchase at the best price available. Motion carried by roll call vote of five (5). COMMUNICATIONS: MATERIAL PURCHASE: ii A letter was read from'City Engineer George R. Fisher, requesting permission to purchase up to $200.00, pipe, cement and -,covers for catch basins and lines; also 30 tons of mix from'L. W. Vail to resurface "A" Street at Railroad crossing, est- imated cost $127.50. Motion•made by Overlie, seconded -by Bonnett authorizing the Engineer to spend up to $200.00 on material for catch basins. Motion carried by roll call vote five (5).' Purdhasing Road mix from L. W. Vail was turned to the Engineer and -City Attorney for opinion as to who shout stand this expense, the 'i Railway Company or the City of Pasco. !I SEWAGE DISPOSAL PLANT: A letter was read from John W. Cunningham & Associates stating that Mr. Zeidlhack was on vacation but will answer the Mayor's letter of September 12th, on his return. AIRPORT LEASES: Three Airport Leases were read as follows: I� Otis Randall Ganders & Magee Kennewick Rifle & Pistol Club Motion made by Milne, seconded by Avery that the Mayor sign leases approved by the i, Airport Committee. Motion carried. SOLICITOR'S ORDINANCE: Pasco Chamber of Commerce letter held up. i' APPOINTMENT,, ELMER MATHESON TO CIVIL SERVICE COMMISSION: A letter was read from Mayor John Beck appointing Elmer Matheson as a member of the Civil , 1 Service Commission to succeed C. P. Shaffer, term to expire Feb. 17, 1954. AIRPORT LEASE: A letter from C. F. Greber, Captain U. S. Navy to City Attorney Orville B. Olson, states that due to war indefiniteness resulting from the foreign situation the 20 ,year lease has been delayed. When a s milar 5 year lease for Tillamook has been consumated, efforts will be renewed to arrange a similar lease. I� NORTHERN PACIFIC RAILROAD CROSSING AT 11th STREET: A letter was read from H. V. I ORDINANCE NO. 702: AN ORDINANCE GRANTING TO NORTHERN PACIFIC RAILWAY li COMPANY, ITS SUCCESSORS AND ASSIGNS, A FRANCHISE TO CONSTRUCT, MAINTAIN AND OPERATE A RAILROAD SPUR TRACK ACROSS SOUTH ELEVENTH AVENUE IN THE CITY OF PASCO, FRANKLIN COUNTY, WASHINGTON Motion made by Overlie, seconded by Avery that Ordinance No. 702 be given the first reading. PURCHASE REQUESTS: City Clerk asks to purchase registration forms from Shaw & Borden Company, Spokane, in the amount of $84.96. She was requested to make purchases locally whenever it was possible. C. F'. Cash, State Auditor ordered and received L, I. D. Motion carried. �I i Water Manager, Myron Radelmiller requests purchase of pipe fittings and gate valves in the anount of $256.96 also drills and taps for two Mueller Machines for approx- imately $20.00. Motion made by Overlie, seconded by Bonnett authorizing purchase. Motion carried by roll call vote of five (5). VOUCHER, TAX COMMISSION: A voucher in the amount.of $5.63, correction of error made in tax report was order- ed paid. Motion so made by Overlie, seconded by ,Avery and ,carried by roll call vote of five (5). L. I. D. #61: A letter was read from Terry Thompson to C. F. Cash stating his bond Attorney Harold Shelelman would check ordinances and advise. REBALIJT I ON NO. 314: Retaining the Firm of Weter, Roberts & Shefelman, Seattle, Washington to furnish legal advice and legal instruments required for L. I. D. No. 61. Resolution No. 314 was read. Motion made by Overlie, seconded by Avery to adopt Resolution No. 314. Motion carried by roll call vote of five (5). BUSINESS LICENSE, ROBERT W. LENHART: A letter was read from R. W. Lenhart requesting that the Council grant a license; if so desired that it carry the restriction that it be effective at 1303 Irving only as long as he is the owner of the business. The Council recommends to the Planning Commission that he be allowed a temporary permit to one year from Jan- uary 1952. VACATING NORTH AND SOUTH ALLEY, BLOCK 3, HELM'S SECOND ADDITION: Guy T. Richards owning all the property abutting on.north and south alley in Block 3, Helm's Second Addition requests that same be vacated. Motion made by Overlie, seconded by Avery that Public Hearing he held October 16, 1951. Motion carried. BUDGET: A copy of the tentative budget also the monthly budget was furnished all members of the Council.
